Attorney Myhre<i> <\/i>said the action is part of the city\u2019s recodification process.<\/p>\n<p>Approved the first reading of an amended Ordinance to correct a typo,creating a Perpetual Restrictive Covenant where properties were removed in accordance with the State Water Commission.<\/p>\n<p>Attorney Myhre the State Water Commission requires the Covenant concerning properties purchased under Permanent Flood Protection.<\/p>\n<p>Approved the first reading of an Ordinance rezoning NDDOT property located at from &#8220;N\/A&#8221; to B-2 Highway Business District. Attorney Myhre said the rezoning is required in conjunction with the new PetroServe, near the Interstate.<\/p>\n<p>Approved the first reading of an Ordinance repealing, amending and reenacting Title 2, Administration, of the revised ordinances of the City of Valley City. Attorney Myhre said the Ordinance is also a part of recodification, with new changes to existing document.<\/p>\n<p>The City Auditor\u2019s position will now be titled City Finance Director.<\/p>\n<p>Commission Luke asked that under the Ordinance that the City Administrator have an annual review, by June 30<sup>th<\/sup> each year, on job performance, by the mayor. Commissioner Nielson suggested input from City Commission members which was included in the Ordinance.<\/p>\n<p>\u3000<\/p>\n<p>Approved the first reading of an Ordinance repealing, amending, and reenacting Title 8, Business &amp; Occupations of the revised ordinances of the City of Valley City, North Dakota. Attorney Myhre said there are no major changes, however the revisions include bringing city licenses into one chapter. E-Cigarettes also regulated by the state, would be included with tobacco products.<\/p>\n<p>Licensing of taxis or Ubber would be regulated.<\/p>\n<p>\u3000<\/p>\n<p>.<\/p>\n<p>RESOLUTIONS<\/p>\n<p>Approved a Resolution awarding construction contract for Water Main Improvement District No. 98. KLJ recommends awarding the contract to Sherman\u2019s of West Fargo, in the amount of $899,539. City Administrator Schelkoph said the property owner is no longer living at the property. He said the parcel in within the flood buyout area.<\/p>\n<p>The City Commission approved starting the property buyout process.<\/p>\n<p>The City Commission selected Pedersen a commissioner, to be on the Planning and Zoning Board to replace Commissioner Magnuson who stated a conflict of interest on the board. This is a required position on the board.<\/p>\n<p>Discussion was held concerning Water Treatment Plant Costs. Commissioner Luke said there are no quality concerns, and noted the increases over the previous lime pit use.<\/p>\n<p>She said city engineers and NDSU authorities are looking into why there are issues as to why the water needs the amount of treatment it\u2019s receiving.<\/p>\n<p>No action was taken by the Commission.<\/p>\n<p>CITY ADMINISTRATORS REPORT No Report.<\/p>\n<p>\u3000<\/p>\n<p>CITY UPDATE &amp; COMMISSION REPORTS<\/p>\n<p>City Auditor Richter said the 2007 bonds are up for refinancing, and a bond sale by the end of this month.<\/p>\n<p>City Assessor Hansen noted that the City Board of Equalization meeting is Tuesday April 12, 2016, at 4-p.m., at City Hall.<\/p>\n<p>City Fire Chief Retterath said the city will partner with the Red Cross in getting more smoke dtectors in homes. He said city hall has information on the safe use of fire pits.<\/p>\n<p>The new city fire truck will be put into service on Wednesday.<\/p>\n<p>KLJ reported that the storm sewer project will start next week, at 8th Avenue Southwest, which will be closed.<\/p>\n<p>The Flood Wall project on College Street contiues and the new pump is operational by the city.<\/p>\n<p>The meeting was shown live on CSi Cable 68, followed by replays.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) The Spiritwood Energy Park Association has been informed that there are three value-added agriculture companies showing an interest in locating in the Spiritwood Energy Park.<\/p>\n<p>SEPA chief operating officer and CEO of the Jamestown\/Stutsman Development Corporation, Connie Ova and Rich Garman Sr., project manager, discussed with the association Tuesday how they are getting the word out about SEPA and its many benefits for companies looking to build new near major transportation lines.<\/p>\n<p>Ova said she would have more information about the three value-added agriculture companies after the next JSDC Board of Directors meeting on April 11.<\/p>\n<p>She said that she and Garman are using every resource available to promote the Energy Park.<\/p>\n<p>\u3000<\/p>\n<p>In other business, the Spiritwood Energy Park Association heard a report from Jeff Zueger, chief operating officer for Midwest AgEnergy, a parent company of Dakota Spirit AgEnergy, on the ethanol plant. He said the facility is running as expected and he is expecting a possible increase in use after the U.S. Department of Agriculture released its crop-planting intentions report last week.<\/p>\n<p>Connie Ova said that she would like to have SEPA have an ex-officio member of the JSDC Board of Directors. An ex-officio member attends and participates in board meetings, but has no voting power. Ova said the JSDC Board of Directors will consider the idea at its next meeting.<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) The Stutsman County Commission has approved paying the county\u2019s share of $34,824 in annual fees to be a member of the South Central Dakota Regional Council.<\/p>\n<p>The approval is stipulated on the Regional Council presenting a policy on bad debts and a policy on fund balance. Stutsman County auditor\/chief operating officer, Casey Bradley, said the council is progressing on getting those policies together.<\/p>\n<p>The County Commission and City Council split the $34,824 fee, with the county\u2019s share being $12,885. Stutsman County\/city of Jamestown pays 33 percent of the total membership fees, making it the largest dues-paying member of the nine-county Regional Council.<\/p>\n<p>In other business, the County Commission unanimously approved placing County Measure 1 on the June 14 primary election ballot. County voters will decide if the Stutsman County state\u2019s attorney position, which is currently held by Fritz Fremgen, will become an appointed position that is appointed by the County Commission or remain an elected position.<\/p>\n<p>The County Commission approved in November having Bradley put together ballot language on the issue after having expressed some concerns about how Fremgen was running the office, including allegations that he created a hostile work environment.<\/p>\n<p>The County Commission also approved a letter of support requested by the Jamestown Regional Airport Authority for having SkyWest Airlines stay as the commercial passenger jet service provider to the airport. SkyWest Airlines and Great Lakes Aviation are two companies bidding for an Essential Air Service contract for 2016 to 2018. SkyWest holds the current EAS contract, which expires at the end of June.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; A 55-year-old Bismarck man is in custody on suspicion of murder.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Police responded to an apartment building shortly before 9 p.m. Tuesday after a building employee reported finding a tenant dead in his apartment.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Police said the death of 61-year-old Greg Comes is suspicious. An autopsy is being performed to determine the cause of death.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Officers arrested the suspect at the scene. He was jailed pending formal charges and an initial court appearance. He also is facing a terrorizing charge filed earlier in Burleigh County and is set to stand trial next month.<\/p>\n<p>&nbsp;<\/p>\n<p>LINCOLN, N.D. (AP) &#8211; Bond has been set at $75,000 cash for a Lincoln man accused of trying to kill a woman by hitting her in the head with a rock and choking her.<\/p>\n<p>Forty-four-year-old Arthur Crissler faces an attempted murder charge and two other felonies that together carry a maximum punishment of 30 years in prison.<\/p>\n<p>Court documents don&#8217;t list an attorney for Crissler, and a home telephone listing for him could not be found.<\/p>\n<p>Court documents say the 41-year-old woman was able to get away on Friday night and flag down a passing motorist when Crissler went inside a residence to allegedly get a gun.<\/p>\n<p>Crissler is on federal probation for a 2007 drug-related conviction.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>WILLISTON, N.D. (AP) &#8211; A former Williams County corrections officer faces more than a dozen years in federal prison after pleading guilty to a child pornography charge.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 49-year-old Steve Brooks, of Williston, reached a deal with prosecutors that calls for a 14-year prison term.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 U.S. District Judge Daniel Hovland must agree. Brooks is to be sentenced June 20.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The nine-year veteran of the county sheriff&#8217;s office was fired after his arrest in May 2015.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0GRAND FORKS, N.D. (AP) &#8211; Fargo police say a 23-year-old man has been arrested in a drug bust on the city&#8217;s north side that yielded numerous narcotics, weapons and counterfeit bills.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Authorities recovered methamphetamine, heroin, fentanyl, marijuana, ecstasy, LSD, various painkillers, testosterone and anabolic steroids. Jack Dalrymple has rejected a request by Democratic leaders who believe a special session is needed to deal with the state&#8217;s projected budget shortfall. The governor said in a statement to The Associated Press that a special session is not necessary and there is a &#8220;plan in place&#8221; that will guide the state through the end of the year. (AP) &#8211; A Fargo businessman and entrepreneur is the Libertarian Party candidate for North Dakota governor. Marty Riske is the former chairman of the state&#8217;s Libertarian Party who owns numerous video stores and hair salons. He began his business career in 1971 when he founded a chair of waterbed and furniture stores in six North Dakota cities.<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; North Dakota Governor Jack Dalrymple is among the featured speakers at the state&#8217;s first demographics conference. The conference is scheduled Wednesday on the campus of Bismarck State College.<\/p>\n<p>&nbsp;<\/p>\n<p>In sports\u2026<\/p>\n<p>Jamestown (CSi) University of Jamestown head men&#8217;s basketball coach Danny Neville has announced the signing of Elijah Kess, who will join the Jimmies in the 2016-2017 season.<\/p>\n<p>This past year, Kess, a 6&#8242; 0&#8243; guard, averaged 10 points, 3 rebounds, and 3 assists per game\u3000for Trinidad State College, a Division 1 junior college in Colorado. Elijah also shot 41% from three-point range. \u3000As a freshman, Kess averaged 7 points, 3 rebounds and 3 assists. He played his high school ball at Lake Clifton High School in\u3000Baltimore, MD.\u3000\u3000<\/p>\n<p>Coach Neville says of Kess, &#8220;Elijah had a great career at Trinidad State College. He was a two-year starter who\u2019s a tough and hard-nosed competitor. He will bring toughness and leadership to our team.
