All members were present.<\/p>\n<p><strong>APPROVAL OF CONSENT AGENDA <\/strong><\/p>\n<p>Approved Monthly Reports from the Fire Chief, Building Inspector, Auditor, Municipal Judge and Public Works Accountant.<\/p>\n<p>Approved Monthly Bills for the City and Public Works in the Amount of $1,801,841.05<\/p>\n<p>Approved \u00a0Block off Street Request for Sheyenne Valley Backing the Badge on August 29, 2019 for Community Extravaganza on 100 \u2013 300 blocks of Central Avenue N<\/p>\n<p>Approve Block off Street Request for Sheyenne Valley Backing the Badge on September 21, 2019 for Got your 6K on 4th Street NW, 9th Avenue NW, 12th Street NW, Central Avenue, Chautauqua Boulevard, and 6th Street NE<\/p>\n<p>Approve an \u00a0Application for Retail Tobacco License for Dakota Silver, LLC<\/p>\n<p>Approve an Application for Plumber License for TNT Plumbing<\/p>\n<p>Approve an Application for Tree Trimming &amp; Removal License for Z\u2019s Trees<\/p>\n<p>Approve Raffle Permits for Valley City USBC Association<\/p>\n<p><strong>PUBLIC COMMENTS:<\/strong><\/p>\n<p><strong>NEW BUSINESS <\/strong><\/p>\n<p>Considered was a request from Valley City-Barnes County Development Corporation for $25,000 per year for 2 years \u00a0from the City Sales Tax, to support workforce development, specifically a Salesforce instruction position at VCSU.<\/p>\n<p>Development Corporation Director, Jennifer Feist said, the Barnes County Commission has approved a like amount. \u00a0She said the position will help grow the existing workforce and expand the workforce.\u00a0 The position starts January 1, 2020.<\/p>\n<p>The City Commission approved the request.<\/p>\n<p>Considered was a \u00a0recommendation from Visitors Committee for Image Enhancement Grant for Barnes County Historical Society in an amount up to $2,500 for an awning.<\/p>\n<p>Bobby Koeplin said, the awning will be placed on the existing canopy, with a do-pass from the committee, with a monetary cap.<\/p>\n<p>Commissioners approved the request.<\/p>\n<p>Considered was a recommendation from Visitors Committee to send letters to all Food &amp; Beverage vendors.\u00a0 Bobby Koeplin said, there is a one percent food and beverage tax in place.\u00a0 He added that all vendors need to aware to charge the tax.<\/p>\n<p>The City Commission approved the recommendation.<\/p>\n<p>Considered was a Renaissance Zone Authority Board recommendation for 5 year income tax exemption and 5 year property tax exemption for new construction, up to $250,000 at 546 Legacy Lane by Legacy Developments, LLC and designate it as VC-116 pending certificate of good standing.<\/p>\n<p>Considered was Renaissance Zone Authority Board recommendation for 5 year income tax exemption and 5 year property tax exemption for new construction, up to $250,000 at 441 12 \u00bd St NE by Legacy Developments, LLC and designate it as VC-118 pending certificate of good standing.<\/p>\n<p>&nbsp;<\/p>\n<p>Consider was a Renaissance Zone Authority Board recommendation for 5 year income tax exemption and 5 year property tax exemption for new construction, up to $250,000 at 461 12 \u00bd St NE by Legacy Developments, LLC and designate it as VC-119 pending certificate of good standing.<\/p>\n<p>City Commissioners approved each recommendation.<\/p>\n<p>Approved was an Application for Property Tax Exemption for Improvements at 535 4th Avenue SW.<\/p>\n<p>Approved was an Application for Property Tax Exemption for Improvements at 107 6th Ave SW.<\/p>\n<p>Approved was \u00a0Preliminary Engineering Reimbursement Agreement with NDDOT for Project No. IM-NHU-2-094(159)290 (2021 Drainage Work Project near Exit 290).\u00a0 City Administrator Schelkoph, said the NDDOT has taken over the storm sewer project in city limits, and is seeking a partnership with the city.<\/p>\n<p>Approved was a gaming site authorization to the VFW, at the AmVets.<\/p>\n<p>Approved was a Labor Club August 23 event .<\/p>\n<p>&nbsp;<\/p>\n<p><strong>ORDINANCE <\/strong><\/p>\n<p>Approved was the second and final reading of an Ordinance to Amend and Reenact portions of Title 1 (General Provisions), Title 14 (Motor Vehicles &amp; Traffic) and Title 17 (Offenses), Valley City Municipal Code.\u00a0 City Attorney Martineck said the Ordinance changes is to come into compliance with the North Dakota Century Code, including changes and additions.\u00a0 Traffic and parking fees have substantially increased.\u00a0 Commissioner Erickson vote in opposition.<\/p>\n<p>Another final reading of an Ordinance regarding changes in the Motor Vehicles &amp; Traffic offenses was approved.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>PUBLIC HEARING <\/strong><\/p>\n<p>A Public Hearing was held regarding Special Assessments confirmed by the Special Assessment Commission for Paving Improvement District No. 116 (Concrete Pavement Repair on 8th Avenue SW, Wintershow Drive, and 5th Avenue NE).<\/p>\n<p>Following the Public Hearing the City Commission approved Special Assessments as recommended by the Special Assessment Commission for Paving Improvement District No. 116<\/p>\n<p>Following a Public Hearing the City Commission approve the Issuance of Class H Brewer Taproom License to Brockopp Brewing, LLC.<\/p>\n<p>A Public Hearing was held \u00a0for the Transfer of Class B and Class C Alcoholic Beverage Licenses to Mosby, LLC dba Boomer\u2019s Corner Keg.<\/p>\n<p>Following the Public Hearing City Commissioners approved the Issuance of Class B and Class C Alcoholic Beverage Licenses to Mosby, LLC dba Boomer\u2019s Corner Keg.<\/p>\n<p>A Public Hearing was held regarding alleged violation of V.C.M.C. 4-01-06 by Woodland Steakhouse City Attorney Martineck explained the violation, concerning the timely filing of an application for a renewal. The manager said she was not aware of the time frame.<\/p>\n<p>Following the Public Hearing the Commission considered the suspension of alcoholic beverage licenses for Woodland Steakhouse due to violation of V.C.M.C. 4-01-06. \u00a0\u00a0 The City Commission voted for no suspension, but be aware of the City Ordinance.<\/p>\n<p>A Public Hearing was held regarding alleged violation of V.C.M.C. 4-01-06 by Sabir\u2019s Dining &amp; Lounge It was stated the owner had medical circumstances and did not timely file the application for renewal.\u00a0 <em>\u00a0<\/em><\/p>\n<p>Following the Public Hearing Commissioners considered suspension of alcoholic beverage licenses for Sabir\u2019s Dining &amp; Lounge due to violation of V.C.M.C. 4-01-06.\u00a0 No suspension was issued by the Commission.<\/p>\n<p>A Public Hearing regarding was\u00a0 held regarding the alleged violation of V.C.M.C. 4-01-06 by VFW Post No. 2764.\u00a0 City Auditor Richter said the paperwork for license renewal was late.\u00a0 <em>\u00a0<\/em><\/p>\n<p>Following the Public Hearing the City Commission considered the suspension of alcoholic beverage licenses for VFW Post No. 2764 due to violation of V.C.M.C. 4-01-06, Alcoholic Beverage.\u00a0 City Commissioners vote for no suspension having served a 10 day suspension.<\/p>\n<p>A Public Hearing was held \u00a0to consider the \u00a0alleged violation of V.C.M.C. 4-01-14, Alcoholic Beverage by American Legion Club.\u00a0\u00a0 City Attorney Martineck said the organization admitted to the violation of serving past the 2-a.m. deadline. \u00a0 Representatives asked the city for leniency, noting dollars raised for the baseball program.\u00a0 The club is currently under a previous violation notice.<\/p>\n<p>A Public Hearing was held \u00a0to consider the \u00a0alleged violation of V.C.M.C. 4-01-14, Alcoholic Beverage by American Legion Club. \u00a0The club is currently under probation for \u00a0a previous violation notice.\u00a0 City Attorney Martineck said the organization admitted to the violation of serving past the 2-a.m. serving deadline.\u00a0\u00a0 Representatives asked the city for leniency, noting dollars raised for the baseball program.<\/p>\n<p>Following the Public Hearing, Commissioners considered the proposed disposition for American Legion Club regarding violation of V.C.M.C. 4-01-14, Alcoholic Beverage.<\/p>\n<p>The City Commission first voted on a motion to issue a $500 fine and a 7 day suspension of the liquor license, within a year, for the second violation that can be divided 3 days and 4 days\u2026. that failed on a 3-2 vote\u2026with Commissioners Erickson, Powell, and Carlsrud voting in opposition.<\/p>\n<p>Commissioners then voted \u00a03-2 to approve a 12 day suspension to be served, on non consecutive days for a year chosen by the American Legion, with the mandatory fine of $500.\u00a0 Commissioners\u00a0 Erickson and Powell voting in opposition.<\/p>\n<p><strong>CITY ADMINISTRATOR\u2019S REPORT \u00a0\u00a0No Report\u2026<\/strong><\/p>\n<p><strong>CITY UPDATES &amp; COMMISSION REPORTS<\/strong><\/p>\n<p>Mayor Carlsrud thanked the Commissioners and staff for their work on the 2020 City Budget.<\/p>\n<p>He reminded motorists not to drive while texting, and be aware of construction zones.<\/p>\n<p>The meeting was shown live on CSi Cable 68, followed by replays<strong>.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Valley City\u00a0 (CSi)\u00a0 The Valley City Commission met in Regular Session, Tuesday evening at City Hall.
