Cooperstown (CSi) The Griggs County States Attorney and Special Assistant Barnes County State\u2019s Attorney, Jayme Tenneson, has told the North Dakota Bureau of Criminal Investigation that he has declined prosecution of Valley City Attorney Russell Myhre concerning an allegation of serving alcohol to minors.<\/p>\n

Tenneson said after reviewing the materials including the statements, recorded interviews and reports, that he has made the decision to decline prosecution for the reason that \u201cI do not believe there is sufficient evidence to obtain a conviction with the standard of proof beyond a reasonable doubt.\u201d<\/p>\n

Myhre\u2019s attorney Joseph Larson said Myhre is gratified that he has been vindicated.<\/p>\n

He says the allegation made against Myhre was untrue and politically motivated and that Myhre\u00a0 will have no further comment regarding this matter.<\/p>\n

BISMARCK, N.D. (AP) – Moody’s Analytics says North Dakota is in recession, but Minneapolis Federal Reserve officials aren’t going that far.<\/p>\n

Moody’s says the pace of job gains in North Dakota is the lowest in half a decade. The oil slump has hurt the state’s economy, and Moody’s points to a “lack of strong growth drivers outside energy and agriculture” as a weakness.<\/p>\n

State government is trying to close a more than $1 billion spending gap blamed largely on slumping oil activity, through cuts mandated by Gov. Jack Dalrymple.<\/p>\n

But Minneapolis Fed Regional Outreach Director Joe Mahon\u00a0says the Fed’s forecast for North Dakota is for moderate growth over the coming year.<\/p>\n

He says overall the state seems to be growing, driven by major metropolitan areas such as Fargo.<\/p>\n

BISMARCK, N.D. (AP) – A Mandan man shot by Bismarck police last month is now formally accused of trying to escape from his hospital room.<\/p>\n

Twenty-six-year-old Travis Clark Jr. faces charges of escape and breaking into a vehicle. Both are felonies that carry a maximum sentence of five years in prison.<\/p>\n

Clark was shot by two Bismarck police officers on Jan. 31 after authorities say he ignored the officers’ commands and reached for what officers believed was a weapon.<\/p>\n

Authorities allege that while Clark was in the hospital on Feb. 7, he overpowered a private security officer, ran from the hospital and entered a vehicle. He later left the vehicle without incident and was returned to custody.<\/p>\n

The Associated Press requested comment from Clark’s attorney.<\/p>\n

FARGO, N.D. (AP) – Two Fargo police officers and the previous Fargo police chief say they are not liable in a lawsuit alleging that a woman was wrongly accused of possessing a meth pipe.<\/p>\n

Sarah Rhodes says in a federal civil rights complaint that police blamed her for a pipe that was thrown on the floor of the squad car by another suspect two days earlier. Rhodes was placed in the squad after she was pulled over for drunken driving.<\/p>\n

Rhodes says she suffered emotional trauma from the incident and it hurt her chances for a job promotion. She’s seeking at least $100,000.<\/p>\n

Officers Jamey Gahner (GAY’-ner) and David Cocharan and former chief Keith Ternes say in their response that police acted “reasonably, lawfully and with probable cause.” They want the case dismissed.<\/p>\n

BISMARCK, N.D. (AP) – The case of a flight attendant accused of using bomb threats to disrupt SkyWest flights he worked in the upper Midwest and on the East Coast last year might not make it to trial in either North Dakota or Virginia.<\/p>\n

Court documents show the Virginia case may be transferred to North Dakota. Prosecutor Gary Delorme says that would indicate a plea agreement or a change of plea might occur. He says cases generally don’t get transferred for trials.<\/p>\n

Justin Cox-Sever’s attorney says they’re “discussing all his options.”<\/p>\n

Cox-Sever is accused of making bogus bomb threats on a July flight from Charlottesville, Virginia, to Chicago, and on a September flight from Minneapolis to Dickinson, North Dakota. His North Dakota trial this week has been delayed until April.<\/p>\n

BISMARCK, N.D. (AP) – Declining oil activity is forcing North Dakota’s Transportation Department to make up for a more than $69 million projected shortfall in fuel tax collections, motor vehicle registrations and other fees.<\/p>\n

Transportation Director Grant Levi told the Legislature’s interim Transportation Committee on Tuesday that some planned road projects “probably” won’t get completed. He says the agency is looking at several cost-saving measures, including not filling about 20 positions and closing five of the state’s 28 rest areas.<\/p>\n

The cuts are unrelated to those the DOT and other state agencies submitted last week to help close a more than $1 billion spending gap blamed largely on slumping oil activity. DOT’s share of those cuts total more than $26 million.<\/p>\n

The Transportation Department has about 1,100 employees.<\/p>\n

BISMARCK, N.D. (AP) – North Dakota State University has been awarded a federal grant of more than $130,000 for agriculture research.<\/p>\n

North Dakota’s congressional delegation says the money will be used for pest-resistant wheat research at NDSU’s School of Natural Resource Sciences.<\/p>\n

The delegation says the goal is to help to prevent damage from pests and increase yields.<\/p>\n

The federal funds are made available by the Agriculture and Food Research Initiative grant program through the U.S. Department of Agriculture.<\/p>\n

BISMARCK, N.D. (AP) – A lottery game played in some northern states for nearly two decades is ending, due to a drop in popularity.<\/p>\n

Wild Card 2 currently is played in North Dakota, South Dakota, Montana and Idaho. The game dates to 1994, and lottery officials in the participating states say it’s run its course. The final drawing is Wednesday.<\/p>\n

Through the years, the game that also was played for a brief time in Nebraska has had dozens of jackpot winners and paid out tens of millions of dollars in prizes.<\/p>\n

The jackpot for the final drawing is $375,000. If there’s a winner, the person will have six months to claim the prize, as usual. If no one wins it, remaining funds will be divided among the four participating states.<\/p>\n

Jametown (CSi) University of Jamestown men’s hockey coach Dean Stork announces the signing of Nicholas Kovacik of Kelowna, British Columbia, who will join the Jimmies in the 2016-17 season.<\/p>\n

Kovacik is a 5′ 10″, 185 pound forward currently playing for the Creston Valley Thunder Cats of the Kootenay International Junior Hockey League. In 45 games this season, Kovacik has 7 goals and 12 assists with 44 penalty minutes.<\/p>\n

“Nicholas is one of the smartest and hardest-working centers I have seen from the KIJHL,” said Stork. “The character shines extremely bright in this individual. He is a natural born leader both on the ice and off the ice. He is an excellent penalty killer and possesses a relentless attitude towards blocking shots and paying the price for his teammates to win a hockey game. I believe Nicholas has not even tapped into his offensive abilities yet and that’s what I will do to help him in his development with UJ hockey.”<\/p>\n

MINNEAPOLIS (AP) – The Minnesota Timberwolves say Nikola Pekovic is out indefinitely as he recovers from right Achilles surgery he underwent last April. The Timberwolves gave an update on Pekovic’s condition after he missed his eighth straight game on Monday night. The big man from Montenegro has played in just 12 games this season after a surgery that was viewed then as a last-ditch effort to relieve chronic pain in his right foot.<\/p>\n

MEMPHIS, Tenn. (AP) – The Memphis Grizzlies say they will spend the rest of the NBA season without center Marc Gasol (gah-SAHL’) because of a broken right foot that required surgery. Gasol played the Grizzlies’ first 52 games before coming out of a Feb. 8 game against Portland because of the injury.\u00a0 He was averaging 16.6 points and 7.0 rebounds this season to help Memphis grab the fifth spot in the Western Conference standings.<\/p>\n

OKLAHOMA CITY (AP) – Kyrie (KY’-ree) Irving has received an apology from Hilton Hotels after the Cleveland Cavaliers guard said he was bitten by bed bugs during his stay in Oklahoma City last weekend.
\nIrving played just nine minutes the next day and later said it was because he discovered the bugs and slept on the couch instead of his bed. He said he had just three hours of sleep and had tightness in his back afterward.<\/p>\n

PHOENIX (AP) – Brewers manager Craig Counsell is looking to set the tone by doing things a bit differently than some players are used to. Counsell is planning to have his pitchers handle the ball a lot and focus on defense before full squad workouts begin Thursday. Counsell became the 19th manager in franchise history when he took over for Ron Roenicke last May.<\/p>\n

SAN DIEGO (AP) – The San Diego Chargers say they want to focus on getting a new stadium built as part of a non-contiguous expansion of the downtown convention center.<\/p>\n

The measure could face strong opposition if any funding would require approval of two-thirds of the voters on the November ballot.<\/p>\n

Mayor Kevin Faulconer and County Commissioner Ron Roberts had preferred a new stadium be built at the site of aging Qualcomm Stadium in Mission Valley.<\/p>\n

WHITE PLAINS, N.Y. (AP) – The roster for the U.S. Davis Cup team has been announced. John Isner (IHZ’-nur), Jack Sock and the Bryan twins will represent the United States against Australia in the first round of play next month.<\/p>\n

The winner of this first-round matchup will face Belgium or Croatia in the quarterfinals in July.<\/p>\n
