TEMPERATURES WILL LIKELY RISE<\/p>\n<p>INTO THE UPPER 60S AND 70S AS A RESULT.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Jamestown (CSi) A three member panel, was sworn in Wednesday morning, at the lower level meeting room at City Hall, as the Jamestown Civil Service Commission followed by an appeals hearing.<\/p>\n<p>They include:<\/p>\n<p><dir><dir>Amie Aesoph<\/dir><\/dir>Kevin Gebhardt<\/p>\n<p>Jon Lillejord (Chairman)<\/p>\n<p>&nbsp;<\/p>\n<p>\u3000<\/p>\n<p>The hearing stems from the termination of Jamestown Police officer Thomas Nagel.<\/p>\n<p>He was represented at the public meeting by attorney Joe Larson, who gave opening statements.<\/p>\n<p>Larson, said the case was about Facebook and how easily it could be hacked or manipulated.<\/p>\n<p>Scott Forsberg, the attorney Representing the city of Jamestown, said the issue was not the Facebook page but about the deceptive way Nagel responded to questions about the incident.<\/p>\n<p>A computer forensic examiner, Don Meinke testified that the information he had seen could not be verified as coming from a specific Facebook account.<\/p>\n<p>Larson called five witnesses through the morning, including two polygraph experts who testified that Nagel truthfully answered &#8220;no&#8221; to questions about being the source of the information to KVLY News, Whistleblower segment or that the information was discussed with another officer or discussed by the Fraternal Order of Police.<\/p>\n<p>&nbsp;<\/p>\n<p>During the afternoon session, called Nagel to the stand. Nagel testified that he had never told anyone that he knew who had made the anonymous tip or violated any JPD policies or the Law Enforcement Code of Ethics.<\/p>\n<p>Nagel testified during rebuttal that the others were &#8220;confused&#8221; and everyone had been pointing a finger at him.<\/p>\n<p>He said he hoped he could be reinstated to the Jamestown Police Department.<\/p>\n<p>On the stand, Jamestown Police Chief Scott Edinger, testified that Nagel had told him and at least four other police officers that he knew who had sent the tip but would not tell them. Edinger said he also placed no value in lie detector testing.<\/p>\n<p>\u3000<\/p>\n<p>City Attorney Leo Ryan, who served as counsel to the Civil Service Committee and presided over the hearing, said the committee can either affirm the termination, reinstate Nagel to who his former position or take any other action it deems justified.<\/p>\n<p>\u3000<\/p>\n<p>Both sides of the case have one week to submit written closing arguments and a proposed finding of fact for the Civil Service Committee to consider. The committee will likely reconvene in about two weeks to deliberate and make a ruling.<\/p>\n<p>\u3000<\/p>\n<p>Nagel was terminated on March 9, 2016, with letter of termination signed by Jamestown City Administrator Jeff Fuchs and Jamestown Mayor Katie Andersen. Andersen and Fuchs hold the &#8220;appointing authority&#8221; under the Jamestown Civil Service ordinance and was based their letter of termination and on Police Chief Scott Edinger\u2019s and the review board\u2019s recommendations.<\/p>\n<p>The review board, consisting of four police officers and one private citizen, recommended terminating Nagel for violating 19 policies.<\/p>\n<p>The termination resulted from internal investigations conducted by the Jamestown Police Department and the Stutsman County Sheriff\u2019s Office after an anonymous tip was made to the KVLY Valley News Live Whistleblower Hotline alleging a sheriff\u2019s deputy and the son of the sheriff were improperly using a Jet Ski owned by Stutsman County. Stutsman County does not own a Jet Ski, and the allegations were proven to be false. The investigations attempted to ascertain who made the allegations and if any violations of department policy or of the North Dakota Peace Officer\u2019s Code of Conduct occurred.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>\u3000<\/p>\n<p>VALLEY CITY, N.D. (AP) &#8211; Valley City police say a bone found by a crew of workers that was originally thought to be human was actually from a raccoon.<\/p>\n<p>Police Chief Fred Thompson said Wednesday that officers photographed the bone and sent the pictures to the State Medical Examiner&#8217;s Office in Grand Forks, which initially determined it was a radius bone. But an in-person examination by a physician has determined that the bone is from a raccoon.<\/p>\n<p>The state&#8217;s Historical Society and the Tribal Historic Preservation Office had been involved in the investigation because the bone was found near Native American burial grounds.<\/p>\n<p>Thompson said the appropriate agencies have been notified and the case is now closed.<\/p>\n<p>\u3000<\/p>\n<p>\u3000<\/p>\n<p>Jamestown (CSi) Stutsman County Emergency Manager Jerry Bergquist reports that Stutsman County participated in the simulated state-wide tornado exercise Wednesday morning, April 27, 2016 as part of Severe Summer Weather Awareness Week.<\/p>\n<p>The exercise began at 11:15 a.m. with a test tornado warning initiated by the National Weather Service. As part of the exercise, the county&#8217;s emergency operations plan was tested, which includes activating siren systems for several communities in the County. The sirens in Medina, Buchanan, Cleveland and Streeter proved to be operational and ready for the summer weather season. Jamestown sirens were also tested; however, the siren located at Lakeside Marina malfunctioned. An effort is underway to get the marina siren repaired and ready for use.<\/p>\n<p>In addition, the National Weather Service activated its All Hazards Radio System, which allowed local radio stations and cable TV providers to test their Emergency Alert Systems.<\/p>\n<p>The CodeRED Weather Warning system that Stutsman County subscribes to was NOT part of the exercise. CodeRED is designed to warn individuals that have addresses located within a warned area. Since the simulated tornado warning did not identify specific warned boundaries, the system did not activate. For those needing assistance to register, contact Stutsman County Emergency Management at 701-252-9093.<\/p>\n<p>\u3000<\/p>\n<p>Jamestown (CSi) Jamestown City Fire Chief, Jim Reuther, says, with the information collected from firefighters, photographing and the processing of the fire scene, the cause of the Tuesday morning fire at 643 First Street West in Jamestown.will be considered as undetermined .<br \/>\nThis concludes the fire investigation and it would be considered closed unless further information is received.<\/p>\n<p>\u3000<\/p>\n<p>Jamestown (CSi) At its meeting Wednesday, the Stutsman County Water Resource Board reviewed the complaint filed by the Winfield Township Board of Supervisors about a dam that was built in 1959 located on a property in the southwest quarter of Section 26, Township 139, Range 62 in Stutsman County.<\/p>\n<p>\u3000<\/p>\n<p>In the complaint Chairman of the Winfield Township Board of Supervisors, Dale Marks, and member of the Stutsman County Commission, Mark Gehlhar and Russell Carlson, also members of the Winfield Township Board of Supervisors, claim that the dam was reworked approximately 10 years ago. While Alan Lindberg built a road to his cabin on the property, a culvert was plugged, allowing more water to be retained in the dam, the complaint states. This plugged culvert has forced the water level higher behind the dam and has caused water to go over adjacent township roads. The complaint states visible water is &#8220;backed up&#8221; to the east all the way to Mud Lake on the Urbana road in Barnes County.<\/p>\n<p>\u3000<\/p>\n<p>Russell Carlson said he and his brother own land northeast of the Lindberg property, and the clogged culvert on Lindberg&#8217;s property has led to water backup on Carlson&#8217;s and his brother&#8217;s properties.<\/p>\n<p>\u3000<\/p>\n<p>Unable to attend Wednesday&#8217;s meeting,Lindberg provided the board with a written response, including a proposal to replace an existing 12-inch diameter culvert in the earth dam on Lindberg&#8217;s property with a 24-inch diameter culvert, which could alleviate the problem of water backup to the east.<\/p>\n<p>\u3000<\/p>\n<p>The board will meet at the Stutsman County Courthouse at 8:30 a.m., Monday, May 2, 2016 with most board members riding out to the dam together. This meeting is a special meeting and Board Chairman, Joel Lees, said the board will likely not make a decision at this meeting.<\/p>\n<p>\u3000<\/p>\n<p>The Stutsman County Water Resource Board will hold a special meeting Monday May 2, 2016, at 9 a.m. at the site of a dam on the property of Alan Lindberg in Winfield Township to address the complaint.<\/p>\n<p>In other business, the board approved an application by Rep. Craig Headland, R-Montpelier, to install subsurface drainage tile over 174 acres in the southwest corner of Section 27 and the northwest corner of Section 34 in Ypsilanti Township.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; The North Dakota Development Fund board this month awarded a total of $1.5 million in financial aid to four projects.<\/p>\n<p>The loan program within the state Commerce Department was created in 1991 to help new or expanding primary sector businesses &#8211; those such as manufacturers and food processors that create new wealth.<\/p>\n<p>This month, Gates Manufacturing of Lansford received a renewal of its $500,000 line of credit, Buzz360 of Fargo was awarded a $160,000 loan, Earth-Kind of Bismarck received a renewal of its $600,000 line of credit and <strong>Buffalo City Wood Products of Jamestown was given a renewal of its $250,000 line of credit.<\/strong><\/p>\n<p>All of the aid is for working capital.<\/p>\n<p>&nbsp;<\/p>\n<p>Bismarck (CSi) Job Service North Dakota\u2019s regional offices will continue to provide outreach services at current and new locations for towns that were affected by the budget shortfall. (AP) &#8211; Eight people have been indicted in a drug conspiracy that federal prosecutors have tied to a homicide in Grand Forks.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Twenty-four-year-old Austin Forsman was shot while sitting in a car in the parking lot of a Grand Forks truck stop on March 11. The indictment says the drug ring &#8220;used violence and the threat of violence to further the conspiracy,&#8221; including Forsman&#8217;s death.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Court documents say one of the defendants was selling large quantities of meth in the Fargo and Moorhead, Minnesota area. All eight defendants face maximum sentences of life in prison without parole.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Thirty-one-year-old Krystal Feist of Grand Forks is charged with Forsman&#8217;s murder and could face life in prison if convicted. Feist is not named in the federal drug indictment.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; The Bismarck Police Department says an officer has returned to regular duty after the McLean County State&#8217;s Attorney determined that a January shooting of a suspect was justified.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 McLean County States Attorney Ladd Erickson said that he had found Sgt. Jordan West&#8217;s actions justified.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Eighteen-year-old Miguel Stubing of Mandan was shot by West on Jan. 23 after allegedly ignoring verbal commands and driving toward West, who was responding to reports of a vehicle stolen out of Mandan.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Court documents show West fired five times at the vehicle to protect himself. The vehicle fled the scene and was later stopped by officers in Emmons County.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Stubing has pleaded not guilty to charges.<\/p>\n<p>&nbsp;<\/p>\n<p>WILLISTON, N.D. (AP) &#8211; A high school basketball coach and teacher in Williston who&#8217;s accused of a sex crime is on administrative leave.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Thirty-three-year-old Walter Eldridge was charged Wednesday with misdemeanor sexual assault, which carries a maximum sentence of 30 days in jail.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Minot Daily News reports court documents show Eldridge is accused of fondling a clothed 18-year-old girl last December. Authorities won&#8217;t say whether she is or was a student.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The Associated Press requested comment Thursday from defense attorney Jeff Nehring.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Eldridge is Williston&#8217;s head girls basketball coach and an English teacher. (AP) &#8211; The lone remaining strip club in downtown Williston is making a dramatic change to its business plan, after city officials put an end to topless dancing in the heart of the oil patch hub.<\/p>\n<p>Heartbreakers plans to convert from a strip club to a gathering spot for the LGBT community.<\/p>\n<p>Owner Jarod Holbrook says the club next month will convert to a gay and lesbian bar.<\/p>\n<p>The City Commission in January restricted all exotic dancing to industrial zones on Williston&#8217;s outer fringe, citing crime around the two downtown strip clubs and a desire for a cleaner image for the city&#8217;s center.<\/p>\n<p>The other club, Whispers, announced plans after the city&#8217;s decision to operate as a sports bar.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0BISMARCK, N.D. (AP) &#8211; The North Dakota Public Service Commission has slated a public hearing for a proposed oil pipeline in McKenzie and Dunn counties.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The meeting is slated May 11 in Killdeer.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The agency says BOE Pipeline LLC has submitted an application for a permit for the location of a new 42-mile long, 16-inch diameter crude oil pipeline. The pipeline will carry crude oil from a new terminal near Johnson&#8217;s Corner to the BOE terminal near Killdeer. The terminal is connected to a company rail hub southwest of Dickinson.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 The company says the pipeline would have a maximum capacity of 165,000 barrels per day. Total cost of the project is estimated to be $55 million.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a0Scientists say wastewater spills from oil development in western North Dakota are releasing toxins into soils and waterways, sometimes at levels exceeding federal water quality standards.<br \/>\n\u00a0In a report published Wednesday, Duke University researchers say they detected high levels of lead, ammonium and other contaminants in surface waters affected by recent wastewater spills in the Bakken oilfield region.<br \/>\n\u00a0They also found that soils at spill sites were laced with radium, a radioactive element in brines that form naturally with underground oil and gas deposits.<br \/>\n\u00a0Geochemistry professor Avner Vengosh says long-term monitoring of waters downstream from the spills is needed to determine whether drinking water quality is at risk.<br \/>\n\u00a0North Dakota environmental health chief Dave Glatt says most wastewater spills are cleaned quickly and pose no threat to humans.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>BISMARCK, N.D. (AP) &#8211; A longtime South Dakota environmental engineer has been hired as North Dakota&#8217;s state engineer.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 North Dakota&#8217;s Water Commission on Wednesday hired Garland Erbele as its top administrator.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Erbele will succeed state engineer Todd Sando, who announced last month that he will retire by the end of June.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Erbele will be North Dakota&#8217;s 18th state engineer.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 As the state engineer, Erbele will serve as secretary to the State Water Commission, which is overseen by a nine-member board, including the governor, who serves as its chairman.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Erbele worked for 35 years at the South Dakota Department of Environment and Natural Resources. He also was the agency&#8217;s lead technical negotiator on water rights issues.<br \/>\n\u00a0<br \/>\n\u00a0\u00a0\u00a0\u00a0 Erbele is from Lehr, North Dakota.
