LISBON, N.D. (AP) – A judge has ruled that the case against a Fort Ransom woman accused of battering her infant son to death should proceed.
Twenty-nine-year-old Jodi Lindvall was originally charged with murder and child abuse for the death of 22-month-old Bentley Lindvall, who died on Sept. 22.
Prosecutors say an autopsy determined the boy had been physically abused and died of a head injury. Lindvall told authorities her son hit his head while she was struggling to change his diaper.
Ransom County Judge Jay Schmitz ruled there’s probable cause for the murder case, but dismissed child abuse charges.
Arraignment for Lindvall is scheduled March 6.
MINOT, N.D. (AP) – A former Three Affiliated Tribes law enforcement officer accused of harboring two men who escaped from a New Town jail has been sentenced to probation.
Jessica Folden was charged in federal court with hindering law enforcement. The charge carries a maximum penalty of one year in prison.
Authorities say Jake White Body and Brandon Young Wolf were at Folden’s residence after they escaped from the Gerald Tex Fox Justice Center in New Town last May.
Folden allegedly lied to officers about the whereabouts of the fugitives and refused to let officers search her residence for several hours.
The two suspects were eventually apprehended.
U.S. District Judge Daniel Hovland sentenced Folden to 18 months of probation.
BISMARCK, N.D. (AP) – The North Dakota Supreme Court has ruled that more than 400 American Crystal Sugars workers in North Dakota who are locked out in a contract dispute are eligible for unemployment benefits.
The decision reverses a lower court’s ruling that said the workers were not eligible for benefits because North Dakota law prohibits unemployment insurance for workers involved in labor disputes.
Nearly 1,300 American Crystal Sugar workers in North Dakota, Minnesota and Iowa have been locked out since Aug. 1, 2011, after their union rejected the cooperative’s proposed contract.
Locked-out workers in Minnesota and Iowa were eligible for unemployment benefits.
Union spokesman John Riskey says “justice has been served” for the 420 workers affected in North Dakota.
North Dakota’s director of unemployment insurance did not immediately return a message for comment.
MINOT, N.D. (AP) – Minot officials are proposing that part of a half-cent city sales tax be used to help pay for a flood control project.
The money would come out of an existing tax that is now split with 50 percent going to capital improvements, 40 percent to economic development and 10 percent for property tax relief.
The new plan changes that formula to 50 percent for flood control, 25 percent for capital improvements, 15 percent for economic development, and 10 percent for property tax relief.
Minot is planning a $530 million flood control project. The Souris River flooded more than 4,000 homes and businesses in the summer of 2011.
The city council’s finance and improvements committee approved the plan Tuesday by a 4-3 vote.
GRAND FORKS, N.D. (AP) – The North Dakota Supreme Court has ruled against the man who wanted to be the North Dakota Libertarian candidate for governor.
The state had ruled earlier that Roland Riemers, of Grand Forks, didn’t qualify for the ballot because his lieutenant governor candidate didn’t turn in the right paperwork.
Riemers argued that the Democratic and Republican candidates for governor didn’t fill out their paperwork correctly either – and they should have been dropped from the ballot.
The Supreme Court ruled said in a ruling released Tuesday that there’s no evidence that the state discriminated against Riemers.
BISMARCK, N.D. (AP) – North Dakota’s House has defeated a measure to create a panel to investigate alleged acts of wrongdoing by politicians.
The Republican-led House voted 70-24 against forming an ethics commission.
House assistant Democratic leader Corey Mock of Grand Forks and Rep. Ed Gruchalla of Fargo sponsored the measure aimed at forming a nine-member ethics commission.
Backers of the proposal say North Dakota, Vermont and Wyoming are the only states that don’t have an ethics commission or committee.
The Legislature also defeated an attempt to create an ethics commission in 2011.
BISMARCK, N.D. (AP) – North Dakota’s Senate approved a measure Monday that closes loopholes used by oil companies in exchange for lower taxes.
The Republican-led body passed the bill 34-13. Democrats say the measure could cost the state billions of dollars in lost revenue in time.
Mandan Sen. Dwight Cook says the measure attempts to bring certainty to the tax code to keep companies drilling. The measure would cut the exemption for so-called stripper wells that is costing North Dakota about $50 million annually.
In exchange, the measure would charge oil companies an effective tax rate of 9.5 percent beginning in 2017 instead of the 11.5 percent tax rate they’re charged now.
Democratic Sen. Connie Triplett of Grand Forks was the bill’s biggest critic. She told fellow lawmakers, “We are giving away the farm.”
BISMARCK, N.D. (AP) – North Dakota’s House has defeated a measure that would have charged industrial water users an excise tax.
The House voted 57-36 Tuesday to kill the bill.
The measure was aimed at taxing oil and gas companies for water drawn from underground.
Fresh water is needed to support oil drilling and hydraulic fracturing, a process that uses pressurized fluid and sand to break open oil-bearing rock 2 miles underground.
Budget analysts say the tax would have raised nearly $20 million over the next two years.
BISMARCK, N.D. (AP) – North Dakota’s Senate has rejected a proposal to buy out the contract of University System Chancellor Hamid Shirvani, who has been on the job for less than a year.
Republican Sen. Tony Grindberg of Fargo offered a floor amendment Tuesday to the higher education funding bill to buy out the final two years of Shirvani’s three-year contract, at a cost of about $854,000.
Grindberg has questioned Shirvani’s leadership style.
Shirvani has been in charge of the university system since last July. His contract runs through June 2015. He is paid $349,000 annually.
MEDORA, N.D. (AP) – Fourteen people are on this year’s ballot for the North Dakota Cowboy Hall of Fame. Trustees will vote on the nominees by mail-in ballots and the inductees will be announced this spring. The induction ceremony is June 22nd in Medora.

ORLANDO, Fla. (AP) – Three fans injured last weekend during a NASCAR race the day before the Daytona 500 have hired a lawyer, but some experts say they could face tough obstacles in winning damages. Some point out that some courts have looked past liability waivers written on the backs of sporting event tickets. Others maintain a ticket is a legal contract that could be hard to overcome in a suit.
