June 9, 2014 – 8:00 a.m.<\/p>\n

\u00a0Present: Hillerud, Trefz, Trautman, Rath, Ritter, Bensch, Tressler, Bergquist<\/p>\n

Others present: Reuther, Klundt, Fuchs, Schwartzkopf, Kourajian, Mayor Andersen, Buchanan, Wollan, Harty<\/p>\n

Absent: Bayer<\/p>\n

Chairman Hillerud called the meeting to order. A motion to approve the minutes from the May 22, 2014 Planning Commission meeting was made by Commission member Trautman, seconded by Commission member Bergquist. Unanimous aye voice vote. Motion Carried.<\/p>\n

Public Hearing:<\/p>\n

The final plat of Jamestown Court Rowhomes Addition, Block 1, Lots 1 &2, a replat of Jamestown Original Addition, Block 41 – Lot 9 and Block 42 – Lots 3-5 & Lots 7, 8, and the South 50\u2019 of Lot 9, City of Jamestown, North Dakota. (401 3rd<\/sup> St SE)<\/p>\n

Stephanie Falkers, of SRF Consulting Group, Inc. gave the staff report. It was the recommendation of staff that the final plat be approved, contingent upon the finalization of the quiet title to resolve the ownership gaps and approval of all improvements by the City Engineer prior to the recording of the plat.<\/p>\n

Chairman Hillerud opened the public hearing.<\/p>\n

Clarice Liechty, 511 8th<\/sup> St SW, appeared questioning what type of housing is being planned. Stephanie said it is our understanding that it is for senior housing, and added that these considerations don\u2019t have any bearing on the plat.<\/p>\n

Chairman Hillerud closed the public hearing.<\/p>\n

Chairman Hillerud expressed his concern with approving the final plat with contingencies attached, especially regarding the potential ownership gaps and the lack of civil drawings. Discussion ensued amongst the commission members.<\/p>\n

Bruce Skipton of Ulteig Engineering spoke on behalf of the owner, explaining that he has been hired to do the Alta survey which should be completed by the end of the week.<\/p>\n

Dan Buchanan, liaison from the City Council, voiced his concerns about approving the final plat with contingencies, and is recommending the plat be tabled until all items have been completed.<\/p>\n

Erin Andersen with Metro Plains Development, had an update from their attorney, they expect to be completed with the quiet claim process in approximately 5 weeks and they are planning to start construction in September, 2014.<\/p>\n

Commission memberTrautman made a motion to table the final plat of Jamestown Court Rowhomes Addition, Block 1, Lots 1 &2, a replat of Jamestown Original Addition, Block 41 – Lot 9 and Block 42 – Lots 3-5 & Lots 7, 8, and the South 50\u2019 of Lot 9, City of Jamestown, North Dakota. (401 3rd St SE). Commission member Ritter seconded. Unanimo<\/a>us aye voice vote. Motion Carried.<\/p>\n

The preliminary plat of Witzig\u2019s Fifth Addition, a Parcel of Land within the Northeast Quarter of Section 34, T140N, R64W within Stutsman County and Extraterritorial Lands of the City of Jamestown, North Dakota.<\/p>\n

Stephanie Falkers, of SRF Consulting Group, Inc. gave the staff report and provided the commission members with updated plans that address some of the concerns raised in the staff report. She noted that the changes were received yesterday.<\/p>\n

Chairman Hillerud opened the public hearing. No one appeared. Chairman Hillerud closed the public hearing.<\/p>\n

As recommended by staff, <\/i>a motion to table the preliminary plat of Witzig\u2019s Fifth Addition, a Parcel of Land within the Northeast Quarter of Section 34, T140N, R64W within Stutsman County and Extraterritorial Lands of the City of Jamestown, North Dakota was made by Commission member Trefz, seconded by Commission member Trautman. Unanimous aye voice vote. Motion Carried.<\/p>\n

Public Hearing:<\/p>\n

Lot 2, Block 1, Proposed Hammer Addition; Lots 5-11, Block 1, Homestead III Addition; Lots 1 & 2, Block 2, Homestead III and Lots 7, 8, 9, Block 6, Homestead Addition from R-1 (One Family Residential District) to P-O-C (Public, Open Development and Conservation District).<\/p>\n

Commission member Trefz moved to accept the findings of staff and continue the zone change from<\/p>\n

R -1 (One Family Residential District) to P-O-C (Public, Open Development and Conservation District) for Lot 2, Block 1, Hammer Addition; Lots 5-11, Block 1, Homestead III Addition; Lots 1 & 2, Block 2, Homestead III and Lots 7, 8, 9, Block 6, Homestead Addition, pending receipt of information from the State Historic Preservation Office as to the specific areas affected by the cultural resource designation and the specific limitations on the subject properties, followed by further discussion by City staff and the City Council as to the further sales of affected City owned property. Seconded Commission member Rath. Unanimous aye voice vote. Motion Carried.<\/p>\n

Discussion relating to Stutsman County Water Resource Board report dealing with drainage issues from a meeting that was held on May 21st<\/sup>, 2014.<\/p>\n

Chairman Hillerud gave details of the meeting stating that there has been a committee formed with various parties and that he will attend the meeting acting as a representative of the City Planning Commission, and will report back to the Planning Commission.<\/p>\n
