{"id":188630,"date":"2020-01-03T14:13:55","date_gmt":"2020-01-03T20:13:55","guid":{"rendered":"http:\/\/csinewsnow.com\/?p=188630"},"modified":"2020-01-03T14:14:15","modified_gmt":"2020-01-03T20:14:15","slug":"grain-facility-cited-grain-bin-fatality","status":"publish","type":"post","link":"https:\/\/csinewsnow.com\/?p=188630","title":{"rendered":"Grain Facility Cited, Grain Bin Fatality"},"content":{"rendered":"<p>Arvilla, ND\u00a0\u00a0 (OSHA) \u00a0 \u2013 The U.S. Department of Labor\u2019s Occupational Safety and Health Administration (OSHA) has cited Columbia Grain International (CGI) LLC for willfully exposing workers to grain-handling hazards after the fatal engulfment of an employee at the company\u2019s Arvilla, North Dakota, storage facility. The company faces $190,000 in proposed penalties.<\/p>\n<p>OSHA inspectors determined that CGI failed to follow OSHA standards during grain bin entry and cleaning operations. OSHA issued a willful citation for allowing employees to \u201cwalk the grain\u201d and for not preventing contact with operating machine parts by locking out the bin\u2019s conveyor system. Violations related to walking\/working surfaces, ladder use, machine guarding, bin entry procedures and bin rescue procedures resulted in serious citations.<\/p>\n<p>\u201cThis tragedy could have been prevented if the employer had simply followed well-known safety procedures,\u201d said OSHA Area Director Scott Overson in Bismarck, North Dakota. \u201cInstead, they exposed employees to dangerous hazards that resulted in the loss of life.\u201d<\/p>\n<p>OSHA\u2019s Grain Handling webpage provides <a href=\"https:\/\/www.osha.gov\/SLTC\/grainhandling\/\">resources on recognizing and controlling hazards<\/a> in the grain industry. OSHA is collaborating with the National Grain and Feed Association, Grain Elevator and Processing Society, American Feed Industry Association, and the Grain Handling Safety Coalition to identify potential hazards at grain, feed and processing facilities through the Stand-Up for Grain Safety Week slated for April 13-20, 2020.<\/p>\n<p>CGI has 15 business days from receipt of the <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/OPA\/newsreleases\/2020\/01\/OSHA-2020-2255.pdf\">citations and penalties<\/a> to comply, request an informal conference with OSHA\u2019s area director or contest the findings before the independent <a href=\"http:\/\/www.oshrc.gov\/index.html\">Occupational Safety and Health Review Commission<\/a>.<\/p>\n<p>Under the <a href=\"https:\/\/www.osha.gov\/laws-regs\/oshact\/completeoshact\">Occupational Safety and Health Act of 1970<\/a>, employers are responsible for providing safe and healthful workplaces for their employees.
