Ostafin hit guard Jeremiah MacDonald, losing consciousness as a result of Ostafin\u2019s assault.<\/p>\n<p>In court Monday, Ostafin testified he thought as he went up to hit MacDonald that MacDonald would defend himself.<\/p>\n<p>Ostafin said he was sorry for his actions and didn\u2019t realize the damage he had done to MacDonald until after the fact.<\/p>\n<p>Ostafin is currently an inmate at the North Dakota State Penitentiary in Bismarck.<\/p>\n<p>Judge Thomas Merrick sentenced Ostafin to serve eight years consecutively at the end of his current sentence for terrorizing.<\/p>\n<p>Ostafin was scheduled to be released on April 22, 2020. With the new sentence, Ostafin will be eligible for release in 2028.<\/p>\n<p>With a Habitual offender status Merrick was able to double Ostafin\u2019s sentence to 10 years in prison.<\/p>\n<p>Merrick said given Ostafin\u2019s criminal history, including convictions in 1990 for murdering his father and stepfather, that he had no problem granting the habitual offender motion.<\/p>\n<p>\u3000<\/p>\n<p>Valley City (CSi) &#8212; The Valley City Commission met in Regular Session Monday evening (Nov 18, 2013) at 5-p.m., at City Hall. All members were present.<\/p>\n<p>Approval of Consent Agenda items included:\u00a0 A Game of Chance Raffle Permit for Benefit for Jill Engler and North Dakota Junior Charolais Association.<\/p>\n<p>Public Forum&#8230;no one spoke.<\/p>\n<p>Ordinances<\/p>\n<p>Approved the Second and Final Reading of an Ordinance changing the regular scheduled meeting day of the City Commission to Tuesday, starting in January 2014.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p>Approved the Second and Final Reading of an Ordinance rezoning I-1 Light Industrial to B-2 Highway Business on Fairhill Properties for Stoudt Properties, LLC.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p>Resolutions<\/p>\n<p>A Public Hearing was held for the replat of Greenline Deere Addition.<\/p>\n<p>Following the Public Hearing the City Commission approved a Resolution of Necessity for the replat of the east end.<\/p>\n<p align=\"justify\">The City Commission approved a Resolution to refer to Professional Land Surveyor.\u00a0 City Attorney Russell Myhre said the next step before the replat, and then back to the City Commission for further review and action<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p align=\"justify\">New Business<\/p>\n<p>The City Commission considered purchasing new radio base stations for Public Works. City Administrator Schelkoph said a base station would replace the phone lines, for radio communications with City Hall, the fire department and other that use base stations. He added the payback over using the phone line, which costs about $400 per month is 18 months.<\/p>\n<p>The quote from Jamestown Communications was approved by the Commissioners.<\/p>\n<p><dir><\/dir>The City Commission went on record to approve the Heritage Fund grant.<\/p>\n<p align=\"justify\">City Commissioners approved \u00a0a Special Alcohol Beverage Permit for Dakota Silver at The Vault for the First Friday Meeting on December 5, 2014.<\/p>\n<p>The City Commission reviewed Water Service Cooperative Agreement with Barnes Rural Water. City Attorney Myhre said the agreement requirement by the state, is mandated between the city and Rural Water, and addresses the needs of the city as it grows. He says federal and state law is also taken under consideration in the agreement. Mayor Werkhoven said the city and Rural Water have been meeting to discuss issues in the agreement.The City Commission took no action on Monday evening.<\/p>\n<p>&nbsp;<\/p>\n<p align=\"justify\">City Administrator Schelkoph&#8217;s Report:<\/p>\n<p align=\"justify\">He said the automated meters have been installed to 5% of the city users, adding that November 22 is the shipping date for the load control relays. He said the water tower standpipe has had problems. He suggested putting a pump at the base to shoot to the top of the unit, to circulate water, and avoid icing problems. With garbage collection a mistake was noted in the commercial rate structure, which is being looked into.\u00a0 He noted that city employees should be standardized in the wearing of vests by city employees on the streets.<\/p>\n<p align=\"justify\">\u00a0<\/p>\n<p>City Updates &amp; Commission Comments<\/p>\n<p>City Attorney Myhre said planning and zoning items are being worked on with proceedures and protocol. With buyouts, some closings are being set. Recodification meetings are continuing. He added that the Myhre Law Offices will be expanding, and should help serve the city.<\/p>\n<p>Mayor Werkhoven noted the need to address issues with street flooding concerning waves created by vehicles and entering houses window wells and into basements.<\/p>\n<p>City Auditor Avis Richter said an independent audit report has been submitted to the city, with a &#8220;clean opinion,&#8221; using generally accepted accounting procedures, presented fairly. She said the report will be placed on the city\u2019s web site.<\/p>\n<p>Commissioner Luke noted changes coming with the city\u2019s electric service in the future coming from WAPA.<\/p>\n<p>The meeting was shown live on CSi Cable 68, followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) &#8212; The Jamestown\/Stutsman Development Corporation,took no action on a proposal but placed it on the agenda for its executive board meeting next Monday.<\/p>\n<p>The proposal\u00a0 to purchase a portion of the development associated with a possible big box home improvement retail store was opposed at a Special JSDC Board meeting, Monday.<\/p>\n<p>Prairie Haven is located west of R.M. Stoudt, northwest of the Buffalo Mall.<\/p>\n<p>Mayor Katie Andersen proposed that JSDC purchase about 43 acres of the 73-acre development for $5.6 million.<\/p>\n<p>Andersen said she brought the proposal to the board as a member of the JSDC Board and not as a representative of the City Council.<\/p>\n<p>JSDC attorney Joe Larson disagreed with Andersen on whether the JSDC could purchase the land, saying &#8220;Changes to the bylaws have to be approved by the city and county. If the JSDC doesn\u2019t change its policy it does not go to the city and county.&#8221;<\/p>\n<p>Larson said he was also concerned about competition issues.<\/p>\n<p>The developer\u2019s agreement between the city of Jamestown and the R.H. Johnson Co. requires the city to purchase the land.<\/p>\n<p>The Prairie Haven development is a project of R.H. Johnson Co., to bring a big box home improvement store such as a Menard\u2019s, Home Depot or Lowes to Jamestown. The development includes a number of lots around the main property for smaller businesses.<\/p>\n<p>Members of the public attending the meeting questioned whether the city should take steps to lure a big box home improvement store to Jamestown.<\/p>\n<p>\u3000<\/p>\n<p>Jamestown (CSi) \u2014 Kevin J. Dvorak, President and CEO of the North Dakota Community Foundation delivered a grant from the North Dakota Community Foundation\u2019s State-wide Greatest Needs (Unrestricted) Fund to the Jamestown Regional Medical Center (JRMC) Foundation. NDCF Area Board Members are Steve Ottmar \u2013 Jamestown, Becky Thatcher-Keller \u2013 Jamestown, Diane Peyerl \u2013 Fural Penn, David &#8220;White Thunder&#8221; Trottier \u2013 Rugby. NDCF Development Director, Kara Geiger also participated in the presentation.<\/p>\n<p>The JRMC Foundation and Family BirthPlace accepted the grant for the Hugs\u00ae Infant Protection System in the amount of $1,500.<\/p>\n<p>Dvorak says, &#8220;The North Dakota Community Foundation is pleased to partner with JRMC. It\u2019s great to see that JRMC is completed and has continued to enhance their equipment and technology, and we are glad to be a part of it.&#8221;<\/p>\n<p>The area grants were made from the North Dakota Community Foundation\u2019s State-Wide Great Needs Fund. Grants were awarded on a competitive basis. This year the Foundation received 149 grant requests of which the Board of Directors approved 49. The NDCF and its component funds will make over $3 million in grants all across North Dakota in 2013.<\/p>\n<p>NDCF Board Member Diane Peyerl. &#8220;I was amazed at the number of grant requests and the incredible projects and programs that are happening across our state. We are pleased that our NDCF grants will enhance the quality of life for North Dakota citizens&#8221; said The North Dakota Community Foundation was organized in 1976.<\/p>\n<p>The Foundation was formed as an efficient means of meeting the needs of North Dakota in the educational, charitable, arts, scientific and health areas. It is a public, non-profit tax-exempt corporation which receives and distributes charitable funds to support a wide range of programs which benefit North Dakotans. The Foundation administers charitable endowment and non-endowment funds in both the restricted and unrestricted categories on behalf of communities, businesses, non-profit organizations, and individuals. The Foundation currently holds assets in excess of $50,000,000 and to date has made more than $54,000,000 in grants all across North Dakota.<\/p>\n<p>&nbsp;<\/p>\n<p>Bismarck (CSi) \u2013 Gayle Nelson and Tena Lawrence of the Jamestown Dollars for Scholars attended the sixth annual North Dakota Dollars for Scholars Conference held in Bismarck on Saturday, November 2, 2013.<\/p>\n<p>Chapter representatives learned about volunteer recruitment and fund raising. For attending the conference, the Chapter will receive a $1,000 scholarship donation from Bank of North Dakota (BND).<\/p>\n<p>North Dakota Dollars for Scholars has 80 community chapters in the state. Bank of North Dakota provides a State Director and operational support for local chapters. Since the first chapter was established in Grand Forks in 1962, Dollars for Scholars chapters in North Dakota have raised over $27 million and helped over 22,500 students.<\/p>\n<p>This year, the Jamestown chapter plans to distribute $17,500 to local high school students and recent graduates attending college. Events such as Blue Jay football &#8220;Touchdown Sponsors&#8221; in addition to chapter memberships increase the funds available for the students.<\/p>\n<p>Individuals and families may donate directly to the local chapter. (AP) &#8211; The prosecutor in Grant County has charged \u00a0two white supremacists with terrorizing after they carried guns in a small North Dakota town they want to turn into a white enclave.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The sheriff arrested 62-year-old Craig Cobb and 29-year-old Kynan Dutton on Saturday after residents of Leith called for help, saying the two men were threatening them with guns.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Cobb told The Bismarck Tribune\u00a0 the group started armed patrols because of harassments.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Grant County authorities say Cobb and Dutton were charged with four counts of felony terrorizing and will appear in court Monday afternoon.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Cobb bought up property in Leith in hopes of attracting more white supremacists there and taking over the town&#8217;s government. (AP) &#8211; A Fargo man convicted of attempted murder for locking two men in his apartment and beating them with a sword and a table leg will serve 10 years in prison.<br \/>\n\u00a0<br \/>\n23-year-old Damon White Bird was sentenced Monday after representing himself in a trial earlier this year.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Jurors also found him guilty of several other charges, including felonious restraint and tampering with evidence.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The prosecutor says one of the men spent 27 days in the hospital and had part of his skull replaced with titanium mesh.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; North Dakota Democratic lawmakers have slated a hearing this week to seek answers on pipeline safety.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The meeting scheduled for Wednesday in Stanley is in response to a massive spill in the northwest corner of the state.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 House Minority Leader Kenton Onstad says residents in western North Dakota increasingly are concerned that another spill could happen similar to the Tesoro Corp. pipeline rupture. That spill was discovered by a farmer in September and sent more than 20,000 barrels of crude oozing across a wheat field near Tioga.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Onstad says the intent of the meeting is to discuss &#8220;the integrity and safety of pipelines&#8221; in the state.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; Lena the turkey will live out her life on a rural Milnor farm, thanks to North Dakota Gov. Jack Dalrymple.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Dalrymple on Monday pardoned the 26-pound, 20-week-old turkey owned by North Dakota Turkey Federation President Harvey Hofer in an annual pre-Thanksgiving holiday ceremony held at the Capitol.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Lena stood stoically in the middle of a conference table during the lighthearted ceremony, prompting Dalrymple to speculate that she had been tranquilized.
