Jamestown (CSi) An investigation into the allegation of misuse of government \u00a0property by the\u00a0Stutsman County Sheriff\u2019s Department has not shown evidence to file charges for defamation. \u00a0The story first aired on Valley News Live.<\/p>\n

\"FremgenFritz3\"<\/a>According to Fritz Fremgren, Stutsman County State’s Attorney,\u00a0 “After a thorough investigation by a senior ND BCI agent, Dale Maixner, an independent review of the investigation was conducted by a veteran prosecutor outside Stutsman County, Cherie Clark, Assistant State’s Attorney, Cass County.\u00a0 Clark’s well written opinion is that there is insufficient evidence to support a criminal prosecution. \u00a0No further criminal investigatory activity is anticipated. ” \u00a0\u00a0<\/span><\/p>\n

The North Dakota Bureau of Criminal Investigation began the \u00a0investigation after it was alleged to Valley News Live that a deputy and the sheriff\u2019s son were using a jet ski reportedly owned by Stutsman County for recreational use. \u00a0 It turns out the county did not own the jet ski and the “claim” was incorrect. \u00a0 The story set off further investigation for possible defamation.<\/p>\n

\"BCIJetSkiValleyNewsLive\"<\/a>Because of the sheriff\u2019s and police chief\u2019s\u00a0potential conflicts, BCI Agent Dale Maixner investigated the potential defamation. \u00a0 Additionally, the BCI report was then reviewed by\u00a0Cherie Clark, Assistant State’s Attorney, Cass County.<\/p>\n

The report said several officers were interviewed from the Jamestown Police Department and Stutsman County Sheriff\u2019s Department. \u00a0Both the report and the review of the report indicate\u00a0\u00a0not enough information was found to file charges against any individuals.<\/p>\n

The analysis by Cherie Clark ,\u00a0Assistant State’s Attorney, Cass County,\u00a0of the report:<\/p>\n

“Stutsman County State\u2019s Attorney Fritz Fremgen requested that I review BCI Report No.\u00a0<\/span>15-0727 and determine whether criminal charges are appropriate. The report involves\u00a0<\/span>potential defamation \u2013 namely, information sent to Valley News Live (\u201cVNL\u201d) that falsely\u00a0<\/span>alluded to Stutsman County law enforcement personnel using a government jet ski for\u00a0<\/span>personal use. After reviewing the report, I have concluded that there is insufficient\u00a0<\/span>evidence to support prosecution of either Jamestown Police Detective Tom Nagel or\u00a0<\/span>Stutsman County Sheriff\u2019s Office Sergeant Elizabeth Kapp.”<\/span><\/p>\n
