{"id":291477,"date":"2025-03-04T13:45:00","date_gmt":"2025-03-04T19:45:00","guid":{"rendered":"http:\/\/csinewsnow.com\/?p=291477"},"modified":"2025-03-07T08:13:47","modified_gmt":"2025-03-07T14:13:47","slug":"minutes-jamestown-city-council-march-3-2025","status":"publish","type":"post","link":"http:\/\/csinewsnow.com\/?p=291477","title":{"rendered":"Minutes Jamestown City Council March 3, 2025"},"content":{"rendered":"\n<p>Unofficial Minutes City Council March 3, 2025 Meeting : <\/p>\n\n\n\n<p>The regular meeting of the City Council was called to order by Mayor Heinrich at 5:00 P.M.<br>The Pledge of Allegiance to the flag was recited.<br>Roll Call showed the following members present: Mayor Heinrich, Council Members Kamlitz, Phillips,<br>Schloegel, Steele, Assistant City Attorney Geroux, and City Administrator Hellekson.<br>Council Member Phillips moved to approve the minutes of the regular council meeting, February 3, 2025,<br>and the committee meeting February 21, 2025. Seconded by Council Member Steele. Unanimous aye vote. Carried.<\/p>\n\n\n\n<p>No bids were received for the sale of abandoned\/impounded vehicles.<br>Assistant City Attorney Geroux informed the Council that there was one bid that was unopened at<br>the February 20, 2025, bid opening for the 4-Wheel Drive Loader for the Solid Waste Department.<br>The bid from General Equipment did have a waivable defect and Assistant City Attorney Geroux did<br>recommend the council waive the defect and open the bid.<br>Council Member Kamlitz moved to waive the defect and open the bid from General Equipment.<br>Seconded by Council Member Schloegel. Unanimous aye vote. Carried.<br>Assistant City Attorney Geroux opened the bid from General Equipment, reviewed it and determined<br>it was a valid bid.<br>Council Member Phillips moved to approve the following consent agenda items:<br>A. Resolution to appoint Joe Rowell, Water Superintendent, as the Member representative and Tyler<br>Michel, Public Works Director, as the Alternate representative to the CIDERS Board.<br>B. Resolution to approve the following pertaining to 2025 Seal Coat, Patching, Construction &amp;<br>Reconstruction District 25-41:<br>a. To approve plans, specifications and estimates for the construction of the district.<br>b. To authorize the advertisement for bids for Seal Coat, Patching, Construction &amp;<br>Reconstruction.<br>C. Resolution to approve the quote for a budgeted 6\u201d Pump from Bierschbach Equipment and Supply in<br>the amount of $46,075.20 to be paid from the Sewer Fund.<br>D. Resolution to approve the quote to purchase pipe for budgeted storm sewer project on 8th Ave NW<br>from Rinker Materials in the amount of $28,707.04.<br>E. Resolution to approve the engineering agreement for the EPA Title V Air Permit for the Municipal<br>Solid Waste (MSW) Landfill.<br>F. Resolution to approve the submittal to ND Dept of Water Resources approval of construction cost<br>share application for CIDERS project.<br>G. Resolution to approve the 2025 City of Jamestown Standard Specifications.<br>H. Resolution to approve a request from Jamestown Gymnastics Club, for a site authorization to<br>conduct gaming at Jamestown Gymnastics Club Board Room on Monday, June 9, 2025.<br>I. Resolution to approve a request from Progress Enterprises Inc., for a gaming site authorization to<br>conduct gaming at Buffalo Grill LLC for the period of April 1, 2025 through June 30, 2025.<br>J. Resolution to approve the street closings and\/or permits to allow alcoholic beverages in fenced areas<br>for the St. Patrick\u2019s Day event, Running of the Green, on March 15, 2025, for the following: All<br>Vets Club; Progress Enterprises, Inc. d.b.a. Buffalo Bar &amp; Lanes; Corner Bar; Jamestown Country<br>Club d.b.a. Elks Lodge; Middles LLC d.b.a. Fred\u2019s Den; Frontier Fort Bar &amp; Grill; Jonny B\u2019s<br>Brickhouse; Knights of Columbus; Blazer, Inc. d.b.a. Shady\u2019s; and The Wooly.<br>K. Resolution to approve a request from Rocky Mountain Elk Foundation Inc for a site authorization to<br>conduct gaming at the Gladstone Inn in the Ball Room on April 12, 2025.<br>L. Resolution to approve a request from Knights of Columbus #1883, for a site authorization to<br>conduct gaming at Don Wilhelm\u2019s 305 Business Loop W, Jamestown, North Dakota on Saturday,<br>September 20, 2025.<br>M. Resolution to approve the 25-year renewal of the ND Army National Guard lease of the Jamestown<br>Civic Center and authorize the Mayor and City Administrator to sign the agreement.<br>N. Resolution to approve the 2025 Farm Lease Agreement with Ben Busch for the 2025 crop year and<br>authorize the Mayor and City Administrator to sign the agreement.<br>O. Resolution to approve the plans and specifications to reroof and reskin the LeFevre storage building<br>located at 1110 Railroad Drive and authorize advertisement for bids.<br>P. Resolution to approve the request from Stride Development to name the City of Jamestown as the<br>Responsible Entity under 24 CFR Part 58 for the Environmental Assessment of the properties<br>located at 902-1514 Gardenette Drive, Jamestown, also known as the Riverside Cottages Project,<br>and authorize the Mayor to sign the Environmental Assessment upon review and approval by city<br>staff.<br>Q. Resolution to approve Change Order No. 1 to Hillerud Construction, Inc. for the kitchen remodel<br>project at the main Fire Hall for a net increase in the contract price of $1,380.00 and authorize the<br>Fire Chief to sign the change order.<br>R. Resolution to approve Payment No. 1, to Enterprise Sales Co., for construction on the South Side<br>Fire Hall Roof, in the amount of $3,950.00.<br>S. Resolution to approve Payment No. 7, to Ferguson Waterworks, for construction on the Water Meter<br>Replacement Program Project #24-61, in the amount of $38,990.00.<br>T. Resolution to approve Payment No. 12 (Inv 100639), to AE2S, LLC, for Water &amp; Sewer Instrument<br>&amp; Control Panel Upgrades Project #24-62, in the amount of $36,299.75.<br>U. Resolution to approve Payment No. 1 (Inv 08387.11-1), to SRF Consulting Group, Inc., for 2025<br>Jamestown Planning and Zoning Technical Services, in the amount of $1,808.59.<br>V. Resolution to approve Payment No. 122 (Inv 100591), to AE2S, LLC, for On Call engineering<br>services (I&amp;C Water) for a total amount of $2,071.50.<br>W. Resolution to approve Payment No. 3 (Inv 57194), to Interstate Engineering Inc., for engineering<br>services on New Roof on Southside Fire Station, in the amount of $650.00.<br>X. Resolution to approve Payment No. 10 (Inv 57189), to Interstate Engineering Inc., for engineering<br>services on Project #24-72 McElroy Sanitary Forcemain Relocation, in the amount of $1,644.00.<br>Y. Resolution to approve Payment No. 12 (Inv 57190), to Interstate Engineering Inc., for engineering<br>services on Project #24-71 Phase II of 96\u201d Storm Sewer Improvement Repair, in the amount of<br>$1,067.50.<br>Z. Resolution to approve Payment No. 14 (Inv 57193), to Interstate Engineering Inc., for engineering<br>services on Project #24-61 Radio Read Water Meters, in the amount of $8,137.50.<br>AA. Resolution to approve Payment No. 17 (Inv 57187), to Interstate Engineering Inc., for engineering<br>services for 2023 Water Main Improvement District #23-61, in the amount of $1,359.50.<br>BB. Resolution to approve Payment No. 27 (Inv 57188), to Interstate Engineering Inc., for engineering<br>services on Project #23-62 North West Booster Station, in the amount of $1,000.00.<br>CC. Resolution to approve Payment No. 357 (Inv 57192), in the amount of $13,632.00, to Interstate<br>Engineering, Inc., for engineering services on various city department consultations as follows:<br>a) (General), in the amount of $5,375.00;<br>b) (Streets), in the amount of $625.00;<br>c) (Sewer), in the amount of $750.00;<br>d) (Water), in the amount of $1,691.00;<br>e) (Solid Waste), in the amount of $4,721.00;<br>f) (Storm Water), in the amount of $470.00.<br>DD. Resolution to allow the February indebtedness in the amount of $4,133,818.10 consisting of<br>$648,122.80 payroll and $3,485,695.30 general obligations.<br>Seconded by Council Member Schloegel. Consent Roll Call No. 1 showed: 5 ayes, 0 nays, 0 absent.<br>Carried.<br>Mayor Heinrich requested more time to work on the language in the 4th and 5th letters to be sent out to water<br>users of the community that have not responded to previous letters sent regarding the new water meter<br>program. The matter will be discussed at a special city council meeting on Thursday, March 6, 2025, at 4:15<br>P.M.<br>Council Member Kamlitz moved a Resolution acknowledging Clarice Liechty\u2019s extraordinary generosity<br>and commitment to the Jamestown Fire Department. Seconded by Council Member Phillips. Roll Call No.<br>2 showed: 5 ayes, 0 nays, 0 absent. Carried.<br>A public hearing was held concerning amending Section 13-1, of the City Code, relating to precincts.<br>No one appeared to object, and no written protests were received. The hearing was closed.<br>Council Member Schloegel moved a Resolution to amend Section 13-1, of the City Code, relating to<br>precincts. Seconded by Council Member Phillips. Roll Call No. 3 showed: 5 ayes, 0 nays, 0 absent.<br>Carried.<br>A public hearing was held concerning amending and re-enacting Ordinance No. 1556 of the City Code<br>by amending the District Map to change the zoning of Court House Square Addition, East \u00bd of Court<br>House Square Less Lots to Berndt &amp; St Plus All Vacated 11th Ave, Court House Square Addition, Lot 4,<br>City of Jamestown, Stutsman County, North Dakota from R-2-A (One to Twelve Family Residential<br>District) to C-2 (General Commercial District). The property is located at 1016 4th St SE and 1017 5<br>th St<br>SE, Jamestown, North Dakota. No one appeared to object, and no written protests were received. The<br>hearing was closed.<br>Council Member Kamlitz moved a Resolution to amend and re-enact Ordinance No. 1556 of the City Code<br>by amending the District Map to change the zoning of Court House Square Addition, East \u00bd of Court House<br>Square Less Lots to Berndt &amp; St Plus All Vacated 11th Ave, Court House Square Addition, Lot 4, City of<br>Jamestown, Stutsman County, North Dakota from R-2-A (One to Twelve Family Residential District) to C2 (General Commercial District). The property is located at 1016 4th St SE and 1017 5<br>th St SE, Jamestown,<br>North Dakota. Seconded by Council Member Phillips. Roll Call No. 4 showed: 5 ayes, 0 nays, 0 absent.<br>Carried.<br>Council Member Steele moved to appoint LeRoy Gross to serve as a member of the Pension<br>Committee to fill a one-year term to expire in March 2026. Seconded by Council Member<br>Schloegel. Unanimous aye vote. Carried.<br>Council Member Kamlitz moved a Resolution to award the bid for the Solid Waste Front End Loader to<br>Titan Machinery in the amount of $176,621 to be paid from the Equipment Replacement Fund and the<br>Solid Waste Fund. Seconded by Council Member Schloegel. Public Works Director Michel provided<br>information. Roll Call No. 5 showed: 5 ayes, 0 nays, 0 absent. Carried<br>Council Member Kamlitz moved a Resolution to approve the bid specifications for new Firefighter<br>Protective Ensemble for Structural Fire Fighting Gear and authorize advertisement for bids. Seconded<br>by Council Member Phillips. Roll Call No. 6 showed: 5 ayes, 0 nays, 0 absent. Carried<br>Mayor Heinrich returned the request by Stride Development for a payment in lieu of taxes (PILOT) for<br>the acquisition and rehabilitation project of Riverside Cottages I, II, and III (currently the Gardenette) to<br>the March 25, 2025 Finance &amp; Legal Committee.<br>Council Member Kamlitz moved a Resolution to approve the readvertisement of an RFP for the sale and<br>development of two (2) city-owned lots located at 301 11th Ave SE (Harold P. Bensch Addition, Block<br>1, Lot 1) and 401 11th Ave SE (Harold P. Bensch Addition, Block 1, Lot 2), Jamestown, North Dakota.<br>Seconded by Council Member Steele. Roll Call No. 7 showed: 5 ayes, 0 nays, 0 absent. Carried<br>Council Member Kamlitz moved to adjourn at 5:38 P.M. Seconded by Council Member Schloegel.<br>Unanimous aye vote.
