sheriff'sbadgegeneric FARGO, N.D. (AP Jul 30, 2013) – A rural North Dakota man says he will not fight Cass County over the seizure of his dogs.
 
     Authorities earlier this month took about 170 dogs and puppies from breeder Darcy Smith, of Wheatland, after reports they were being kept in poor condition.
 
     Prosecutors say the dogs had no access to food or water, and had no air conditioning or ventilation in hot conditions.
 
     KFGO radio reports that a hearing on whether Smith could keep the dogs was held Tuesday morning in Fargo, but Smith decided not to contest a district judge’s order giving the sheriff’s office control of the animals.
 
     Most of the dogs are in foster care and soon will be available for adoption.
