Jamestown, ND (KCSi-T.V. News Jan 7, 2013) — Two McDonald’s restaurant employees in Jamestown, may face charges from the Stutsman County State’s Attorney.
Police Chief Scott Edinger says, a fight allegedly occurred between the two on December 27, 2012.
Police are investigating who started the altercation.
One of the two men was treated at Jamestown Regional Medical Center for injuries sustained in the fight.
Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council met in Regular Session on Monday evening (Jan 7, 2013) at City Hall. Council Member Brubakken was not present, being ill.
Items discussed separately on the Consent Agenda, included:
Item “H” was asked to removed by City Engineer Reed Schwartzkopf, a Resolution to authorize entering into an agreement with CPS, Ltd., relating to prepare the 2013 Annual Groundwater Quality Assessment report, in the amount of $14,379.00.
He asked that an hourly proposal to be included, when called upon.
The item was approved including the amendment.
Also approved was a Resolution to direct Ulteig Engineers, Inc., to re-confirm the latest offer by the City to Sellin Brothers, Inc., for acceptance or to allow the matter to proceed to arbitration, in settlement for the final payment on the Reconstruction of the Business Loop East Project, SU-2-987(029)033.

Resolutions:
The City Council considered a weapons replacement policy for the Jamestown Police Department. Police Chief Scott Edinger said three options were offered.
Officers make the purchase….the police department purchase a uniform weapon….the city float an interest free loan, for a five year replacement, from a reputable firearm company.
Mayor Andersen said she favored option three.
The City Council voted unanimously to include all police department weapons, under option three.
Consideration of the proposals relating to traffic engineering services were postponed until this month’s Public Works Committee meeting.
Mayor Appointments:
Approved was the appointment of James Boyd to serve as a member of the Regional Airport Authority for a term to expire December 2017.
Also approved was the appointment of Jon Lillijord to serve as members of the Civil Service Commission for terms to expire January 2017.
Both are reappointments.
Also discussed was the appointment of Bill Kennedy to serve as a member of the James River Valley Library Board for a term to expire.
The appointment is by the City Council members.
Three members are appointed by the City Council, three members appointed by the county commission and one board member is jointly appointed.
Mayor Andersen said since the library boards combined into a joint board, by a vote of the people, the city and the James River Valley Library Board are not moving in the same direction.
The Mayor suggested delaying an appointment until the city and joint library meet for further discussions.
The Mayor moved to table the topic until the next committee meeting.

In Other Business:
The City Council unanimously approved entering into a temporary Farmland Lease with the State of North Dakota for a small tract of land located in the S1/2, SW1/4 of Section 1-139-64, Stutsman County, ND, for the construction and maintenance of a Water Storage Reservoir, with the term beginning January 1, 2013, and ending December 31, 2018.
City Administrator Jeff Fuchs said, eventually the city will be seeking a 100 year lease.
The tower will be located on State Hospital land, with the city in the process of obtaining easements.
Also considered were Resolutions pertaining to 2012 Water Tower and Water Distribution System Improvements Project:
The City Council then forwarded the plans and specifications, as prepared by the Interstate Engineering, for construction of the Water Tower, to the next committee or a Special City Council meeting.
The City Administrator was then instructed to advertise for bids for construction of the Water Tower.
Mayor Andersen said the new 750,000 gallon water tower planned for Southwest Jamestown is slated to be constructed this summer.
Interstate Engineering in Jamestown is updating the city on the design work.

She added the tower should be operational by the end of this year.
Mayor Andersen said the Stutsman Rural Water District Board will meet on Wednesday January 9, 2013, to discuss items under negotiations with the city.
The Mayor indicated the city council will meet later this week in response to the next offer from Rural Water.
She said the city has retained Tammy Norgaard from the Vogel Law Firm as co-council.
The Mayor added that until City Attorney Ken Dalsted returns to town, the city’s Assistant City Attorney will also be involved in discussions.

Valley City, ND (KCSi-T.V. News) — The Valley City Commission met in Regular Session Monday evening (Jan 7, 2013) in City Hall. All members were present.

Resolutions:
An open Public Hearing was held to Consider the I-94 Regional Development Corridor Plan submitted by Valley City/Barnes County Development Corporation, and the Developer’s Agreement submitted by John Deere Seeding Group.
Valley City Barnes County Development Corporation, Director, Jennifer Feist spoke, and indicated that the plan needs approval by later this month.
John Deere Seeding’s David Bradford said that the plan and additional land secures the business in Valley City.
Following the Public Hearing the City Commission passed a Resolution approving the I-94 Regional Development Corridor Development Plan.
City Commissioners then passed a Resolution approving the Developer’s Agreement between the City of Valley City and John Deere Seeding Group.
Commissioners approved a resolution on the 9-1-1 Emergency System, with a stipulation moved by Commissioner Nielson, that that Resolution takes place when the 9-1-1 operations is moved, and under county control, expected in July this year, or if the move occurs earlier.
It was also clarified that the Police Chief and, or, the City Administrator meet with the 9-1-1 Committee on a monthly basis.
New Business
Discussion was held and consideration of transferring 9-1-1 funding from City of Valley City to Barnes County.
City Administrator Schelkoph said, billing would go from the City Auditor’s Office to County, control, relative to when the 9-1-1- operation is transferred.
The City Commission, Monday, approved the transfer, effective January 1, 2013.
The City Commission approved accepting 6 th Avenue NE Mill & Overlay, Paving Improvement District No. 99.
Commissioners then discussed Permanent Flood Control, and options, with KLJ.
Proposal include 24 foot flood wall and clay levees.
Commissioner Luke suggested including portable flood control structures, and use the Army Corps of Engineers model.
She added, the structures should be placed in order to preserve the way Valley City looks.
Commissioner Nielson said the flood prevention structures would be constructed a certain distance from the river.
Mayor Werkhoven pointed out that with the property buyouts, the additional land will allow more placement of temporary dikes.
The City Commission on Monday, took no official action.
The City Commission then discussed proceeding with an erosion study for the Sheyenne River. Commissioner Luke said in addition to flooding issues, water coming down from Devils Lake, is another important issue concerning erosion and river bank stability.
She pointed out a study is needed as to how best to stabilize the river bank.
She asked the City Commission to consider, she, pursuing funding and bidding for an erosion control and river bank stabilization study.
Mayor Wekhoven said making a decision now is premature, pending state funding, that will be taken up in the 2013 State Legislature.
Commissioner Luke said she was looking a getting permission to seek forms of funding.
Mayor Werkhoven said there may be funds available, under the federal Clean Water Act.
The City Commission took no official action.
City Administrator Report and City Updates & Commission Comments:
David Schelkopf said one of the properties under the flood buyout agreements are left to move, and asbestos inspection is required.
He said Main Street will be closed starting January 14, 2013, while sheet piling is place along the river, continuing 235 feet extending from where the area now leaves off.
He added that the property value assessment of the Audi is continuing, which needs to be assessed at least $2-million dollars.
He commended the Valley City Police Department and other law enforcement agencies on safely handling the stand off at a home in Valley City, on New Year’s Day.
City Fire Chief Retterath said the outdoor warning sirens are expected to be operational by about January 22, 2012.

VALLEY CITY, N.D. (AP) – An indoor gun range in Valley City has been closed because of excess lead.
City Administrator David Schelkoph says the range was closed after state health officials did an inspection last month.
The range is in the basement of the city’s law enforcement center.
Schelkoph says the city must clean up the lead and install a ventilation system before anyone can use the range.
Jamestown, ND (KCSi-T.V. News) — Jamestown Mayor Katie Andersen says starting work on improving the city’s sanitary sewer system will take place this summer.
On Monday’s (Jan 7, 2013) Wayne Byers Show on CSi Cable 2, Mayor Andersen said, the initial work will include replacing two sewer lift stations, on in Southwest Jamestown, near the James River, and the other in Northwest Jamestown, near Bollinger Tennis courts.
Also a new force main will be installed in Southeast Jamestown.
The improvements will target other areas of Jamestown, as Interstate Engineering will inform the media to alert the public as to the areas under construction, and any traffic detours that will occur.
The upgrades are scheduled to be completed by the end of this year.
On another topic Mayor Andersen said the new 750,000 gallon water tower planned for Southwest Jamestown is slated to be constructed this summer.

Jamestown, ND (KCSi-T.V. News Jan7, 2013) — Law enforcement agencies throughout North Dakota will conduct increased seatbelt enforcement from Friday, January 11 through Saturday, January 19, 2013.
During this time, the North Dakota Department of Transportation (NDDOT) will provide funding to the North Dakota Highway Patrol, North Dakota Sheriff’s Offices and local Police Departments to have additional officers on duty in an effort to remind motorists to buckle up.
Safety Director, Mark Nelson, says “This increased enforcement period is part of the statewide “Click It or Ticket” enforcement campaign. The highest number of crashes in 2011 occurred in the month of January. Typically, two-thirds of fatal crash victims were not wearing a seatbelt.
In 2011, 69% of individuals killed in motor vehicle crashes were not wearing seatbelts. To do their part, law enforcement across the state will focus their efforts on seatbelt enforcement to keep all drivers and passengers safe by ensuring seatbelts are buckled.
Nelson adds , ” Wearing a seatbelt is the first thing you should do when you get into a vehicle, Buckling up will dramatically increase chances of survival during a crash. During this increased enforcement period our goal is to remind people how important seatbelts really are. We want everyone to buckle up every trip, every time.”
FARGO, N.D. (AP) – A man charged in a synthetic drug ring that led to the overdose deaths of two North Dakota teenagers has pleaded guilty in federal court in Fargo to a conspiracy charge.
Twenty-three-year-old Casey Rosen struck a deal with prosecutors to avoid the possibility of a life sentence. Assistant U.S. Attorney Chris Myers says Rosen is to be sentenced April 9.
Myers says Rosen was a key partner to Andrew Spofford, who authorities say was the leader of the ring in eastern North Dakota and northwestern Minnesota. Spofford pleaded guilty to drug and conspiracy charges last fall.
Rosen is the 11th person to plead guilty in the case. Four have been sentenced to prison terms ranging from about two years to more than 12 years.
DICKINSON, N.D. (AP) – Authorities in Dickinson have arrested eight people in a prostitution sting. Detective Kylan Klauzer tells the Bismarck Tribune that seven men and one woman were taken into custody in the operation over the weekend. Klauzer says all eight suspects were released on bond.
DEVILS LAKE, N.D. (AP) – Devils Lake is cracking down on a group of people who are repeatedly jailed for public intoxication by making it illegal to sell alcohol to what it calls “habitual drunkards.” The Forum newspaper reports that most of the people on the initial list were American Indians, and Spirit Lake tribal official Paul Matheny said it had the appearance of being racially motivated.
CANDO, N.D. (AP) – A potential deal to sell a North Dakota pasta plant is off the table.
Bektrom Foods official Bruce Satromsays the Michigan-based manufacturer has pulled its offer to buy the plant.
Bektrom had been negotiating with the family of Leonard Gasparre, who died in 2011. Gasparre built the Cando plant in the mid-1980s and added a plant in Devils Lake in the 1990s.
The Devils Lake plant closed last March, shifting operations to Cando. The Cando plant closed in October.
Towner County Economic Development Corp. president JoAnn Rodenbiker says officials continue to work with family representatives to reopen the Cando plant.
Ultra Green Packaging bought the Devils Lake facility.
In the early 1990s, the two plants had a combined 325 employees.
BISMARCK, N.D. (AP) – Today kicks off another session of the state Legislature, this one expected to go until at least May 1. Among the highlights of the first week will be Gov. Jack Dalrymple’s scheduled State of the State address in early afternoon. Tomorrow, Chief Justice Gerald VandeWalle (VAN’-duh-wall) briefs lawmakers on issues affecting North Dakota’s judicial system.
District 12, Republican State Representative, Alex Looysen, of Jamestown, is a 21-year-old junior studying biology at Jamestown College, and the youngest legislator in Bismarck.
He’s taking this semester off from J.C. to serve.
BISMARCK, N.D. (AP) – North Dakota’s Democratic Party has hired Bismarck native Chad Oban as its new executive director. And the state’s Republican Party is looking for a new executive director to replace Anthony Reedy, who has taken a job as director of Virginia’s state Republican Party. Oban succeeded Andrew Zabel, who left the post late last year.
WILLISTON, N.D. (AP) – The U.S. Postal Service is holding public meetings this week in the western North Dakota oil patch communities of Watford City, Williston and Tioga.
The Postal Service is working to manage growth and improve customer service in the rapidly growing oil patch. Dakotas District Manager Roy Reynolds will talk about plans to improve mail delivery and other services during the meetings and listen to concerns and suggestions from the public.
The sessions are Tuesday night in the Watford City Civic Center, Wednesday night in Williston City Hall and Thursday afternoon in Tioga City Hall.
FARGO, N.D. (AP) – The Army Corps of Engineers is holding a public meeting for landowners south of Fargo who would be affected by a Red River diversion project.
The corps and Red River Diversion Authority have proposed a ring dike for the communities of Oxbow, Hickson and the Bakke subdivision, which is part of a proposed water staging area.
Corps officials say residents in those areas have been contacted about the meeting, which is scheduled Tuesday at 6 p.m. at Bennett Elementary School in Fargo.
The 36-mile diversion would move water from the north-flowing Red River around the Fargo area, which battled major flooding for three straight years, starting with a record crest in 2009.
The White House has signed off on the $2 billion project, but it still needs approval from Congress.
MANDAN, N.D. (AP) – Weed control officers from around North Dakota are in Mandan this week.
The North Dakota Agriculture Commissioner’s Weed Forum is Tuesday, and the annual meeting of the North Dakota Weed Control Association is Tuesday through Thursday.
Agriculture Commissioner Doug Goehring will be one of the speakers at the Weed Forum. He says it’s an opportunity for local, state and federal officials to develop cooperative programs and strategies for fighting weeds.

FARGO, N.D. (AP) – Two-time national champion North Dakota State is No. 1 in the final Football Championship Subdivision polls of the season.
The Bison are atop both the coaches’ poll and The Sports Network Poll, after beating Sam Houston State 39-13 in the FCS title game on Saturday. NDSU also beat Sam Houston State in last year’s championship game.
Sam Houston State is ranked No. 2 in both of the final polls. The rest of the Top Five also is the same: Georgia Southern, Eastern Washington and Montana State.
South Dakota State finished No. 17 in the coaches’ poll and No. 14 in the TSN poll. The Jackrabbits made the playoffs but lost to NDSU in the second round.
BISMARCK, N.D. (AP) – The North Dakota Game and Fish Department has a new deputy director.
Former state legislator Duane DeKrey began in the position Jan. 1.
Game and Fish had been without a deputy director since June, when Roger Rostvet retired after serving in the role since 1998.
State Game and Fish Director Terry Steinwand says DeKrey has the ability to integrate the department’s current views as well as provide a different viewpoint that will help move the department forward.
DeKrey says he’s always had an interest and appreciation for wildlife.
The Pettibone native is an avid deer hunter and landowner and has also served more than 30 years in the North Dakota National Guard.

MIAMI (AP) – Alabama raced out to a 35-0 lead and claimed its second consecutive national championship by clobbering Notre Dame 42-14. A.J. McCarron completed 20 of his 28 passes for 264 yards and four touchdowns, two to Amari Cooper. Eddie Lacy rushed for a 20-yard touchdown less than three minutes into the game and finished with 140 yards on 20 carries.
MIAMI GARDENS, Fla. (AP) – No surprise as Alabama (13-1) was voted national champion by The Associated Press for the ninth time, more than any other program in college football, after routing Notre Dame 42-14 on Monday night. Notre Dame, No. 1 coming into the BCS championship, dropped to No. 4. Oregon (12-1) finished second, and undefeated Ohio State (12-0), banned from the postseason because of NCAA sanctions was third. Georgia and Texas A&M tied for fifth. Stanford, South Carolina, Florida and Florida St. followed.

UNDATED (AP) – Unbeaten Duke and Michigan hold the top two spots in The Associated Press’ college basketball poll for the fourth straight week.
Duke received 62 first-place votes Monday from the 65-member national media panel, with Michigan getting the other three.
Louisville overtook unbeaten Arizona to be ranked third. Completing the top 10 are Indiana, Kansas, Syracuse, Minnesota, Gonzaga and Missouri.
No. 23 Wichita State and No. 24 UNLV are back in the rankings. Oklahoma State and Pittsburgh dropped out from last week. Wyoming, the other unbeaten Division I school, remains unranked.

ORCHARD PARK, N.Y. (AP) – Calling himself the right man for the job, Doug Marrone took over as the Buffalo Bills’ new coach, charged with restoring the one-time lustre to the tarnished franchise.
Marrone was hired less than a week after Buffalo fired Chan Gailey following three losing season that extended the Bills playoff drought to 13 straight years.
Marrone has spent the last four seasons turning around a dismal program at Syracuse. He went 25-25 including a pair of wins in the Pinstripe Bowl.
Marrone becomes the Bills’ fifth coach in 12 years
SYRACUSE, N.Y. (AP) – A person familiar with the selection process tells The Associated Press that Syracuse will name defensive coordinator Scott Shafer as the Orange’s next coach.
The person spoke on condition of anonymity because there has not been an official announcement from the university.
Time was of the essence to find a replacement with national signing day looming.
Though the university had not made an announcement, Shafer’s Wikipedia page already was updated on Monday night to say he was the coach, and his son and former players Rob Long and Antwon Bailey congratulated him on Twitter.
KANSAS CITY, Mo. (AP) – Andy Reid has taken over as head coach of the Kansas City Chiefs, launching a new beginning after 14 seasons as Philadelphia head coach.
Reid takes over for Romeo Crennel (kreh-NEHL’), who joined Reid and five other NFL coaches in losing their jobs last Monday.

UNDATED (AP) – The NHL appears headed toward a 48-game season for the second time in two decades.
The NHL and players association came to an agreement on a new deal to end the lockout on Sunday.
“I think 48 is most likely at this point, unless the players can expedite their ratification process,” NHL deputy commissioner Bill Daly wrote in an email Monday to The Associated Press.
The NHL shortened its 82-game slate to 48 games during the 1994-95 season after a 103-day lockout. A 301-day lockout in 2004-05 made the NHL the first major North American professional sports league to lose an entire season.

MINNEAPOLIS (AP) – Minnesota Timberwolves forward Kevin Love met with doctors yesterday to evaluate his right hand, which is broken for the second time this season. Team president of basketball operations David Kahn says Love will be out for “a number of weeks.” Kahn also says guard Ricky Rubio is expected to play today against Atlanta.
MILWAUKEE (AP) – The Milwaukee Bucks will have a head coach Tuesday night against Phoenix.
A person with knowledge of the decision tells The Associated Press that Scott Skiles is out after four-plus seasons and a 162-182 record. Skiles leaves with the Bucks on a four-game losing streak that’s dropped them to 16-16.

UNDATED (AP) – The Texas Rangers have completed a $10 million, one-year deal for six-time All-Star Lance Berkman to be their designated hitter. The contract includes a vesting option for 2014 and was finalized today after Berkman passed a physical.
Also, reliever Mike Gonzalez and the Milwaukee Brewers have finalized a $2.25 million, one-year contract.
PGA-TOURNAMENT OF CHAMPIONS
KAPALUA, Hawaii (AP) – Dustin Johnson, Nick Watney and Mark Wilson got off to a good start today in the Tournament of Champions. Then again, just starting was good.
Three days behind schedule because of high wind, the PGA Tour finally got its 2013 season started on the day its first tournament was supposed to finish. Watney rolled in a long eagle putt and joined Johnson and Wilson in a tie for the lead with a 4-under 69. That matches the highest score to lead after one round in 15 years at Kapalua.
The opening round was scrapped on Friday and Sunday because of gusts topping 40 mph, and no one could play Saturday.

WASHINGTON (AP) – Curbing gun violence is one of the big topics at the White House this week. The Obama administration is having discussions with gun owner groups, victims’ organizations and representatives from the video-game industry. Vice President Joe Biden will take the lead in meetings tomorrow and Thursday.
PHOENIX (AP) – An initiative to curb gun violence comes today from former Congresswoman Gabrielle Giffords and her husband, mark Kelly, on the second anniversary of the shooting that killed six people and wounded her. They write in an op-ed in USA Today that their Americans for Responsible Solutions initiative will help raise money to support greater gun control efforts.
HENRIETTA, N.Y. (AP) – An upstate New York woman charged in connection with two guns used in a former neighbor’s deadly Christmas Eve ambush of firefighters is due before a judge in Western New York today. Prosecutors say the woman indicated on a form that two guns she bought in 2010 were for her, but they were really for neighbor William Spengler Jr., an ex-convict who wasn’t allowed to have them. Two firefighters were killed.
DAYTONA BEACH, Fla. (AP) – A state appellate court is being asked today to decide whether Casey Anthony was actually in police custody when she lied to detectives, telling them her 2-year-old daughter had been kidnapped. If judges on the Fifth District Court of Appeals rule she was, they could overturn her misdemeanor convictions because she hadn’t been read her Miranda rights.
WASHINGTON (AP) – The government is warning consumers to inspect Fisher-Price Newborn Rock ‘N Play Sleepers recliner seats due to risk of exposure to mold. The Consumer Product Safety Commission says mold can develop between the removable seat cushion and the hard plastic frame if the sleeper remains wet or is infrequently cleaned.
