Planning Commission

 

May 13, 2013 – 8:00 a.m.

 

 

 

Present: Hillerud, Bergquist, Ritter, Johnson, Trautman, Trefz, Tressler, Bensch

 

Absent: Purdy

    1. Chairman Hillerud opened the meeting. A motion was made by Bensch to approve the minutes from the April 8, 2013 regular Planning Commission meeting. Seconded by Trautman . Motion Carried.
    2. Public Hearing – plat request:

The preliminary plat of Anne Carlsen Center Addition, Lot 1, Block 1, Anne Carlsen Center Addition within NE 1/4, Section 3, T139N, R64W, Stutsman County, North Dakota.

Stephanie Falkers, of SRF Consulting gave the staff report explaining the details of the plat request. and recommends approval of the preliminary plat.

Chairman Hillerud opened the public hearing.

Eric Monson, CEO of Anne Carlsen Center, spoke in favor of the preliminary and was open to any questions from the staff or Commission.

Chairman Hillerud closed the public hearing.

A motion was made by Commission member Trefz to accept the findings of staff and approve the preliminary plat of the Anne Carlsen Center Addition, contingent on the completion and approval of a developer’s agreement, as it meets the requirements of Section 9 of Appendix B. Seconded by Trautman. Roll Call. Unanimous aye vote. Motion Carried.

    1. Public Hearing – zone change request:

Lot 2, Block 1, Meadowlark Lane Addition from R-1 (One Family Residential District) to R-3 (General Multiple Dwelling District).

Cindy Gray, of SRF Consulting, Inc. gave the staff report explaining the adjacent properties, etc. The recommendation is that this zone remain R-1, and to deny this request. Cindy stated that zone protests have been received. The 150’ notification area totals 38.72% of the protest area, exceeding the 20% that is needed for protest.

Chairman Hillerud opened public hearing.

Jason Anderson, 1710 5th St NE, spoke about the zone change area and that it is right across the street from his home and he is opposed to the zone change.

Mike Rene, 611 Eastwood Drive, spoke about the fact that he built his home in this area because of the residential zoned area and is opposed to the zone change.

Phil Brossart, 414 17th Ave NE, spoke that the development would be inconsistent in this area and he opposes the zone change.

Chairman Hillerud closed the public hearing.

Discussion from members included Commission member Trefz asking if there was protest was received from the Jamestown Public School. According to staff, there has been nothing received from JPS. Commission member Johnson asked if staff was aware of multi-family dwellings already in the area and if the developer is looking for other areas. Staff is aware of existing multi-family dwellings and does not have any other information from developers.

Commission member Bensch related that it would be good if there was a proposed plan from a developer to review before the zone change request. Cindy stated that currently R-4 is the only zone that requires a developer plan.

Commission member Trefz stated that he agrees with staff recommendation and the most important item is that a zone change will allow for any change allowed within that zone, rather than what the plans of the developer may be.

Commission member Trefz made a motion to accept the findings of staff and recommend denial of the zone change from R-1 to R-3 on Lot 2, Block 1, Meadowlark Lane Addition. Seconded by Trautman. Roll Call. 7 ayes, 1 nay (Johnson). Motion Carried.

    1. Public Hearing – zone change request:

Lots 1-12 and Lots 32-44 and that part of the existing alley adjoining said lots, Block 9, Kelley & Fuller’s Second Addition from M-1 (Limited Industrial and Manufacturing District) to R-3 (General Multiple Dwelling District).

Stephanie Falkers, of SRF Consulting, gave the staff report. No protests have been received. Staff is recommending approval of the zone change request.

Chairman Hillerud opened the public hearing.

Alan Lindberg, 1512 9th Ave SE, owner of property to be rezoned appeared before the Commission to answer any questions. He stated the plan for the area not including the old Job Service building, is to focus on the vacant land, and would like to put single family condominium patio homes in that area which will clean up the area and provide housing.

Rita Lulai, 301 11th Ave NE, adjacent property owner questioned if this development will raise taxes and will it affect the community center across the street.

Harold Newman, property owner in the existing development, agrees with project development and offered to answer any questions.

Chairman Hillerud closed the Public hearing.

Commission member Bensch made a motion to accept the findings of staff and recommend approval of the zone change from M-1 to R-3 on Lots 1-12 and 32-44, Block 9, Kelley & Fuller’s Second Addition. Commission member Johnson seconded. Roll Call. Unanimous aye vote. Motion Carried.

    1. Approve the final plat of Glenmac First Addition, A replat of Lots 1-5 and Lots 8-12 of Block 7, Atkinson & Pannell’s Addition, City of Jamestown, North Dakota.

Stephanie Falkers of SRF Consulting, Inc. gave the staff report. The Preliminary plat was approved at last months’ Planning Commission meeting. Staff is recommending final approval of this plat.

Chairman Hillerud opened the public hearing. No one appeared. Chairman Hillerud closed the public hearing.

Commission member Trefz made a motion to accept the findings of staff and recommend approval of the Final Plat of Glenmac First Addition as it meets the requirements of Appendix B of the City Code. Seconded by Commission member Ritter. Roll call. Unanimous aye vote. Motion Carried.

    1. SRF Consultants – Discussion relating to a Zoning Ordinance Amendment to amend and re-enact Section 5.4, Appendix C, of the Code of the City of Jamestown pertaining to uses permitted in R-3 Districts.

Stephanie Falkers, of SRF Consulting, Inc. said this will be an item for next month with a public hearing. She explained the ordinance change and the final report showed examples of development in Fargo.

Commission member Trefz stated that we should be looking at some new language in this change. Chairman Hillerud asked if maximum sizes allowed will be included in the change. Staff explained they will do more research and include more specifics in the text change.

Chairman Trefz stated the importance of the staff reports. Chairman Hillerud agreed. Commission member Johnson requested the reports state who prepared the findings. Cindy Gray, of SRF Consulting, Inc. explained how the reports are generated. Chairman Hillerud asked that staff reports get to them a week earlier than the meeting. Cindy stated the applications only have 2 weeks lead time and it is difficult to get a report prepared in such a limited time.

Chairman Hillerud discussed timelines in the application process. Stephanie Falkers, of SRF Consulting, Inc. recommended creating a policy about timelines relating to applications for plats, zone changes, etc. to include a possible 6 week deadline.

Commission member Trefz stated that a policy had been discussed relating to the timeline and it needs to be formally approved by the City Council. He recommends a timeline be formalized and becomes the standard practice.

Commission member Tressler asked if a formal motion needs to be made relating to the timeline issue. Chairman Hillerud said more discussion relating to this matter will be held in the future. There was no formal motion made regarding the time line issues.
