NEW SALEM, N.D. (AP) – The Morton County Sheriff’s Office has seized 119 horses after finding 96 dead horses at a ranch north of New Salem over the weekend.

Sheriff Dave Shipman says there’s adequate feed and water for some of the horses and they will be cared for on scene, but those in bad condition will be removed from the ranch.

The state’s attorney’s office will be considering whether to file charges in the case.

Authorities did not identify the ranch owner. Shipman says the man is retired and “just got in way, way over his head.” He says the man is cooperating.

BISMARCK, N.D. (AP) – Lawmakers are considering new rules for taxing production from oil wells in North Dakota.

Republican Sen. Dwight Cook of Mandan says the bill introduced Monday attempts to bring certainty and stability to the oil industry and the state.

He says the bill closes a tax loophole for so-called stripper wells that costs the state millions in revenue annually. Those wells are exempt from the state’s 6.5 percent extraction tax, but not a 5 percent production tax.

The new tax structure also would eliminate price triggers that would lessen state taxes for companies if the price of oil falls below a certain level.

In exchange, companies would be charged an effective tax rate of 9.5 percent beginning in 2017 instead of the 11.5 percent tax rate they’re charged now.

Hurley Enterprises spokesman Dave Gorham says it’s too difficult to comply with regulations, and the company is turning to wastewater lagoons as more of them come online. The disposal violations occurred in 2011 and 2012, when Gorham says there were fewer lagoon options.

Hurley isn’t contesting the fine and Gorham says the company wants to work with the state to come up with better disposal methods. But he also says the company believes the fine amount is “exorbitant.”

The Health Department says Hurley and another company didn’t follow correct procedures for applying the wastewater to fields.
