VALLEY CITY, N.D. (AP) \u2013 85 year old Art Kirschenmann <\/strong>has died from injuries suffered in a house fire in Valley City.<\/p>\n

Fire Chief Gary Retterath says it appears the blaze broke out shortly before 3 a.m. Sunday in the home\u2019s basement.<\/p>\n

Retterath says the body of Kirschenmann has been sent to the State Forensic Examiner\u2019s Office for an autopsy to determine his cause of death.<\/p>\n

Kirschenmann\u2019s wife Arlene,<\/strong> was injured in the fire, and was reported in fair condition in a Fargo hospital, Monday.<\/p>\n

State fire marshal investigator, Ken Sisk said Monday the cause of the fire is still under investigation and didn\u2019t know when a determination will be made.<\/p>\n

Valley City (CSi) Valley City’s City Attorney, Russell Myhre claims Valley City Mayor Bob Werkhoven has created a hostile work environment in City Hall, also\u00a0alleging Werkhoven harassed city employees including Myhre<\/p>\n

Myhre has issued a grievance about Werkhoven\u2019s behavior to his attorney Joseph Larson who represents Myhre and three other city employees.<\/p>\n

After reviewing the Myhre grievance Larson says Mayor Werkhoven\u2019s conduct is erratic and his behavior combative.<\/p>\n

In a another issue, four city employees want an investigation into whether Robert Drake\u2019s ‘letter of 15 questions,” presented to the city in December are defamatory and if Mayor Werkhoven was involved in creating the letter.<\/p>\n

Meanwhile, Valley City Police Lt. David Swenson is accusing Valley City Mayor Bob Werkhoven of creating an abusive and hostile work environment.<\/p>\n

In his grievance Swenson accused the Mayor of trying to get people to protest his promotion to Lieutenant during a swearing in ceremony in November of 2015.<\/p>\n

Swenson said this issue stems from 2011 when the city of Valley City tried to fire Dean Ross and myself over false accusation. He said Ross and the city reached a settlement and he retired in good standing.\u00a0 Swenson said Mayor Werkhoven has disliked him since this incident.<\/p>\n

Swenson\u2019s attorney Joseph Larson said Mayor Werkhoven has hated Swenson for supporting former police chief Dean Ross and carried a personal grudge against Swenson.<\/p>\n

BISMARCK, N.D. (AP) \u2013 North Dakota Attorney General Wayne Stenehjem (STEHN\u2019-juhm) says it\u2019s “no surprise” the Supreme Court will not allow the state to enforce a law banning abortions when a fetal heartbeat is detected as early as six weeks into a pregnancy.<\/p>\n

The justices on Monday turned away the state\u2019s appeal of lower court rulings that struck down the 2013 fetal heartbeat law as unconstitutional. The law never took effect, and abortion rights supporters said it was the strictest anti-abortion measure in the country.<\/p>\n

Stenehjem called review of the law a “longshot,” especially after the high court last week rejected Arkansas\u2019 bid to enforce its own fetal heartbeat law, banning some abortions at 12 weeks.<\/p>\n

Stenehjem says he now considers it to be settled law<\/p>\n

\u3000\u00a0DICKINSON, N.D. (AP) – No criminal charges will be filed in the death of a Bismarck man at a construction site in Dickinson.

\n\u00a0\u00a0\u00a0\u00a0 The remains of 30-year-old Eric Haider were found last May, three years after he went missing at a work site where he had been working with a plumbing company.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Police say Haider was buried alive, and there was nothing suspicious in the autopsy report.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Stark County State’s Attorney Tom Henning declined to file any charges, and the case is closed.<\/p>\n

\u00a0MANDAN, N.D. (AP) – A 38-year-old Mandan man will spend three months in prison for sexually assaulting a girl.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Jeromy Don Krueger was sentenced Monday to one year with all but three months suspended, followed by four years of supervised probation.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Krueger was accused of sexually assaulting a girl on several occasions between December 2013 and March 2015.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 He was arrested last March after one of the victim’s friends told Burleigh County Sheriff’s Department deputies about the sexual abuse. Court documents show that both the victim and Krueger confirmed the abuse when they were interviewed by investigators.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Krueger pleaded guilty to felony sexual assault in October.<\/p>\n

\u00a0BISMARCK, N.D. (AP) – A homeless man charged with murder in North Dakota has changed his plea to guilty.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Forty-five-year-old Mark Butts pleaded guilty Monday in Bismarck.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Butts was initially charged with class AA felony murder in December 2014 after authorities said he stabbed 57-year-old Richard Glover in a car in Bismarck. Police found Glover’s body on the street next to the car.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 For pleading guilty, Butts’ charge has been lowered to a class A felony, punishable by up to 20 years in prison.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Judge Bruce Haskell ordered a pre-sentence investigation to be done before Butts is sentenced.<\/p>\n

\u00a0MINOT, N.D. (AP) – A North Carolina man says he will plead guilty to a federal drug charge in North Dakota.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Roderick Harris is charged with four counts, including possession with intent to distribute methamphetamine. In exchange for pleading guilty to that charge, the government says it will drop the other three counts.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Harris, of Maxton, North Carolina, faces a maximum penalty of life in prison and a minimum sentence of 10 years behind bars.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Authorities charged Harris after a search of a Minot home turned up several pounds of meth, two stolen guns, $20,000 in cash and hundreds of prescription pills from a home.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Harris’ brother, Frederick Harris, has pleaded not guilty in federal court to drug and weapons charges. Frederick Harris is from Minot.<\/p>\n

\u00a0FARGO, N.D. (AP) – A federal judge has sentenced two men to more than three years in prison for distributing a powerful synthetic drug that led to numerous overdoses in the Grand Forks area.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Kain Schwandt and David Noye Jr. pleaded guilty earlier to conspiracy to possess with intent to distribute controlled substances. Authorities say the two men continued to deal powdered fentanyl after they knew that one of their customers died from an overdose.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 U.S. District Judge Ralph Erickson on Monday sentenced Schwandt to 42 months in prison and Noye to 39 months behind bars. The judge said the case is “as bad as it gets” for a drug conspiracy.

\n\u00a0\u00a0\u00a0\u00a0 Attorneys for the two defendants say their clients have taken responsibility for their actions and both have been model citizens since their arrests.<\/p>\n

\u00a0BISMARCK, N.D. (AP) – Attorney General Wayne Stenehjem (STEHN’-juhm) says the fundraising arm of North Dakota State University violated the state’s open records law.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Stenehjem said in a written opinion issued Monday that the North Dakota State University Development Foundation and Alumni Association violated state law when it refused to release the applications for people seeking to become its next president and CEO.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Stenehjem said The Forum newspaper in Fargo requested an opinion from the state after the foundation refused to release the original applications for the positions. A search firm hired by the foundation had removed any identifying information and was in possession of the original applications.
\n\u00a0
\n\u00a0\u00a0\u00a0\u00a0 Stenehjem said the search firm was acting as an agent of a public entity and was therefore subject to the open records law.

\u00a0BUFFALO, N.D. (AP) – North Dakota’s Health Department has extended a public comment period and scheduled a public hearing on a proposed 9,000-hog operation near Buffalo.

\n\u00a0\u00a0\u00a0\u00a0 The comment period will run to March 19, and an informational meeting and public hearing will be held March 17 at the Buffalo Senior Citizens building.

\n\u00a0\u00a0\u00a0\u00a0 Minnesota-based Pipestone Holdings LLC is planning the $15 million Rolling Green Family Farms hog facility. It needs a permit from the Health Department.

\n\u00a0\u00a0\u00a0\u00a0 Rolling Greens Family Farms spokesman Barry Kerkaert says the hog farm would create jobs, boost the local economy and not pose risks to the environment.

\n\u00a0\u00a0\u00a0\u00a0 Minot is one of 13 communities sharing in about $1 billion through the Housing and Urban Development’s National Disaster Resiliency Competition.

\n\u00a0\u00a0\u00a0\u00a0 The federal officials liked Minot’s proposals for a one-stop social service center, a technical education center, affordable housing and non-structural techniques to reduce flood risk.

\n\u00a0\u00a0\u00a0\u00a0 Minot’s application totaled nearly $183 million. That means other money is needed from private sources such as foundations to fully complete the work.

FARGO, N.D. (AP) – Junior guard Carlin Dupree has rejoined the North Dakota State basketball team, two weeks after leaving because he was unhappy with his role.<\/p>\n

Dupree said in a statement issued by the school Monday that he made “a selfish decision” and hopes he’ll be forgiven.<\/p>\n

Coach David Richman says Dupree is a member of the Bison family and will be supported. But he also says Dupree is returning with “some adjusted expectations,” and it hasn’t been decided whether he’ll play again this season.<\/p>\n

Before leaving, Dupree had played in 17 games and was averaging seven points, three rebounds and two assists. The Milwaukee native is best known for coming off the bench and scoring four straight points in overtime to spark an 80-75 win over Oklahoma in the 2014 NCAA Tournament.<\/p>\n

MINNEAPOLIS (AP) \u2013 Third baseman Trevor Plouffe and the Minnesota Twins have agreed to a $7.25 million, one-year contract to avoid arbitration.<\/p>\n

Plouffe gets a raise of $2.45 million under Monday\u2019s agreement. He hit .244 last season with 22 homers and a career-high 86 RBIs. He also set career bests in hits (140), runs (74) and games (152), solidifying himself in the middle of the Twins order.<\/p>\n

The settlement was $225,000 below the midpoint between the $7.9 million Plouffe had asked for in arbitration and the $7 million Minnesota had offered.<\/p>\n

Plouffe\u2019s development as a solid power hitter and capable defensive third baseman led the Twins to move prized prospect Miguel Sano to the outfield. Sano came up through the minors as a third baseman and mostly served as a DH in his 80 games with the Twins last year.<\/p>\n
