HIGHS IN THE UPPER 40S.<br \/>\n\u00a0<\/p>\n<p>RAIN THURSDAY EVENING THROUGH FRIDAY EVENING, BETWEEN A HALF AND ONE INCH.<\/p>\n<p>HIGH RAIN RATES ARE NOT ANTICIPATED&#8230;AND MOST AREAS ARE RATHER DRY FOR FALL&#8230;SO IMPACTS SHOULD BE LIMITED.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) A Minot man is be sought by the Stutsman County Sheriff\u2019s Office, who allegedly sold stolen heavy equipment to two Stutsman County residents earlier this year.<\/p>\n<p>37 year old Benjamen Wayne Smith, was charged September 21, 2015, in Southeast District Court in Jamestown with three counts of theft of property. The first count, a Class A felony, alleges that Smith transferred a stolen Caterpillar skid steer loader to a Pingree resident on April 14th. The second count, a Class C felony, is for the flatbed trailer the skid steer loader was on. The skid steer loader and trailer were stolen from a Harbor, Washington, company.<\/p>\n<p>The third count, a Class B felony, alleges Smith sold a second skid steer loader to a Buchanan resident on May 15th. The second skid steer was stolen from a Bismarck-based landscaping business.<\/p>\n<p>Stutsman County Sheriff\u2019s Office detective, Major Jason Falk says,<\/p>\n<p>Smith did not appear in court for these charges because he has not been apprehended.<\/p>\n<p>The investigation is in cooperation with the Bismarck Police Department<\/p>\n<p>Falk\u2019s report lists two other suspects, a man from Watford City and a man from Bismarck, who were involved in transporting the allegedly stolen equipment. No charges had been filed against those men as of Tuesday afternoon.<\/p>\n<p>Anyone with information about Benjamen Smith is asked to call the Stutsman County Sheriff\u2019s Office at 251-6200.<\/p>\n<p>The maximum penalty for a Class A felony is 20 years in prison and a $20,000 fine. The maximum penalty for a Class B felony is 10 years in prison and a $20,000 fine. The maximum penalty for a Class C felony is five years in prison and $10,000 fine.<\/p>\n<p>&nbsp;<\/p>\n<p>Valley City (CSi) The Valley City Commission met Tuesday evening at City Hall. Auditor Richter said the issue concerns those who have a hardship in removing trees, giving those property owners more time to pay for the work through Special Assessment.<\/p>\n<p>Commissioners then considered selling fire damaged city property located at W 42.5\u2019 lot 1 &amp; e 7.5\u2019 of alley between lots 1 &amp; 2 block 31 (50\u2019) Benson\u2019s Addition (Lavake property), 626 4th <span>St SW. Paul Diegel requested to buy the property. Special Assessments will be transferred to the new property owners. The property without the house is to be advertised for $5,000, plus the current Special Assessments of $11,000.<\/span><\/p>\n<p>The Commissioners approved the advertising of the property for sale.<\/p>\n<p>\u3000<\/p>\n<p>The City Commission reviewed a Valley Recycling Contract. City Administrator Schelkoph said the changes in the new contract includes a five year contract with two renewal options.<\/p>\n<p>Changes in the advertising was included, with a minimum of $2,000 per calendar year.<\/p>\n<p>Another change is recycling of materials, at two sites, and moved to transfer station, plus a second location. The 90 percent of total compensation will remain the same.<\/p>\n<p>Commissioners approved the contract.<\/p>\n<p>\u3000<\/p>\n<p>CITY ADMINISTRATORS REPORT<\/p>\n<p>David Schelkoph said a Job Service request will be made to advertise for a new police chief, in the wake of Fred Thompson\u2019s resignation.<\/p>\n<p>He said resumes and applications will be taken through the end of November, then interviewing candidates in the first part of December and have someone ready to go by the middle of January.<\/p>\n<p>City Attorney Russell Myhre said Chief Thompson has brought several improvements to the police department.<\/p>\n<p>Thompson says most of his family lives in the Henderson area and he will be moving back to Henderson, Nevada, where he was police chief prior to coming to Valley City, after he retires. Thompson says, his time with the Valley City Police Department has been good.<\/p>\n<p>&nbsp;<\/p>\n<p>CITY UPDATES &amp; COMMISSION REPORTS<\/p>\n<p>Fire Chief Retterath said six applicants have applied for open positions.<\/p>\n<p>KLJ indicated a change in traffic flows with the finishing of some of the permanent flood control project areas. A news release will be issued by KLJ when the changes become effective. Work will continue as along as the weather permits. (AP) &#8211; A North Dakota woman accused of driving under the influence is facing a number of charges after she hit a traffic light pole while her four children were in her vehicle.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The 26-year-old Brittany Hale, of Bismarck, has been charged with DUI while accompanied by a minor, reckless endangerment and criminal vehicular injury.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities say Hale&#8217;s blood alcohol level was nearly three times the legal limit when her vehicle left the road and hit the pole Sunday in Bismarck. Court records show she told a witness that she was &#8220;texting and driving&#8221; and didn&#8217;t see where she was going.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The four children were transported to a hospital. A 7-year-old boy was injured in the crash.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Hale&#8217;s court record doesn&#8217;t list an attorney who could comment on the charges.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; The judge presiding over a sex trafficking trial underway in Bismarck has become frustrated with the defendant who is representing himself because he doesn&#8217;t appear to be ready for the proceedings.<br \/>\n\u00a0<br \/>\n\u00a0The \u00a0frustration from U.S. District Judge Daniel Hovland was evident when defendant Keith Graves cross examined a witness Tuesday. Hovland told Graves he ignored advice to work with a professional attorney.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Graves faces 11 charges related to sex trafficking by force or coercion, obstruction, and methamphetamine possession and distribution. Authorities say Graves beat some of his victims and forced at least one woman to perform sex acts on him.<\/p>\n<p><a title=\"The Bismarck Tribune reports\" href=\"http:\/\/bismarcktribune.com\/news\/local\/crime-and-courts\/jury-hears-witness-testimony-in-first-full-day-of-graves\/article_cdd2bfa9-82d9-5a13-b62f-28ace03c8a21.html\" target=\"_blank\">The Bismarck Tribune reports,<\/a> on Tuesday, one of those women got the chance to tell the jury her story.<\/p>\n<p>The Jamestown woman spent only four or five days with Graves, but in that time she told the jury that he forced her to perform sexual favors on clients and himself on several occasions.<\/p>\n<p>As Assistant U.S. Attorney Brandi Sasse Russell questioned her, she told the jury how, in addition to sexual favors, Graves made her hand drugs over to buyers in exchange for money, despite Graves being present at the transaction.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Graves was one of the main subjects in &#8220;The Overnighters,&#8221; which won an award at the 2014 Sundance Film Festival. (AP) &#8211; U.S. Attorney Chris Myers says a federal officer was justified in shooting and killing a man on the Spirit Lake Indian Reservation last summer.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Bureau of Indian Affairs Officer Terry Morgan shot and killed 31-year-old Joseph Charboneau during a standoff with officers on June 16. Myers says an investigation by his office concluded Morgan was justified in using deadly force.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The FBI has said the incident began when officers went to a residence to arrest another person, and an altercation ensued with Charboneau.
