Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council met in Special Session, on Thursday (Jan 10, 2013,) at 4-p.m., at City Hall.

The City Council entered into Executive Session to consult with the City Attorney, concerning, territorial service claims by Stutsman Rural Water District.

Those present at the Executive Session were: Mayor Andersen, City Council Members Kourajian, Gumke, Brubakken, and Buchanan, along with City Administrator Jeff Fuchs, City Fire Chief Jim Reuther, City Engineer Reed Schwartzkopf, and the Assistant City Attorney, Mary Jensen.

The Rural Water District met in Executive Session on Wednesday this week, in response to a city proposal in the on-going negotiations, which the City Council reviewed in Executive Session.

As issue is whether the City of Jamestown, or Stutsman Rural Water District is to serve the area west of Jamestown, in this case, specifically the Titan Machinery building, under construction, across from Jamestown Regional Medical Center.

A city Ordinance outlines that any facility within city limits has to be serviced by the city, with this area previously annexed into Jamestown city limits.

Stutsman Rural Water District contends that a federal code protects rural water companies from cities going into their territory.

The City Of Jamestown and the Rural Water District are negotiating a royalty figure the city would pay and keep the rural water district from filing an injunction.

At Thursday’s City Council meeting, the Council returned to open session, with Mayor Andersen saying there was no formal action to be taken by the Council, and the meeting was adjourned.

The open portion of Thursday’s City Council meeting was shown live on CSi 67.

Last summer, a building permit was issued by the city, and ground was broken for the new Titan Machinery building, after a development agreement with the city of Jamestown, which stated the city would get water to the building.

Developer Robert Thompson assumes the city will have liability issues if Titan is not provided water.

GRAFTON, N.D. (AP) – A former stockbroker accused of swindling clients in Walsh County out of more than $2 million has pleaded guilty. The Grand Forks Herald reports 59-year-old Ross Haugen might avoid prison time if he comes up with $2.1 million in restitution by the end of the month. Haugen faces similar charges in November 2011.

BISMARCK, N.D. (AP) – A ceremony is scheduled in Bismarck this weekend to honor some North Dakota National Guard soldiers who served in Kosovo.

The “Freedom Salute” event Sunday for the 55 soldiers with the 1st Battalion of the 112th Aviation Regiment is at the Army Aviation Support Facility. Gov. Jack Dalrymple and state Guard commander Maj. Gen. David Sprynczynatyk (sprihn-suh-NAT’-ihk) are scheduled to speak.

The soldiers mobilized in September 2011 in support of the NATO peacekeeping mission in Kosovo. They returned home last September.

BISMARCK, N.D. (AP) – North Dakota’s workers’ compensation agency has ended a contract with a company that failed to complete a computer system overhaul. The Bismarck Tribune reports Workforce Safety and Insurance Director Bryan Klipfel told state lawmakers Wednesday that the agency’s contract with Chicago-based Aon eSolutions expired at the end of 2012 and the WSI committee overseeing the project decided not to renew it.

BISMARCK, N.D. (AP) – Some state agencies in North Dakota are objecting to a proposal to put their airplanes into a central management system overseen by the Transportation Department.

The bill being considered by state lawmakers was proposed by an interim legislative committee after a study of state-owned and state-leased airplanes. It would be modeled after the state motor vehicle pool.

Agency heads say there are numerous problems with the proposal.

State Aeronautics Commissioner Larry Taborsky says insurance rates would increase if older planes are pooled with newer ones. He also says safety is an issue if pilots are flying unfamiliar planes.

Officials with the Highway Patrol and the Game and Fish Department say they might run afoul of federal regulations if they are forced to put their airplanes into a state pool.

BISMARCK, N.D. (AP) – North Dakota’s top oil regulator says increased federal regulations and competition from other oil plays could drastically cut production in the state’s oil patch.

State Mineral Resources Director Lynn Helms told the North Dakota House Appropriations Committee that the state’s oil industry is healthy. But he says “it’s not all roses and sunshine.”

Helms appealed to lawmakers to keep a $1 million fund available to challenge the federal government if it imposes additional hydraulic fracturing regulations. Helms says the state should have the authority to set its own regulations when it comes to oil drilling.

Mitch Vance of Bismarck says he doesn’t think the state should be using taxpayer money to fund lawsuits against the federal government. He says oil companies should fund such lawsuits.

WILLISTON, N.D. (AP) – The U.S. Postal Service is taking steps to improve service in western North Dakota’s booming oil patch.

Postal Service Dakotas District Manager Roy Reynolds says it isn’t acceptable to have slow mail delivery and long lines at post offices. He held public meetings this week in Watford City, Williston and Tioga.

Reynolds says the Postal Service is already making changes, such as installing parcel lockers in Williston. Rather than wait in line to retrieve a package, customers find a key in their post office boxes that allows them to retrieve the package from a parcel locker.

Reynolds says the Postal Service also is working to hire more staff.

A job fair is planned next week in Watford City.

BISMARCK, N.D. (AP) – The chairman of the Turtle Mountain Band of Chippewa has asked North Dakota lawmakers to share the state’s oil wealth. Chairman Richard McCloud addressed both chambers yesterday. McCloud says North Dakota’s tribes are asking for a “helping hand, not a hand out.”

FORT TOTTEN, N.D. (AP) – The Bureau of Indian Affairs has announced an initiative to expedite fingerprinting of foster parents on the Fort Totten Indian Reservation. The BIA says it has provided three mobile fingerprinting units to the Spirit Lake Tribe and BIA social services staff on the reservation. Under a 2006 law, all adults in a household where minor children are to be placed must be fingerprinted as part of a background investigation.

BISMARCK, N.D. (AP) – The commanding officer of a Navy nuclear submarine being named for North Dakota is slated to give an update Friday to the Legislature about the vessel’s progress.

Navy Cmdr. Douglas Gordon will address the North Dakota Senate and House on the USS North Dakota. Gov. Jack Dalrymple proclaimed Friday as USS North Dakota day.

NBA…

MINNEAPOLIS (AP) – The Minnesota Timberwolves say coach Rick Adelman will miss more time while he tends to his wife, who has been in the hospital. The team made the announcement yesterday. Adelman has missed two straight games and the Wolves say his status remains day-to-day.

NFL…

EDEN PRAIRIE, Minn. (AP) – Minnesota Vikings linebacker Chad Greenway has been added to the NFC Pro Bowl team as an injury replacement for Dallas’ DeMarcus Ware. Greenway will be the first Vikings linebacker to play in consecutive Pro Bowls since Scott Studwell in 1987-88. The Vikings credited Greenway with a career-best 191 tackles in 2012.

CLEVELAND (AP) – The Cleveland Browns have hired Carolina offensive coordinator Rob Chudzinski as their new coach.
Chudzinski first head coaching job comes with the team he loved as a kid.  The 44-year old had two previous assistant coaching stints with the Browns in 2004 and 2007. He becomes Cleveland’s sixth full-time coach since 1999.

JACKSONVILLE, Fla. (AP) – The Jacksonville Jaguars fired coach Mike Mularkey after one season Thursday. The 2-14 record the Jags had in 2012 was the worst in franchise history.

New general manager David Caldwell made the announcement, giving him a clean slate heading into 2013.  Caldwell added there were no plans for the Jaguars to attempt to acquire Jets back-up quarterback Tim Tebow (TEE’-boh). The former Heisman Trophy winner from Florida is a Jacksonville native.

SANTA CLARA, Calif. (AP) – David Akers is keeping his job as San Francisco’s starting kicker for Saturday’s playoff game against Green Bay. The 49ers (11-4-1) signed Billy Cundiff on Jan. 1 to compete with Akers, who has struggled this season while making only 29 of 42 field-goal attempts. Akers revealed last week he underwent double hernia surgery last February, then re-aggravated the area when he slipped on the field during practice.

The 15-year veteran understood why Cundiff was brought in, but Akers made it clear he wants to remain the kicker.

NASCAR…

DAYTONA BEACH, Fla. (AP) – Two-time Daytona 500 winner Michael Waltrip will enter NASCAR’s premier event next month in a one-race deal with Swan Racing. The season-opening Feb. 24 race marks the debut for the team under new owner Brandon Davis, who has vowed the No. 30 car will no longer “start and park.”  David Stremme will take over as the full-time driver for the team for the rest of the season.

DAYTONA BEACH, Fla. (AP) – Danica (DAN’-ih-kuh) Patrick says she does not plan to race in this year’s Indianapolis 500 because she wants to concentrate on her first full-time season in NASCAR’s Sprint Cup series.

Patrick also skipped the Indy 500 last year, instead running in the Coca-Cola 600 at Charlotte Motor Speedway on the same day. She said Thursday that she will do the same in 2013.

GOLF…

HONOLULU (AP) – Scott Langley had a memorable rookie debut on the PGA Tour.  Russell Henley wasn’t too shabby, either.

Langley thrived on a penetrating ball flight and a pure putting stroke for an 8-under 62, giving him a one-shot lead over Henley in the Sony Open.

The two played in the same group and they put on a remarkable show along the back nine at Waialae (wy-uh-LAY’-uh) Country Club. Henley made five birdies on the coming home, but couldn’t keep up at the end when he misplayed a chip on the par-5 18th.

Langley played bogey-free and made a couple of long putts, including a 55-footer for eagle on No. 9.

Scott Piercy and Tim Clark were at 66.

In world and national news…

WASHINGTON (AP) – The Federal Aviation Administration has ordered a comprehensive review of the Boeing 787’s critical systems after a fire and fuel leak earlier this week.      HARTFORD, Conn. (AP) – Connecticut’s chief medical examiner says he doubts that toxicological tests and analysis of the body of the Connecticut elementary school shooter will explain his actions. The Hearst Connecticut Media Group reports Dr. H. Wayne Carver II, who autopsied the body of gunman Adam Lanza, said an examination of Lanza’s brain showed nothing unusual and calls the testing a “fishing expedition.”

SALT LAKE CITY (AP) – Authorities in Utah say they suspect a missing 13-year-old girl who was found unharmed late yesterday was harbored by someone and police are trying to find out who. The girl disappeared this week without shoes or a coat in the chilly Salt Lake City area. Brooklyn Gittins telephoned her grandmother late yesterday from a Wal-Mart store.

CENTENNIAL, Colo. (AP) – An arraignment is scheduled today for James Holmes, who is to be tried on 166 felony counts in the Colorado theater shootings that killed 12 people. Holmes’ attorneys say they’re not ready to enter a plea and will seek a delay. A judge has ruled there’s enough evidence to try Holmes.

LOS ANGELES (AP) – A police spokesman in Los Angeles says SWAT officers have entered a Nordstrom Rack clothing store where at least one woman was believed kept hostage during an armed robbery. Fourteen people who had been inside the store are safe. City News Service says the robbery was reported just after 11 p.m. yesterday.
