News) &#8212; The Jamestown City Council met in Regular Session on Monday (Aug 5, 2013) at City Hall. All members were present.<\/p>\n<p>Under bids:<\/p>\n<p>Opening bids for the sale of an impounded\/abandoned 2008 Nissan.<\/p>\n<p>Opening bids for the as-direct sale of 1999 GMC Suburban.<\/p>\n<p>Consent Agenda items considered separately included:<\/p>\n<p>&nbsp;<\/p>\n<p>Item &#8220;B&#8221; was asked to be removed by a audience member, Jerry Demore, a Resolution to authorize reinstatement of the original $100,000 of Economic Development Funds for FLEX PACE funding for Buffalo City Rotisserie Grill with the City Share to be 100% and paid from the City Sales Tax Fund.<\/p>\n<p>He asked why the item was to be reinstated, and questioned why the request was made.<\/p>\n<p>Mayor Andersen explained the application was on behalf of the new owner, who decided not to use another type of loan for the previous remodeling. She further explained the process of Flex Pace Funding.<\/p>\n<p>The City Council then voted to approve the reinstatement, on a 3-2 vote, with Council Members Buchanan and Brubakken voting in opposition..<\/p>\n<p>\u3000<\/p>\n<p>Council Member Buchanan asked that item &#8220;E&#8221; be discussed, a Resolution to approve the request from Dean Hafner and Clyde Schmaltz to use the 25%\/75% special assessment provisions provided in Section 8 of Appendix B of the City Code relative to the development of 6-10 additional lots in the Meadow\u2019s Addition on 3<span style=\"font-size: xx-small;\">rd <\/span>St NE, and for the City to cover the estimated $30,000 cost of increasing a portion of the water main to be looped and various ditch and storm water improvements.<\/p>\n<p>He asked for reconsideration and denial.<\/p>\n<p>He also questioned the percentage of Special Assessment in Section 8, and the Section of the City Code, itself.<\/p>\n<p>He also questioned the procedure in coming to the City Council, and asked for a written opinion for the City Attorney.<\/p>\n<p>Mayor Andersen said the plan was to provide a tool for developers, and help solve the housing shortage, and help create new housing starts.<\/p>\n<p>Dean Hafner spoke and agreed with statements made by the Mayor.<\/p>\n<p>The City Council voted 4-1 to approve the request with Council Member Buchanan voting in opposition.<\/p>\n<p>On the Regular Agenda:<\/p>\n<p>A Public Hearing was held, concerning the special assessment list for Seal Coat, Patching, Construction and Reconstruction District #12-41.<\/p>\n<p>Following the Public Hearing the City Council approved the special assessments in the total amount of $2,178,412.10, with the City Share to be $512,185.56, with the balance of $1,666,226.54 to be assessed to benefited properties within the district.<\/p>\n<p>Another Public Hearing was held concerning the request to vacate the unvacated alley portion adjacent to Lots 8, 9, that portion of Lot 10 line perpendicular to the east lot line of Lot 32, and all Lots 32 &amp; 33, Block 9, Kelley &amp; Fuller\u2019s 2<span style=\"font-size: xx-small;\">nd <\/span>Addition, all to the City of Jamestown, Stutsman County, North Dakota.<\/p>\n<p>Following the Public Hearing, the City Council approved the request.<\/p>\n<p>Committee Reports:<\/p>\n<p>The City Council awarded the bid for the as-is direct sale of a 1999 GMC Suburban to\u00a0 Budget Auto Sales &amp; Service in the amount of $1,110.00.<\/p>\n<p>\u3000<\/p>\n<p>Under Ordinances:<\/p>\n<p>Discussion was to be held on a Ordinance to create and enact a new Chapter 27 of the City Code pertaining to the regulation of sexually oriented businesses of adult cabarets and escort services.<\/p>\n<p>Mayor Andersen said still at issue was the distance the businesses can be located from residences, churches and schools, along with the right combination of zoning.<\/p>\n<p>Other options under consideration in lieu of a distance limit is fencing, and hours of operation.<\/p>\n<p>At Monday\u2019s meeting, City Attorney Ken Dalsted requested the item be delayed and taken up at this month\u2019s committee meeting, and the item was tabled until then.<\/p>\n<p>A Public Hearing was held, concerning an Ordinance to annex the remaining undeveloped land located with the Marjo First Addition and located within the NE1\/4, Section 30, T140N, R63W, into the City of Jamestown, Stutsman County, ND.<\/p>\n<p>Following the Public Hearing the Council approved the Second Reading.<\/p>\n<p>\u3000<\/p>\n<p>A Second Reading of an Ordinance to amend and re-enact Section 5.4, Appendix C of the City Code, pertaining to uses permitted in R-3 Districts, was approved.<\/p>\n<p>The change allows unlimited number of units on a lot.<\/p>\n<p>Hearing From The Audience: No one spoke.<\/p>\n<p>Appointments: None were made. Mayor Andersen suggested that in the future openings be advertised.<\/p>\n<p>\u3000<\/p>\n<p>Mayor and Council Members Report: Council Member Buchanan said that he and Council Member Kourajian attended a recycling symposium, ane heard specifically about successfully recycling efforts in Grand Forks. He suggested the City of Jamestown again look seriously at recycling. He pointed out that Valley City has a 24\/7 recycling program.<\/p>\n<p>Kourajian pointed out that recycling save space in the landfill and agreed that Jamestown needs to address recycling included in the strategic plan.<\/p>\n<p>Mayor Andersen said she attended a workshop in Jamestown attended by 40 individuals. It was hosted by the North Dakota League of Cities outlining open records and meeting laws by the North Dakota Attorney General\u2019s Office, and other items concerning running governmental agencies.<\/p>\n<p>Other business:<\/p>\n<p>The City Council approved the request for a gaming site authorization for the Jamestown Hockey Booster Club, Inc., at the Quality Inn &amp; Suites (Executive Room), for February 12, 2014.<\/p>\n<p>As explained by Darrell Hournbuckle of Interstate Engineering, Council Members approved a Change Order to Sellin Brothers, Inc., for construction on Wastewater Lift Station &amp; Force Main Improvement Project, Phase II, Force Main &amp; Gravity Sewer &amp; District for a net increase in the contract price of $5,671.32.<\/p>\n<p>He pointed out that with the sanitary sewer project, the area of 4<sup>th<\/sup> Avenue is moving slower than anticipated, due to soil issues, and accepting pavement.<\/p>\n<p>At the lift station replacement in the Jamestown Business Center, the work was slowed by hitting rocks, which has broken some equipment.<\/p>\n<p>\u3000<\/p>\n<p>The City Council accepted the proposal from Energy Services Group for a Guaranteed Savings Project for the Jamestown Civic Center. A portion of the project costs will go to pay toward lower energy costs.<\/p>\n<p>The City Council approved entering into a Development Agreement between the City of Jamestown and Anne Carlsen Center, providing for completion of engineering documents required for Anne Carlsen Center Addition.<\/p>\n<p>The new addition is east of Jamestown Regional Medical Center.<\/p>\n<p>Council Members approved Resolutions pertaining to Paving, Water &amp; Sewer District, including setting up and establishing the district.<\/p>\n<p>It also included having Interstate Engineering, Inc., prepare a report of the general nature, purpose and feasibility, and an estimate of costs for the district. along with<\/p>\n<p>preparing plans and specifications for the construction of the district, and accepting and approving the plans and specifications, as prepared by Interstate Engineering, Inc., for the construction of the District. Four gateways will be installed.<\/p>\n<p>Completion is expected in early 2014.<\/p>\n<p>With the buyout program for 2013, the city met with Deb Kantrud of the South Central Regional Council and discussed the previous year\u2019s buyouts for future reference.<\/p>\n<p>City Updates &amp; Commission Comments<\/p>\n<p>City Police Chief Fred Thompson said in his first year with the Department he\u2019s seen numerous improvements.<\/p>\n<p>KLJ reported the 9<sup>th<\/sup> Avenue Northwest project will be receiving concrete in about two weeks. All projects are expected to wind down in the next few weeks.<\/p>\n<p>Mayor Werkhoven noted debris of clay still in some parts of town from the June 20, 2013 flash flooding.<\/p>\n<p>He noted he attended the Devils Lake Water Commission meeting, where it was noted the Lake levels, may possible be lowering by fall.<\/p>\n<p>Commissioner Nielson reported fire fighters passed tests, with a higher than national average score.<\/p>\n<p>She pointed out the first block party is set for Tuesday at 6-p.m., at 6<sup>th<\/sup> Avenue.<\/p>\n<p>Commisioner Luke noted new items at the library.<\/p>\n<p>The meeting was shown live on CSi 68, followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown, ND (KCSi-T.V. News Aug 5, 2013) &#8212; The new Southwest water storage tank and associated force main project is progressing on time.<\/p>\n<p>On Monday\u2019s (Aug 5, 2013) Wayne Byers Show on CSi Cable 2, Jamestown Mayor Katie Andersen said, the footings for the tower have been placed and a the trench for the force main, to supply water to the elevated tank is in the process of being dug. (a portion of the trench digging can be seen near the Jamestown Wal-Mart.<\/p>\n<p>The tower is expected to be up and supplying water to southwest Jamestown later this year, and the tower will be painted next spring.<\/p>\n<p>She added that the Jamestown sanitary sewer project is progressing as well, and contractors are in touch with the principal and staff of Washington Elementary School on 4<sup>th<\/sup> Avenue, Northwest, as the work there is expected to be finished and the street repaved in plenty of time for the first day of school later this month.<\/p>\n<p>\u3000<\/p>\n<p>Jamestown, ND (KCSi-T.V. News) &#8212; Some of the dogs rescued recently from an apparent puppy mill in Wheatland, North Dakota, on July 10, 2013 are now available for adoption.<\/p>\n<p>Many of the dogs seized by the Cass County sheriff\u2019s deputies, were neglected and undernourished, and others had fur matted so badly that they couldn\u2019t move.<\/p>\n<p>Their former owner, 51 year old Darcy Smith, of Wheatland, waived his rights to regain custody of the dogs during a court hearing last week, which allowed them to be legally adopted by others interested.<\/p>\n<p>The Wheatland dogs have been distributed to rescue organizations, led by &#8220;4 Luv of Dog Rescue,&#8221; in Fargo.<\/p>\n<p>Also Prairie Paws Rescue of Jamestown has taken nine of the dogs, and four of them are likely to be ready for adoption as soon as they are spayed or neutered.<\/p>\n<p>It\u2019s expected the remaining five dogs will take longer to put up for adoption, still being scared and shy, based on their previous experience.<\/p>\n<p>Foster families are also wanted for the dogs.<\/p>\n<p>Anyone fostering or adopting them, is required to have a fence, and the dogs need to be leash-trained, or housebroken.<\/p>\n<p>Meanwhile Prairie Paws Rescue has 18 other dogs in need of homes, and seven kittens.<\/p>\n<p>For more information on fostering, adopting or becoming a &#8220;Wheatland Dog Buddy,&#8221; on line visit<\/p>\n<p><a href=\"http:\/\/www.prairiepawsrescue.com\/\"><b>www.prairiepawsrescue.com<\/b><\/a><\/p>\n<p>E- Mail prairiepawsrescue@hotmail.com or call 320-4553.<\/p>\n<p>\u3000<\/p>\n<p>\u3000From JSDC<\/p>\n<p>Jamestown, ND (KCSi-T. News Aug 5, 2013) &#8212; Jamestown\/Stutsman Development Corporation staff, DeAnn Brunner and Holly Miller, attended the International Economic Development Council\u2019s Workforce Conference July 18th-19th, 2013.<\/p>\n<p>The course focused on the workforce topic and the idea that skilled workers are the backbone of a productive and efficient economy. This course explained the strong relationship between economic and workforce development through case studies, practical examples, and current research. DeAnn and Holly learned what programs currently leverage federal, state, and local financial resources to support workforce development. The conference also covered collaborative programs that will help upgrade the skills of the community&#8217;s existing workforce.<\/p>\n<p>Ms. Miller, summed up her experience at the conference, by saying, &#8220;The networking opportunities at this conference were invaluable. I was able to take away key points from every speaker and apply them to scenarios in our community, as well as learn more about the key role education plays in strengthening and growing our workforce. (AP) &#8211; Fargo police are searching for a person who robbed a pizza delivery driver at gunpoint.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities say the holdup happened about midnight while the driver was making a delivery. The driver wasn&#8217;t hurt.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 A police dog was brought in to search the neighborhood but didn&#8217;t find the robber. Police say they are following up on a couple of leads.<\/p>\n<p>&nbsp;<\/p>\n<p>FARGO, N.D. (AP) &#8211; A former Fargo investment broker who pleaded guilty to bilking 18 investors out more than $900,000 has been sentenced to 10 years in prison.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Judge Frank Racek sentenced 65-year-old Robert Medhus (MAY-hoos) on Monday. Medhus had pleaded guilty in East Central District Court in June to 13 counts of securities fraud, two counts of theft of property and one count of selling unregistered securities.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Prosecutors say Medhus forged client checks, created fake investment account statements and failed to invest client assets as promised.\u00a0<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The North Dakota Securities Department uncovered the fraudulent scheme after receiving investor complaints, and the Cass County State&#8217;s Attorney investigated criminal charges.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0FARGO, N.D. (AP) &#8211; Cool average temperatures across North Dakota have been good for small grain development, but warmer weather and additional moisture is needed to help row crops.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The U.S. Agriculture Department says in its weekly crop says that some western and extreme northern and southern areas of the state received significant rainfall, but most central and eastern areas received little to no moisture.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Topsoil moisture supplies are rated 7 percent very short, 32 percent short, 56 percent adequate and 5 percent surplus.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Durum wheat headed is at 99 percent, ahead of the 93 percent average. (AP) &#8211; The Federal Emergency Management Agency says that the number of temporary housing units still occupied in Ward County after the 2011 Souris River flood has fallen below 70.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 FEMA says completed sales have surpassed 200 with less than two months remaining in the agency&#8217;s housing mission, which ends Sept. 24. Displaced residents have the option of purchasing the unit in which they are living.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Three of the 69 remaining temporary units are on private property in the Souris Valley. (AP) &#8211; A federal judge says the wife of a man convicted of bilking millions of dollars out of people in North Dakota, South Dakota, Minnesota and elsewhere in an investment fraud scheme cannot collect proceeds from his insurance policy<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Verlin Swartzendruber, of Laredo, Texas, was sentenced in 2010 to five years in prison, after pleading guilty to one count of wire fraud. He was ordered to pay back more than $3 million.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Swartzendruber&#8217;s wife, Lois, filed a motion in federal court asking to keep the insurance proceeds. She says the money should be excluded from restitution because the law considers her an innocent spouse.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 U.S. District Judge Ralph Erickson in Fargo denied the claim Monday. Erickson says he&#8217;s sympathetic to her financial hardship but she&#8217;s not the owner of the policy.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; North Dakota public lands officials say they&#8217;ve incorporated many recommendations to protect habitat on 54,000 acres slated for mineral leasing.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The land falls under at least partial control of the North Dakota Department of Trust Lands. Officials will auction mineral leases on the properties Tuesday in Medora. Many of the tracts are near wildlife habitat or natural landmarks.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Game and Fish Department has recommended restrictions on many of the tracts to limit impacts on wildlife. Other agencies, including federal wildlife and historic preservation officials, also have submitted comments with concerns.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 State Lands Commissioner Lance Gaebe (GAY&#8217;-bee) says officials have imposed restrictions or alerted developers that restrictions could apply to protect historical, paleontological or archaeological resources. (AP) &#8211; South Dakota lottery officials say an 84-year-old Pierre man has claimed a Wild Card 2 jackpot worth nearly a half-million dollars.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Duane Delaney lives within walking distance of the South Dakota Lottery office, and he turned in his ticket for $499,694 on Monday. As an assistant, she worked primarily as the hitting coach while also working with outfield defense and the catchers.<\/p>\n<p>Fracker is a 2008 graduate of Indiana State University, where she lettered four years in softball as a catcher. Prior to joining the VCSU staff in February 2012, she worked assistant coach jobs at Drexel University and Oberlin College.<\/p>\n<p>Hanek comes to VCSU from Miles Community College in Miles City, Mont. She officially takes over the Viking women\u2019s basketball program on Aug. 19. She replaces Jill DeVries, who resigned earlier this summer.<\/p>\n<p>Hanek spent one year as head women\u2019s coach and assistant men\u2019s coach at Miles Community College.
