40-year-old Omar Toure of Columbus, Ohio, has been held without bond since his March 2015 arrest. A trial is slated for August.
Toure’s attorney, Kevin McCabe, filed for a motion to dismiss the case, arguing that delays have made it difficult to find witnesses.
Williams County prosecutor Nathan Madden says Toure’s request for an interpreter who speaks Wolof, a language spoken in Senegal and other African countries, has caused delays.

FARGO, N.D. (AP) – The U.S. Army Corps of Engineers has signed off on a Red River diversion project around the flood-prone cities of Fargo and Moorhead, Minnesota.
The project partnership agreement with the Fargo-Moorhead Diversion Authority clears the way for construction to begin on the 30-mile channel, which is meant to reduce the flood risk for 225,000 people and 70 square miles of infrastructure.
Fargo Mayor Tim Mahoney calls the singing a “significant milestone” for the $2.1 billion project.
The two cities dealt with three straight years of high water beginning with a record crest in 2009 that destroyed about 100 structures and took a massive sandbagging effort to save other homes. Fargo last experienced significant flooding in 2013.
A ceremony to mark the formal agreement is scheduled Monday in Fargo.

MEDORA, N.D. (AP) – Commissioners in western North Dakota’s Billings County have approved a zoning change that could lead to the construction of a refinery near Theodore Roosevelt National Park.

Houston-based Meridian Energy Group Inc. wants to build the $850 million oil refinery on a site about 3 miles from the park. The company still needs to secure a state air quality permit.

The  public’s testimony showed the divisions between supporters, who like the idea of the 200 good-paying jobs that refinery is expected to create, and opponents, who believe the project will compromise the park.

Roosevelt, who was president from 1901 to 1909, set aside millions of acres for national forests and wildlife refuges during his administration.

NBA…

UNDATED (AP) – The Miami Heat can say goodbye to Dwyane (dwayn) Wade.

The 12-time NBA All-Star guard has ended his 13-year run with the team for a two-year, $47 million contract with the Bulls. Miami offered $40 million over two years for Wade to stay in the uniform that he’s worn his entire career

The Chicago native has averaged 23.7 points and 5.8 assists since being taken with the fifth overall pick in the 2003 draft. Wade scored 19 points a game while appearing in 74 games for the Heat last season.

Meanwhile, a person familiar with the trade says the Bulls have sent Mike Dunleavy to the Cleveland Cavaliers to help make room for the incoming Wade. The 35-year-old Dunleavy averaged a career-low 7.2 points in 31 games for the Bulls last season.

Chicago made further cap room by shipping guard Jose Calderon and two second-round draft picks to the Lakers. That’s according to someone with knowledge of the trade.

Wade says his decision to leave the Miami Heat for the Chicago Bulls was still “surreal” thisy morning, when he appeared as the guest-host of “Live with Kelly” alongside Kelly Ripa.

Wade made the appearance in New York. He accepted the invitation to guest-host Thursday’s show weeks ago.

He thanked Heat fans in his opening remarks on the show, says he hadn’t slept in days while deliberating and even lost 5 to 10 pounds because he hadn’t been able to eat.

Wade says he would consider doing some on-screen work after his playing career ends, telling The Associated Press that was one of the reasons he accepted the hosting chance.

MINNEAPOLIS (AP) -The agent for Brandon Rush says he has agreed to a one-year, $3.5 million deal with the Minnesota Timberwolves.

Mark Bartelstein of Priority Sports says Rush came to agreement with the Timberwolves on Wednesday. He gives them some much-needed shooting off the bench.

Rush averaged 4.2 points in 72 games for the Golden State Warriors last season. He has overcome some serious knee issues to resume his career and has shot 40 percent from 3-point range in eight seasons.

The Timberwolves badly needed to add a shooter to a team that was near the bottom of the league in 3-point field goals and attempts last season.

Rush is the second signing of a quiet summer for the Timberwolves. They added center Cole Aldrich on Monday.

A person with knowledge of the situation tells The Associated Press that the Rockets have agreed to terms with Nene (nuh-NAY’) on a one-year, $2.9 million deal.

NEW YORK (AP) – Time’s up for the old NBA shot clock.

The league will debut a new timing system and shot clock this week in Las Vegas during the NBA Summer League, which will then be integrated into all 29 arenas for the 2016-17 season.

The league says Thursday the new clock will feature the game clocks, 24-second and timeout, the first time they have all been in one piece of hardware.

Developed by Swiss watchmaker Tissot, the league’s official timekeeper, the timing system will allow for clearer footage to assist referees and the Replay Center, and provides a benefit to some fans. The clock’s LED glass is nearly transparent when in use, giving fans behind the baskets a view to the court that was previously obstructed.

The NBA introduced the shot clock for the 1954-55 season and it has been positioned on top of the backboard since 1977.

In world and national news…

FALCON HEIGHTS, Minn. (AP) – Protesters are calling it another case of racial profiling. A 32-year-old Minnesota man was shot to death by a police officer during a traffic stop last night. And the girlfriend of the dead man livestreamed from the scene on Facebook, saying police had shot Philando Castile “for no apparent reason.” Castile’s girlfriend says her boyfriend told the officer he had a permit to carry a concealed weapon, and when Castile began putting his hands up, he was shot several times. The video shows a bloodied Castile still alive.
Castile’s mother says she had  instructed her son to always “comply” if he was ever stopped by law enforcement.

Valerie Castile told CNN Thursday that her son, Philando Castile, didn’t deserve “to be shot down like this.”

The 32-year-old man was shot in a car Wednesday night in the largely middle-class St. Paul suburb of Falcon Heights.

Valerie Castile says her son was just “black in the wrong place” and that he was a victim of “a silent war against African American people.”

Police have not released details about the officer involved.

She says she’s angry that officials wouldn’t let her identify her son’s body and that she will have to wait until after the autopsy to see him.
WASHINGTON (AP) – Republican members of the House say they want answers from FBI Director James Comey, who’s been summoned to Capitol Hill today to explain why he recommended that Hillary Clinton not be prosecuted over her private email setup. Comey will appear before the House Oversight and Government Reform Committee. Next week Attorney General Loretta Lynch, who decided no charges would be filed, is likely to face questions at a separate oversight hearing of the House Judiciary Committee.

WASHINGTON (AP) – Donald Trump is meeting privately today with rank-and-file congressional Republicans, but some GOP plan to skip the gatherings. They’ve expressed skepticism, criticism or outright opposition to the presumptive GOP presidential nominee. Sen. Kelly Ayotte (AY’-aht) of New Hampshire says she has to attend an Armed Services Committee hearing at the same time. Congressman Mario Diaz-Balart of Florida says he’ll have to check his calendar.

ATLANTA (AP) – A vigil will be held today at Emory University in Atlanta for two students killed when a group of armed extremists stormed a restaurant in Dhaka, Bangladesh last weekend.      LOS ANGELES (AP) – Actress and comedian Sarah Silverman says she’s “insanely lucky to be alive.” Silverman says on Facebook that she underwent surgery after the piece of cartilage that covers the windpipe swelled up. The condition can block the flow of air into lungs and is potentially life threatening. Silverman says she spent a week recovering at Cedars-Sinai Medical Center in Los Angeles.
