JAMESTOWN, N.D. (AP,CSi) – Jamestown police say an early morning home invasion ended with a man being shot.<\/p>\n

Lt. Justin Blinsky says the man who broke into the home, at\u00a01115 1st Avenue North, shortly before 12:30 a.m. Friday got into a confrontation with the homeowner and was shot \u00a0in the abdominal area with a handgun . He was taken toJamestown Regional Medical Center, and later tranferred to\u00a0a Fargo hospital with injuries that Blinsky says do not appear to be life-threatening.<\/p>\n

There was another male and female in the house during the incident. Blinsky says all of the people appear to know one another.<\/p>\n

Blinsky said the doors to the house were locked and that the man who broke into the house knew the man and a female who were in the residence at the time of the incident.<\/p>\n

The investigation is ongoing and no names of anyone involved have been released by the Jamestown Police Department.<\/p>\n

The Stutsman County Sheriff\u2019s Office, Stutsman County Narcotics Task Force and North Dakota Bureau of Criminal Investigation assisted at the scene.<\/p>\n

Jamestown (CSi) Perfect weather helped attract a record crowd to The Community Block Party Thursday, in Downtown Jamestown, estimated at between 3,000 and 4,000 people.<\/p>\n

Jamestown (CSi) Jamestown City Council committees met Thursday afternoon at City Hall.<\/p>\n

POLICE & FIRE COMMITTEE BUSINESS:<\/p>\n

Discussion related to possible asset forfeiture for new gun range. Police Chief Scott Edinger said the assets come from dollars seized in a drug raid. He said it amounts to about $75,000. The property being considered is a gravel pit, north of Border States Paving.<\/p>\n

The committee recommends adding the dollar amount to the 2016 city budget as a line item, when the exact amount is known. The gun range may open in 2016.<\/p>\n

The committee considered first reading of an ordinance to recommend the use of All-Terrain-Vehicles and Utility-Task-Vehicles in the City of Jamestown and was defeated on a 3-2 vote.\u00a0 Mayor Katie Andersen and Councilman Ramone Gumke voted in favor of considering a first reading of an ordinance allowing the vehicles on city streets. Councilmen Charlie Kourajian, Dan Buchanan and Steve Brubakken opposed.<\/p>\n

Police Chief Edinger said he considers the vehicles safer than motorcycles.<\/p>\n

Council Member Buchanan explained his disapproval of ATVs by saying that most cities in North Dakota disapprove there use on city streets, adding the vehicles are not intended for street use, and cited insurance companies including Progressive mainly insuring the vehicles for off-road use, and sited safety studies. He pointed out cornering skid issues. He added that Jamestown residents he has spoken to, are opposed.<\/p>\n

PUBLIC WORKS COMMITTEE:<\/p>\n

The committee recommends postponing the river bank stabilization project until 2016 and move anticipated funding adding $7500 into 2016 budget to repair channel banks at 11th Street NW AND along the Buffalo Scenic Road near the culvert from State of ND lands adjacent to the road. Being late in this year\u2019s construction season, work will start next spring.<\/p>\n

The committee recommends an adjustment submittal to the ND Department of Emergency Services, minus some federal dollars being refunded..<\/p>\n

Legal and Finance carryover item from Tuesday\u2019s meeting.<\/p>\n

Joint Powers Agreement between the Jamestown Park District and City of Jamestown for the TRAC Facility, will be sent to the City Council without recommendation. It includes the effective date of the sales tax, and the start date of the tax collections.<\/p>\n

The committee moves to the council without recommendation, the request for a liquor license for an establishment to be located on First Avenue, South, between the Maple Mall and The Kitchen Store.<\/p>\n

Valley City (CSi) The Valley City State University V-500 Board of Directors kicked off the 2015-2016 campaign. The V-500 organization conducts an annual membership drive to support academic scholarships at the university. Last year, V-500 allocated over $250,000 to academic scholarships for incoming Valley City State University students.<\/p>\n

This year the new members include Erica Bunn (VCSU), Kelli Heath (VCSU), Bill Mason, and Laurel Westby (VCSU) to the board. The board promotes fundraising events like the VCSU Rendezvous coming up October 23 and the VCSU Scholarship Auction to be held April 15, 2016. (CSi) The North Dakota Education Fact Finding Commission at Barnes County North Public School Thursday afternoon for an impasse hearing.<\/p>\n

Barnes County North School Board and the Barnes County North Education Association have been meeting since May to settle the terms of a proposed two-year contract.<\/p>\n

Dean Rummel, chair of the Fact Finding Commission, said in seven to 10 days the commission will issue a recommendation.<\/p>\n

At issue is a thousand dollars, difference between a $2,250 raise over two years and a $1,250 raise over two years.<\/p>\n

Jamestown (CSi) The 51st Annual Jamestown Fine Arts Association Art Show opens Saturday, August 29, 2015 with a reception at the Arts Center from 1 to 3 p.m.<\/p>\n

At 1:15 p.m. Saturday the awards will be given by the judges. There is a $100 cash prize for best in show, the piece the judges determine to be the best of all in the exhibits. The winner in each category receives $50, and the people\u2019s choice winner will receive $50.<\/p>\n

The art work will remain on exhibit at the Arts Center through October 3rd<\/sup>.<\/p>\n

There are 39 artists with 77 pieces on display.<\/p>\n

Each artist may select up to three pieces to be be part of the show and exhibit if those pieces are ready for display, being framed or is ready to be hung on a wall.<\/p>\n

The JFAA Art Show is also a juried show, as a judge or judges will review each piece before the show opens. The two judges, are from the art faculty from Valley City State University, Armando Ramos and Karri Dieken. Ramos did his undergraduate studies at the Kansas City Art Institute and his graduate studies at Montana State University. He has been an artist in residence at art centers in California and Vermont.<\/p>\n

EVILS LAKE, N.D. (AP) – The attorney for a 54-year-old Grand Forks man facing criminal charges in a fatal boat crash says he’s devastated by the incident.\u00a0

\nThomas Burns did not speak or enter a plea during a court hearing Thursday. Burns’ attorney, Darla Schuman, said he continues to be under medical care for his injuries.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Authorities allege that Burns was intoxicated on Aug. 9 when a boat he was driving on Devils Lake struck a tree about 30 yards from shore. He is charged with felony manslaughter, felony reckless endangerment and boating under the influence.

\n\u00a0\u00a0\u00a0\u00a0 Twenty-six-year-old April Stenger, of Detroit Lakes, Minnesota, was killed. Three other passengers were injured.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 District Judge Lee Christofferson set bail at $20,000 and required frequent alcohol testing and monitoring of Burns, with no boating or fishing.\u00a0<\/p>\n

MINOT, N.D. (AP) – A Texas man who stabbed to death a fellow oil field worker in a North Dakota hotel about four years ago is seeking to be released from state supervision.<\/p>\n

Thirty-seven-year-old Charles Davis, of Trinity, Texas, acknowledged killing 48-year-old Donald Flowers, of Wichita Falls, Texas, in a conference room at the Candlewood Suites in Minot in March 2011. But he was found to be not criminally responsible due to mental illness, and sent to the State Hospital in Jamestown for treatment of schizophrenia.<\/p>\n

Two psychologists testified this week that Davis is not a substantial risk to the public if released from supervision. Prosecutors argued he might be a risk if he fails to take his medicine.<\/p>\n

Judge Stacy Louser ordered both sides to submit written arguments, after which she will rule.<\/p>\n

\u00a0WILLISTON, N.D. (AP) – An inmate who went missing from a minimum-security prison in Bismarck more than two months ago has been arrested in Williston.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Thirty-nine-year-old Ernesto Difabio left the Missouri River Correctional Center on June 14. Authorities say he was found hiding in the basement of a Williston home on Tuesday and taken into custody.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Police also arrested the woman who owned the home on a charge of hindering law enforcement.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Difabio had been serving a five-year sentence on convictions for burglary and theft in the Williston area when he went missing.

\u00a0BISMARCK, N.D. (AP) – State School Superintendent Kirsten Baesler says North Dakota will recover more than $316,000 as compensation for problems schools had earlier this year administering new state assessments in math and English.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 The Smarter Balanced Assessment Consortium that developed the online tests intended to align with Common Core standards will forfeit to the state about $92,000 in membership fees for the last academic year. The state’s fee for this school year will be cut by about 40 percent.

\n\u00a0\u00a0\u00a0\u00a0 North Dakota adopted Common Core standards in 2011 and began to fully implement them during the 2013-14 school year. The state has been participating with 17 others in the consortium, and is one of three that contracted with New Hampshire-based Measured Progress for test administration.

\n\u00a0\u00a0\u00a0\u00a0 Montana and Nevada also experienced problems with the tests.

BISMARCK, N.D. (AP) – North Dakota has agreed to pay $58,000 in legal fees and costs associated with a federal lawsuit that challenged the state’s ban on same-sex marriage.

\n\u00a0\u00a0\u00a0\u00a0 Court documents show that nearly $7,000 will be paid to the National Center for Lesbian Rights. The remainder will be split by lawyers who represented the plaintiffs.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 The lawsuit was thrown out shortly after the U.S. Supreme Court legalized gay marriage in all 50 states.<\/p>\n

(AP) – A North Dakota woman has sued American Crystal Sugar, alleging she endured years of sexual discrimination and harassment when she worked at the company’s East Grand Forks plant. KFGO-AM reports Janine Bailey filed her lawsuit in U.S. District Court in Minnesota on Thursday.American Crystal Vice President Lisa Borgen tells KFGO that the company vigorously denies the allegations. She says the company doesn’t tolerate discrimination or harassment in the workplace.<\/p>\n

\u00a0BISMARCK, N.D. (AP) – A federal judge in North Dakota has blocked a new rule that would give the federal government jurisdiction over some state waters.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 U.S. District Judge Ralph Erickson of North Dakota issued a temporary injunction Thursday against the Obama administration rule. The rule gives the U.S. Environmental Protection Agency and Army Corps of Engineers authority to protect some streams, tributaries and wetlands under the Clean Water Act.

\n\u00a0\u00a0\u00a0\u00a0 Thirteen states led by North Dakota asked Erickson to suspend guidelines they say are unnecessary and infringe on state sovereignty. The federal government says the new rule clarifies ambiguity in the law and makes it easier for the states to manage some waterways.

\n\u00a0\u00a0\u00a0\u00a0 The other states involved are Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, New Mexico, Nevada, South Dakota and Wyoming.<\/p>\n

BISMARCK, N.D. (AP) – The North Dakota Oil and Gas Division says about 2,100 gallons of oil and 12,600 gallons barrels of saltwater were released, contained and recovered on a site just outside of Williston.

\n\u00a0\u00a0\u00a0\u00a0 StatOil Oil and Gas LP reported Wednesday’s incident to the state division.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 The company reported that the cause of the contained fluid release at the oil and gas well is listed as equipment failure, which caused a tank to overflow. The site is about 15 miles northwest of Williston.

BISMARCK, N.D. (AP) – North Dakota’s congressional delegation says the 11 narcotic task forces are sharing a federal grant to continue illegal drug-fighting efforts.

\n\u00a0\u00a0\u00a0\u00a0 The delegation says the $447,000 grant comes from the U.S. Justice Department.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 North Dakota’s attorney general’s office will administer the grants. The funds can be used for such things as training, personnel, equipment and supplies.<\/p>\n

MISSOULA, Mont. (AP) \u2013 Longtime sports broadcaster Brent Musburger, who grew up in Billings, will call the season-opening football game between Montana and four-time defending FCS champion North Dakota State in Missoula.<\/p>\n

The FCS battle will be aired on ESPN\u00a0 CSi Cable 14, starting at 1:30 p.m. on Aug.29, 2015,\u00a0and marks the start of the football season as part of the network\u2019s second annual FCS Kickoff.<\/p>\n

First-year Montana football coach Bob Stitt said Musburger called him Monday to let him know that he and color commentator Jesse Palmer will call the game.<\/p>\n
