News Oct 7, 2013) \u2013 With the Jamestown Sanitary Sewer Project, Interstate Engineering reports, residents and motorists are advised that starting Monday (Oct 7, 2013), a section of 3rd Avenue NW is expected to close for pavement replacement as part of the Jamestown sanitary sewer project.<\/p>\n<p>Crews are working in the area of 17th St SE and 19th Ave SE.<\/p>\n<p>3rd Avenue NW will close from 6th Street NW to 9th Street NW. The streets that intersect 3rd Avenue NW in this area will remain open during this time.<\/p>\n<p>This closure is expected to be in place for about one week. News) &#8212; The Jamestown City Council met in Regular Session Monday evening (Oct 7, 2013) at 5-p.m., at City Hall. All members were present.<\/p>\n<p>Consent Agenda Items discussed separately included:<\/p>\n<p>Council Member Kourajian asked for item \u201cK\u201d be removed a Resolution to enter into an agreement with a consulting engineering firm to obtain an estimated<\/p>\n<p>cost of extending sanitary sewer service to the property owned by Duane Enzminger northwest of the Airport. He questioned how the sewer line will reach the property.<\/p>\n<p>Mayor Andersen said the pipe will run along the city right of way, within city limits, with a tie at the northwest corner of the airport land. The land will be annexed into the city. Following the discussion the item was approved.<\/p>\n<p>Resolutions:<\/p>\n<p>Public Hearings:<\/p>\n<p>Concerning the request for vacation of a roadway adjacent to Lot 4, Block 2,<\/p>\n<p>and Lot 1, Block 3, Replat of Joos First Subdivision, a portion of NE \u00bc of SE \u00bc and SE \u00bc of NE \u00bc<\/p>\n<p>Section 13-140-64, Midway Township, Stutsman County, North Dakota. Developer Duane Enzminger said he did not want the vacation approved.\u00a0<span style=\"color: #ff0000;\">\u00a0(Steve\u00a0 Bossert spoke and said he favored the topic be tabled, at this time.)\u00a0<\/span>\u00a0Norma Jo Trenda wants the vacation, noting children in the area would be subjected to heavy equipment in their play area. Speaking at the meeting, were Brenda Monson, and Jess Tripp who submitted the vacation request.<\/p>\n<p>Following the Public Hearing the City Council tabled the item, pending more answers on the development.<\/p>\n<p>The City Council tabled the request of Casey Willman and Lucas Dockter for approval of a Renaissance Zone Project on the N1\/2 of Lot 13, less the East 40\u2019, Block 32, Original Addition (113 1st Ave. South). The application was not completed, so the City Council table the request.<\/p>\n<p>Ordinances:<\/p>\n<p>First Readings included:<\/p>\n<p>To amend and re-enact an Ordinance amending the District Map to change the zoning of Block 2 of the proposed Lindberg Addition, a replat of Lots 11, 12 &amp; 32 and portions of Lots 7-10 and 33, Block 9, Kelly &amp; Fuller\u2019s Second Addition, from R-3 (Limited Multiple Residential) to C-1(General Commercial).<\/p>\n<p>To amend and re-enact an ordinance by amending the District Map to change the zoning of Lots 1-14 and Outlot A, Block 1, of the proposed Lindberg Addition, a replat of Lots 1-6 and 34-44 and portions of Lots 7-10 and 33, Block 9, Kelly &amp; Fuller\u2019s Addition, from R-3 (Limited Multiple Residential) to R-4 (Planned Residential).<\/p>\n<p>To amend and re-enact an Ordinance by amending the District Map to change the zoning of land located in Stutsman County, North Dakota, from A-1 (Agricultural District) and P-O-C (Public, Open Development and Conservation District) to R-1 (One Family Residential District). Second Readings and Public Hearings will come before the November City Council.<\/p>\n<p>A Second Reading of an Ordinance to create and enact a new Chapter 27 of the City Code pertaining to the regulation of sexually oriented businesses of adult cabarets and escort services,<span>strip clubs, adult modeling agencies, adult theaters and sexual encounter centers. \u00a0<\/span>The Ordinance as presently written the business, not, have an alcoholic beverage license, must locate in M-2 Manufacturing zoning, not within 300 feet of a residence, church, school, or other sexually oriented business, or an alcoholic beverage establishment.<\/p>\n<p>The Ordinance requires background checks of the owners and those involved in the business, in order to deter illegal sexual activities on site.<\/p>\n<p>Signage is required to be a one color square sign, with no neon signage, and the building must be one color. No fencing or other physical barriers will be required which could hide illegal activity. Included is signage indicating age restrictions about entering the business, or employed by the business, at no younger than 18 years of age.<\/p>\n<p>On Monday\u2019s (Oct 7, 2013) Wayne Byers Shown on CSi Cable 2, Mayor Andersen said the Ordinance is meant to regulate a sexually oriented business, or adult cabarets and escort services, as to location and other issues that involve that type of business.<\/p>\n<p>Now, that type of business would be allowed to locate anywhere in city limits.<\/p>\n<p>She added that in the future the Ordinance can be amended, if necessary, noting that land annexed into the city in the future, may have an impact on where the businesses may locate. She added to date, no applications have been received.<\/p>\n<p>At Monday\u2019s meeting, Susan Roemmich spoke of an Ordinance in Minot, and said the proposed Jamestown Ordinance of 300 feet is too close, and noted Registered Sex Offenders in the community, and patients at the State Hospital, that may be adversely effected by such as business.<\/p>\n<p>The City Council voted Monday, voted unanimously to pass the Ordinance.<\/p>\n<p>Other Second Readings approved included:<\/p>\n<p>To amend and re-enact a Section the City Code pertaining to classification and disposition of traffic offenses.<\/p>\n<p>Another amends and re-enacts a Section of the City Code pertaining to penalties regarding the offense of theft.<\/p>\n<p>Tabled was an Ordinance to enact a Section of the City Code pertaining to beekeeping in the City of Jamestown, due to parties not present to give input on the topic.<\/p>\n<p>Approved was an Ordinance to amend Chapter 22 of the Code of the City by repealing and re-enacting Section 22-2 which sets forth regulations concerning begging and panhandling.<\/p>\n<p>Also approved is an Ordinance, to amend and re-enact Chapter 1, Section 1-10, of the City Code pertaining to regulations regarding court fees.<\/p>\n<p>Hearing From The Audience: The City Council approved recognizing the Ladies Individuals MC as an other public spirited organization and to authorize the issuance of a Charity Local Permit for October 13, 2013, at Tapps Lounge (Quality Inn).<\/p>\n<p>Mayor and Council Member Report: No one spoke.<\/p>\n<p>Other Business:<\/p>\n<p>The City Council approved advertising for the construction of Jamestown Water Treatment Plant Backwash Pond Pump Station and Force Main Project.<\/p>\n<p>The City Council discussed entering into an agreement between the City of Jamestown, Great River Energy and Stutsman Rural Water District for the City to provide process water to the proposed Dakota Spirit AgEnergy Biorefinery.<\/p>\n<p>No action was taken.<\/p>\n<p>The Council then approved authorizing Interstate Engineering to negotiate the proposed upgrades.<\/p>\n<p>The City Council voted to approve and accepted the 2012 City Audit, as prepared by Schauer &amp; Associates, PC<\/p>\n<p>Council members approved a proposal received from Pierce Roofing regarding water drainage at the Jamestown Fire Station.<\/p>\n<p>To Council approved a proposal regarding the chimney at the Jamestown Fire Station.<\/p>\n<p>The final payment on the Titan sewer line, was also approve.<\/p>\n<p>A Public Hearing was held at 6-p.m., concerning the proposed budget for City General and Special Funds for the fiscal period January 1, 2014, through December 31, 2014.<\/p>\n<p>With the 2014 City Budget:<\/p>\n<p>Second Readings approved included the appropriation of the General and Special Funds for the fiscal year January 1, 2014, through December 31, 2014. The mill levy reduced by 5.75 mills from the 2013 budget.<\/p>\n<p>An Ordinance pertaining to the appropriation of the Revenue and Special Funds for the fiscal year January 1, 2014, through December 31, 2014.<\/p>\n<p>The City Administrator was directed to notify the County that the City of Jamestown should be exempt from the County Library Levy as the City maintains its own library, and then to certify the tax levies to the County for the fiscal period January 1, 2014, through December 31, 2014.<\/p>\n<p>The meetings were shown live on CSi 67, followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Valley City, ND (KCSi-T.V. News) &#8212; The Valley City Commission met in Regular Session, Monday evening (Oct. 7, 2013) at City Hall. City Commissioner Nielson was present via a conference call.<\/p>\n<p>Jennifer Pickard, the Executive Director of a Bullying Support Group talked about the group, and that it\u2019s a peer support group. She noted that bullying occurs not just in schools, but in all walks of life. She said Wednesday October 9, 2013, residents are asked to wear orange shirts or orange ribbons, to show support, and she announced local showings of the move \u201cBully.\u201d<\/p>\n<p>&nbsp;<\/p>\n<p>Approval of Consent Agenda items included:<\/p>\n<p>Monthly Reports from the Fire Chief, Building Inspector, Auditor, Municipal Judge and Public Works Accountant.<\/p>\n<p>Monthly Bills for the City and Public Works in the Amount of $2,185,667.74.<\/p>\n<p>Public Forum<\/p>\n<p>Bob Drake spoke about the armed citizens watch patrol. , and the number of fights that he says are occurring downtown&#8230;11 fights 3 weeks, he said, plus domestic disturbances . He said arming individuals is not the main goal, but rather to stop fights. He noted many years of law enforcement experience, have resigned the Valley City Police Department.<\/p>\n<p>He said an officer with 28 years experience has left the Police Department.<\/p>\n<p>Police Chief Fred Thompson said, some officers left to retire, or to seek positions with more money. He said officers who left &#8220;wouldn&#8217;t give me a straight answer.&#8221;<\/p>\n<p>City Attorney Russell Myhre said in talking with his peers, they noted an increase in criminal activity in North Dakota.<\/p>\n<p>He said he does not recommend an armed citizens patrol, as the individuals would not be trained, and the city would incur liabilities.<\/p>\n<p>He said fights in Valley City are occurring in parking lots, and streets, and not inside bars.<\/p>\n<p>Mayor Werkhoven said the fights are not necessarily caused by people just moving to Valley City.<\/p>\n<p>Ordinances<\/p>\n<p>Approved the second and final reading of , an ordinance approving the 2014 budget. City Auditor Avis Richter said, the budget is just under $1.2 million, at 94 mills. She said the budget now will be sent to Barnes County for approval.<\/p>\n<p>Resolutions<\/p>\n<p>Approved a Resolution for a Special Alcohol Beverage Event license for Market Place Liquors and Dakota Silver to serve wine and beer at the Barnes County Museum on November 5, 2013, for the Rotary Club\u2019s Wine and Beer Tasting.<\/p>\n<p>.<\/p>\n<p>New Business<\/p>\n<p>The City Commissioners approved a Cost Participation and Maintenance Agreement with the NDDOT for the I-94 Exit 294 Lighting with the city cost share of $23,927.<\/p>\n<p>Commissioners voted to approve a Cost Participation and Maintenance Agreement with the NDDOT for the 7th Street SE road extension, by John Deere Manufacturing Plant.<\/p>\n<p>The City Commission approved the preliminary engineering design and construction contract for I-94 Regional Development Corridor Phase I (7th Avenue Street Improvement \u2013 Greenline Deere Addition) with Moore Engineering, Inc. in the amount of $283,500, paid with and approved by the Economic Development.<\/p>\n<p>The City Commission approved the preliminary engineering design and construction contract for I-94 Regional Development Corridor Phase I (water, sanitary and storm sewer improvements) with Moore Engineering, Inc. in the amount of $256,100.<\/p>\n<p>The City Council approved the preliminary engineering design contract for I-94 Regional Development Corridor Phase I (I-94 and Wolski Plaza Road Improvements) with Moore Engineering, Inc. in the amount of $87,000.<\/p>\n<p>The City Commissioners approved the Cass County Electric and Valley City Public Works Service Territorial Agreement.<\/p>\n<p>Approved a Food and Beverage Grant for\u00a0the North Dakota \u00a0Winter Show in the amount up to $75,000, through a Convention and Visitors Committee fund to make improvements to the North Dakota Winter Show Events Center.<\/p>\n<p>Visitors Committee Chairman Bobby Koepplin said the part of the money will replace roof truses damaged by heavy snow in the winter of 2011. The rest of the money will be used to expanding horse stalls to help bring more events to the NDWS Event Center.<\/p>\n<p>Koepplin said \u00a0the total cost of the upgrade will be slightly more than $144,000. The North Dakota Winter Show will have to cover the balance of the cost.<\/p>\n<p>The City Commission\u00a0 approved using Public Works funds, up to $400,000, for the local share of 25% for the Phase II buyout for 5th Avenue SW.<\/p>\n<p>The City Commission approved the amendment to the SWC buyout contract.<\/p>\n<p>The City Commissioners directed the permanent flood committee to develop a conceptual permanent flood control plan including funding for the November 18, 2013 commission meeting. (Commissioner Luke)<\/p>\n<p>City Administrator Report<\/p>\n<p>David Schelkoph gave an update on the installation of the automated utility meters, and the equipment communicating within the system.<\/p>\n<p>The Recodification process is proceeding.<\/p>\n<p>The Barnes Rural Water agreement is nearing completion, pending one more meeting, followed by presentations to their board and the City Commission.<\/p>\n<p>City Updates &amp; Commission Comments:<\/p>\n<p>City Auditor Richter noted the next City Commission meeting will be held on TUESDAY Oct 22, 2013, instead of Monday Oct 21.<\/p>\n<p>Fire Chief Retterath said applications are being reviewed, and more are being accepted in the recruitment of volunteer city fire fighter.<\/p>\n<p>&nbsp;<\/p>\n<p>City Police Chief Fred Thompson said a new officer will be coming on duty with the swearing in at the next City Commission meeting.<\/p>\n<p>The meeting was shown live on CSi Cable 68, followed by replays.<\/p>\n<p>Jamestown, ND (KCSi-T.V. News) &#8212; Jamestown Mayor Katie Andersen says the Jamestown City Council will meet in Special Session Wednesday (Oct 9, 2013) at City Hall, to discuss economic indicators in Jamestown.<\/p>\n<p>On Monday\u2019s Wayne Byers Show on CSi Cable 2, the Mayor said the meeting will address \u201cretail leakage,\u201d or, how to retain retail business in Jamestown.<\/p>\n<p>Areas of discussion is scheduled to include:<\/p>\n<p>\uf0b7 Receiving information relative to certain economic indicators in the Jamestown Trade Area;<\/p>\n<p>\uf0b7 Possible discussion concerning information received relative to certain economic indicators;<\/p>\n<p>\uf0b7 Possible discussion relative to a business concern indicating potential location in the Jamestown Trade Area.<\/p>\n<p>The Mayor added that it\u2019s possible that the City Council may enter into Executive Session to discuss certain proprietary information relative to a potential business locating into the Jamestown Trade Area.<\/p>\n<p>The Mayor also said the City of Jamestown will be updating and replacing traffic control signals on 10th Street Southeast at the intersections of 1st Avenue, 4th Avenue and 7th Avenue Southeast, with the parts to be used to update the traffic signals on 1st Avenue.<\/p>\n<p>She said with the upcoming completion of the city\u2019s Land Use and Transportation Plan, further recommendations may be made on the 1st Avenue traffic signals.<\/p>\n<p>With the Jamestown Sanitary Sewer Project, Mayor Andersen said the project is on schedule. She noted that with access to the MGM mobile home area, crews are working to have the work done there within about two days.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0Cooperstown, ND\u00a0 (KCSi-T.V. News Sept 24, 2013)\u00a0 \u2013\u00a0\u00a0 The Griggs County Commissioners recall election is set for\u00a0today October 8, 2013, in Cooperstown.<\/p>\n<p>A number of Griggs County residents are upset with the County Commission after they approved a plan to build a new courthouse despite voters rejecting the idea once.<\/p>\n<p>Voters also \u00a0rejected a plan to renovate the existing courthouse twice in three separate elections.<\/p>\n<p>In the recall election:<\/p>\n<p>District 1 commissioner Ron Halvorson is being challenged by John Wakefield.<\/p>\n<p>District 2 commissioner Ronnie Edland is being challenged by Shawn Steffen.<\/p>\n<p>District 3 commissioner Dennis Halvorson is being challenged by Ron Dahl.<\/p>\n<p>District 4 commissioner Keith Monson is being challenged by Troy Olson.<\/p>\n<p>\u00a0District 5 commissioner Robert Johnson will face Dale Pedersen in the recall.<\/p>\n<p>The polls at Cooperstown City Hall will be open on Tuesday, October 8, 2013 \u00a0from 9am to 7pm.<\/p>\n<p>Griggs County Auditor Cynthia Anton says it\u2019s the first time in the history of Griggs County that five commissioners have been the target of a recall.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; Power has been restored to hundreds of people in southwest North Dakotans after the weekend snowstorm, but several hundred are still without electricity.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Mor-Gran-Sou Electric Cooperative and Slope Electric co-manager Chris Baumgartner says at least 550 customers remained without power late Monday. That&#8217;s down from about 800 on Sunday. He says it will be days before power is restored to all customers because of the tough working conditions for crews.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Montana Dakota Utilities Co. spokesman Mark Hanson says he expects power to be restored to all but about 100 customers Monday evening, down from 750 on Sunday.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The storm dumped up to 1 1\/2 feet of snow on the region, downing hundreds of power lines.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0FARGO, N.D. (AP) &#8211; Prosecutors have filed new charges against a man whose murder conspiracy conviction was overturned by the North Dakota Supreme Court.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 26-year-old Cody Borner faces seven felony charges, including terrorizing, aggravated assault and reckless endangerment.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 A jury in June 2012 convicted Borner, of Stanton, and Richard Whitman, of Hazen, of conspiracy to commit murder in the January 2012 shooting death in Beulah of Mike Padilla, of Billings, Mont. Padilla&#8217;s brother, Timothy, was wounded in the shooting that authorities say resulted from a drug-fueled dispute.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Supreme Court justices in a split decision in August reversed Borner&#8217;s conviction, ruling that language used in charging documents was improper. The ruling gave prosecutors authority to charge Borner with another crime. The high court has not ruled in Whitman&#8217;s case.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0WASHINGTON (AP) &#8211; A public health group says North Dakota has the lowest rate of drug overdose deaths in the nation.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 According to the report by the Trust for America&#8217;s Health, 3.4 per 100,000 people in the state died from a drug overdose in 2010.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The document says prescription drug related deaths now outnumber those from heroin and cocaine combined, and drug overdose deaths exceed motor vehicle-related deaths in 29 states and Washington, D.C.\u00a0<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The group says West Virginia had the highest rate of prescription deaths in 2010, 28.9 out of 100,000, and South Dakota was second, with 6.3 out of 100,000.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Deputy Director Rich Hamburg of Trust for America&#8217;s Health says the group worked with other agencies to help states figure out how to deal with the problem.<\/p>\n<p>&nbsp;<\/p>\n<p>GRAND FORKS, N.D.
