Valley City, ND (WDAY TV) — A misunderstanding between the City of Valley City and Barnes County led to accusations of hacking.

Barnes County employees gained access to an emergency call taken by the city regarding a deer on the road. Controversy stemmed from a comment made by a city employee during the call.

The city was concerned about how the county had accessed the recording. But the 911 recording that was allegedly “hacked” was recorded on a server that both Valley City Police and Barnes county have access to.

City Attorney, Russell Myhre, says, “There is no investigation that is going to go forward from this point in time. Basically, what the state’s attorney and I are going to be working towards is to see if we can get this information back to our respective commissions and then make sure they understand clearly what took place.”

Myhre and Barnes County State’s Attorney Lee Grossman said in a joint release that they are disappointed in both the city and the county in how this entire matter was handled.

They believe it stems from a mistrust bred through years of conflict between the two entities.

 

Jamestown, ND (KCSi-T.V. News Feb 7, 2013) — Jamestown Regional Airport Manager, Matthew Leitner says January airline boarding were a 224.

On Thursday’s Wayne Byers Show on CSi Cable 2, Leitner said that compares 436 boardings in January of 2012, when Delta served Jamestown with larger aircraft.

Leitner added that this January’s 224 number while lower than a year ago, still reflects an increase in recent boardings under Great Lakes Aviation when it was in the high 100’s.

Leitner pointed out that if each Jamestown departure had 10 passengers, the Jamestown boardings would be 900 per month.

Great Lakes Airlines Public Relations Director, Monica Taylor-Lee recently said that when Jamestown boardings are consistently higher than presently the airline may look at the numbers as justifying Jamestown with larger planes.

On other topics, Leitner said that the North Dakota State Senate is reviewing two aviation related bills.

He said SB 2278 deals with funding all 89 airports in North Dakota.

Presently only airports with commercial air service are funded.

SB 2006 deals with adding $9.45 million to the State Aeronautics Commission budget for the upcoming biennium.

Leitner said that budget has not been increased in several years, and will benefit airports, including Jamestown to accomplish capital improvement projects.

 

BISMARCK, N.D. (AP) – A North Dakota man says he will plead guilty to hitting his brother in the head with a sledgehammer during a fight.
 
     Joey Short, of Belcourt, faces a federal court charge of assault with a dangerous weapon. The charge carries a maximum penalty of 10 years in prison.
 
     The incident occurred in October 2012. Authorities say the 24-year-old Short struck his older brother in the head numerous times.
 
     Investigators say 33-year-old Jason Short required numerous stitches. He was treated and released at a Belcourt hospital.
 
     A plea hearing has not been scheduled.

 

BISMARCK, N.D. (AP) – Bismarck police have arrested two people in the armed robberies of a hotel and a gas station. The 19-year-old woman and 39-year-old man are accused of using a handgun to hold up the MainStay Suites and the Country West Shell within a matter of minutes early Monday. The suspects were arrested Wednesday and did not immediately make a court appearance.

 

 BISMARCK, N.D. (AP) – Officials in Burleigh and Morton counties who seized 157 horses from a New Salem man because of alleged neglect are asking a judge to order the animals put up for adoption.
 
     The horses were seized after authorities found 99 dead horses on the man’s property in the two counties. Two of the rescued horses have since died.
 
     The man has not been criminally charged.
 
Officials from the two counties called law enforcement officers, veterinarians and volunteers to testify about the condition of the animals during a 2 1/2-hour hearing Thursday.
 
     The counties have petitioned the court to place the animals permanently in the custody of the two sheriff’s departments.
 
     Judge Bruce Romanick has 10 days to issue an opinion in the matter.

 

LISBON, N.D. (AP) – A judge is deciding whether there’s enough evidence to proceed with a murder trial in the case of a Fort Ransom woman accused in the death of her toddler son.

Twenty-nine-year-old Jodi Lindvall had a preliminary hearing Thursday on charges of murder and child abuse in the Sept. 22 death of 22-month-old Bentley Lindvall. Judge Jay Schmitz will issue a ruling later on whether the case moves forward.

Prosecutors say an autopsy determined the boy had been physically abused and died of a head injury. Court documents indicate Lindvall told authorities her son hit his head while she was struggling to change his diaper, and that she also had seen her live-in boyfriend shake the boy. The boyfriend has not been charged.

Lindvall could face life in prison if convicted.

 

 BISMARCK, N.D. (AP) – MDU Resources Group Inc. announced Thursday that it will build a diesel refinery near Dickinson in western North Dakota’s booming oil patch.
 
     The Bismarck-based company says the refinery could cost up to $300 million. It would operate nonstop, producing 20,000 barrels of diesel and kerosene daily.
 
     Officials say it would employ 100 people and help meet demand for diesel in the region.
 
     North Dakota has only one oil refinery, Tesoro Corp.’s facility in Mandan.
 
     Gov. Jack Dalrymple says developing another refinery has been a long-time goal of the state.

 

BISMARCK, N.D. (AP) – The North Dakota Senate has passed legislation that would require a doctor performing abortions to be an OB-GYN with hospital-admitting privileges.
 
     Republican Senator Spencer Berry, a Fargo physician, introduced the bill. He said before Thursday’s vote that it’ll ensure that women getting abortions get the best health care possible.
 
     Opponents said it was a clear challenge to Roe versus Wade and a woman’s right to get an abortion.
 
     Sen. Stanley Lyson, a Republican from Williston and retired sheriff, said he’d at first supported the bill but ultimately changed his mind because “decisions like that should be left up to the woman and her family and her God and not a group of people in the Legislature.”
 
     The Red River Women’s Clinic in Fargo is North Dakota’s sole abortion provider.

 

 BISMARCK, N.D. (AP) – A Fargo Democrat has introduced the toughest legislation to date aimed at curbing the oil industry’s practice of burning and wasting natural gas as an unwanted byproduct of oil production.
 
     Senator Tim Mathern’s bill hits the oil industry in its pocketbook by cutting out an easily used exemption. Oil producers can flare natural gas for a year without paying taxes or royalties on it. And companies can request an extension because of the “economic hardship” of connecting the well to a natural gas pipeline.
 
     Mathern’s measure mandates that companies pay taxes and royalties after one year, even if the gas goes up in smoke.
 
     Mathern says the state is losing millions of dollars in tax revenue because the natural gas is being burned off and wasted.

 

 BISMARCK, N.D. (AP) – A lawmaker who’s been critical of the North Dakota University System chancellor says Hamid Shirvani has resolved questions about a Grand Forks building.
 
     But Fargo Sen. Tony Grindberg hasn’t changed his mind about a proposal to provide money to buy out Shirvani’s contract.
 
     Shirvani has been criticized for a proposal to create office space in a new information technology building on the University of North Dakota campus. He and Board of Higher Education President Duaine Espegard told a legislative committee Thursday that the office was never planned as a private executive suite, and doesn’t affect the size or cost of the building.
 
     Grindberg has criticized Shirvani as being a questionable leader who has created an environment of fear and retaliation. Shirvani says he’s doing what he was hired to do.

 

BISMARCK, N.D. (AP) – A state lawmaker says North Dakota University System Chancellor Ham Shirvani has told some legislators that five of the 11 public college presidents in the state are unqualified or insubordinate and likely will be relieved of duty. Shirvani tells The Forum newspaper that he never made that statement. Bismarck Rep. Bob Martinson contends the alleged comment is an example of Shirvani’s overbearing style of leadership that has rankled some state lawmakers.

 

 BISMARCK, N.D. (AP) – Attorney General Wayne Stenehjem (STEHN’-juhm) says North Dakota’s share of a multistate settlement with one of the nation’s biggest mortgage processing companies is just under $220,000.
 
     Lender Processing Services Inc. has agreed to pay $121 million to resolve states’ claims that it wrongfully foreclosed on homeowners who should have been allowed to stay in their homes.
 
     State attorneys general alleged that the company engaged in unlawful practices including “robo-signing,” in which it automatically signed off on foreclosures without properly reviewing documents.

 

In sports…

 FARGO, N.D. (AP) – North Dakota State finished sixth in attendance in the Football Championship Subdivision. Final figures released by the NCAA show NDSU averaged about 18,500 fans over six regular-season and three postseason games. The Bison won their second straight FCS title last month.

 

OMAHA, Neb. (AP) – Nebraska-Omaha hockey coach Dean Blais might have to take into account the position of the sun when he prepares for Saturday’s outdoor game against North Dakota.
 
     Partly-cloudy skies are forecast, and the sun could be a factor in the first period at TD Ameritrade Park in Omaha, Nebraska. Blais said his team will choose to start with the sun at its back if that’s the case.
 
     Blais will take any advantage he can get. Only two points separate the second-place Mavericks (16-10-2, 12-6-2) and North Dakota (14-8-6, 9-5-6) in the WCHA standings.
 
     A junior-level game between the Omaha Lancers and Lincoln Stars will precede North Dakota-UNO. Officials said about 12,000 tickets have been sold. Temperatures in the upper 40s are expected.

 BOZEMAN, Mont. (AP) – Troy Huff scored 25 points on 10-of-17 shooting, leading North Dakota’s second-half comeback in an 82-73 victory over Montana State last night. Xavier Blount had 19 points and seven rebounds, and Christian Moon added 16 points, for the Bobcats, who hosted UND in Bozeman, Montana for the first time since 1964.

 

ROCHESTER, Mich. (AP) – Oakland coach Greg Kampe earned his 500th official victory Thursday night when the Golden Grizzlies outlasted North Dakota State 66-63.
 
     Oakland (12-13, 7-4 Summit League) trailed 63-62 when Duke Mondy stole the ball from TrayVonn Wright and drove for the go-ahead basket with 20.2 seconds left. Mike Felt then missed an open 3-pointer for the Bison (18-6, 9-3), and although Wright rebounded, he fell down and was called for traveling.
 
     Mondy made two free throws with 6.4 seconds remaining, and the Golden Grizzlies fouled intentionally to prevent a chance for a tying 3-pointer.
 
     Kampe now has 500 victories according to NCAA records, although Oakland credits him with two more because of forfeits.

 MINNEAPOLIS (AP) – Minnesota Timberwolves guard Ricky Rubio has been added to the player pool for the rising stars game as part of the All-Star festivities. He’ll join teammate and fellow guard Alexey Shved at the February 15th event. Rubio played in the rising stars game last season.
 
     MINNEAPOLIS (AP) – Kevin Love is trying to assure his Minnesota Timberwolves teammates and fans that he’s committed to winning with the team that drafted him. Love joined the team at practice yesterday for the first time since having surgery on his broken hand last month. He says he hopes to be back on the court sometime next month.

     PEBBLE BEACH, Calif. (AP) – Two players are at 6-under through one round of the multi-course Pebble Beach Pro-Am.
 
     Russell Knox fired a 64 at the par-70 Monterrey Peninsula Shore Course, while Hunter Mahan a 6-under 66 at Pebble Beach.
 
     Greg Owen, Scott Langley and Ryuji Imada shot 5-under 65s at Monterrey. Matt Every, Ted Potter Jr. and Seung-Yul Noh are at 5-under 67.

     AUSTIN, Texas (AP) – A Dallas promotions company sued Lance Armstrong on Thursday, demanding he repay $12 million in bonuses and fees it paid him for winning the Tour de France.
 
     SCA Promotions had tried in a 2005 legal dispute over the bonuses to prove Armstrong cheated to win before it ultimately settled and paid him.
 
     Armstrong recently acknowledged using performance-enhancing drugs after the U.S. Anti-Doping Agency in 2012 detailed a sophisticated doping program by his Armstrong’s teams. Armstrong was stripped of his seven Tour de France victories and given a lifetime ban from sports.

BOSTON (AP) – Even before the first snowflake fell today, the storm poised to dump up to 3 feet of snow from New York City to Boston and beyond prompted schools closings, train suspensions and cancelation of thousands of flights. Widespread power outages are feared as wind gusts could reach 75 mph.
 
     BIG BEAR LAKE, Calif. (AP) – The heavily armed ex-Los Angeles police officer believed to have killed a police officer and two other people remains free today despite a massive manhunt near a ski resort where his burned truck and footprints were found. Christopher Dorner has promised in a rambling manifesto to bring “warfare” to police and their families.
 
     WASHINGTON (AP) – An expansion of gun sale background checks may be gaining currency through the efforts of a bipartisan quartet of senators, including two National Rifle Association members and two with “F” ratings from the firearms lobby. Public polling overwhelmingly supports such an expansion and the lawmakers’ efforts could boost chances of getting it passed.
 
     CLEVELAND (AP) – Prosecutors are hoping for a life prison term when the ringleader of beard- and hair-cutting attacks on fellow Amish gets sentenced today in Ohio. The case has shed unwelcome light on discipline and dissent in a community that tries to stay apart from modern culture. The ringleader, Samuel Mullet Sr., and 15 members of his extended family face sentencing in U.S. District Court.
 
     PARACHINAR, Pakistan (AP) – Government officials say a bomb planted near a market in northwestern Pakistan killed 10 people and wounded 23 others today. It’s the latest in an uptick in attacks in recent months. The blast occurred in a semiautonomous tribal region along the Afghan border where the military has been battling a domestic Taliban insurgency.
