Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council met in Special Session, and then recessed into closed Executive Session on Wednesday morning, (Mar 13, 2013) at City Hall.

The purpose of the session was to consult with the City Attorney concerning territorial service claims made by Stutsman Rural Water District.

At issue is whether the City of Jamestown, or Stutsman Rural Water District is to serve the area west of Jamestown, in this case, specifically the Titan Machinery building, under construction, across from Jamestown Regional Medical Center.

Attending the Executive Session were: Mayor Andersen, City Council Members Kourajian, and Brubakken….City Administrator Jeff Fuchs, Assistant City Attorney Mary Jensen, City Attorney Ken Dalsted on the phone, along with legal counsel Tammy Norgaard, from the Vogel Law Office in Fargo, also on the phone, and City Engineer Reed Schwartzkopf, along with City Fire Chief Jim Reuther.

Following the closed Executive Session, the City Council reconvened into the open Special Session.

Mayor Andersen said there was no action to be taken by the City Council and the meeting was adjourned.

The open portion of the meeting was shown live on CSi 67.

Under a previous Resolution, the City Council, on March 6, 2013, tabled consideration of awarding bids for the water and sewer district that would service the Titan Machinery building under construction across from Jamestown Regional Medical Center, which needs to be awarded by March 30th this year, or re-bid.

Despite the continued impasse, construction on the Titan building has restarted.

C.I. Construction, President and project manager for the Titan Machinery project, Robert Thompson says, construction workers have installed a water line from the building to the east edge of the property, allowing continued construction of the building and space around the structure.

Thompson adds the plan is to finish the building and have either the City of Jamestown or Stutsman Rural Water connect to its line after a decision is reached, as to which entity will provide Titan with water.

BISMARCK, N.D. (AP) – The North Dakota Aeronautics Commission says 8,000 more passengers boarded airlines in the state than during the previous February

Williston led the way with a boarding increase of 138 percent, but Minot, Bismarck, Grand Forks and Fargo also had their best Februarys on record.

Statewide, boardings climbed by more than 10 percent to 93,679 in February.

Boardings at Jamestown Regional Airport in February 2013 were 184, compared to 797 in February of 2012. The lowest number sine 149 passengers boarded in Jamestown in 2008.

Commission director Larry Taborsky says statewide, airlines have been responding to increased demand by increasing the number of flights and available seats.

Taborsky says that if North Dakota airports had additional capacity, the numbers would be even higher.

Jamestown, ND (KCSi-T.V. News) — The Jamestown Fire Department is hosting a “Volunteer Firefighter Recruitment Presentation” on March 26th, 2013 at the main fire station at 7:00pm.

Some nearby homes and a crew camp were evacuated as a precaution. McKenzie County Emergency Manager Jerry Samuelson says residents were allowed back in a few hours and no injuries were reported.

The company provides insulation for tanks used in the oil fields. Samuelson says company officials told authorities there were no toxic chemicals on site.

DICKINSON, N.D. (AP) – Trial has been scheduled next month for a Dickinson insurance agent accused of stealing $30,000 from a client.

Assistant Attorney General Jon Byers says Scott Biggs has rejected a proposed plea agreement.

Judge Zane Anderson set trial for April 3-5.

State Insurance Commissioner Adam Hamm has ordered Biggs to stop doing business in North Dakota.

FARGO, N.D. (AP) – A federal appeals court has upheld the conviction and sentence of a North Dakota woman convicted of embezzling from the Spirit Lake Tribe.

Patricia Robertson was convicted in October 2011 on theft and embezzlement charges. She was sentenced to probation and ordered to pay back nearly $5,500.

Robertson argued in her appeal that the conviction should be overturned because of errors during jury instructions, and the sentence was not valid because of a special condition prohibiting her from consuming alcohol.

The 8th U.S. Circuit Court of Appeals denied both claims in a ruling released earlier this week.

GRAFTON, N.D. (AP) – A former stockbroker in Grand Forks and Grafton who scammed six clients out of about $1.9 million has been sentenced to two years in prison.

Judge Laurie Fontaine also ordered 59-year-old Ross Haugen to pay back the money and to serve nine years of supervised probation after his prison term.

Haugen pleaded guilty to seven felony charges in January. He initially had faced 60 charges in a case that took three years to resolve.

Haugen earlier lost both his federal and state securities licenses.

BISMARCK, N.D. (AP) – North Dakota’s Senate may vote Friday on a pair of anti-abortion measures already approved by the House.

The Senate Judiciary Committee on Wednesday gave a “do-pass” recommendation to a House bill that would prevent women from having abortions based on gender selection or a genetic defect like Down syndrome. The Senate committee also recommended passage of a House bill that would ban doctors from performing an abortion if a fetal heartbeat is detected.

The committee gave a 4-3 “do pass” recommendation on both measures.

BISMARCK, N.D. (AP) – Several North Dakota lawmakers have proposed legislature that would have the state department of health establish and administer an autism spectrum disorder database.

The bill would include a record of all reported cases of autism spectrum disorder in the state, as well as other information deemed relevant and appropriate by the state department .
Backers say the goal is to complete surveys of the disorder, enabling research and analysis, and provide services to individuals who need them.

The bill states that the reporting would have to be done by a doctoral-level professional with experience treating autism spectrum disorders.

BISMARCK, N.D. (AP) – St. James Basilica’s, clergy and congregation in Jamestown celebrated the selection of a new pope Wednesday, including the ringing of bells, a special Eucharist and display of the papal flag.

Bismarck Bishop David Kagan says the election of Argentine Cardinal Jorge Bergoglio (HOHR’-hay bur-GOHG’-lee-oh) as Pope Francis marks a joyous and holy moment. Kagan says that with the election the ordinary work of the Holy See will begin again, including the appointment of a new bishop for the Diocese of Fargo.

BISMARCK, N.D. (AP) – A Powerball ticket sold at a Cenex store in the North Dakota city of Wahpeton is worth $1 million.

The ticket matched the first five numbers but missed the Powerball in Wednesday’s drawing. The first five numbers are 5, 9, 28, 32 and 38, and the Powerball is 29.

North Dakota lottery officials say the winning ticket is the largest sold in the state this year. The winner did not immediately come forward.

The North Dakota ticket was one of five $1 million winners. There were two in Florida, one in Kentucky and one in New Hampshire.

No one won the jackpot. The top prize goes to an estimated $216 million for the Saturday drawing.

Powerball is played in 42 states, the District of Columbia and the U.S. Virgin Islands.

In sports…

FARGO, N.D. (AP) – The Fargo Park Board has decided to make the city’s discounted golf passes more inclusive.

The  unanimous decision by the park board comes after park officials denied a family pass to a lesbian couple legally married in Iowa.

The board’s decision changes the name of the discounted pass from “family” to “household,” and a couple no longer needs to be married to get one.

Board President Joel Vettel says the focus is to get more people involved in making use of the city’s parks. He says the Board is not about defining marriage, but about parks and recreation.

The couple who were denied a pass says they were elated the Board decided to change the passes.

NBA…

MINNEAPOLIS (AP) – Timberwolves forward Kevin Love met with a specialist yesterday to examine his surgically repaired hand, and it doesn’t appear he’ll be back anytime soon. The team says Love’s hand is “healing properly,” but he hasn’t been cleared for full practice yet. His next evaluation by doctors won’t come for another two to three weeks.

ATLANTA (AP) – Just when the Lakers were finally looking like the team everyone expected them to be, Kobe Bryant crumpled to the court.

Now, that playoff push in Los Angeles looks a lot more tenuous.

Bryant went down with a severely sprained left ankle after missing a game-tying shot in the closing seconds of a 96-92 loss to the Atlanta Hawks on Wednesday night.

While X-rays were negative, the Lakers said their star was out indefinitely.

TORONTO (AP) – Toronto Raptors forward Andrea Bargnani (ahn-DRAY’-uh barn-YAH’-nee) is expected to miss the rest of the NBA season with an elbow injury.

The Raptors say the injury is not related to Bargnani’s previous right elbow ailment that forced him to miss 26 games earlier this season.

TENNIS…

INDIAN WELLS, Calif. (AP) – Top-ranked Novak Djokovic (NOH’-vak JOH’-kuh-vich) has defeated Sam Querrey 6-0, 7-6 (6) to reach the quarterfinals of the BNP Paribas Open in a match that began four hours late after a marathon day. Djokovic was brutally efficient in the first set after walking unsmiling onto the court early today as the remaining fans made their way from the stadium’s upper reaches to the lower bowl. Querrey, who will take over as the top-ranked American in the next ATP Tour rankings, fought back in the second set.

NFL…

ENGLEWOOD, Colo. (AP) – The Denver Broncos have signed Pro Bowl wide receiver Wes Welker to a two-year contract. Welker is the premier slot receiver in the league, catching 118 passes for 1,354 yards and six TDs for New England last season. He spent his last six seasons with the Patriots, catching 672 passes for 7,459 yards and 37 touchdowns.

ALLEN PARK, Mich. (AP) – Reggie Bush is joining the Detroit Lions, giving them another speedy playmaker for an offense that already includes star receiver Calvin Johnson. Meanwhile, the agent for Jason Jones says the 26-year-old defensive end has agreed to terms with the Lions. And the agent for Detroit cornerback Chris Houston says the player has also agreed to a new deal that will keep him with the Lions.

VATICAN CITY (AP) – Pope Francis has started the day with a prayer at Rome’s main basilica. He’s also celebrating an inaugural Mass in the Sistine Chapel, where cardinals yesterday elected him leader of the Catholic Church. The Vatican says Francis may be meeting with his predecessor Benedict in a few days.

BAGHDAD (AP) – Iraqi authorities say several coordinated blasts have rocked central Baghdad today, and gunmen are locked in a battle with security forces. Authorities say at least 12 people have been killed and at least 30 are wounded. The attacks happened near the heavily fortified Green Zone that houses several foreign embassies and Iraqi government offices.

HERKIMER, N.Y. (AP) – Authorities say the suspect in the fatal shooting of four men in neighboring upstate New York villages was holed up in a small, cluttered room in an abandoned bar when he died in a shootout with police SWAT teams.
State police Superintendent Joseph D’Amico says 64-year-old Kurt Myers fired through a first-floor door after troopers and FBI agents entered around 8 a.m. Thursday, killing an FBI dog sent into the room.
D’Amico says police returned fire, killing Myers.
His death ended a nearly 19-hour standoff that began after police say he killed four men and wounded two others at a barber shop in Mohawk and a car care business in Herkimer.
D’Amico says police still don’t know why Myers went on the shooting rampage.
TOKYO (AP) – Honda is recalling nearly 250,000 vehicles in the U.S, Japan and several other countries because their brakes can suddenly kick in even when the driver isn’t braking. Some of the models affected are the Acura RL and MDX models and the Pilot. And they all were made from March 2004 through May 2006. Honda says no accidents have been blamed on the problem.

MIAMI (AP) – A Carnival cruise ship is reporting equipment problems in the Caribbean, one month after another of the company’s ships had tourists stranded for five days in the Gulf of Mexico with no power. The U.S. Coast Guard says the Carnival Dream’s captain is reporting possible trouble with the ship’s propulsion system. The ship is docked in St. Maarten. The Coast Guard says the ship’s sewer and power are working.
