NO<br \/>\n\u00a0HAZARDOUS WEATHER IS EXPECTED AT THIS TIME.<\/p>\n<p>\u00a0DANGEROUS WIND CHILLS ARE POSSIBLE NORTH SUNDAY NIGHT INTO MONDAY\u00a0AND ACROSS MOST AREAS MONDAY NIGHT INTO TUESDAY.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) The Jamestown City Park Board has unanimously approved plans for a petition drive to place a one percent city sales tax before the voters, possibly in April of 2015.<\/p>\n<p>The tax would be used for construction of the Two Rivers Activity Center and requires a simple majority to pass.<\/p>\n<p>The ballot measure calls for a yes or no vote on the 1 percent sales tax that would remain in place until the debt associated with the construction of the TRAC building is retired or until June 30, 2040, whichever comes first.<\/p>\n<p>If constructed, the TRAC building would be located near Jamestown High School.<\/p>\n<p>Parks and Recreation Department Director Doug Hogan says, the draft petition would be submitted to the city of Jamestown for review next week.<\/p>\n<p>Then, the city has 10 days to review the petition and if approved volunteers can start gathering the signatures. 15 percent of the votes cast in the last presidential election are required, or 1,053 signatures.<\/p>\n<p>Hogan adds that the Parks and Recreation Department will cover the estimated $10,000 cost of the special election.<\/p>\n<p>Hogan said the department is planning on starting a capital fundraising drive.<\/p>\n<p>Final costs of the project could be determined by the amount of capital raised during the drive plus the $28.5 million the Parks and Recreation Department would be able to borrow if the sales tax is approved.<\/p>\n<p>Parks and Recreation would own and operate the recreation center and employ about 50 additional people to operate the center. Other participating groups include Jamestown Public Schools,\u00a0James River Family Fitness,\u00a0Jamestown Tennis Association and the Jamestown Gymnastics Club.<\/p>\n<p>&nbsp;<\/p>\n<p>FARGO, N.D. (AP) &#8211; A federal appeals court says three Jamestown Police officers who shot a Jamestown man after he came out of his apartment carrying a shotgun did not use excessive force.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Michael Partlow was hospitalized for about three weeks following the September 2010 incident. Partlow later filed suit against the officers, who appealed after a federal judge failed to dismiss the complaint.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 A three-judge panel of the 8th U.S. Circuit Court of Appeals ruled in a 2-1 decision that the officers should not face legal action.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Partlow said in his suit that he was bending down to place the gun on the ground when the officers opened fire. The appeals court said that even if the officers were mistaken about Partlow pointing the gun at them, their reaction was &#8220;objectively reasonable.&#8221;<\/p>\n<p>\u00a0The case has been remanded to the U.S. District Court for further proceedings.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) The Salvation Army has options to donate through gift giving.<\/p>\n<p>On Tuesday\u2019s Wayne Byers Show on CSi Cable 2, the Salvation Army\u2019s Planned Giving Division, Director, Faye Miller, said gifts may include giving to an endowment fund, or through a charitable gift annuity.<\/p>\n<p>She travels North Dakota and Minnesota explaining certain types of gifts and funding options through the Salvation Army Gift Giving Division.<\/p>\n<p>She pointed out that individuals may also remember the Salvation Army in their wills.<\/p>\n<p>She pointed out that making a qualifying gift to the Salvation Army Endowment Fund, realizes a 40 percent North Dakota income tax credit to offset 2014 taxes.<\/p>\n<p>She added that the credit is available to both individuals and businesses with the minimum qualifying gift at $5,000, which may be in lump sum form, or aggregated over the tax year.<\/p>\n<p>The maximum credit for a single tax year is $10,000 for and individual $20,000 for a married couple and $10,000 for business entities. (AP) &#8211; North Dakota&#8217;s Historical Society has drafted an agreement to finalize the purchase of the boyhood home of famous band leader Lawrence Welk.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 State Historical Society Director Claudia Berg says the group&#8217;s board is slated to vote on the agreement next month. The group voted to buy the Strasburg homestead from Welk&#8217;s nieces about a year ago. But a final sale price was not negotiated.\u00a0<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Legislature last year included $100,000 in the Historical Society&#8217;s budget for the purchase but lawmakers stipulated that repairs must first be made.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Berg says most of the work has been done. She says all other repairs to the site must be made by spring.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Berg says some of the $100,000 payment will be held until all work is completed.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; Warrants have been issued in North Dakota for four people accused of forging checks worth more than $23,000.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The\u00a0 complaint against the individuals states that during August and September, 26-year-old Rusty Crowe and 24-year-old Patrick Crowe used several people to knowingly cash forged checks from Cyclone Drilling and the Three Affiliated Tribes. The checks were cashed at a Bismarck area grocery store.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The complaint states the Mandaree men paid a nominal sum to the people cashing the checks. The warrants for the men have been issued for leading a criminal association charge, a felony punishable by up to 10 years in prison.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Warrants were also issued for 23-year-old Megan Marie Hale, of Newtown, and 19-year-old Shelton Lane Price, of Bismarck. They are facing counterfeiting charges.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0\u00a0FARGO, N.D. (AP) &#8211; Fargo police are looking for help in identifying a man considered to be a &#8220;person of interest&#8221; in a rape investigation.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The case involves a man who last weekend walked into an unlocked apartment occupied by three North Dakota State University students. KFGO radio reports that the suspect sexually assaulted one woman and attempted to assault another woman. One of the victims broke free during a struggle and ran to a neighbor&#8217;s apartment.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Police have released the image of a man who showed up on a trail camera during an investigation into window peeping last April. No further details were released.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0WILLISTON, N.D. (AP) &#8211; One of two men accused in an oil patch drug case involving methamphetamine, heroin, cocaine and marijuana has pleaded not guilty to eight counts.\u00a0<br \/>\n\u00a0<br \/>\n32-year-old Jose Villalpando is charged with four counts of delivery of a controlled substance and four counts of possession of a controlled substance.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities say a search warrant in the case led to 9 ounces of meth, 8.8 ounces of heroin, 6 pounds of marijuana and about an ounce of cocaine.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Villalpando has said through an interpreter that the drugs belonged to Porifirio Jimenez, who is also charged in the case. Jimenez is scheduled for a preliminary hearing on Jan. 15.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Villalpando and Jimenez are each being held on $2 million bond.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0 WAHPETON, N.D. (AP) &#8211; An Idaho man convicted of killing a man outside of a strip club in Williston has been sentenced to life in prison without the possibility of parole. Jonathan Horvath was found guilty of murder, two counts of terrorizing and one count of reckless endangerment in the March 2013 death of Derrick Spiegel. Authorities said Spiegel was killed on a sidewalk outside a strip club following an argument.<br \/>\n\u00a0<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; North Dakota health officials have identified another case of hepatitis C in Minot. That makes 51 cases of the viral infection that can cause serious liver damage. Most patients have been former or current residents of ManorCare nursing home. But officials say this latest case isn&#8217;t connected to ManorCare.<br \/>\n\u00a0<\/p>\n<p>\u00a0 BISMARCK, N.D. (AP) &#8211; North Dakota officials are reporting widespread cases of the flu.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The state Department of Health says there were 332 cases of laboratory-confirmed influenza as of the middle of December. Several community outbreaks have been reported in recent weeks.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Health officials say the flu activity has started earlier than normal and it&#8217;s important for people to get flu shots as soon as possible.<br \/>\n\u00a0\u00a0\u00a0\u00a0\u00a0BISMARCK, N.D. (AP) &#8211; North Dakota&#8217;s population has reached an all-time high.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The U.S. Census Bureau on Tuesday said the state has 739,482 residents. That&#8217;s an increase of more than 15,000 residents from last year&#8217;s count.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 In the early 2000s, North Dakota was one of only a few states with a declining population. The state began to reverse that trend in 2004 because of the oil boom and the population has grown every year since.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Gov. Jack Dalrymple says the state&#8217;s economic growth during the past decade &#8220;continues to keep North Dakotans home.&#8221; He adds that the state is attracting new residents who want good jobs, a stable economy and a quality of life that is second to none.&#8221;<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The state has added about 94,000 residents since 2004.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0 BISMARCK, N.D. (AP) &#8211; A proposed bill that was requested by the North Dakota Board of Higher Education would exempt contact information for college students from the state&#8217;s open records law.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The move was prompted after a Bismarck-based advertising agency that handles much of the marketing state Republican Party requested the information for about 48,000 students during the campaign season.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Democratic leaders complained about the request and asked Attorney General Wayne Stenehjem to block the release. The season starts May 9<sup>th<\/sup>.<\/p>\n<p>Returning is the two-night Labor Day races.
