News Aug 23, 2012) &#8212; <span style=\"color: #ff0000;\">A Southeast District Court Jury, of eight women and four men, in Jamestown Thursday (Aug 23, 2012) has found 35 year old Leron Howard of Jamestown guilty of Murder and Criminal Conspiracy in death of\u00a0\u00a0Somali immigrant, Abdi Ali Ahmed, of Jamestown.<\/span><\/p>\n<p>The jury deliberated about seven and a half hours, on Wednesday and five and a half hours on Thursday before returning the verdict about 2: 30 p.m. on Thursday.<\/p>\n<p>Howard, appeared to break down as the verdicts were read.<\/p>\n<p>Murder and Criminal Conspiracy are Class AA felonies punishable by life in prison without parole.<\/p>\n<p>The jury decided to deliberate on the murder charge rather than manslaughter.<\/p>\n<p>Manslaughter is a Class B felony punishable by 10 years in prison and a $10,000 fine.<\/p>\n<p>Southeast District Court Judge, Thomas Merrick says sentencing will be handed down after a pre-sentencing investigation, in about eight weeks<\/p>\n<p>Howard\u2019s court appointed defense attorney, Steve Mottinger, asked the jury to convict Howard of manslaughter during closing arguments.<\/p>\n<p>Following the verdict, Mottinger said, &#8220;I think we picked a good jury, the jury obviously worked very hard at this.&#8221;<\/p>\n<p>Prosecutor, Stutsman County State\u2019s Attorney, Fritz Fremgen, said the case fits the definition of murder.<\/p>\n<p>After the\u00a0verdict,\u00a0 was read,\u00a0 Fremgen credited the jury for their dedication to the case.<\/p>\n<p>Ahmed&#8217;s family say\u00a0despite the guilty\u00a0verdict, justice has still not been served, and are concerned that\u00a0presiding judge, Thomas Merrick, will not give Howard the maximum sentence of life in prison without parole.<\/p>\n<p>They were not satisfied that co-defendent, Janelle Cave was convicted in February of this year,\u00a0of the lesser charge of manslaughter, Ahmed&#8217;s death.<\/p>\n<p>Cave \u00a0is appealing her conviction in the North Dakota Supreme Court.<\/p>\n<p>Abdi Ali Ahmed\u2019s body was found in a road ditch near Spiritwood, on April 30, 2011. An autopsy revealed he died of blunt force trauma to the head and he was also stabbed twice in the abdomen.<\/p>\n<p>On the stand Tuesday, Howard admitted to striking Ahmed twice during an altercation during the early morning hours of April 30, 2011.<\/p>\n<p>Jury selection in the case began Aug. 14, 2012 with testimony beginning on Aug. 15, 2012.<\/p>\n<p>Closing arguments were heard in the case Tuesday.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0Jamestown, ND\u00a0 (KCSi-T.V. News)\u00a0 \u2013\u00a0 The Jamestown Public Works Department announces that spraying in the City of Jamestown for adult mosquitoes is scheduled for tonight, Thursday, August 23, 2012\u00a0 and will <span style=\"color: #ff0000;\">continue for the following 2-3 evenings as is necessary<\/span>.<\/p>\n<p>\u00a0<span style=\"text-decoration: underline;\">All spraying is contingent upon <strong>weather conditions. <\/strong><\/span><\/p>\n<p>All spraying operations will take place between approximately 8:30 PM (dusk) until approximately 6:00 AM.<\/p>\n<p>Parents are advised to keep children out of the streets and away from the spray machines.<\/p>\n<p>Motorists are urged to use caution when traveling in the vicinity of sprayer units.<\/p>\n<p>Residents can obtain additional reduction of mosquito populations by supplementing the mosquito control operations with the spraying of individual backyards where necessary.<\/p>\n<p>It is also recommended that grass be mowed regularly and shrubs trimmed to reduce resting places for the mosquitoes.<\/p>\n<p>Articles holding water such as tires and other receptacles should be emptied to prevent the development of mosquito larvae.<\/p>\n<p>If there are any questions about the scheduled residential application, please feel free to call City Hall at 252-5900.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown, ND (KCSi-T.V. News) &#8212; The Jamestown City Council&#8217;s Public Works, and Police and Fire Committees met Thursday evening (Aug 23, 2012) at City Hall. Council Member Gumke was not present.<\/p>\n<p>Fire Committee:<\/p>\n<p>No items of discussion at this time.<\/p>\n<p>&nbsp;<\/p>\n<p>The Police Committee considered a request that funds received by the Jamestown Police Range Committee from the recycling of brass items be deposited in the Range Committee fund for range maintenance.<\/p>\n<p>The brass items came from the Police Department, Sheriff&#8217;s Department, Stutsman County Corrections, James River Correctional Center, ND Game &amp; Fish, BCI, and the ND Highway Patrol.<\/p>\n<p>Police Chief Scott Edinger said 1,100 pounds of brass items was received, amounting to just over $2,000.<\/p>\n<p>The committee recommends authorizing using the funds for range maintenance.<\/p>\n<p>The funds will be put into the city&#8217;s self-clearing fund, until The Range Committee is formally organized.<\/p>\n<p>At that time the funds will be transferred.<\/p>\n<p>\u3000<\/p>\n<p>Public Works Committee:<\/p>\n<p>The committee recommends putting on the September City Council agenda without recommendation, the Supplemental Agreement from Interstate Engineering, Inc. relating to the Sanitary Landfill.<\/p>\n<p>The agreement for engineering services for the expansion of the landfill to the adjacent 80-acres, in the amount of $99,500. Pending review of the original agreement.<\/p>\n<p>City Engineer Reed Schwartzkopf said the expansion is projected for about 225 years. The landfill is seeing a 10% to 15% increase in waste each year.<\/p>\n<p>\u3000<\/p>\n<p>The committee then placed on the September Council agenda without recommendation a Supplemental Agreement No. 1 from Interstate Engineering, Inc. relating to the Inert Landfill. The amount is $38,200. Pending review of the original agreement.<\/p>\n<p>\u3000<\/p>\n<p>The committee recommended approving creating Sewer District # 12-31 and Water District #12-61 relating to the Titan Addition utility extensions.<\/p>\n<p>Steve Aldinger of Interstate Engineer presented drawings of the sewer and water line plans.<\/p>\n<p>He said the construction costs are estimated at $800,000 to $900,000.<\/p>\n<p>City Engineer Reed Schwartzkopf said properties west and south of<\/p>\n<p>the Titan property will be able to tie into the line when future development happens.<\/p>\n<p>He said the city&#8217;s failure to address corridor issues in the<\/p>\n<p>past, means the city is paying more for the route of these lines,<\/p>\n<p>now.<\/p>\n<p>The committee also recommends sending to the NDDOT, a permit application for boring for the lines.<\/p>\n<p>&nbsp;<\/p>\n<p>The committee discussed costs and options relating to the West Business Loop sidewalk construction.<\/p>\n<p>City Engineer Schwartzkopf presented the options.<\/p>\n<p>He added property owners still need to be apprised as to how the sidewalks would affect their properties, including parking lot spaces.<\/p>\n<p>He said there should be sufficient city right of ways to install the five foot wide sidewalks.<\/p>\n<p>The Mayor moved for the city engineer to pursue the project, and contact property owners, which was approved to recommend to the City Council.<\/p>\n<p>&nbsp;<\/p>\n<p>Discussion then related to overload\/oversize vehicles &amp; establishing permit, fee &amp; procedures policy for vehicles coming through the city.<\/p>\n<p>City Engineer Schwartzkopf recommended charging a permit fee.<\/p>\n<p>He said the vehicles are headed to the western North Dakota oil patch.<\/p>\n<p>The committee recommends moving forward in developing a policy.<\/p>\n<p>The meeting was shown live on CSi Cable 67, followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Valley City, ND (KCSi-T.V. News) &#8212; Valley City residents are seeing some changes in the faces of buildings, while VCSU notes renovations, and the future of the Auditorium is being reviewed.<\/p>\n<p>At the August 20,2012 Valley City Commission meeting, City Administrator, David Schelkoph said a 3-step process is involved in the sale of City Auditorium.<\/p>\n<p>He said prospective buyers have previously shown interest in purchasing the building, however several issues have slowed progress on the sale.<\/p>\n<p>Meanwhile, the new $500,000 renovation of Valley City State University\u2019s cafeteria recently was completed with a ribbon cutting.<\/p>\n<p>Valley City State President Dr. Steve Shirley says the new facility serves students and the community with a selection of healthy food choices and traditional favorites.<\/p>\n<p>The Straus Mall has been renovated.<\/p>\n<p>George Gaukler purchased the building and is making improvements, to attract new businesses.<\/p>\n<p>The new water treatment is operational and was recently dedicated by Governor Dalrymple and other officials.<\/p>\n<p>&nbsp;<\/p>\n<p>\u3000MINOT, N.D. (AP) &#8211; Minot police say there is nothing suspicious about the death of a man whose body was pulled from the Souris River and that it appears the death was accidental.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The body of 47-year-old Michael Alumbaugh was recovered on Aug. 16. Minot police released his identity on Thursday.<br \/>\n\u00a0 Capt. Dan Strandberg says the death happened in an area where transients are known to live.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0FARGO, N.D. (AP) &#8211; A 17-year-old Fargo boy accused of robbing a<br \/>\ngas station in the town of Mapleton also is one of three suspects<br \/>\nin a holdup at a Fargo restaurant.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Cass County State&#8217;s Attorney Birch Burdick says he hasn&#8217;t made<br \/>\nany decisions yet on possibly trying to get the boy&#8217;s case<br \/>\ntransferred from juvenile court to adult court.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The boy was arrested about half an hour after the armed robbery<br \/>\nat Gordy&#8217;s Travel Plaza in Mapleton about 6 p.m. Monday.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The boy also is accused in the armed robbery of the Giant Panda<br \/>\nrestaurant last Friday, along with a 15-year-old boy and<br \/>\n17-year-old girl.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; A North Dakota man has pleaded guilty to a<br \/>\ncharge of domestic assault by a habitual offender.<br \/>\n\u00a0\u00a0\u00a0\u00a0 U.S. Attorney Timothy Purdon announced Thursday that 38-year-old<br \/>\nIsadore Eagle Boy of Cannon Ball pleaded guilty in U.S. District<br \/>\nCourt.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Eagle Boy is accused of assaulting a woman numerous times on<br \/>\nMarch 29. He lived with the woman.<\/p>\n<p>Eagle Boy had previously been convicted twice in Standing Rock Sioux Tribal Court for domestic assault offenses that involved the same woman.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Eagle Boy faces a maximum sentence of five years in prison and a<br \/>\n$250,000 fine. Sentencing is scheduled for Feb. 19.<\/p>\n<p>\u3000<\/p>\n<p>\u00a0MINOT, N.D. (AP) &#8211; The Army Corps of Engineers has awarded a<br \/>\ncontract to complete repairs to Souris River levees damaged by<br \/>\nhistoric flooding last summer.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Minnesota-based Ceres Environmental Services landed the $469,000<br \/>\njob of restoring multiple levee sites in the Minot and Burlington<br \/>\nareas.<\/p>\n<p>Construction is to be done by the end of the year.<br \/>\nThe corps has spent nearly $3 million fixing the levee system since the 2011 flood.<\/p>\n<p>The agency says that once the final repairs are done, residents will have the same flood protection they had before the flood.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0 Separately, U.S. Sen. John Hoeven says the corps is giving Minot<br \/>\n$1.9 million for sanitary sewer repairs that he says are essential<br \/>\nin the effort to develop new housing.<\/p>\n<p>Ground was broken Thursday for a $109 million housing and retail project.<\/p>\n<p>&nbsp;<\/p>\n<p>\u3000\u00a0BISMARCK, N.D. (AP) &#8211; A state board is hiring a consultant for<br \/>\nadvice on how to invest a North Dakota oil tax fund that has $500<br \/>\nmillion in it.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Legacy Fund gets 30 percent of North Dakota&#8217;s oil tax<br \/>\ncollections.<\/p>\n<p>The money in the fund can&#8217;t be spent until 2017.<\/p>\n<p>Right now, the money is stashed in bonds that don&#8217;t earn much interest.<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0 A board headed by Hazen state Sen. Randy Christmann oversees the<br \/>\nfund&#8217;s operations.<\/p>\n<p>Board members want to put some of the Legacy Fund&#8217;s money into stocks.<br \/>\n\u00a0\u00a0\u00a0\u00a0 On Thursday the board voted to hire a consultant to provide<br \/>\nadvice about how much of the fund should be put into other investments.<br \/>\n\u00a0\u00a0\u00a0\u00a0 Christmann says after the consultant is hired, the report should<br \/>\ntake about two months to finish.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0GRAND FORKS, N.D. (AP) &#8211; A Grand Forks County committee wants to<br \/>\ndevelop about 300 acres of unused land on the Grand Forks Air Force<br \/>\nBase.<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Base Realignment Impact Committee works to ensure the future<br \/>\nof the base.<\/p>\n<p>The\u00a0 group is trying to fulfill Defense Department requirements to lease land on the base just west of Grand Forks.<br \/>\n\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>The goal is to develop the land for private companies and other entities interested in establishing facilities on the base.<br \/>\nOfficials say a lease could help expand the presence of unmanned aircraft systems on the base and in the region.<\/p>\n<p>&nbsp;<\/p>\n<p>In world and national news&#8230;<\/p>\n<p>HOBBS, N.M.
