Jamestown, ND (KCSi-T.V. News) — The Stutsman County State’s Attorney has filed charges against an inmate accused of attacking a prison guard at the James River Correctional Center on July 28, 2013.
Shawn Ostafin has been charged with the assault on the correctional officer, Jeremiah MacDonald.
MacDonald sustained severe head injuries and was airlifted to a Bismarck hospital.
Ostafin was serving a sentence for terrorizing.
Ostafin is also charged as a habitual offender.
If found guilty on that charge Ostafin could face an additional ten years in prison.
He will make an initial court appearance on an aggravated assault charge on September 25 2013. A jury trial is scheduled in the case for November 15, 2013. Ostafin was disciplined last year for assaulting two staff members at the state penitentiary in Bismarck.
In 1990 he was convicted in the murders of his father and stepmother in Mandan.
