REVISED DRAFT MINUTES – Planning Commission
July 14, 2014 – 8:00 a.m.

- Chairman Hillerud called the meeting to order. Commission member Trautman made a motion to approve the minutes from the June 9, 2014 Planning Commission meeting. Seconded by Ritter. Unanimous voice aye vote. Motion Carried.
- Public Hearing:
The final plat of Jamestown Court Rowhomes Addition, Block 1, Lots 1 & 2, a replat of Lots 3, 4, 5, 7, and 8, and part of Lots 6 and 9, Block 42, Original Townsite Addition, City of Jamestown, North Dakota. (401 3rd St SE) This item was tabled at the June 9, 2014 meeting.
Stephanie Falkers, SRF Consulting Group, Inc. gave the staff report.
Chairman Hillerud opened the public hearing. No one appeared. Chairman Hillerud closed the public hearing. Chairman Hillerud relayed that he has in interest in this item, but has no contract signed, and is willing to abstain from voting if so moved. Commission member Trefz made a motion to allow Hillerud to vote. Commission member Trautman seconded. Unanimous voice aye vote. Motion Carried.
Commission member Bensch made a motion to accept the findings of staff and recommend approval of the Final Plat of Jamestown Court Rowhomes Addition, a replat of Lots 3,4,5,7, and 8 and part of Lots 6 and 9, Block 42, Original Addition, as it meets the requirements of Section 13 of Appendix B contingent on the quiet title paperwork being in hand. Commission member Trautman seconded the motion. Roll Call. Unanimous aye vote. Motion Carried.
- Public Hearing:
The preliminary plat of Witzig’s Fifth Subdivision, a Parcel of Land within the Northeast Quarter of Section 34, Township140 N, Range 64 W within Stutsman County and Extraterritorial Lands of the City of Jamestown, North Dakota. This item was tabled at the June 9, 2014 meeting.

Commission Member Bensch seconded. Roll Call. Unanimous aye vote. Motion Carried.

- Public Hearing:
The preliminary plat of Scherbenske Third Estates Subdivision, Lots 1 through 8, Block 1, a replat of Lots 3 through 12, Block 2, Scherbenske Estates and Lot 4, RTS First Addition within the NW ¼ of Section 8, Township 139 N, Range 63 W, within Stutsman County and the Extraterritorial Land of the City of Jamestown, North Dakota (8528 37th Street SE, 8530 37th Street SE, 8532 37th Street SE, 8536 37th Street SE, 8540 37th Street SE, 8542 37th Street SE, and 8548 37th Street SE).
Stephanie Falkers, SRF Consulting Group, Inc. gave the staff report. Discussion among members followed with Commission member Bayer questioning if there are any current City policies in place relating to the one acre lot size necessary for septic systems as is required by the ND Department of Health. Stephanie relayed that there are currently no ordinances or requirements in place that require an analysis of the soil suitability for a drain field at this time
Chairman Hillerud opened the public hearing.
Dustin Bakken, Stutsman County Tax Director, spoke about the septic systems, and that the one-acre size does not mean that Central Valley Health Unit will allow a septic system, he also requested more time to review any upcoming applications, but recommended approval of the final plat from the County standpoint.
Chairman Hillerud closed the public hearing.
Chairman Hillerud also spoke about the need for all preliminary plat requests, final plat requests and zoning change requests to be made in a more timely fashion, as a whole, in accordance with the timelines as established in the application paperwork provided on the City’s website, to allow all parties adequate time to review the applications, explained that the map published is preliminary and is not required by State Century Code. She explained that the requirements were not met on time. Discussion was held relating to time requirements and standards among members and staff. Chairman Hillerud stated that this discussion should be continued at a later date.
Commission member Bayer made a motion to accept the findings of staff and approve the Preliminary Plat of Scherbenske Third Estates Subdivision, a replat of Lots 3 through 12, Block 2, Scherbenske Estates and Lot 4, RTS First Addition, as it meets the requirements of Section 9 of Appendix B. Seconded by Commission member Trautman. Roll Call. Unanimous aye vote. Motion Carried.
- Public Hearing:
The preliminary plat of Scherbenske Industrial Addition, Lots 1 through 3, Block 1 being
within the SE ¼ of Section 31, Township 140 N, Range 63 W, City of Jamestown, Bloom Township, Stutsman County, North Dakota (2511 17th St SE).

Commission member Trautman made a motion to accept the findings of staff and approve the Preliminary Plat of Scherbenske Industrial Addition, a subdivision within the SE ¼ of Section 31, Township 140 N, Range 63 W, as it meets the requirements of Section 9, Appendix B. Seconded by Trefz. Roll Call. Unanimous aye vote. Motion Carried.
- Discussion took place relating to a Subcommittee meeting of the SCWR Board that was held on June 24, 2014. Chairman Hillerud represented the City Planning Commission at the meeting and said he has copies of the minutes if anyone would like them. The meeting revolved around the area drainage issues which are presently being encountered, and in the future, will continue to be encountered as a result of the City’s growth and the need for a watershed delineation master plan. It was determined that the first step is a study. After discussion regarding possible funding sources of the study, it was decided that the Committee would approach the JSDC for funding. A RFQ is being developed and will be distributed to engineering firms.
City Engineer Schwartzkopf relayed that he has talked to Committee Secretary Dalsted and that approximately 90% of the RFQ should be completed soon.
Mayor Andersen spoke about the funding from JSDC which would be temporary, as when and if the land is developed, the developers would be assessed the costs.
She noted that a Joint Powers Agreement would be required with the Townships and the City in order to setup the appropriate special assessment districts within the area.All four Townships were represented at the meeting. The next meeting will be on July 15th, 2014 at 10 am at the LEC. The meeting agenda will review the draft scope of work and JSDC funding application and discuss the required approvals with the four townships.
Chairman Hillerud asked if any applications have been received for the upcoming two Planning Commission vacancies. Mayor Andersen said two applications have been received, one from Don Frey and one from Mike Reinhardt, she also stated that Commission Trefz will not be seeking re-election.
