News Aug 20, 2012) \u2013 A woman who has been convicted of manslaughter says she sold drugs to the victim.<br \/>\nTwenty-two-year-old Janelle Cave testified during the fifth day (Monday Aug 20, 2012) of 34-year-old Leron Howard\u2019s trial that she sold 18-year-old Abdi Ali Ahmed marijuana.<\/p>\n<p>Howard has pleaded not guilty to murder and criminal conspiracy in the April 2011 death of Ahmed, whose body was found in a ditch near Spiritwood.<br \/>\nA jury convicted the 22-year-old Cave on manslaughter and criminal conspiracy charges in February.<\/p>\n<p>She is appealing.<\/p>\n<p>Her sentence required her to testify at Howard\u2019s trial.<br \/>\nCave denied Ahmed owed her any money.<\/p>\n<p>Cave testified that Howard struck Ahmed outside her trailer and knocked him unconscious.<\/p>\n<p>They transported Ahmed to the home of Delmonte Jones near Spiritwood, where they left Ahmed unconscious in the car.<\/p>\n<p>Cave testified that they went into the Jones\u2019 home where they did marijuana.<\/p>\n<p>The jury heard testimony regarding information recovered from a phone that allegedly belonged to Howard.<\/p>\n<p>Tuesday may be the last day of testimony in the case.<\/p>\n<p>Howard is expected to take the stand during the trial to tell his version of the events surrounding Ahmed\u2019s death.<br \/>\nJudge Thomas Merrick says the case could go to the jury by midweek.<\/p>\n<p>\u3000<\/p>\n<p>Valley City, ND (KCSi-T.V. News) &#8212; The Valley City Commission met in Regular Session on Monday (Aug 20, 2012) at City Hall.<\/p>\n<p>All Commissioners were present.<\/p>\n<p>Consent Agenda items approved includes:<\/p>\n<p>A Game of Chance Raffle Permit for Valley City State University Golf Team.<\/p>\n<p>A Master Heater Installer License for Quality Heating &amp; Air Conditioning.<\/p>\n<p>\u3000<\/p>\n<p>Public Forum: No One Spoke.<\/p>\n<p>\u3000<\/p>\n<p>Resolutions:<\/p>\n<p>City Commissioners approved a Resolution, accepting the low bid and awarding the contract for Pavement Marking Improvements to Northstar Safety Inc. in the amount of $119,406.20.<\/p>\n<p>Funds come from the State Highway Department.<\/p>\n<p>\u3000<\/p>\n<p align=\"justify\">A Resolution was approved consisting of a Street Right of Way issue on 11<sup>th<\/sup> Avenue SW between 5<sup>th<\/sup> and 6<sup>th<\/sup> Street SW.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">An easement will be created for city access for infrastructure purposes, while others will be able to sell properties.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">Property lines will be indicated by GPS and staked.<\/p>\n<p align=\"justify\">The City Commission approved the First Reading of An Ordinance,creating a Perpetual Restrictive Covenant where properties were removed in accordance with the State Water Commission, regarding previously flood areas.<\/p>\n<p align=\"justify\">\u00a0Thirteen properties are involved.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">New Business:<\/p>\n<p align=\"justify\">\u00a0A Public hearing was held on the Final Status and Performance Reports from City of Valley City for $310,000 of CDBG Funding for a Valley City Emergency Sewer Project.<\/p>\n<p>The project stems from 2009 flooding.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">City Commissioners approved three Renaissance Zone applications for a 5 year income tax exemption and 5 year property tax exemption for Six D Construction, and designate the three projects as VC-68, VC-69 and VC-70.<\/p>\n<p>The applications are for Phase III of the Legacy Place expansion.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">An Image Enhancement Retail and Image Grant for Valley Service in the amount of $3,092, was approved. The amount will be used for signage improvements.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p>\u00a0Another Image Enhancement Retail and Image Grant for VCSU in the amount of $5,000 was approved.<\/p>\n<p>The dollars to be used to replace the electronic signage, near Osmond Fieldhouse.<\/p>\n<p>\u3000<\/p>\n<p>\u00a0The City Commission apporved a Flex PACE loan to Nicki and Josh Nelson (The Tax Team) in the amount of $6,000, to buy down interest.<\/p>\n<p>The loan will be repaid.<\/p>\n<p>\u3000<\/p>\n<p>Commissioners approved an application to Block Off Street at 3<sup>rd<\/sup> Avenue SE from Main Street to Alley on August 25 for Boomer&#8217;s Benefit.<\/p>\n<p>&nbsp;<\/p>\n<p>The City Commission then approved land conveyance for the property line correction\/encroachment by Valley City Development property for Malach USA.<\/p>\n<p>The property owned by the city is not usable.<\/p>\n<p>\u3000<\/p>\n<p>The Commission approved a Construction Engineering Agreement for Pavement Marking Improvements to Kadrmas Lee &amp; Jackson in the amount of $11,000.<\/p>\n<p>\u3000<\/p>\n<p>Consideration was given for bids for Five Traffic Signal Controller replacements.<\/p>\n<p>The Commission approved the bid of $41,751.<\/p>\n<p>\u3000<\/p>\n<p>The City Commission tabled approving $70,000 for pavement reconstruction on 4<sup>th<\/sup> Avenue NE between 6<sup>th<\/sup> and 9<sup>th<\/sup> Street NE, and 8<sup>th<\/sup> Street NE between 3<sup>rd<\/sup> and 4<sup>th<\/sup> Avenue Northeast, near the water treatment plant.<\/p>\n<p align=\"justify\">\u3000<\/p>\n<p>The Commisioners reviewed the plan to sell the auditorium. City Administrator Schelkoph said a plan has been developed to review potential purchasers plans for the building, plus a bidding pool would be established.<\/p>\n<p>\u3000<\/p>\n<p>City Administrator Report:<\/p>\n<p>David Schelkoph reported progress of street projects, as Chad Peterson from KLJ gave an update on the sanitary sewer, storm sewer and water main projects, along with street reconstruction pours and overlays.<\/p>\n<p>Schelkopf reported on the events surrounding the failure of the Master Sewer Lift Station, last week.<\/p>\n<p>He said the good news of the problem was that no one was injured in the process of containing the sewage when the plug failed during routine maintenance last Thursday.<\/p>\n<p>He said the quick response of city crews in installing pumps, saved the city and it\u2019s citizens dollars and &#8220;heartaches,&#8221; with what could have happened with damages.<\/p>\n<p>Four pumps are now working and two additional pumps will be going back on line this week.<\/p>\n<p>He pointed out the State Health Department was notified and kept up to date on the pumping of the raw sewage into the Sheyenne River, which was stopped last Friday afternoon.<\/p>\n<p>A final report will be issued to the city and State Health Department.<\/p>\n<p>\u3000<\/p>\n<p>City Updates &amp; Commission Comments:<\/p>\n<p>Commissioner Magnuson praised the city crews in their quick response to the main sewage lift station emergency last week.<\/p>\n<p>City Attorney Russell Myhre said closing has been completed on 13 flood buyout properties.<\/p>\n<p>City Auditor Richter said copies of the 2013 city budget has been readied to be presented on Monday August 27, 2012, the start of the budgeting process.<\/p>\n<p>\u3000<\/p>\n<p>Police Chief Thompson told the Commissioners that when dispatch receives 9-1-1 phone calls, each call will be responded to with a police officer sent to the scene.<\/p>\n<p>He said the change in policy is now in effect.<\/p>\n<p>\u3000<\/p>\n<p>Mayor Werkhoven said it was refreshing to see the flood property buyouts are progressing, along with the plans to sell the auditorium.<\/p>\n<p>&nbsp;<\/p>\n<p>The meeting was shown live on CSi 68,followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown, ND (KCSi-T.V. (AP) &#8211; Authorities have arrested a teenage boy in the armed robbery of a gas station in the southeastern North Dakota town of Mapleton.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The robbery at Gordy&#8217;s Travel Plaza was reported about 6 p.m. Monday.<\/p>\n<p>The Cass County Sheriff&#8217;s Office says the 17-year-old suspect was stopped a short time later on Interstate 29 in the Fargo area and arrested without incident.<\/p>\n<p>Authorities say items in the boy&#8217;s car link him to the holdup.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 No one was injured in the incident.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; A North Dakota man has pleaded guilty to<br \/>\nattacking two women.<br \/>\n\u00a0\u00a0\u00a0\u00a0 U.S. Attorney Timothy Purdon announced Monday that 21-year-old<br \/>\nLionel R. Jewett OF Fort Yates pleaded guilty to counts of assault<br \/>\nwith intent to commit murder, two counts of assault with a<br \/>\ndangerous weapon and two counts of burglary.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Prosecutors say Jewett attacked two women in January of this<br \/>\nyear. Jewett attacked one woman with a garden hoe and kicked both<br \/>\nwomen.<\/p>\n<p>He also stole a vehicle, tools and some money from a local<br \/>\nchurch in March and October of last year.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Sentencing is set for Dec. 10.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; A North Dakota district judge has been<br \/>\ndisciplined by the state Supreme Court, but she says she&#8217;s pleased<br \/>\nby some parts of the court&#8217;s ruling.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Supreme Court admonished Cynthia Feland for her conduct in<br \/>\nher former job as a Burleigh County prosecutor.<\/p>\n<p>She&#8217;s been a judge for almost two years.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The case arose from Feland&#8217;s prosecution of former North Dakota<br \/>\nworkers&#8217; compensation director Sandy Blunt.<\/p>\n<p>Blunt was convicted of misspending agency funds.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Supreme Court says Feland failed to turn over some evidence<br \/>\nto Blunt&#8217;s defense lawyer.<\/p>\n<p>The court said the mistake didn&#8217;t hurt Blunt&#8217;s case.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Feland says she&#8217;s pleased the Supreme Court concluded she didn&#8217;t<br \/>\nwithhold evidence on purpose, and that her error didn&#8217;t harm<br \/>\nBlunt&#8217;s defense.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The admonishment won&#8217;t affect Feland&#8217;s ability to work as a<br \/>\njudge.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0\u00a0 WILLISTON, N.D. (AP) &#8211; A state health official says it doesn&#8217;t<br \/>\nappear that an oil well blowout south of Williston contaminated<br \/>\nwater sources.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Environmental geologist Kris Robertss ays \u00a0dozens of acres of crops and pasture land have been affected by the 800 gallons of oil and salt water<br \/>\nthat sprayed over the area last week.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Roberts says cleanup crews have placed absorbent booms to<br \/>\nprevent contamination from spreading into a creek that empties into<br \/>\nLake Sakakawea on the Missouri River.<\/p>\n<p>They also are cutting and removing contaminated vegetation. (AP) &#8211; Health officials in the Minot area are looking into how many damaged houses have been abandoned following the historic Souris River flooding last summer.<\/p>\n<p>Those that have been deserted stand to be razed for health and safety reasons.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The city earlier reported about 280 houses throughout the river valley left untouched since the 2011 flood.<\/p>\n<p>The First District Health Unit is investigating how many have truly been abandoned.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Environmental Health Director Jim Heckman\u00a0says \u00a0a number of people have notified officials that they are rebuilding or trying to sell their homes.<\/p>\n<p>He says fewer than 50 people have failed to reply to First District&#8217;s notice of potential demolition.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 City Finance Director Cindy Hemphill says property owners will be billed for the cost of demolition.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D.
