News Jul 30, 2013) \u2014 The North Dakota Highway Patrol is investigating an attack by an inmate on a guard at the James River Correctional Center that occurred on Sunday, about 1:10 p.m.<\/p>\n<p>Corrections officer, Jeremiah McDonald was airlifted to a Bismarck hospital for treatment of severe head injuries.<\/p>\n<p>There were no weapons involved.<\/p>\n<p>McDonald\u2019s condition was not immediately released.<\/p>\n<p>No one else was involved in the incident, and the inmate, Shawn Ostafin was not injured.<\/p>\n<p>The Highway Patrol Captain Bryan Niewind says charges will be filed against Ostafin, who is serving time for the 1990 murders of his father and stepmother in Mandan, and is serving a sentence for terrorizing.<\/p>\n<p>Niewind says the exact charges have not yet been determined, partly because authorities are still waiting to see the extent of McDonald\u2019s injuries.<\/p>\n<p>Ostafin, formerly of Mandan, has a violent criminal history.<\/p>\n<p>He served a lengthy sentence for the 1990 murders of his father and stepfather and is now serving time for terrorizing.<\/p>\n<p>Last year Ostafin, was disciplined for assaulting two staff members at the State Penitentiary in Bismarck.<\/p>\n<p>&nbsp;<\/p>\n<p>Valley City, ND\u00a0 (KCSi-T.V. News Jul 30, 2013)\u00a0 Valley City Police say 24-year-old Nathan Preston\u00a0reported to police that\u00a0 two pit bulls approached him and a woman at a camp fire.<\/p>\n<p>Fearing\u00a0the dogs were going to attack, he grabbed a handgun from the woman and fired several rounds at the dogs.<\/p>\n<p>Officers quickly arrived and saw two pit bulls leaving the scene, but could not catch them.<\/p>\n<p>Anyone with information is asked to call Valley City Police.<\/p>\n<p>The State&#8217;s Attorney&#8217;s Office will determine whether to file charges.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown, ND\u00a0 (KCSi-T.V. (AP) &#8211; A collision involving an Amtrak train and a bulldozer in northwestern North Dakota killed the driver of the bulldozer.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Highway Patrol identified the driver as 45-year-old Dennis McQueen of Williston.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Amtrak&#8217;s Empire Builder train was traveling from Seattle to Chicago with 326 passengers and crew when it collided with the bulldozer at a private crossing about 9 miles west of Trenton on Monday evening. No train passengers were hurt. Amtrak says two engineers were treated at a hospital for minor injuries and released.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The patrol says there was significant damage to the lead locomotive of the train. The front wheels of the locomotive came off the tracks. The 13-car train continued on with the aid of two BNSF Railway freight locomotives, after a delay of more than 11 hours.<\/p>\n<p>&nbsp;<\/p>\n<p>FARGO, N.D. (AP) &#8211; A rural North Dakota man says he will not fight Cass County over the seizure of his dogs.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities earlier this month took about 170 dogs and puppies from breeder Darcy Smith, of Wheatland, after reports they were being kept in poor condition.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Prosecutors say the dogs had no access to food or water, and had no air conditioning or ventilation in hot conditions.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 KFGO radio reports that a hearing on whether Smith could keep the dogs was held Tuesday morning in Fargo, but Smith decided not to contest a district judge&#8217;s order giving the sheriff&#8217;s office control of the animals.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Most of the dogs are in foster care and soon will be available for adoption.<\/p>\n<p>&nbsp;<\/p>\n<p>FARGO, N.D. (AP) &#8211; Prosecutor Cherie Clark says she&#8217;ll seek jail time for three former North Dakota State football players accused of skipping out on court-ordered community service.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 One of the three, Don Carter, appeared in court on a bench warrant Monday. Arrest warrants have been issued for Aireal Boyd and D.J. McNorton.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 They&#8217;re among 15 people accused of faking signatures on petition forms for two ballot initiatives last summer. (AP) &#8211; A change of plea hearing for a man accused of threatening to kill a federal judge in North Dakota was postponed when the defendant did not answer questions.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Carlos Kidd is charged with two counts of mailing threatening communications. Authorities say he mailed letters from Texas to U.S. District Judge Daniel Hovland in Bismarck.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Kidd&#8217;s lawyer filed notice earlier this month that his client wanted to change his plea to guilty.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Court documents show that Kidd did not respond when U.S. District Judge Ralph Erickson asked him Tuesday whether he wanted to go to trial or enter a plea.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Erickson ordered an evaluation on whether Kidd is competent to stand trial.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Kidd is currently serving two prison sentences, including 10 years for escape and five years for harassment.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0MINOT, N.D. (AP) &#8211; A North Dakota man accused of threatening to blow up a Social Security office in Minot has pleaded guilty.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Kevin Skiles pleaded guilty in federal court Monday to threatening to damage or destroy property by means of explosive.\u00a0<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 A sentencing hearing is set for Oct. 21.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities say the 54-year-old Skiles left a voicemail message on the phone of a Social Security representative after identifying himself, giving his social security number, and leaving his phone number.\u00a0<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Skiles allegedly threatened to blow up the building and told the employee, &#8220;I&#8217;m coming in tomorrow and you guys aren&#8217;t going to like it.&#8221;<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The charge carries a maximum sentence of 10 years in prison.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; Attorney General Wayne Stenehjem says North Dakota&#8217;s annual crime report &#8220;is not a rosy one.&#8221;<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Stenehjem says the per capita crime rate increased 7.9 percent in 2012. The number of offenses reported by local law enforcement agencies jumped from 13,778 in 2011 to 14,866 last year.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Stenehjem issued a new report Tuesday that provides statistics for crimes ranging from murder to car thefts. Data show that crime was up in nearly every category.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The number of violent crimes rose 7.2 percent and make up nearly 10 percent of reported crimes. (AP) &#8211; Two vulnerable adults who were judged to be in need of a public administrator to oversee their financial affairs are suing Grand Forks County, claiming they were fleeced by two county officials.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The attorney representing Faith Krueger and Paul Veum says they are missing hundreds of thousands of dollars in cash and assets and that the county is liable.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 County attorney Howard Swanson says it isn&#8217;t clear that any assets are missing and that if they are, the county isn&#8217;t responsible.<br \/>\n\u00a0<br \/>\n\u00a0 In a separate action, county officials are fighting with state insurance officials over whether the state should play claims made by the county for alleged improper actions by the same public administrator and her assistant.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 No criminal charges have been filed.<\/p>\n<p>&nbsp;<\/p>\n<p>HETTINGER, N.D. (AP) &#8211; Residents in Adams County of North Dakota are debating a proposed wind farm.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The\u00a0 project would place up to 75 wind turbines in the county, which borders South Dakota in the far southwestern corner of the state.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Developers say the farm would provide $800,000 to be split among landowners and pump about $650,000 in tax revenue to the county each year.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Duck Creek Township resident Bill Elder says he&#8217;s opposed to the project. He says his family chose to live in the area for the beauty of the land and the privacy, and believes the farm would be an eyesore.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 County resident Larry Slater likes the idea. He says it would provide good shade for cattle and would be a tourist attraction for the county.<\/p>\n<p>&nbsp;<\/p>\n<p>FORT TOTTEN, N.D. (AP) &#8211; Benson County is moving about 10 social services workers to office space on the Spirit Lake Reservation, where most clients for Medicare, Medicaid and food stamps live.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The county and tribe plan to sign a lease agreement Wednesday.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The plan grew out of meetings of county, tribe and other regional officials in response to child protection issues at Spirit Lake. The federal Bureau of Indian Affairs took over that system last October after heavy criticism that it was failing to protect vulnerable children on the reservation.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The county employees moving to reservation office space currently are scattered at sites in Maddock, Minnewaukan and the Crow Hill District of Spirit Lake.
