April 28, 2014 – 8:00 a.m.<\/p>\n
Present: Hillerud, Tressler, Trautman, Bayer, Bensch, Ritter<\/p>\n
Others present: Mayor Andersen, Fuchs, Klundt, Reuther, Schwartzkopf, Buchanan, Kourajian, Wollan, Harty<\/p>\n
Absent: Bergquist, Trefz, Rath<\/p>\n
1. Chairman Hillerud called the meeting to order. A motion to approve the minutes from the April 14, 2014 Planning Commission meeting was made by Commission member Trautman. Seconded by Commission member Ritter. Unanimous aye vote. Motion Carried.<\/p>\n
Chairman Hillerud elected to change the order of agenda items, moving items 4 and 5 ahead of items 2 and 3.<\/p>\n
2. The final plat of Witzig\u2019s Fourth Addition, within the Northeast Quarter of Section 34, T140N, R64W of the Fifth Principal Meridian, being within Stutsman County and Extraterritorial Lands of the City of Jamestown, North Dakota.<\/p>\n
Stephanie Falkers, of SRF Consulting Group, Inc. gave the staff report.<\/p>\n
Chairman Hillerud opened the public hearing. No one appeared. Chairman Hillerud closed the public hearing.<\/p>\n
A motion was made by Commission member Trautman to accept the findings of staff and recommend approval of the final plat of Witzig\u2019s Fourth Addition, located within the NW \u00bc of the NE \u00bc of Section 34,Twp 140N, R64W to the City Council, as it meets the requirements of Section 13 of Appendix B of the Jamestown Municipal Code. Seconded by Commission member Bensch. Roll Call. Unanimous aye vote. Motion Carried.<\/p>\n
3. The final plat of Hammer Addition, a Replat of Homestead III Addition, Lots 1 and 12, Block 1, City of Jamestown, North Dakota.<\/p>\n

A motion was made by Commission member Ritter to accept the findings of staff and recommend approval of the final plat of Hammer Addition, a Replat of Lots 1 and 12, Block 1, Homestead III Addition to the City Council, as it meets the requirements of Section 13 of Appendix B of the Jamestown Municipal Code. Commission member Trautman seconded. Roll Call. Unanimous aye vote. Motion carried.<\/p>\n
4. The preliminary plat of Country Side Estates, a Replat of City West Subdivision, Stutsman County, North Dakota.<\/p>\n

Chairman Hillerud opened the public hearing.<\/p>\n
Clarice Liechty of Jamestown, ND appeared and voiced her concerns relating to the 80\u2019 width of the street on 16th St SW and the costs associated with this. Ms. Liechty also expressed her concerns as to how this development fits into extra-territorial zoning and is concerned with the 17th St SW frontage road. Chairman Hillerud stated that it was not the intent that the 17th Street SW frontage road be abandoned, but rather, the potential changes to the bypass could result in 16th Street SW being the preferred arterial given its\u2019 increased distance from the bypass.<\/p>\n
Stephane Falkers, of SRF Consulting, Inc. appeared to answer questions relating to her concerns. No one else appeared. Chairman Hillerud closed the public hearing.<\/p>\n
Chairman Hillerud explained his understanding of the situation as to the developer\u2019s wish to not be annexed into the City and the City\u2019s significant expense to provide for the infrastructure needed if the development was to be annexed into the City. City Engineer, Reed Schwartzkopf said there is no plan for infrastructure at this time.<\/p>\n
Commission member Trautman expressed concern regarding the need for improvement of the right of way through the Witzig addition at 16th St SW to provide an additional point of access in and out of the development and how the developer, Stutsman County, Midway Township and the City of Jamestown would work together to accomplish the establishment of a roadway. City Engineer Schwartzkopf explained that he assumed the City would do what is necessary to work with the township & county on this area. Commission member Trautman also voiced her concerns relating to emergency services in this area.<\/p>\n
Brian Paulson, Assistant Fire Chief of the Stutsman County Rural Fire Department, appeared and stated that they prefer to see more access roads going into the area.<\/p>\n
Commission member Ritter voiced her concern with the rural water & sewer services in the area and asked for clarification relating to the ND State one acre septic system requirement and the possibility of the State legislature increasing the area requirement.<\/p>\n
Geneva Kaiser, with Stutsman Rural Water District, appeared and said, at this time, it is their intent to run 6\u201d water mains through the development for potable water use.<\/p>\n
Discussion among members and City Engineer Schwartzkopf continued relating to the ND State law concerning the one acre sewer septic size requirement. Chairman Hillerud asked Stephanie Falkers if she was aware if ND State law required additional acreage for a septic system if the property was used for multi-family or commercial use. Stephanie was not aware of any additional acreage requirements, but stated that the septic system would need to be approved based upon the final use.<\/p>\n
Commission member Trautman asked for more information relating to 16th St SW.<\/p>\n
Stephanie Falkers, of SRF Consulting, Inc. spoke answering commission members\u2019 concerns. Commission member Bensch stated that the dedicated right of way through the Witzig\u2019s plat is has 80\u2019 streets. Members discussed areas of concern relating to consistency that should be defined relevant to these types of developments within the one mile extra-territorial limits.<\/p>\n
Jack Meikle, property owner along 16th St SW, appeared and stated he is not opposed to the development, but is concerned about curb & gutter and the drainage of stormwater in the area. City Engineer Schwartzkopf explained the roads throughout the development will be gravel with ditches and culverts to handle the stormwater.<\/p>\n
Commission member Trautman made a motion to accept & recommend approval of the preliminary and final plat of Country Side Estates with 60\u2019 ROW for 16th St SW, subject to development of the ROW in the Witzig Plat. Motion seconded by Commission member Bensch. Roll Call. Unanimous aye vote. Motion Carried.<\/p>\n
5. Commission member Bayer encouraged the entities to meet and continue working together so that the Planning Commission members and developers will be on the same page when these issues arise.<\/p>\n
Chairman Hillerud commented that this area was defined within the growth management plan as Development Phase 1. He asked City Engineer Schwartzkopf if any studies had been completed to determine what infrastructure needs there may be, and the related costs, should any development be proposed in the Phase 1 areas. With that information, Planning Commission members could see what would be needed in various areas as to whether the City could provide services, etc. and whether or not annexation was feasible for the City. City Engineer Schwartzkopf said the Land Use & Transportation Plan doesn\u2019t provide utility information.<\/p>\n
Commission member Trautman thanked the representatives from the Stutsman County Rural Fire and Stutsman Rural Water District for their attendance.<\/p>\n
