{"id":177292,"date":"2019-08-08T06:00:04","date_gmt":"2019-08-08T11:00:04","guid":{"rendered":"http:\/\/csinewsnow.com\/?p=177292"},"modified":"2020-03-05T08:13:55","modified_gmt":"2020-03-05T14:13:55","slug":"benefiel-bound-over-for-trial-remains-in-custody","status":"publish","type":"post","link":"http:\/\/csinewsnow.com\/?p=177292","title":{"rendered":"Benefiel bound over for trial, remains in custody"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-189504\" src=\"http:\/\/csinewsnow.com\/wp-content\/uploads\/2020\/01\/BenefielJason-300x202.png\" alt=\"\" width=\"300\" height=\"202\" srcset=\"http:\/\/csinewsnow.com\/wp-content\/uploads\/2020\/01\/BenefielJason-300x202.png 300w, http:\/\/csinewsnow.com\/wp-content\/uploads\/2020\/01\/BenefielJason-260x175.png 260w, http:\/\/csinewsnow.com\/wp-content\/uploads\/2020\/01\/BenefielJason.png 445w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Jamestown\u00a0 (CSi)\u00a0 31 year old Jason Benefiel, a former State Hospital Patient, has been bound over for trial, following his preliminary hearing Wednesday in Southeast District Court in Jamestown before Judge Daniel Narum.\u00a0 Benefiel remains in custody pending further court appearances.<\/p>\n<p>Benefiel is accused of striking and choking an employee of the State Hospital on March 29, 2019.<\/p>\n<p>He\u2019s charged with attempted murder and aggravated assault.<\/p>\n<p>The Stutsman County State&#8217;s Attorney&#8217;s Office is also alleging he is a habitual offender and would double the possible penalty for the charges to life in prison on the attempted murder charge plus 10 years in prison on each of the aggravated assault charges.<\/p>\n<p>Benefiel\u2019s court appointed attorney, Scott Sandness indicated that the case is now assigned to a trial judge and motion hearings concerning Benefiel&#8217;s mental health at the time of the incident are anticipated.<\/p>\n<p>Benefiel is charged with criminal attempt &#8211; murder, a Class A felony, and two counts of aggravated assault, Class C felonies.
