JAMESTOWN, N.D. (AP & KCSi-T.V. News Aug 20, 2012) \u2013 A woman who has been convicted of manslaughter says she sold drugs to the victim.
\nTwenty-two-year-old Janelle Cave testified during the fifth day (Monday Aug 20, 2012) of 34-year-old Leron Howard\u2019s trial that she sold 18-year-old Abdi Ali Ahmed marijuana.<\/p>\n

Howard has pleaded not guilty to murder and criminal conspiracy in the April 2011 death of Ahmed, whose body was found in a ditch near Spiritwood.
\nA jury convicted the 22-year-old Cave on manslaughter and criminal conspiracy charges in February.<\/p>\n

She is appealing.<\/p>\n

Her sentence required her to testify at Howard\u2019s trial.
\nCave denied Ahmed owed her any money.<\/p>\n

Cave testified that Howard struck Ahmed outside her trailer and knocked him unconscious.<\/p>\n

They transported Ahmed to the home of Delmonte Jones near Spiritwood, where they left Ahmed unconscious in the car.<\/p>\n

Cave testified that they went into the Jones\u2019 home where they did marijuana.<\/p>\n

The jury heard testimony regarding information recovered from a phone that allegedly belonged to Howard.<\/p>\n

Tuesday may be the last day of testimony in the case.<\/p>\n

Howard is expected to take the stand during the trial to tell his version of the events surrounding Ahmed\u2019s death.
\nJudge Thomas Merrick says the case could go to the jury by midweek.<\/p>\n

Valley City, ND (KCSi-T.V. News) — The Valley City Commission met in Regular Session on Monday (Aug 20, 2012) at City Hall.<\/p>\n

All Commissioners were present.<\/p>\n

Consent Agenda items approved includes:<\/p>\n

A Game of Chance Raffle Permit for Valley City State University Golf Team.<\/p>\n

A Master Heater Installer License for Quality Heating & Air Conditioning.<\/p>\n

\u3000<\/p>\n

Resolutions:<\/p>\n

City Commissioners approved a Resolution, accepting the low bid and awarding the contract for Pavement Marking Improvements to Northstar Safety Inc. in the amount of $119,406.20.<\/p>\n

Funds come from the State Highway Department.<\/p>\n

\u3000<\/p>\n

A Resolution was approved consisting of a Street Right of Way issue on 11th<\/sup> Avenue SW between 5th<\/sup> and 6th<\/sup> Street SW.<\/p>\n

\u00a0<\/p>\n

An easement will be created for city access for infrastructure purposes, while others will be able to sell properties.<\/p>\n

\u00a0<\/p>\n

Property lines will be indicated by GPS and staked.<\/p>\n

The City Commission approved the First Reading of An Ordinance,creating a Perpetual Restrictive Covenant where properties were removed in accordance with the State Water Commission, regarding previously flood areas.<\/p>\n

\u00a0Thirteen properties are involved.<\/p>\n

\u00a0<\/p>\n

New Business:<\/p>\n

\u00a0A Public Hearing was held on the Final Status and Performance Reports from City of Valley City for $310,000 of CDBG Funding for a Valley City Emergency Sewer Project.<\/p>\n

The project stems from 2009 flooding.<\/p>\n

\u00a0City Commissioners approved three Renaissance Zone applications for a 5 year income tax exemption and 5 year property tax exemption for Six D Construction, and designate the three projects as VC-68, VC-69 and VC-70.<\/p>\n

The applications are for Phase III of the Legacy Place expansion.<\/p>\n

\u00a0<\/p>\n

An Image Enhancement Retail and Image Grant for Valley Service in the amount of $3,092, was approved. The amount will be used for signage improvements.<\/p>\n

\u00a0<\/p>\n

Another Image Enhancement Retail and Image Grant for VCSU in the amount of $5,000 was approved.<\/p>\n

The dollars to be used to replace the electronic signage, near Osmond Fieldhouse.<\/p>\n

 <\/p>\n

The City Commission apporved a Flex PACE loan to Nicki and Josh Nelson (The Tax Team) in the amount of $6,000, to buy down interest.<\/p>\n

The loan will be repaid.<\/p>\n

 <\/p>\n

Commissioners approved an application to Block Off Street at 3rd<\/sup> Avenue SE from Main Street to Alley on August 25 for Boomer’s Benefit.<\/p>\n

 <\/p>\n

The City Commission then approved land conveyance for the property line correction\/encroachment by Valley City Development property for Malach USA.<\/p>\n

The property owned by the city is not usable.<\/p>\n

 <\/p>\n

The Commission approved a Construction Engineering Agreement for Pavement Marking Improvements to Kadrmas Lee & Jackson in the amount of $11,000.<\/p>\n

 <\/p>\n

Consideration was given for bids for Five Traffic Signal Controller replacements.<\/p>\n

The Commission approved the bid of $41,751.<\/p>\n

 <\/p>\n

The City Commission tabled approving $70,000 for pavement reconstruction on 4th<\/sup> Avenue NE between 6th<\/sup> and 9th<\/sup> Street NE, and 8th<\/sup> Street NE between 3rd<\/sup> and 4th<\/sup> Avenue Northeast, near the water treatment plant.<\/p>\n

\u3000<\/p>\n

The Commisioners reviewed the plan to sell the auditorium. City Administrator Schelkoph said a plan has been developed to review potential purchasers plans for the building, plus a bidding pool would be established.<\/p>\n

\u3000<\/p>\n

City Administrator Report:<\/p>\n

David Schelkoph reported progress of street projects, as Chad Peterson from KLJ gave an update on the sanitary sewer, storm sewer and water main projects, along with street reconstruction pours and overlays.<\/p>\n

Schelkopf reported on the events surrounding the failure of the Master Sewer Lift Station, last week.<\/p>\n

He said the good news of the problem was that no one was injured in the process of containing the sewage when the plug failed during routine maintenance last Thursday.<\/p>\n

He said the quick response of city crews in installing pumps, saved the city and it\u2019s citizens dollars and “heartaches,” with what could have happened with damages.<\/p>\n

Four pumps are now working and two additional pumps will be going back on line this week.<\/p>\n

He pointed out the State Health Department was notified and kept up to date on the pumping of the raw sewage into the Sheyenne River, which was stopped last Friday afternoon.<\/p>\n

A final report will be issued to the city and State Health Department.<\/p>\n

City Updates & Commission Comments:<\/p>\n

Commissioner Magnuson praised the city crews in their quick response to the main sewage lift station emergency last week.<\/p>\n

City Attorney Russell Myhre said closing has been completed on 13 flood buyout properties.<\/p>\n

City Auditor Richter said copies of the 2013 city budget has been readied to be presented on Monday August 27, 2012, the start of the budgeting process.<\/p>\n

Police Chief Thompson told the Commissioners that when dispatch receives 9-1-1 phone calls, each call will be responded to with a police officer sent to the scene.<\/p>\n

He said the change in policy is now in effect.<\/p>\n

Mayor Werkhoven said it was refreshing to see the flood property buyouts are progressing, along with the plans to sell the auditorium.<\/p>\n

BISMARCK, N.D. (AP) – The federal government is putting a
\nproject to raise flood-prone railroad tracks in the Devils Lake
\nregion on the fast track.
\n\u00a0\u00a0\u00a0\u00a0 The Transportation Department late last year awarded $10 million
\nfor the rail improvements in the flooded Devils Lake region.<\/p>\n

The project is among four transportation projects that President Barack
\nObama on Monday said would be expedited to improve aging
\ntransportation infrastructure.<\/p>\n

The others are in Maine, Oregon and Washington. Other projects will be announced later.
\n\u00a0\u00a0\u00a0\u00a0 The $100 million project in North Dakota will raise about 15
\nmiles of track that is owned by BNSF Railway but also used by
\nAmtrak passenger trains that travel between Chicago and the Pacific
\nNorthwest.
\n\u00a0\u00a0\u00a0\u00a0 The White House says federal reviews will be done over the
\nwinter and construction is expected next summer.<\/p>\n

GRAND FORKS, N.D. (AP) – A cancer researcher who resigned from
\nDuke University in North Carolina two years ago is now working in
\nNorth Dakota.
\nAnil Potti (uh-NEEL’ PAHT’-ee) is a medical oncologist at the Cancer
\nCenter of North Dakota in Grand Forks.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Potti came under scrutiny in 2010 and later resigned after
\nquestions arose about his claim to be a Rhodes Scholar and about
\nthe integrity of his research.<\/p>\n

The North Carolina Medical Board concluded that Potti acted unprofessionally.
\n\u00a0\u00a0\u00a0\u00a0 Potti left a South Carolina cancer center earlier this year
\nfollowing a CBS “60 Minutes” report about his Duke research.
\n\u00a0\u00a0\u00a0\u00a0 The head of the Grand Forks cancer center says Potti has been
\nunfairly accused.<\/p>\n

William Noyes also says Potti’s work at Duke involved research and not patient care.<\/p>\n

\u00a0WILLISTON, N.D. (AP) – Crews have completed work on a temporary
\ntruck bypass on the west side of Williston.
\n\u00a0\u00a0\u00a0\u00a0 The 16-mile bypass will help route heavy oil field truck traffic
\naround Williston and ease congestion in city limits.<\/p>\n

A temporary bypass also is planned on the east side of Williston. It’s to be
\ndone by the end of the year.
\n\u00a0\u00a0\u00a0\u00a0 Local and state officials including Gov. Jack Dalrymple held a
\ndedication ceremony Monday for the $12 million west-side project.<\/p>\n

ST. LOUIS (AP) – Congressman Todd Akin says he was wrong in
\nclaiming that women’s bodies are able to prevent pregnancies in “a
\nlegitimate rape” situation.<\/p>\n

The Missouri Republican Senate candidate went on Mike Huckabee’s national radio show Monday to apologize for comments that aired yesterday.<\/p>\n

Those comments prompted some Senate Republicans to call for him to get out of the race.<\/p>\n

But Akin is vowing to continue his campaign, saying he’s not the first politician to suffer from what he called “foot-in-mouth disease.”
\n\u00a0\u00a0\u00a0\u00a0\u00a0
\n\u00a0\u00a0\u00a0\u00a0 WASHINGTON (AP) – President Barack Obama says he’s had to point
\nout “sharp differences” with Mitt Romney on issues, but says
\nnothing in his campaign ads about the GOP candidate has been “out
\nof bounds.”<\/p>\n

At a White House news conference Monday, Obama also defended ads attacking Romney’s refusal to release more than two years’ worth of tax returns.<\/p>\n

He says those seeking the White House must know their life is an “open book.”<\/p>\n

Police have said officers had frisked Chavis Carter twice after a traffic stop without finding a gun before he was fatally shot last month.

The Florida woman was acquitted last year on a charge of murdering her
\n2-year-old daughter, Caylee.<\/p>\n

She’s been serving probation on a check fraud conviction at an undisclosed location in Florida.
