{"id":246774,"date":"2022-04-13T15:53:11","date_gmt":"2022-04-13T20:53:11","guid":{"rendered":"http:\/\/csinewsnow.com\/?p=246774"},"modified":"2022-04-13T20:14:42","modified_gmt":"2022-04-14T01:14:42","slug":"investigation-sexual-assault-allegations-against-heinrich","status":"publish","type":"post","link":"http:\/\/csinewsnow.com\/?p=246774","title":{"rendered":"Assault allegations against Mayor found insufficient"},"content":{"rendered":"<p>Update:\u00a0 Jamestown\u00a0 (CSi)\u00a0 An investigation into sexual assault allegations against Jamestown Mayor Dwaine Heinrich has found insufficient evidence to warrant a criminal prosecution.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-98450 size-thumbnail\" src=\"http:\/\/csinewsnow.com\/wp-content\/uploads\/2016\/04\/Fremgen-Fritz-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/>Documents released by Stutsman County State\u2019s Attorney Fritz Fremgen, indicate that reports and surveillance video were unable to clearly give any indication of the incident between Mayor Heinrich and the accuser.<\/p>\n<p>The report, said the incident occurred on January 29th when the caller approached Heinrich and asked why taxes were so high. The Mayor was also accused of collecting petition signatures, which Heinrich said in reports he had brought a petition for his friend to sign and did not ask anyone else.<\/p>\n<p>Following a discussion, Heinrich stated \u201cthis conversation is over\u201d and attempted to fold his business card and give to the caller. On the second or third try, Heinrich managed to put the business card in the caller\u2019s pocket. This led to the caller claiming Heinrich had grabbed their breast, but clarified in a report to police that he did not mean to touch the caller\u2019s breast and was just trying to keep the card from falling out of their pocket.<\/p>\n<p>\u201cI did not see anything in the surveillance video that corroborates [the] claim the caller was touched on the breast or a witness claim that Heinrich pushed the caller,\u201d the report states.<\/p>\n<p>It was determined that the facts of the incident don\u2019t constitute sexual assault or disorderly conduct.<\/p>\n<p>(<a href=\"http:\/\/csinewsnow.com\/?p=244153\">Mayor Heinrich Statement Video, Feb 7, 2022 City Council Meeting<\/a>)<\/p>\n<p><span id=\"page11R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">From:<\/span> <span dir=\"ltr\" role=\"presentation\">Fritz Fremgen, State&#8217;s Attorney, Stutsman County<\/span><\/span><span id=\"page11R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">To:<\/span> <span dir=\"ltr\" role=\"presentation\">Special Agent Shawn Banet, ND Bureau of Criminal Investigation<\/span><\/span><span id=\"page11R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Date:<\/span> <span dir=\"ltr\" role=\"presentation\">13 April 2022<\/span><\/span><span id=\"page11R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Subject<\/span> <span dir=\"ltr\" role=\"presentation\">05 2022 04 12 declination Heinrich, incident numbers 22-02213, BCI22-00073<\/span><\/span><span id=\"page11R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><\/span><\/p>\n<p><span id=\"page11R_mcid4\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">1.<\/span> <span dir=\"ltr\" role=\"presentation\">Thank you for your reports regarding an allegation of offensive touching alleged to have <\/span><span dir=\"ltr\" role=\"presentation\">occurred on 29 January 2022 in Stutsman County.<\/span><\/span><span id=\"page11R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">2.<\/span> <span dir=\"ltr\" role=\"presentation\">There is insufficient evidence to warrant initiating a criminal prosecution.<\/span><\/span><span id=\"page11R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">3.<\/span> <span dir=\"ltr\" role=\"presentation\">On 29 January 2022, a person [hereinafter Caller] telephoned dispatch and complained<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">that the mayor of Jamestown was &#8220;being pretty belligerent, poking me in the chest, and <\/span><span dir=\"ltr\" role=\"presentation\">touching my breast.&#8221;<\/span><\/span><span id=\"page11R_mcid7\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">4.<\/span> <span dir=\"ltr\" role=\"presentation\">Later, Jessica Willman, an associate of Caller&#8217;s, claimed Mayor Heinrich pushed Caller.<\/span><\/span><span id=\"page11R_mcid8\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">5.<\/span> <span dir=\"ltr\" role=\"presentation\">Jamestown Police Department (JPD) officers responded initially and wrote reports. 22-<\/span><span dir=\"ltr\" role=\"presentation\">02213.<\/span><\/span><span id=\"page11R_mcid9\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">6.<\/span> <span dir=\"ltr\" role=\"presentation\">Special Agent Banet of the North Dakota Bureau of Investigation (BCI) reported JPD <\/span><span dir=\"ltr\" role=\"presentation\">asked BCI to assist with the investigation. BCI22-00073.<\/span><\/span><span id=\"page11R_mcid10\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">7.<\/span> <span dir=\"ltr\" role=\"presentation\">Special Agent Banet re-interviewed both Caller and Heinrich. Banet also interviewed <\/span><span dir=\"ltr\" role=\"presentation\">Bartender Remillong, Heinrich&#8217;s friend Brown, and Caller&#8217;s associate Jessica Willman.<\/span><\/span><span id=\"page11R_mcid11\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">8.<\/span> <span dir=\"ltr\" role=\"presentation\">Caller reported Caller wore the same clothes to the interview with Banet that Caller had <\/span><span dir=\"ltr\" role=\"presentation\">on during the 29 January 2022 incident. Banet&#8217;s photographs show Caller wearing light <\/span><span dir=\"ltr\" role=\"presentation\">work boots or hiking boots, blue work jeans with spots of pigment on the knees and <\/span><span dir=\"ltr\" role=\"presentation\">quadriceps areas, a grey hooded sweatshirt, a ScentBlocker Dream Season Silent Shell <\/span><span dir=\"ltr\" role=\"presentation\">Jacket (Mossy Oak Break &#8211; Up camouflage pattern), and a baseball cap. The hunting\u00a0<\/span><span dir=\"ltr\" role=\"presentation\">jacket had a pocket on the wearer&#8217;s right side. The zipper for the pocket was oriented <\/span><span dir=\"ltr\" role=\"presentation\">vertically. Caller&#8217;s gender is not apparent from the photographs.<\/span><\/span><span id=\"page11R_mcid12\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">9.<\/span> <span dir=\"ltr\" role=\"presentation\">Caller told Banet Caller approached Heinrich and asked why our housing taxes were so <\/span><span dir=\"ltr\" role=\"presentation\">high adding,<\/span> <span dir=\"ltr\" role=\"presentation\">we have the highest housing taxes in the state of North Dakota<\/span><span dir=\"ltr\" role=\"presentation\">. Caller told <\/span><span dir=\"ltr\" role=\"presentation\">Banet Caller did not know whether it was illegal to circulate a petition in a bar. Although <\/span><span dir=\"ltr\" role=\"presentation\">uncertain about the legality, Caller told Banet that Caller suggested to Heinrich that he <\/span><span dir=\"ltr\" role=\"presentation\">was collecting petition signatures from people who were drunk and that this was illegal.<\/span><\/span><span id=\"page11R_mcid13\" class=\"markedContent\"><\/span><\/p>\n<p><span id=\"page11R_mcid13\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">10.<\/span> <span dir=\"ltr\" role=\"presentation\">Heinrich indicated to JPD&#8217;s Officer Stoen that Heinrich brought the petition for his friend <\/span><span dir=\"ltr\" role=\"presentation\">to sign and did not ask anyone else to sign it. Heinrich&#8217;s friend, Brown, acknowledged<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Heinrich gave Brown two petitions, Brown signed them, and they continued to visit at the <\/span><span dir=\"ltr\" role=\"presentation\">bar.<\/span><\/span><\/p>\n<p><span id=\"page40R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">11.<\/span> <span dir=\"ltr\" role=\"presentation\">Brown told Banet that after Caller came between he and Heinrich, Brown turned his back <\/span><span dir=\"ltr\" role=\"presentation\">and was not paying attention to Heinrich and Caller&#8217;s conversation. Brown said he looked <\/span><span dir=\"ltr\" role=\"presentation\">over and saw Heinrich had his business card in his hand and heard Heinrich say, &#8220;Here&#8217;s <\/span><span dir=\"ltr\" role=\"presentation\">my number, We can discuss this at a later time.&#8221;<\/span><\/span><span id=\"page40R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">12.<\/span> <span dir=\"ltr\" role=\"presentation\">Caller told Banet Heinrich attempted to give his business card to Caller and Caller <\/span><span dir=\"ltr\" role=\"presentation\">rebuffed the attempt saying, &#8220;You&#8217;re the mayor and I know how to contact you if I need to <\/span><span dir=\"ltr\" role=\"presentation\">contact you.&#8221;<\/span><\/span><span id=\"page40R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">13.<\/span> <span dir=\"ltr\" role=\"presentation\">Heinrich told Banet the following. Caller became upset when Heinrich could not recite <\/span><span dir=\"ltr\" role=\"presentation\">the number of employees working at the James River Correctional Center. Caller started <\/span><span dir=\"ltr\" role=\"presentation\">arguing about high property taxes. Heinrich told Caller that &#8220;This conversation is over.&#8221;<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Heinrich folded his business card in half and tried to give it to Caller. On the second or <\/span><span dir=\"ltr\" role=\"presentation\">third try Heinrich managed to put the business card in Caller&#8217;s pocket. Caller was <\/span><span dir=\"ltr\" role=\"presentation\">wearing mens clothing and a baseball cap. Heinrich assumed Caller was a guy and had <\/span><span dir=\"ltr\" role=\"presentation\">no idea Caller was a female. When caller refused the business card, Heinrich tried to put <\/span><span dir=\"ltr\" role=\"presentation\">the card in Caller&#8217;s zipper jacket pocket.<\/span><\/span><span id=\"page40R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">14.<\/span> <span dir=\"ltr\" role=\"presentation\">Caller told Banet that Heinrich put the card in Caller&#8217;s jacket pocket and in so doing <\/span><span dir=\"ltr\" role=\"presentation\">&#8220;grabbed&#8221; Caller&#8217;s breast. Caller clarified Heinrich did not mean to touch Caller&#8217;s breast <\/span><span dir=\"ltr\" role=\"presentation\">and was just trying to keep the card from falling out of Caller&#8217;s pocket. Caller told Banet <\/span><span dir=\"ltr\" role=\"presentation\">that Caller believed Heinrich did not know Caller is female.<\/span><\/span><span id=\"page40R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">15.<\/span> <span dir=\"ltr\" role=\"presentation\">Bartender Remillong reported he saw no pushing but indicates there was a heated <\/span><span dir=\"ltr\" role=\"presentation\">discussion.<\/span><\/span><span id=\"page40R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">16.<\/span> <span dir=\"ltr\" role=\"presentation\">I was given the proprietor&#8217;s surveillance video from three different cameras. The video is <\/span><span dir=\"ltr\" role=\"presentation\">not dispositive. The resolution is low. Caller and Heinrich are facing each other and the <\/span><span dir=\"ltr\" role=\"presentation\">angles don&#8217;t allow the viewer to see what is happening between them. Caller approached\u00a0<\/span><span dir=\"ltr\" role=\"presentation\">Heinrich and sat down in the chair next to him. Caller and Heinrich appeared to be\u00a0<\/span><span dir=\"ltr\" role=\"presentation\">conversing. I did not see anything in the surveillance video that corroborates Caller&#8217;s\u00a0<\/span><span dir=\"ltr\" role=\"presentation\">claim Caller was touched on the breast or Willman&#8217;s claim that Heinrich pushed Caller.<\/span><\/span><span id=\"page40R_mcid6\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">17.<\/span> <span dir=\"ltr\" role=\"presentation\">Bartender Remillong reported Jessica Willman was the first to make an accusation by <\/span><span dir=\"ltr\" role=\"presentation\">saying, &#8220;He touched you. That&#8217;s assault.&#8221;<\/span><\/span><span id=\"page40R_mcid7\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">18.<\/span> <span dir=\"ltr\" role=\"presentation\">Caller echoed Willman&#8217;s sentiment when Caller reported to Banet, &#8220;Nobody has the right <\/span><span dir=\"ltr\" role=\"presentation\">to touch anyone.&#8221;<\/span><\/span><span id=\"page40R_mcid8\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">19.<\/span> <span dir=\"ltr\" role=\"presentation\">These facts do not constitute sexual assault. N.D.C.C. \u00a7 12.1-20-07. Sexual assault <\/span><span dir=\"ltr\" role=\"presentation\">requires<\/span> <span dir=\"ltr\" role=\"presentation\">sexual contact<\/span><span dir=\"ltr\" role=\"presentation\">, a phrase defined by North Dakota Century Code \u00a7 12.1-20-02(5).<\/span><br role=\"presentation\" \/><\/span><\/p>\n<p><span id=\"page40R_mcid8\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">To constitute sexual contact, touching must be done to arouse or satisfy sexual or <\/span><span dir=\"ltr\" role=\"presentation\">aggressive desires. There is no evidence that any touching was for either of those <\/span><\/span><span id=\"page52R_mcid0\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">purposes. Caller acknowledged any touching of her breast was inadvertent. Caller <\/span><span dir=\"ltr\" role=\"presentation\">acknowledged Heinrich was just trying to keep the card from falling out of Caller&#8217;s <\/span><span dir=\"ltr\" role=\"presentation\">pocket. Caller told Banet there was no touching for sexual gratification.<\/span><\/span><span id=\"page52R_mcid1\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">20.<\/span> <span dir=\"ltr\" role=\"presentation\">These facts do not constitute disorderly conduct. N.D.C.C. \u00a7 12.1-31-01. Disorderly <\/span><span dir=\"ltr\" role=\"presentation\">conduct requires the intent to harass, annoy, or alarm another or action done in reckless <\/span><span dir=\"ltr\" role=\"presentation\">disregard of that possibility. The two subsections of disorderly conduct warranting <\/span><span dir=\"ltr\" role=\"presentation\">review are g and h.<\/span><\/span><span id=\"page52R_mcid2\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">A.<\/span> <span dir=\"ltr\" role=\"presentation\">(1)<\/span> <span dir=\"ltr\" role=\"presentation\">Subsection 12.1-31-01(g) prohibits acting with the above intent to &#8220;Create <\/span><span dir=\"ltr\" role=\"presentation\">a hazardous, physically offensive, or seriously alarming condition by any<\/span><span dir=\"ltr\" role=\"presentation\">act that serves no legitimate purpose.&#8221;<\/span><\/span><span id=\"page52R_mcid3\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2)<\/span> <span dir=\"ltr\" role=\"presentation\">In regard to subsection g, there was no hazard. Subsection g requires<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">either criminal recklessness or actual intent to be physically offensive or<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">seriously alarming. Those malicious states of mind are absent.<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">&#8220;Recklessly&#8221; is defined at N.D.C.C. \u00a7 12.1-02-02(1)(c). Heinrich<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">indicated placing the card in Caller&#8217;s jacket pocket was a diplomatic<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">method of discontinuing an unproductive conversation. That&#8217;s a legitimate<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">purpose.<\/span><\/span><span id=\"page52R_mcid4\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">B.<\/span> <span dir=\"ltr\" role=\"presentation\">(1)<\/span> <span dir=\"ltr\" role=\"presentation\">Subsection 12.1-31-01(h) precludes &#8220;Engaging in harassing conduct by<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">means of intrusive or unwanted acts, words, or gestures that are intended<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">to adversely affect the safety, security, or privacy of another person.&#8221;<\/span><\/span><span id=\"page52R_mcid5\" class=\"markedContent\"><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">(2)<\/span> <span dir=\"ltr\" role=\"presentation\">Subsection h requires intent to adversely affect another&#8217;s safety, security,<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">or privacy. That malicious state of mind is absent. Caller told Banet<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Caller believed Heinrich did not mean to touch Caller&#8217;s breast. Caller told<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Banet Caller believed Heinrich did not know Caller was female or that<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">there would be a breast behind the pocket<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Update:\u00a0 Jamestown\u00a0 (CSi)\u00a0 An investigation into sexual assault allegations against Jamestown Mayor Dwaine Heinrich has found insufficient evidence to warrant a criminal prosecution.
