Valley City, ND (KCSi-T.V. News Mar 27, 2013) — The Valley City Commission met in Special Session Wednesday (Mar 27, 2013) at 8-a.m. at City Hall.  All Commissioners were present with Commissioner Luke participating via telephone.

Commissioners overviewed the spring 2013 flood forecast with U.S. Army Corps of Engineers Bald Hill Dam, Manager Rich Schueneman.

He said, as of this morning the Lake Ashtabula level was at 1257. 15 feet, with the maximum draw down scheduled for 1257 feet..

The Bald Hill Dam release this morning was cut to 100-120 cfs.

He said the release will continue to be cut back to match inflows.

He pointed out that the flood buyouts in Valley City has eliminated the need for 200,000 sandbags should the need for flood protect arise.

Schueneman pointed out that the latest snow pack moisture survey indicates 2-4 inches locally and about 3-5 inches in the upper basin, which he said is good figure right now.

He added that the National Weather Service will issue an updated seven day forecast this Friday.

He said the river level, trigger that requires the installation of clay dikes on the Sheyenne in Valley City is 17 feet and at 18 feet the flow is 5500 cfs through Valley City.

A Valley City Public Works budget update was presented by City Administrator David Schelkoph, which is planned to be regularly updated.

He presented the five year overview history of each of the department’s budgets.

He projects a profit in the electrical department.

He pointed out if the AMI meter reading proposal is approved, it will mean a reduction in overall costs.  A public meeting is planned for April 4, 2013.

Each department’s estimated incomes were projected, with the electrical department income projected at $7.169 million.

The Water Department budget was broken down to Treatment Plant income, and operations and maintenance.

Discussions included the AMI and Electric Fund Payback Funds

He said cash on hand is about $5.829 million.

Schelkoph pointed out improvements to the downtown electric substation, and a transformer change out.

Capital Improvement projects are earmarked at $1.4 million.

The Commissioners discussed transfers from the city’s electric fund to other utilities and for permanent flood control in Valley City, which includes $1 million.

More decisions will be made based on action by the State Water Commision.

Jamestown, ND (KCSi-T.V. News Mar 26, 2013)– Area law enforcement were alerted to an airplane that made a forced landing, on Tuesday afternoon.

Stutsman and LaMoure County Sheriffs Offices were alerted just before 2-p.m.

Stutsman County Sheriff Chad Kaiser said he was contacted by Minneapolis air control that a small plane was having mechanical difficulty and was going down in a field, about 18 miles south of Jamestown and about a mile west along county road 46.

The incident was reported by another aircraft flying within range of the plane that was having the problem, and that it was going to land.

The plane, a 1978 Cesna 172,  landed safely  in the field, and was located by authorities, a half mile southwest of the intersection of Highway 281 and Highway 46.

Highway Patrol Sgt., Thomas Herzig reports, the pilot, 46 year old Keith Melius of Faulkton, South Dakota, maintained control of the plane, during the landing on the snow covered field.

He was not injured, the aircraft sustained some damages, yet to be determined.

 The incident remains under investigation by the Federal Aviation Adminstration, and the National Transportation Safety Board.

 

BISMARCK, N.D. (AP Mar 26, 2013) – North Dakota Gov. Jack Dalrymple acknowledges a court battle is likely after he signed legislation banning most abortions if a fetal heartbeat can be detected – something that can happen as early as six weeks into a pregnancy.

 

The Republican governor says in a statement that “the likelihood of this measure surviving a court challenge remains in question.” He calls the measure “a legitimate attempt by a state legislature to discover the boundaries” of the U.S. Supreme Court’s 1973 Roe v. Wade ruling.

 

Dalrymple on Tuesday also signed into law another measure that would makes North Dakota the first to ban abortions based on genetic defects such as Down syndrome. He also endorsed a measure that requires a doctor who performs abortions to be a physician with hospital-admitting privileges.

Dalrymple says he fielded scores of telephone calls in the days leading up to his decision to sign three anti-abortion bills that make the state the most restrictive in the nation to get an abortion.
 
     He told The Associated Press on Tuesday night that calls were evenly divided between people supporting the bills and those calling on him to veto them.
 

After Dalrymple signed three bills that would make North Dakota the most restrictive state in the nation to get an abortion, he stopped short of saying whether he might sign a fourth.
 
     The Republican governor told The Associated Press on Tuesday: “I’ve already signed three bills. Draw your own conclusion.”

BISMARCK, ND – Gov. Jack Dalrymple today (Mar 26, 2013) signed HB 1305, HB 1456 and SB 2305 and provided the following statements to the Legislature:

North Dakota House and Senate presiding officers:

I have signed HB 1305 which would ban abortions performed solely for the purpose of gender selection and genetic abnormalities.

I have signed HB 1456 which would ban abortions after the detection of a fetal heartbeat. Although the likelihood of this measure surviving a court challenge remains in question, this bill is nevertheless a legitimate attempt by a state legislature to discover the boundaries of Roe v. Wade. Because the U.S. Supreme Court has allowed state restrictions on the performing of abortions and because the Supreme Court has never considered this precise restriction in HB 1456, the constitutionality of this measure is an open question. The Legislative Assembly before it adjourns should appropriate dollars for a litigation fund available to the Attorney General.

I have signed SB 2305 which requires admitting and staff privileges at a nearby hospital for any physician who performs abortions in North Dakota. The added requirement that the hospital privileges must include allowing abortions to take place in their facility greatly increases the chances that this measure will face a court challenge. Nevertheless, it is a legitimate and new question for the courts regarding a precise restriction on doctors who perform abortions.

 

　BISMARCK, N.D. (AP) – The director of North Dakota’s sole abortion provider says people stopped by the downtown Fargo facility to donate cash shortly after Gov. Jack Dalrymple signed the nation’s most restrictive abortion legislation. Red River Women’s Clinic director Tammi Kromenaker calls the legislation “extreme and unconstitutional.”  Kromenaker says Dalrymple has “awoke a sleeping giant” by approving the legislation.

 

Jamestown, ND (KCSi-T.V. News) Temple Baptist Church in Jamestown will present “The Passion Play,” written by Debbie Kercher, in 2000, with performances March 28-March 31,2013, at 7-p.m., nightly, with the church located at 1200 12^th Avenue, Northeast, near Jamestown High School.

“The Passion Play,” is a musical drama depicting the last week of Jesus’ life.

The play is a mix of drama and contemporary Christian music. Most of the dialogue comes directly from the Bible.

Pastor Randy Jaspers on Tuesday’s (Mar 26, 2013) Wayne Byers Show on CSi Cable 2, said, the play has 8 different scenes… 13 songs… and about 80 cast members.

He added, at the new church location the audience will be close to the stage, to “See, Feel, and hear the Good News of God’s greatest gift.”

Seating is expanded, but limited to 400.
There is no charge for the performance and no reserved seating.

The play runs about an hour and 45 minutes, and may be too intense for very young children, as the crucifixion is intensely portrayed, with the role of Jesus played again by Chirs Hoak.

This is the 7th time the church has offered the play, the first in its new facility.

The first time the play was offered was in 2001 at TBC’s former home on 4th Avenue NW.

The last time TBC offered the Passion Play was in 2009, prior to the construction of its present facility in NE Jamestown.

He said the response was overwhelming.

Since that initial performance the church has offered the play three times at the Reiland Fine Arts Center and twice at the Jamestown High School Theatre.

Over the years he said, the play has remained much the same, with some adjustments in music and enhanced scenery.

The biggest change is in the personnel, most of whom call TBC their home, with about a third to one half of the cast and crew new to the production this year.

There is no admission charge, and those planning to attend should arrive at the church a half hour before the play starts.

 

BISMARCK, N.D. (KCSi-T.V. News Mar 26, 2013) – The N.D. Governor’s Committee on Aging will sponsor a health and wellness forum on Tuesday, April 9, 2013, from 9 a.m. to 1:15 p.m. at the Valley City Senior Center, 139 Second Ave. S.E.

The forum will feature state and local health experts with tips on healthy living, maintaining independence, proper nutrition, and identity theft prevention. The event is free and open to the public.

The event kicks-off with a presentation on proper nourishment of bones and joints by Ellen Bjelland, North Dakota State University Extension Agent from Barnes County. Later in the morning, attendees will learn about proper use of over-the-counter medications from Amy Noeske, a pharmacist from Mercy Hospital. The final morning session will focus on healthy meal planning and cooking for one led by Sharon Buhr, a dietician from Mercy Hospital, and Michon Kysilka, a dietetic student from the University of North Dakota.

The afternoon will feature a presentation on document security and retention and scam prevention. Secure shred bins will be available free of charge for anyone interested in properly disposing of any personal documents. Delores Rath, a member of the Governor’s Committee on Aging, will discuss the committee’s role and community supports and services that are available for independent living.

A senior meal will be served at noon. Reservations are required and can be made by calling 701-845-4300 by Monday, April 8. The suggested donation for the meal cost is $3.50 for people over the age of 60, and $6.25 for other attendees.

“Health prevention and wellness is important to the vitality of a community,” said Carrie Thompson-Widmer, Regional Aging Services program administrator for South Central Human Service Center. “This event will provide face-to-face conversation, good information, and offers something for everyone.”

Forum sponsors include the Governor’s Committee on Aging, N.D. Department of Human Services’ Aging Services Division, South Central Human Service Center, and the Valley City Senior Center.

GRAFTON, N.D. (AP) – A Minnesota man has been sentenced to a year in prison for forcing his girlfriend and her 6-year-old daughter to stand outside in the cold in northeastern North Dakota.
 
     Authorities say 44-year-old Scott Boothman, of Warroad, Minn., was driving with his girlfriend and her girl from Warroad to Grand Forks on Dec. 9 when he forced them to stand outside at an Interstate 29 exit near Grafton after an argument. The woman and girl were not hurt despite the wind chill being as cold as 30 degrees below zero.
 
     Boothman was arrested following a chase with police that authorities say reached speeds of 100 mph. He pleaded guilty in January to reckless endangerment and drunken driving. He initially had faced a more serious charge of terrorizing.

 

 FARGO, N.D. (AP) – Fargo police say they’ve arrested a 58-year-old man on suspicion of aggravated assault after a stabbing in the city.
 
     Lt. Joel Vettel says a man was taken to a local hospital for injuries consistent with being stabbed with some sort of edge weapon during an incident on 10th St. South.
 
     The man who was arrested has not yet been formally charged.

 

 BISMARCK, N.D. (AP) – A 19-year-old woman accused of robbing two Bismarck businesses and participating in a burglary has pleaded guilty to six felony charges. The Bismarck Tribune reports that Justice Maxine Lange pleaded guilty yesterday to five counts of conspiracy to commit robbery and one count of conspiracy to commit burglary. She’ll be sentenced at a later date.

 

BISMARCK, N.D. (AP) – North Dakota’s Senate has shot down a measure to allow bottle rocket sales in the state.
 
     The Senate voted 29-17 on Tuesday to keep the 4-year-old ban in place.
 
     Eye doctors prompted the Legislature to ban bottle rocket sales in 2009, saying the fireworks cause eye injuries. An effort to overturn the ban failed in 2011. 
 
     The current law still allows people to possess and shoot off bottle rockets but businesses in North Dakota can’t sell them.

 

WILLISTON, N.D. (AP) – Williston city commissioners have rejected a request from 10 local pastors that would have paved the way for concealed guns in churches.
 
     The pastors say they don’t necessarily plan to allow concealed weapons, but they want the decision left up to churches and not the government. The Rev. Will Page says, “somewhere in this country there is some evil man that is plotting another mass murder.”
 
     Thecommissioners on Tuesday night expressed concerns about safety if churchgoers are allowed to carry concealed weapons. Commissioner Tate Cymbaluk said if numerous people had guns, it could lead to a dangerous crossfire.
 
     The commission voted 4-1 to deny the petition.
 
     State lawmakers are considering a bill that would allow concealed weapons in a church if the church approves it.

 

 DICKINSON, N.D. (AP) – Bismarck-based MDU Resources Group Inc. and Indianapolis-based Calumet Specialty Products Partners have broken ground for a diesel refinery in North Dakota. The $300 million Dakota Prairie Refinery on 318 acres west of Dickinson will process up to 20,000 barrels of oil daily.

 

 WASHINGTON (AP) – Sen. Heidi Heitkamp says New York Mayor Michael Bloomberg should worry about crime and gun issues in his own city, not North Dakota.
 
     The North Dakota Democrat is responding to a $12 million national ad campaign launched by Mayors Against Illegal Guns, a group Bloomberg is supporting and co-founded. The ads support background checks. About $156,000 will be spent to run the ads in North Dakota.
 
     Bloomberg announced the ads on Saturday.

     FARGO, N.D. (AP) – Two unanimous selections – Bismarck Century senior Hannah Larson and Fargo North senior Kira Larson – lead the list of honorees on the North Dakota Class A all-state girls basketball first team.
 
     The all-state team – selected by the North Dakota Associated Press Sportscasters and Sportswriters Association – includes 11 athletes.
 
     Joining Hannah Larson and Kira Larson on the first team are Grand Forks Red River senior Ellie Ripplinger, Jamestown senior Kyra Dewald and Fargo Shanley freshman Sarah Jacobson.
 
     Hannah Larson capped her prep basketball career by helping the Patriots to their second consecutive state championship. She was named Miss Basketball.
 
     Larson, a 6-foot forward, averaged 15 points per game, 11.3 rebounds per game, 2.7 assists per game, 2.8 blocks per game and 2.2 assists per game for the Patriots. She also was an all-state, first-team selection in volleyball, but has chosen to play basketball in college. Larson has yet to decide where she will play.

 

GRAND FORKS, N.D. (AP Mar 27, 2013) – The University of North Dakota men’s hockey team is ranked seventh in both national polls heading into the NCAA tournament.

UND slipped one spot in both the USCHO.com and USA Today/USA Hockey Magazine polls.

UND plays Niagara on Friday in the opening game of the NCAA West Regional at Grand Rapids, Mich. Niagara is ranked 14th in both polls.

Quinnipiac once again holds the top spot in both polls.

 

   MINNEAPOLIS (AP) – Minnesota athletic director Norwood Teague is set to begin searching for Tubby Smith’s replacement. The men’s basketball coach was fired after the Gophers were eliminated from the NCAA tournament. Virginia Commonwealth’s Shaka Smart and former Timberwolves coach Flip Saunders are among the names that have been floated as possible replacements.

     UNDATED (AP) – Kyle Lohse (lohsh) and the Milwaukee Brewers have put the finishing touches on their three-year, $33 million contract. The last big-name free agent to sign with a team, Lohse joins a club that has had a suspect rotation. A year ago with the Cardinals, Lohse was 16-3 with a 2.86 earned run average.

Detroit is rounding out its pitching staff. Rick Porcello has earned the No. 5 starter’s job in the Tigers’ rotation, and Drew Smyly will start the season in the bullpen.

The trade sending outfielder Vernon Wells to the Yankees from the Angels has been completed, with Los Angeles picking up about $28.5 million of the $42 million Wells is owed over the last two years of his contract.
 
    NASCAR-FONTANA FALLOUT

     CHARLOTTE, N.C. (AP) – NASCAR has declined to dole out any punishment for altercations that occurred during and after Sunday’s race at Fontana, Calif.
 
     Circuit chairman Brian France says that the contact between Joey Logano and Denny Hamlin as they battled for the win was just the kind of throwback racing he expects out of his drivers and the new Gen-6 car.
 
     Hamlin will be sidelined at least six weeks because of a fractured vertebra sustained in the crash.
 
     NASCAR said it won’t penalize Tony Stewart for scuffling with Logano after the race, and series officials saw nothing to indicate Logano or Hamlin was trying to intentionally wreck each other as they raced for the win. In addition, NASCAR officials have given no thought to policing blocking, which is what Logano did to Stewart on the final restart to trigger the post-race confrontation.

     KEY BISCAYNE, Fla. (AP) – Five-time champion Serena Williams has advanced to the Sony Open semifinals and tied the women’s record for career victories in the tournament by beating No. 5-seeded Li Na 6-3, 7-6.
 
     Sam Querrey (KWEER’-ee) has lost his fourth-round match, and for the first time the tournament will have no American in the men’s quarterfinals.

WASHINGTON (AP) – It’s the second of two days of Supreme Court arguments on gay marriage — and today’s focus is a federal law that prevents married gay Americans from getting the same federal benefits that go to straight married couples. Lower federal courts have struck down that section of the 1996 Defense of Marriage Act. Yesterday, justices heard arguments over California’s voter-approved ban on same-sex marriage — and they indicated that they may avoid a sweeping ruling on whether gays have a right to marry.
 
     SEOUL, South Korea (AP) – Tensions are increasing yet again between North and South Korea. The North today has cut a military hotline that has been essential for the operation of an industrial complex in the North — a complex that employs hundreds of workers from the South. It’s the last major symbol of cooperation between the two countries. When the link was last cut three years ago, many South Koreans were stranded in the North.

 
     PHOENIX (AP) – Some U.S. senators who are part of a group putting together an immigration reform plan will be visiting the U.S.-Mexican border today. Republicans John McCain and Jeff Flake of Arizona are supposed to be joined by Democrats Chuck Schumer of New York and Michael Bennet of Colorado. They’re wrapping up a bill designed to secure the border and put 11 million illegal immigrants on a path to citizenship.
 
     WASHINGTON (AP) – A new study says insurance companies may have to spend a third more for medical claims under health care reform. The Society of Actuaries says since the increased costs would likely be passed on to customers, uninsured Americans and those buying a policy directly from the insurance company should be concerned. The Obama administration is questioning the study, saying it doesn’t take into consideration cost relief strategies, such as tax credits.
 
     SEFFNER, Fla. (AP) – An apparent sinkhole has forced two families from their Florida duplex. They live in the same area where a sinkhole opened under a man’s bedroom less than a month ago, killing him. Authorities say crews found soft soil around the duplex, which has buckled floors and cracked walls — and they recommended that the residents spend the night elsewhere.
