Jamestown  (CSi) The week of April 30th has been designated, “Severe Summer Weather Awareness Week,” for the entire state of North Dakota.  This annual event is intended to remind the public of the dangers associated with severe summer weather including:  lightning, high winds, large hail, flash floods and tornadoes. All of which, can cause severe property damage, personal injury, and even death.

On Monday’s Wayne Byers Show on CSi Cable 2, Stutsman County, Emergency Manager, Jerry Bergquiest said in the past, as part of the awareness week activities, a statewide tornado exercise was initiated by the National Weather Service.  However, due to changes in warning technology, the statewide test can no longer be conducted.  But, because of the importance of the test, Stutsman County will conduct a modified exercise that will begin at about 11:15 a.m. Wednesday, May 2nd. The exercise will simulate what occurs locally when a tornado warning is issued by the National Weather Service.The sirens will operate for about 3 minutes at approximately 11:15 a.m.

The Regular first Wednesday of the month CSi Cable interrupt test from the LEC dispatch will be conducted independently  on Wednesday morning.

Barnes County Emergency Manager Sue Lloyd says there will be one North Dakota statewide “test” tornado warning on Wednesday, May 2nd, around 11:00 am Central Daylight Time.

A speaker was Lloyd Nelson concerning the StreetScape Project, concerning city funding sources.

He said downtown businesses should be assessed for the costs, and funding not come from other city funding sources.

Former Mayor Robert Werkhoven agreed that the local share of improvements should come from business owners.

Nelson added a petition to have the project put to a vote, has been rejected twice.

 

Also speaking was Gary Schelagel, who addressed street repair costs, and the method of repairs, siting full depth repairs, and removing drainage.  He pointed to the StreetScape Project.

 

ORDINANCE

The City Commission approved the second and final reading of, an Ordinance Amending Title 4, Alcoholic Beverages.  City Attorney Mertins outlined changes, including employees attending server training, time period, plus items removed concerning a roster of employees, along with adjustments to application of license requirements, and the license payment schedule.  Plus penalties if the license is not renewed or the payment is not received, on time.

 

NEW BUSINESS

City Commissioners, approved a Recommendation from Renaissance Zone Board for 523 Legacy Lane for a 5 year income tax exemption and a 5 year property tax exemption up to $250,000 for purchase of a new home, and designate it as VC-84 (pending receipt of Certificate of Good Standing)

 

Approved a Recommendation from Renaissance Zone Board for 1036 7th Avenue NW for a 5 year income tax exemption and a 5 year property tax exemption for new construction, and designate it as VC-108 (pending receipt of Certificate of Good Standing).

From the audience Lloyd Nelson suggested that when the tax exemptions are approved that assessments for other properties in town by reduced by  five percent for five years.

 

Approved was a Special Alcohol Beverage Event Permit for Hi-Line Hospitality at VCSU on May 10, 2018 for Employee Recognition Dinner.

 

 

Approved a Construction Engineering Services with KLJ for Paving Improvement District No. 116 in the amount of $56,500.

 

City Commissioners approved a Construction Engineering Services with KLJ for Sanitary Improvement District No. 62 in the amount not to exceed $6,700.

 

The City Commission approved a Construction Engineering Services with KLJ for Storm Sewer Improvement District No. 51 in the amount of $10,900.

 

Considered was implementation of Request For Proposal process for two 2019 Construction infrastructure projects that have not been assigned engineering firms.  City Administrator Schelkoph said the RFP will be sent to contractors, and the replys reviewed by a committee, including two city commission members, before coming for recommendation by the City Commission.

City Commissioners in favor with Commissioner Pedersen voting in opposition.

 

CITY ADMINISTRATOR’S REPORT

David Schelkoph reminded citizens that next week is citywide cleanup week, with items being collected during the regularly scheduled garbage pickup day.

He outlined other items such as what will be picked up and not picked up.

He asked that bags containing items not be excessively heavy, so they don’t break.

He pointed out that Main Street will be closed, possibly up to November this year, in addition to other street projects.

 

CITY UPDATES & COMMISSION REPORTS

City Attorney Mertins said, Robert Drake has served the city with notice to provide a review of the rejection of the petition to put to a vote the scope of the proposed StreetScape project.

Also, Drake has issued a restraining order, that bids for the project not be advertised for the project, until legal avenues have been addressed and decided.

Mertins says a court date has been set, to hear the restraining order.

City Fire Chief Gary Retterath said a Burn Ban is in effect for Valley City until further notice, due to the dry conditions, which includes all outdoor recreational burning.  It does NOT include the use of gas fired grills.

He added that officials continue to plan for Valley City hosting the  State Firefighters Convention this summer.

Mayor Carlsrud pointed out that city alleys will be addresses with maintenance, of the muddy conditions, after citywide cleanup week is over in two weeks.

The meeting was shown live on CSi 68 followed by replays.

 

 

Jamestown  (CSi) Jamestown Tourism Director, Searle Swedlund is hoping a middle ground and compromise can be reached concerning the issue of keeping open, or closing the entrance gate to Frontier Village.

On Tuesday’s Wayne Byers Show on CSi Cable 2 Swedlund said an issue is how to protect the Village from vandals and burglaries, while keeping it accessible to visitors and tourists, and still sending a message that the Village is open year ‘round including access to the Buffalo Statue, and National Buffalo Museum.

The Village has security cameras in operation, and police regularly patrol the Village.

Swedlund added the importance of winter access to the Village.

The Frontier Village Board, and City of Jamestown have held discussions on the gate issue, and at a recent City Council Finance Committee meeting, it was decided that a committee consisting of the Police Department, National Buffalo Museum, Tourism, and the Frontier Village, and City Council representative discuss the issues, and report back to the Legal Committee.

City Attorney Leo Ryan has said the access roadway needs to be open, and that city has options of having the police chief declaring the access road, it a “play street,” or the city may do so, to keep access through the Village. Ryan said if the gate was to be opened or closed, it would need to be done by a city employee.  The  North Dakota Century Code indicates that any gates be closed overnight.

The possibility of having the gate operated electronically has also been discussed.

 

Also  on our show Tuesday, Swedlund pointed out that the roadway and retaining wall project repair project has started adjacent to Frontier Village’s amphitheater, with the work anticipated to be completed this month.

Grant money from the North Dakota Department of Transportation has gone toward the project costs, to shore up the wall, while filling in the large hole in the pavement next to the wall.

Swedlund said that Tourism continues to work on promoting sites in Jamestown that are available to tourists, not found anywhere else, in addition to the Buffalo Statue.

He suggested that connections to Jamestown may include having private industry and businesses becoming more involved in promoting Jamestown.

 

 

Bismarck  (NDDOT) – The North Dakota Department of Transportation has started issuing the  “Real ID-compliant credentials.”

Driver’s license offices in Fargo and Minot will start issuing the credentials May 21, with Williston and Dickinson on May 22.  Grand Forks will issue them on May 23.

Jamestown and Devils Lake will begin May 24.

Just the Bismarck driver’s license location is issuing the Real IDs at this time.

Real ID requirements stem from 9/11 Commission recommendations.

Real ID compliant credentials meet “federal standards for physical security and verification of identity and legal presence in the United States.

The Real ID is indicated by a star in the upper right hand corner, of a drivers license, permit or ID.

Starting in October 2020, everyone will be required to have federally approved identification like a Real ID, or a passport to enter federal facilities or board a domestic flight.

Obtaining a Real ID-compliant credential is just like applying for a new driver’s license. There is no additional cost for a Real ID.

 

SALEM, Ore. (AP) — Jurors have convicted a former North Dakota college student in the killing of a drug dealer’s father in Salem, Oregon.

The Statesman Journal reports 24-year-old Denzel Hawthorne was found guilty of murder, but not guilty of aggravated murder on Monday. Sentencing has been scheduled for May 16.

Attorneys representing Hawthorne argued that their client wasn’t capable of murderous intent. They said he has an intellectual disability that was exacerbated by blows to the head he received while playing football in high school and at Trinity Bible College in Ellendale, North Dakota.

The day before the August 2016 shooting, Hawthorne and a college teammate drove to Salem from North Dakota to collect on a drug debt. The dealer wasn’t home, and a struggle with the man’s father ensued.

The teammate, Eloy Carrera, pleaded guilty to murder in February and was sentenced to at least 25 years in prison.

 

 

FARGO, N.D. (AP) — Planting of many crops is getting underway in North Dakota with the warmer spring weather over the past week.The federal Agriculture Department says in its weekly crop report that about 10 percent of the sugar beet crop is in the ground.Seeding of spring and durum wheat, canola, oats, barley and dry peas also has begun, though none of those crops is more than 3 percent complete.About half of the state’s topsoil and subsoil moisture supplies are rated adequate to surplus.Calving in North Dakota is three-fourths done, with cattle and calf conditions rated mostly fair to good.Eighty-eight percent of the state’s winter wheat crop is rated fair, good or excellent.

 

BISMARCK, N.D. (AP) — A federal judge has denied North Dakota’s request to delay part of a ruling that found problems with the state’s voter identification laws.

U.S. District Judge Daniel Hovland in his order Monday dismissed the state’s concerns that people could take advantage of expanded identification.

Hovland last month expanded the proof of identity Native Americans can use for North Dakota elections, and eliminated a requirement that those documents include residential street addresses. Those sometimes aren’t assigned on American Indian reservations.

North Dakota officials called that part of the ruling unworkable, and claimed someone with only a post office box could still vote where they don’t live.

Secretary of State Al Jaeger says the state is appealing the case.

 

 

 

WEST FARGO, N.D. (AP) — West Fargo police have arrested a driver that led officers on a pursuit during which speeds reached more than 100 mph.

Authorities say the man fled from a traffic stop about 11:30 p.m. Monday after hitting a curb. Police began a pursuit and chased the man through a construction zone.

KFGO reports officers ended the pursuit as the driver approached another construction zone. Officers used the vehicle’s license plate to trace the 27-year-old man to a home in Fargo where he was arrested.

 

 

BISMARCK, N.D. (AP) — A spokesman for Republican Rep. Kevin Cramer’s Senate campaign is apologizing for a photo in a fundraising letter that shows Cramer talking to two Democrats.

Campaign manager Patrick Finken says the photo was “inadvertently used” in a letter to potential Republican donors.

Katherine Satrum, one of the Democrats in the photo, sent a letter to the editor to North Dakota’s major newspapers last week criticizing Cramer for the photo. She says it was a “deliberate and dishonest attempt to mislead the public” that she was supporting Cramer.

Finken says the photo was taken in 2014 by Cramer’s daughter, Annie, at a Fourth of July celebration at the Capitol in Bismarck. Finken says the person who assembled the letter didn’t know the identities of people in the photo with Cramer.

 

 

BISMARCK, N.D. (AP) — Oil refineries in Mandan and Dickinson will be changing owners when Marathon Petroleum Corp. merges with Andeavor.

Andeavor was recently known as Tesoro. It employs 300 people at its two North Dakota refineries.

Marathon Petroleum is buying Andeavor for more than $23 billion, a transaction that would make the combined company the largest U.S. refiner. The combined company will have headquarters in Ohio and will be called Marathon Petroleum.

The Bismarck Tribune reports Andeavor also owns pipelines in North Dakota, natural gas processing plants near Belfield and New Town and a rail terminal at Fryburg. Marathon Petroleum owns an interest in the Dakota Access pipeline.

The merger is expected to close in the second half of 2018.

 

 

 

BISMARCK, N.D. (AP) — Regulators have approved a $1.8 million natural gas pipeline project in northwestern North Dakota.

ONEOK Rockies Midstream plans to convert an existing natural gas gathering pipeline and a portion of another gathering pipeline into a natural gas liquids transmission line.

The Bismarck Tribune reports the state Public Service Commission approved the Cherry Creek Pipeline project Monday, saying it will provide a safer transportation option and help reduce the wasteful flaring of excess natural gas in the oil patch.

The project will move up to 50,000 barrels of natural gas liquids from a gas processing plant in McKenzie County to a plant in Williams County, where it will go into the Bakken Pipeline.

The Cherry Creek Pipeline crosses the Missouri River and has shut-off valves on both sides of the crossing.

Unable to fight back from a nine-run deficit in the first inning, Valley City State University drops to 14-28 (NSAA 7-15) overall on the season going into the conference tournament.

 

 

College Golf…

WAVERLY, IA (Mark Potts) – Valley City State’s golf teams closed the season strong on Tuesday, shooting their best rounds of the NSAA Tournament during the fourth and final round.

The Viking men scored the second-best round of the day as they moved up to third place at the NSAA Tournament. Valley City State’s men carded a team total of 298 during Tuesday’s final round, finishing only behind Bellevue’s 291 for the day.

The strong finish helped the Vikings move past Viterbo University for third place overall at the tournament. VCSU entered the day seven shots behind Viterbo, but the Vikings were 14 shots lower than the V-Hawks during the final round.

NBA-GRIZZLIES-BICKERSTAFF

MEMPHIS, Tenn. (AP) — J.B. Bickerstaff will remain head coach of the Memphis Grizzlies after serving in an interim capacity this season.

Bickerstaff took over for David Fizdale in late November and went 15-48 amid a patchwork lineup. Mike Conley played just 12 games before undergoing season-ending surgery on his left heel and Achilles tendon. Tyreke Evans missed 30 games and JaMychael Green played just 55 of 82 games.

The Grizzlies did not disclose terms of Bickerstaff’s new deal. He will be introduced at a news conference Wednesday.

 

NHL-STANLEY CUP PLAYOFFS…

 

UNDATED (AP) — Last year’s Stanley Cup finalists find themselves trailing two games to one in their respective second-round series after losing on Tuesday.

Alex Ovechkin (oh-VEHCH’-kihn) scored with 1:07 left to give the Washington Capitals a 4-3 win over the Penguins at Pittsburgh. The Pens led 3-2 until Matt Niskanen beat Matt Murray just over five minutes into the third period.

Nicklas Backstrom set up second-period goals by John Carlson and Chandler Stevenson. Braden Holtby faced just three shots in the third period and finished with 19 saves.

Jake Guentzel (GEHNT’-sul) and Sidney Crosby each scored their eighth goal of the postseason and had an assist for the Penguins, who host Game 4 on Thursday.

In Winnipeg, the Nashville Predators squandered a 3-0 lead in a 7-4 loss to the Jets. Blake Wheeler broke a 4-4 deadlock by netting a power-play goal with 4:59 remaining.

Wheeler and Dustin Byfuglien (BUHF’-lihn) each scored twice for the Jets, who were blanked until Paul Stastny (STAS’-nee) beat Pekka Rinne (REE’-nay) 2:38 into the second period. Wheeler and Brandon Tanev (TAN’-ehv) put the game out of reach with empty-net goals.

Connor Hellebuyck (HEH’-leh-buhk) made 26 saves and settled down after yielding three goals on 12 shots in the opening period.

The series stays in Winnipeg for Game 4 on Thursday.

 

NHL-SENATORS-COACHES

OTTAWA, Ontario (AP) — Guy Boucher will be back behind the Ottawa Senators bench next season.

Senators general manager Pierre Dorion confirmed that Boucher and his assistants will return despite the club’s second-to-last place finish this season.

Dorion said Boucher would run the power play, while assistants Rob Cookson and Marc Crawford will join Boucher behind the bench.

Boucher’s future was in doubt after the Senators struggled to a 28-43-11 record.

UNDATED (AP) — The Atlanta Braves’ latest phenom looked pretty good against the New York Mets on Tuesday.

Mike Soroka picked up a victory in his major league debut and the Braves pulled within a half-game of the NL East lead by downing the first-place Mets, 3-2. Soroka allowed just one run over six innings and threw shutout ball until Yoenis Cespedes (yoh-EH’-nehs SEHS’-peh-dehs) hit a solo homer in the sixth.

Freddie Freeman hit a two-run double while Atlanta scored three times in the first inning off Noah Syndergaard (SIHN’-dur-gahrd). Rookie Ronald Acuna (ah-KOO’-nuh) Jr. scored a run and was among six players to collect two of the Braves’ 15 hits.

Checking out Tuesday’s other major league action:

— Yadiel Rivera was just 2-for-20 this season before delivering a walk-off single in the 10th inning to send the Marlins to their fourth consecutive win, 2-1 over the Phillies. Cameron Maybin tripled and scored the winning run that sent Philadelphia to its fourth straight loss.

— Bryce Harper was moved to the leadoff spot for the first time in five years and responded with a three-run homer to break a 5-for-36 slump in the Nationals’ 12-4 pounding of the Pirates. Max Scherzer is 6-1 after winning his fifth straight start, allowing two runs and three hits while striking out eight in 6 1/3 innings.

The Cardinals stopped a three-game skid by scoring twice in the bottom of the ninth to beat the White Sox, 3-2. Matt Carpenter tied it with a homer before Marcell Ozuna (oh-ZOO’-nuh) doubled and scored the winning run on Yadier (YAH’-dee-ehr) Molina’s single.

— Ryan Braun’s two-run double put the Brewers ahead to stay in a 7-6 verdict over the Reds. Travis Shaw broke his 0-for-19 slump with a two-run homer, while Jesus Aguilar and Hernan Perez added solo shots.

— Charlie Blackmon and David Dahl hit back-to-back homers off Kyle Hendricks to begin the Rockies’ 3-1 win over the Cubs in Chicago. Nolan Arenado (ar-eh-NAH’-doh) also went deep and Jon Gray tossed three-hit ball over seven innings to help Colorado end the Cubs’ season-high five-game winning streak.

— Daniel Descalso atoned for a big error by providing a go-ahead, two-run triple in the seventh inning to send the Diamondbacks to their fifth win in six games, 4-3 over the Dodgers. A.J. Pollock homered for the fourth time in two nights, and pinch-hitter Christian Walker smacked a 479-foot solo shot as Arizona pulled even with Boston for the majors’ top record at 21-8.

— The Padres downed the Giants, 3-2 on Eric Hosmer’s tiebreaking homer in the ninth. Hosmer also tripled earlier and scored, and Christian Villanueva hit his ninth home run of the year to help San Diego win for the third time in 10 games.

— Jorge Soler (HOHR’-hay soh-LEHR’) unloaded a three-run homer off Brian Johnson in the 13th inning before the Royals hung on for a 7-6 win at Boston. The Red Sox were two outs away from improving to 22-7 until Alex Gordon went deep off Craig Kimbrel in the ninth.

— Gary Sanchez broke a scoreless tie by slamming a three-run homer off Ken Giles in the ninth to send the Yankees to their 10th win in 11 games, 4-0 over the Astros. Houston wasted a strong pitching performance from Justin Verlander, who tied a career high with 14 strikeouts while limiting New York to three hits over eight shutout innings.

— Kendrys Morales homered twice and reached base five times to help the Blue Jays knock off the Twins, 7-4 in 10 innings. Toronto scored twice on wild pitches in the final inning to send Minnesota to its 11th loss in 12 games.

— The Angels pulled out a 3-2 win over the Orioles on Justin Upton’s RBI single in the bottom of the ninth. Nick Tropeano pitched scoreless one-hit ball into the seventh inning, but Los Angeles coughed up a 2-0 lead in the ninth before halting a four-game skid.

— Dee Gordon went 5-for-5 and Nelson Cruz crushed a three-run homer in the fifth inning to put the Mariners ahead to stay in a 6-3 decision over the Athletics. Felix Hernandez gave up three runs and just three hits over six frames as Seattle improved to 17-11.

— Joey Gallo and Isiah Kiner-Falefa homered on consecutive pitches off Nick Goody in the 12th inning to power the Rangers past the Indians, 8-6. Texas recovered after Michael Brantley belted a game-tying grand slam with two out in the ninth.

— The Rays lost for only the second time in 11 games as Matthew Boyd held them to a run and seven hits in six innings of Detroit’s 2-1 victory. Nicholas Castellanos and Leonys Martin (lee-OH’-nees mahr-TEEN’) sandwiched RBI doubles around Matt Duffy’s run-scoring grounder.

UNDATED (AP) — The Giants announced good news and bad concerning their pitching staff on Tuesday.

Johnny Cueto (KWAY’-toh) has been placed on the 10-day disabled list with inflammation in his pitching elbow. Cueto leads the majors with a 0.84 ERA and is 3-0 with 26 strikeouts in 32 innings over five starts.

The Giants also said ace Madison Bumgarner has been cleared to resume throwing. Bumgarner broke the pinkie on his left hand in the team’s final spring training game and is at least a month away from returning.

In other major league news:

— The Twins have placed third baseman Miguel Sano (sah-NOH’) on the 10-day disabled list with a strained left hamstring. Sano is batting just .213 with four doubles, five home runs, 14 RBIs and nine walks in 20 games.

— Angels closer Keynan Middleton has landed on the DL with right elbow inflammation. He felt pain in his elbow last weekend, but Middleton said his elbow already felt better with two days of rest.

— Right-handed starter Erasmo (eh-RAS’-moh) Ramirez and righty reliever Dan Altavilla have been put on the 10-day disabled list by the Mariners. Ramirez has a strained muscle in his right rotator cuff and is expected to miss a month. Altavilla has inflammation in the AC joint of his right shoulder.

— The Athletics and Mariners will open next season with a two-game series in Tokyo on March 20 and 21. It will mark the fifth time Major League Baseball will start the season in Japan. The A’s and Mariners also faced each other in the last opening series at the Tokyo Dome, splitting two games in 2012.

ORCHARD PARK, N.Y. (AP) — Russ Brandon has abruptly resigned his dual role as president of the NFL’s Buffalo Bills and NHL’s Buffalo Sabres. The decision comes after he was confronted by owners Terry and Kim Pegula regarding an inappropriate relationship with a female employee. That’s according to two people with direct knowledge of the situation.

The Pegula’s did not provide a reason for accepting the resignation.

Kim Pegula will take over Brandon’s roles overseeing the Bills, Sabres and Pegula Sports Entertainment, the company which controls the owners’ numerous holdings.

 

KENTUCKY DERBY

Justify is early favorite

LOUISVILLE, Ky. (AP) — Justify has been made the early 3-1 favorite for Saturday’s Kentucky Derby and has drawn the No. 7 post.

Justify is 3-0 in his brief career, winning by a combined 19 lengths. He didn’t race as a 2-year-old.

Europe-based Mendelssohn the second choice at 5-1 and will start from the 14th post among the 20-horse field in the 144th Run for the Roses. No European horse has ever won the first jewel of the Triple Crown.

 

TENNIS-WIMBLEDON PRIZE MONEY

LONDON (AP) — The winners of the singles titles at Wimbledon will each receive just over $3 million as part of a 7.6 percent increase in the total prize money at this year’s tournament.

The All England Club says the total prize fund will be $46.5 million.

First-round losers will receive $53,000, but they may have to forfeit their prize money if they retire from the match or perform “below professional standards.”

Injured players will receive 50 percent of their first-round prize money if they withdraw on site by the Thursday before the start of play. An injured player’s replacement would take the other 50 percent.
