He offered mediation on behalf of Genesis Mediation regarding conflicts and grievances filed against city government officials. He explained the process with those involved in the conflicts. He noted that the mediation service fees will be charged to the city.<\/p>\n<p>The city will hire its own attorney.<\/p>\n<p>ORDINANCES:<\/p>\n<p>Approved the first reading of an Ordinance repealing, amending, and reenacting Chapter 1, General Provisions of the revised ordinances of the City of Valley City, North Dakota.<\/p>\n<p>City Attorney Myhre said the Ordinance is part of the re-codification process.<\/p>\n<p>It addresses criminal offenses and specifies what category various crimes will be considered, for example a misdemeanor. It does not currently specify a specific penalty schedule, as Myhre said that would be left up to the Municipal Judge.<\/p>\n<p>Commissioner Luke asked for that to be included in the Ordinance.<\/p>\n<p>NEW BUSINESS:<\/p>\n<p>City Commissioners heard the Bright Energy Solutions annual report from Marcy Douglas.<\/p>\n<p>The rebate program was explained, programmed specifically for Valley City.<\/p>\n<p>She said the Cash Rebate Program is geared to reduce peak electrical usage, demand.<\/p>\n<p>She pointed out the city\u2019s distribution of energy savings light bulbs.<\/p>\n<p>She outlined various energy efficient programs available to residential and commercial customers.<\/p>\n<p>She said Valley City has reached its energy savings goal, each year since the implementation in 2010.<\/p>\n<p>City Commissioners approved the 2016 Public Works Capital Budget.<\/p>\n<p>Approved a sidewalk contract for 2016 with Lynn Johnson. City Administrator Schelkoph said the contract concerns replacing city sidewalks, and the Commission approved a contract.<\/p>\n<p>City Commissioners approved continuing the forestry contract with Willis Wagar for the 2016 summer season. His salary is increase 1.3 percent, at $6,400 for the summer month work.<\/p>\n<p>Approved replacing the Public Works snow blower for a new Tenco 202 from Swanston Equipment in the amount of $128,600 with trade. City Administrator Schelkoph said the present 10 year old blower lost an engine bearing this past year. A dump truck purchase will be held off in order to purchase the snow blower.<\/p>\n<p>The Commissioners approved a request from Valley Development Group to approve releasing $50,000 for an economic development project to proceed. Valley City Barnes County Economic Development Corporation would not release the name of the company under consideration.<\/p>\n<p>The Dollars would come from the economic developement fund, with additional funding being secured.<\/p>\n<p>The location under consideration would occupy the Northwest Industrial Park Building the former John Deere location. Enhancements are planned for the building.<\/p>\n<p>She said the business would employee 7-10 full time jobs at $15-$16 per hour, with benefits.<\/p>\n<p>She said the Barnes County Commission has approved releasing the $50,000.<\/p>\n<p>CITY ADMINISTRATORS REPORT<\/p>\n<p>David Schelkoph noted the City of\u00a0Valley\u00a0City\u00a0has received a Water Quality Award, and added that officials with Flood Control America will be in Valley City to instruct workers on installing the aluminum planks for the permanent flood control project.<\/p>\n<p>City Fire Chief Retterath reminded resident to check their smoke detector batteries and that the units works.<\/p>\n<p>KLJ reported that the flood control wall project along Viking Drive is progressing and is expected to be completed in that area in 4-6 weeks.<\/p>\n<p>CITY UPDATE &amp; COMMISSION REPORTS<\/p>\n<p>Mayor Werkhoven said he will be in attendance at the Upper Sheyenne Basin meeting, Wednesday at 9-a.m., at the Valley City Eagles Club<\/p>\n<p>The meeting was shown live on CSi Cable 68 followed by replays<\/p>\n<p>JAMESTOWN, N.D. (AP) &#8211; A Killdeer woman accused of causing a crash that killed a man and injured another last year has been sentenced.<\/p>\n<p>Southeast Judicial District Judge John Greenwood sentenced 19-year-old Ashley Birkle to two days in jail and two years of probation after she pleaded guilty to negligent homicide and possession of alcohol as a minor.<\/p>\n<p>The crash occurred on Feb. 2, 2015, on Interstate 94 near Jamestown. The Highway Patrol says Birkle&#8217;s vehicle crossed the highway median and struck a pickup, killing 61-year-old David Herold, of Garfield, Minnesota, and injuring Matthew Schroeder, of Dalton, Minnesota.<\/p>\n<p>Birkle told authorities she had fallen asleep. Investigators found text messages she had sent while on the road, but couldn&#8217;t determine she was texting when the crash happened.<\/p>\n<p>Greenwood also ordered Birkle to complete 80 hours of community service.<\/p>\n<p>Jamestown (CSi) Jamestown Police wants to warn residents that a convicted sex offender has changed Jamestown addresses.<\/p>\n<p>Brandon Scott Schafer now resides at 219 \u00bd 7<sup>th<\/sup> Avenue Southeast.<\/p>\n<p>His vehicle is a maroon 1997 Ford Mustang, with ND license plate, EUH901<\/p>\n<p>He is a White male, 6 feet tall weighing 140 pounds with hazel eyes and brown hair.<\/p>\n<p>Schafer has been assigned a High Risk Assessment by the North Dakota Risk Level Committee, of the North Dakota Attorney General\u2019s Office.<\/p>\n<p>Schafer was convicted of Gross Sexual Imposition, involving a 13 year old female friend.<\/p>\n<p>The report says, no force was used.<\/p>\n<p>The conviction date was July 19, 2012 in Ransom County District Court.<\/p>\n<p>The disposition was 366 days, 282 days suspended, 5 years supervised probation.<\/p>\n<p>He is currently on probation with North Dakota Parole and Probation.<\/p>\n<p>Schafer is not wanted by police at this time, and has served the sentence imposed by the court.<\/p>\n<p>This notice is meant for public safety and not to increase fear in the community, nor should this information be used to threaten, assault, or intimidate the offender.<\/p>\n<p>Attempts to harass, intimidate or threaten these offenders, families, landlords, or employers will be turned over for prosecution.<\/p>\n<p>Printed handouts of Schafer\u2019s photo and demographics are available at the Jamestown Police Department.<\/p>\n<p>More information on registered offenders is available at the North Dakota Attorney General\u2019s web site: <a href=\"http:\/\/www.sexoffender.nd.gov\/\">www.sexoffender.nd.gov<\/a><\/p>\n<p>Jamestown Police also report that<\/p>\n<p>a convicted sex offender has changed Jamestown addresses.<\/p>\n<p>Anthony Allen Rolland is now sleeping in his car located at the 100 block of 1st Street West (city parking lot) Jamestown ND.<\/p>\n<p>More information posted on line at CSiNewsNow.com<\/p>\n<p>Bismarck (CSi) The North Dakota Aeronautics Commission reports that Jamestown Regional Airport boardings in February this year increased over a year ago.<\/p>\n<p>The report says the February 2016 boardings were 892 compared to 798 in 2015.<\/p>\n<p>Through February 2016 Jamestown boardings were 1,814 compared to 1,382 the first two months of 2015.<\/p>\n<p>Jamestown (CSi) The Veterans Administration is offering programs regarding health care issues.<\/p>\n<p>On Tuesday\u2019s Wayne Byers Show on CSI Cable 2, Stutsman County Veterans Service Officer, David Bratton said, the VA has announced the Community Care Center to help vets with Choice Program billing.<\/p>\n<p>He pointed out that March is Traumatic Brain Injury Awareness Month, pointing out that the VA has a Registry for treatment for TBI.<\/p>\n<p>He added that the VA\u2019s Call to Action program is geared to end veterans suicides, with a reported 22 per day. He said the program emphasizes same-day attention for those that are suicidal.<\/p>\n<p>He added that the Veterans\u2019 Crisis Line is available 24\/7 at 1-800-273-8255.<\/p>\n<p>He said that the PTSD group meeting at the LEC in Jamestown is every 2<sup>nd<\/sup> and 4<sup>th<\/sup> Thursday of the month from 12:30 p.m., to 2-p.m., with a combat veteran from the VA in Fargo hearing concerns and offering support and programs available.<\/p>\n<p>He said that the VA\u2019s Healthcare enrollment for pending applications has been extended one year.<\/p>\n<p>He reminded veterans that the Burleigh County van makes stops in Jamestown for Stutsman County vets to go to the VA in Fargo and back. His office in the basement of the Law Enforcement Center in Jamestown has more information on the availability of the van by calling 701-252-9043.<\/p>\n<p>Bratton noted that March 29 is Vietnam Veterans Day is March 29<sup>th<\/sup> each year, which coincides with the date in 1973 when the last American troops left Viet Nam at the conclusion of the American involvement in the war.<\/p>\n<p>He noted that he will not be in the office from March 21-23 for training. Anyone wishing an appointment should work around those dates, or call the office to leave a message that he can return when he gets back.<\/p>\n<p>&nbsp;<\/p>\n<p>Valley City (CSi) The topic of Deep Bore Hole Drilling will be on the agenda, at the Upper Sheyenne Basin meeting, this morning at 9-a.m., at the Valley City Eagles Club.<\/p>\n<p>A research project, part of an $80 million Federal Energy Department project is looking at if deep rock is suitable for nuclear waste disposal.<\/p>\n<p>Officials have emphasized that at this time no nuclear waste will be disposed of near Rugby and test holes will be plugged.<\/p>\n<p>However resident in several counties are skeptical, and petitions in opposition have been given to Pierce County, for a permanent deep hole drilling ban.<\/p>\n<p>Pierce County planners are recommending a permanent ban on deep bore hole drilling to stop the federal project in that county.<\/p>\n<p>Other counties proposed for this deep bore hole drilling project include Barnes, Burleigh and Wells counties in North Dakota.<\/p>\n<p>Valley City Mayor, Bob Werkhoven met with members of the Upper Sheyenne Basin in Carrington last month to express concerns with deep bore hole drilling.<\/p>\n<p align=\"center\">Valley City (CSi) &#8211; Paleontologists from the North Dakota Geological Survey will began setting up a new display at the Barnes County Museum in Valley City beginning on Tuesday.The new exhibit will feature many different types of fossils, some of which would have been typical plant and animal life of eastern North Dakota millions of years ago.<\/p>\n<p>Clint Boyd, Senior Paleontologist with the Geological Survey says, &#8220;In addition to having specimens from eastern North Dakota, like some of the mosasaur fossils that are found there, we are really excited to feature specimens from other parts of the state as well. One of the most exciting pieces that will be on display comes from a recent find this summer of a duck-billed dinosaur rib with bite marks.&#8221;<\/p>\n<p>The overall exhibit will also feature a full cast of a <i>Triceratops <\/i>skeleton, which was originally constructed in Valley City, has recently been out on loan, and is being returned from Tennessee. Museum curator Wes Anderson is happy to see the cast return to fill a void from a previous fossil display that left the museum at the end of 2015.<\/p>\n<p>Museum Director, Wes Anderson adds, &#8220;It\u2019s a wonderful opportunity to partner with the state to provide a great experience and understanding of the history of North Dakota for our visitors and our community. This allows us to better tell the story of eastern North Dakota and augment our display capabilities.&#8221;<\/p>\n<p>The three person paleontology team will work for most of the week with staff and volunteers from the Barnes County museum to get the exhibit in place and ready for viewing. An official unveiling will be announced at a later date- but the fossils should be ready for the public to view as early as Thursday this week.<\/p>\n<p>Jamestown (CSi) A committee has been formed in an attempt to resolve a disagreement between the Stutsman County Commission and South Central Dakota Regional Council.<\/p>\n<p>The committee will include members from the County Commission, Regional Council and Jamestown\/Stutsman Development Corporation.<\/p>\n<p>The committee Commission Chairman Mark Klose following a discussion with Joe Neis, chairman of the Regional Council and Deb Kantrud, executive director of the Regional Council.<\/p>\n<p>The County Commission had been asked to reconsider paying dues to the Regional Council after voting in September not to include the dues in the 2016 budget.<\/p>\n<p>Klose said communication between the Regional Council and the County Commission was part of the problem.<\/p>\n<p>&nbsp;<\/p>\n<p>MINOT, N.D. (AP) &#8211; A child care operator charged with negligent homicide in the drowning death of a 5-year-old Velva girl has reached a plea agreement with prosecutors.<\/p>\n<p>The \u00a0deal calls for 45-year-old Heather Tudor to plead guilty to operating without a daycare license and child neglect in exchange for probation and no jail time. Prosecutors would drop the negligent homicide charge.<\/p>\n<p>Judge Laurie Fontaine will decide Monday whether to approve the deal.<\/p>\n<p>Tudor was operating a day care last June when Gracelyn Aschenbrenner was found unresponsive in Velva&#8217;s city pool. She remained on life support for nearly a month before dying.<\/p>\n<p>Five current and former officials with the state Department of Human Services also face charges related to the case, along with a McHenry County social worker.<\/p>\n<p>&nbsp;<\/p>\n<p>FARGO, N.D. (AP) &#8211; The North Dakota Supreme Court has overturned the conviction of a man who was tried last year on a drunken driving charge that was 20 years old.<\/p>\n<p>Jason Gale was arrested for DUI in 1995 in Grand Forks but wasn&#8217;t called to court until last July, when a jury found him guilty of the charge. Defense attorney Scott Brand successfully argued to justices that the delay violated Gale&#8217;s right to a speedy trial.<\/p>\n<p>The opinion says a Grand Forks judge did not address the city&#8217;s effort in pursuing Gale&#8217;s proceedings, and justices cannot presume that a 20-year-old case was &#8220;diligently prosecuted when there is no evidence of any prosecution at all.&#8221;<\/p>\n<p>The Supreme Court says two decades is an unprecedented amount of time for a DUI case to remain idle.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; The maker of MAC industrial heaters has let go of most of its Bismarck workforce and is closing the facility there this summer.<\/p>\n<p>50 employees were laid off Feb. 17, with the remaining 23 employees at the Bismarck plant losing their positions between now and July 29.<\/p>\n<p>MAC Inc. was purchased in 2014 by Wisconsin-based Generac Holdings Inc. Gordon Michaelson, vice president of mobile operations, said in a statement that Generac decided to consolidate manufacturing operations, resulting in the closure of its Bismarck facility.<\/p>\n<p>MAC came to Bismarck in 2010.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; The two competing hospitals in Bismarck will be working together in the wake of the announcement by CHI St. Alexius Health earlier this week that it&#8217;s closing two departments and laying off workers.<\/p>\n<p>The hospital is shuttering its inpatient pediatric and rehab units by the end of the week, laying off 23 employees and reassigning another 39 to other areas of care. Officials cite a changing health care environment and low patient numbers in the two units.<\/p>\n<p>CHI St. Alexius CEO and President Kurt Schley says the hospital is working with Sanford Health to transfer patients from the pediatric unit.<\/p>\n<p>Sanford CEO and President Craig Lambrecht says that hospital also is in &#8220;hiring mode&#8221; and would welcome applications from St. Alexius workers who are losing their jobs.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; Attorney General Wayne Stenehjem says the North Dakota Health Council broke open records and meetings laws by failing to provide sufficient notice of a public meeting.<\/p>\n<p>Stenehjem says the council failed to give public notice of its August 2015 meeting at the same time its members were notified. The meeting date was determined three months in advance but the notice wasn&#8217;t posted until 13 days before the meeting.<\/p>\n<p>The complaint was filed by Don Morrison, executive director of the Dakota Resource Council, and Darrell Dorgan, a member of the North Dakota Energy Industry Waste Coalition.<\/p>\n<p>Stenehjem ordered the state Health Council to provide the minutes free of charge to Morrison, Dorgan and anyone else who requests them.<\/p>\n<p>&nbsp;<\/p>\n<p>GRAND FORKS, N.D. (AP) &#8211; Supporters of a University of North Dakota music program that is being suspended due to budget woes are asking higher education officials to reconsider the move.<\/p>\n<p>The music therapy program uses music to help clients who are undergoing various forms of treatment. There are currently 48 students in the program.<\/p>\n<p>Music therapy students Jenna Tullis and Melea Hoeffner (muh-LEE&#8217;-ah HEFF&#8217;-ner) appealed to state Board of Higher Education members Tuesday to save the curriculum. They say its loss would be detrimental to the entire music department.<\/p>\n<p>The director of the program, Meganne Masko, told the board that 100 percent of graduates have found jobs, typically at institutions like retirement homes, hospitals and schools.<\/p>\n<p>Board president Kathleen Neset says the board will ask UND administrators to take another look at its decision.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; A group says it will push a ballot measure to increase North Dakota&#8217;s tobacco taxes.<\/p>\n<p>The coalition is called Raise it for Health North Dakota and is backed by the American Lung Association in North Dakota and other groups.<\/p>\n<p>The coalition says it will release details Wednesday at the state Capitol.<\/p>\n<p>North Dakota ranks 47th among states in the amount of tax smokers pay.\u00a0 Retailers have successfully fought off several attempts to raise the state&#8217;s tobacco tax in the past two decades. The last increase was imposed in 1993.<\/p>\n<p>State lawmakers defeated two efforts to raise the tobacco taxes in 2015.<\/p>\n<p>&nbsp;<\/p>\n<p>GRAND FORKS, N.D. (AP) &#8211; A former Republican congressman from Minnesota has been tabbed as the new president of the University of North Dakota. The state Board of Higher Education voted to offer the job to Mark Kennedy, the director of the Graduate School of Political Management at George Washington University in Washington, D.C. Kennedy was in Congress from 2001 through 2007.<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; North Dakota continues to see bleaker-than-expected state tax revenue collections from declining oil activity in the state. Office of Management and Budget Director Pam Sharp told a panel of lawmakers that tax collections already are down $6.4 million since January. Gov. Jack Dalrymple on Feb. 1 ordered cuts in state government and a raid on a rainy day fund to make up for more than $1.1 billion in shortfalls.
