GRAND FORKS, N.D. (AP) – A three-judge appeals panel has scheduled a Feb. 14 hearing in St. Paul, Minn., on a lawsuit over the University of North Dakota’s retired Fighting Sioux nickname.

A judge last May dismissed the lawsuit filed against the NCAA by nickname supporters at the Spirit Lake and Standing Rock Sioux reservations. They claimed they were not included in discussions when the NCAA and the state negotiated a settlement to retire the nickname.

The supporters appealed to the 8th U.S. Circuit Court of Appeals. The 8th Circuit assigned the three-judge panel to hear the case.

Sixty-eight-percent of North Dakota voters last June voted to drop the nickname deemed “hostile and abusive” by the NCAA. A separate lawsuit filed by other supporters was dismissed last August.
