FARGO, N.D. (AP) – A man shot by Jamestown police officers after he came out of his Southwest Jamestown apartment building carrying a shotgun says in a civil lawsuit he never aimed the gun at anyone and police used excessive force.<\/p>\n

Michael Partlow survived the September 2010 shooting.<\/p>\n

Partlow’s attorneys say their client made suicidal threats after a night of drinking, and his sister called police.<\/p>\n

The lawsuit says Partlow was bending down to place the gun on the ground when police opened fire.<\/p>\n

The suit, which seeks unspecified damages, names officers Joseph Stadler, Michael Craig and Sidney Mann, was well as the city of Jamestown.<\/p>\n

Jamestown City Attorney, Ken Dalsted, did not respond to requests for an interview.<\/p>\n

A jury later convicted Partlow of terrorizing, but found he did not attempt to inflict bodily injury.<\/p>\n

Partlow was given a two-year suspended prison sentence and five years of supervised probation.<\/p>\n

Valley City, ND (KCSi-T.V. News Sept 19, 2012) \u2014 Anyone with a metal detector, with headphones, unit, is asked to contact, Barnes County Airport Authority Chairman, Dennis Helland, or the Barnes County Sheriff\u2019s Office.<\/p>\n

The equipment will be used by the Federal Aviation Administration in their investigation into the plane crash that took the life of Bob Odegaard on September 7, 2012, while he was practicing for a Valley City air show that was to be held the next day.<\/p>\n

The metal detector is needed to locate a digital camera memory card.<\/p>\n

The camera was mounted on Odegaard\u2019s plane.<\/p>\n

The search for the card is planned, next week.<\/p>\n

Jamestown, ND (KCSi-T.V. News) — Fans of Elvis Presley are invited to a Jamestown show, highlight the entertainers memorabilia, and a sale of items obtain from Elvis\u2019 Graceland mansion, in Memphis.<\/p>\n

On Wednesday\u2019s Wayne Byers Show on CSi Cable 2, Jack Gorman of Jamestown said, he\u2019s followed Elvis\u2019 career and attended hundreds of Elvis concerts.<\/p>\n

Jack and his wife, Betty, have brought back from Graceland memorabilia including jumpsuits and other Elvis items.<\/p>\n

Gorman said Elvis souvenirs can be purchased at the Knights of Columbus Hall in Jamestown, October 5,6, 2012 from 10-a.m., to 8-p.m., both days.<\/p>\n

The costs of the souvenirs range in price from $4 to $25.<\/p>\n

Also available will be photos of Elvis, taken by Gorman, from Elvis\u2019 last concert, at a cost of $5 each.<\/p>\n

Also showing will be rare concert footage of Elvis on a big screen T.V. along with a video of a private tour of Graceland.<\/p>\n

The cost of admission is:<\/p>\n

Children 11-17 years old, $5, 10 and younger, free<\/p>\n

Gorman added, those attending the Jamestown showing can take as many photos as they like, or record anything in the room.<\/p>\n

BISMARCK, N.D. (AP) – North Dakota’s Supreme Court has refused a
\nrequest to put a medical marijuana initiative on the November
\nballot.
\n\u00a0\u00a0\u00a0\u00a0 In a brief order Wednesday, the court said it won’t intervene in
\nthe dispute.
\n\u00a0\u00a0\u00a0\u00a0 Secretary of State Al Jaeger wouldn’t put the proposal on the
\nballot because of what he said was evidence of petition fraud.
\nMedical marijuana supporters were asking the Supreme Court to
\noverride Jaeger.<\/p>\n

They say some petitions were valid, and Jaeger didn’t try to sort them out.
\n\u00a0\u00a0\u00a0\u00a0 The secretary of state says he’s pleased by the court’s
\ndecision.<\/p>\n

He says dozens of North Dakota counties are already having their ballots printed.
\n\u00a0\u00a0\u00a0\u00a0 Fargo state Rep. Steve Zaiser is chairman of the initiative campaign.<\/p>\n

He says he’s disappointed that “a lot of work went down the drain.”<\/p>\n

\u00a0BISMARCK, N.D. (AP) – New estimates put North Dakota’s budget
\nsurplus at a staggering $1.6 billion.
\n\u00a0\u00a0\u00a0\u00a0 In July the state’s budget surplus was estimated at $850
\nmillion. That doesn’t count $1.1 billion in state reserve funds
\nthat have restrictions on how they can be spent.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Gov. Jack Dalrymple credits explosive growth in sales tax
\nrevenues for much of the increase.
\n\u00a0\u00a0\u00a0\u00a0 He says oil exploration in western North Dakota has caused a
\nbigger increase in tax collections than anyone expected.
\n\u00a0\u00a0\u00a0\u00a0 Dalrymple says much of the surplus should be devoted to one-time
\npublic works projects and tax cuts.
\n\u00a0\u00a0\u00a0\u00a0 A legislative committee heard a report Wednesday on the revenue
\nestimates.
\n\u00a0\u00a0\u00a0\u00a0 The surplus number also doesn’t include money that’s expected to
\nflow into a newly established state public works fund. It could
\nhave almost $700 million by June.<\/p>\n

BISMARCK, N.D. (AP) – A 74-year-old West Fargo landlord
\nsentenced to two years in prison for running over an ex-tenant with
\nhis Hummer has appealed to the North Dakota Supreme Court.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Alois Vetter argues that jurors who last fall convicted him of
\naggravated assault and reckless endangerment should not have been
\nallowed to consider the vehicle a dangerous weapon in the February
\n2011 incident.
\nBecause of the finding, a judge was forced to give Vetter the mandatory
\nminimum two-year sentence.
\n\u00a0\u00a0\u00a0\u00a0 Vetter’s attorney says automobiles are not specifically
\nclassified as dangerous weapons under state law.<\/p>\n

Prosecutor Cherie Clark says the issue boils down to intent, which is for a jury to decide.
\n\u00a0\u00a0\u00a0\u00a0 The Supreme Court will rule later.<\/p>\n

\u00a0BISMARCK, N.D. (AP) – A Bismarck woman is accused of stealing
\nmore than $15,000 from her employer.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Thirty-nine-year-old Dawn Bad Warrior faces a felony theft
\ncharge that carries a maximum punishment of 10 years in prison.<\/p>\n

Court documents do not list an attorney for her, and a telephone
\nlisting could not immediately be found.
\n\u00a0\u00a0\u00a0\u00a0 Police say \u00a0an audit at Money Lenders uncovered $8,600 in bogus loans and $7,000 missing from the vault.<\/p>\n

\u00a0FARGO, N.D. (AP) – A Minnesota manufacturer is suing the head of
\nthe North Dakota Trade Office for allegedly breaking agreements he
\nmade while with the company.
\n\u00a0\u00a0\u00a0\u00a0 The complaint filed by Mattracks alleges that Dean Gorder
\nviolated confidentiality and noncompetition agreements he signed at
\nthe time of his hiring that barred him from using contacts or
\ninformation he gleaned as an employee to benefit another company.
\n\u00a0\u00a0\u00a0\u00a0 The\u00a0 lawsuit was filed against Gorder and the North Dakota Trade Office.
\nThe plaintiffs say in a statement that the lawsuit lacks merit.
\n\u00a0\u00a0\u00a0\u00a0 Mattracks is seeking more than $50,000 and an end to the alleged
\nviolation of the agreements.
\n\u00a0\u00a0\u00a0\u00a0 Mattracks makes rubber tracks for vehicles and markets them
\ninternationally.<\/p>\n

The Fargo-based Trade Office promotes international business opportunities for North Dakota companies.<\/p>\n

\u00a0RAPID CITY, S.D. (AP) – A Rapid City surgeon accused of income
\ntax evasion is on trial.
\n\u00a0\u00a0\u00a0\u00a0 Assistant U.S. Attorney Kevin Koliner told jurors in his opening
\nstatement in federal court Tuesday that the case is simple – Edward
\nPicardi “made a heck of a lot of money and didn’t want to pay his
\ntaxes.” Koliner said Picardi owes more than $1 million in back
\ntaxes.
\n\u00a0\u00a0\u00a0\u00a0 Defense attorney Jennifer Culotta said the government has worked
\non the case for more than 10 years to “fit square pegs into round
\nholes to fit their philosophy.” She said it is not illegal for
\nsomeone to try to “minimize” their taxes.
\n\u00a0\u00a0\u00a0\u00a0 The Rapid City Journal reports\u00a0 that the trial is scheduled to last as long as six weeks.<\/p>\n

WASHINGTON (AP) – Farm-state members of Congress for decades
\nhave campaigned on the back of farm bills delivering
\nelection-season subsidies and other goodies to rural voters.<\/p>\n

\u00a0\u00a0\u00a0\u00a0 Not this year. The bill is stalled, primarily because House GOP
\nleaders don’t want a noisy fight over food stamps this close to the
\nelection.<\/p>\n

That poses a particular problem for some Republicans in
\ntight races for the Senate or House who will go home empty-handed
\nwhen Congress adjourns this week.
\n\u00a0\u00a0\u00a0\u00a0 Democratic challengers are using the farm bill as an example of
\nhow they say the Republican-run House is ineffective.<\/p>\n

The issue has affected Senate races in Montana and North Dakota, along with House races in South Dakota, Colorado and Iowa.<\/p>\n

ATLANTA (AP) – It’s Mitt Romney’s turn to highlight some
\nvideotaped comments from his rival — pointing to a video of Obama
\nfrom 1998 in which the then-state-senator said he believes in
\nredistribution “at least to a certain level to make sure
\neverybody’s got a shot.”<\/p>\n

Romney told donors today in Atlanta that it’s not the way America works.<\/p>\n

He said it’s an idea that would “kill the American entrepreneurship that’s lifted our economy over the years.”

\n\u00a0\u00a0\u00a0\u00a0 PARIS (AP) – A small package bomb has exploded inside a kosher
\ngrocery store in a Paris suburb, wounding at least one person.<\/p>\n

That word comes from an agency that tracks anti-Semitic attacks in
\nFrance.<\/p>\n

The reason for the attack isn’t clear, but it rattled
\nnerves amid global tensions over a U.S.-produced film insulting to Islam.<\/p>\n

And the attack came a few hours after a satirical French weekly published caricatures of the Prophet Muhammad.

\nfinding fault with the agency’s handling of a gun-trafficking probe

\nscenes in the U.S. and Mexico.<\/p>\n

The inspector general’s report cites misguided strategies, errors in judgment and management failures.
\nIt refers more than a dozen people for possible disciplinary action
\nfor their roles in Operation Fast and Furious.<\/p>\n

The report did not criticize Attorney General Eric Holder.

\n\u00a0\u00a0\u00a0\u00a0 NEW YORK (AP) – Stocks have been trading above their four-year
\nclosing highs again today, after a pair of encouraging reports
\nabout the housing market.<\/p>\n

The National Association of Realtors says home sales jumped to the highest level in more than two years in August.<\/p>\n

The government reported earlier that construction of single-family homes was also the fastest in more than two years.

\n\u00a0\u00a0\u00a0\u00a0 WASHINGTON (AP) – Scientists say the amount of ice in the Arctic
\nOcean shrank to an all-time low this year, smashing old records for
\nthe critical climate indicator.<\/p>\n

The ice cap at the North Pole measured 1.32 million square miles on Sunday. The previous low was 1.61 million square miles in 2007.<\/p>\n

Records go back to 1979 based on satellite tracking. Ice in the Arctic melts in summer and grows in winter, and it started growing again on Monday.
