Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council’s Finance & Legal, Building Planning & Zoning, and Civic Center & Promotion Committees, met Tuesday evening (Apr 23, 2013 at City Hall. All members were present.
With Finance & Legal Committee business:
The committee recommends approving the application from Brolin Investing for Renaissance Zone tax incentives on (Lots 1-9 and 34-44, except the North 10 feet of the East 5 feet of Lot 4, and except the North 10 feet of Lot 5, and except the North 18 feet of Lots 6 & 7, and except the North 70 feet of Lots 8 & 9, Block 9, Kelly & Fuller 2nd Addition,) by the granting of a five (5) year 100% property tax exemption and a request to the State for a five (5) year 100% state income tax exemption. The area is now included in the expanded boundary of the Renaissance Zone.
The committee recommends approving the application from CVA, Inc., for Renaissance Zone tax incentives on )Lots 8-12, except the South 103.21 feet of said Lots 8 & 9, Block 9, Kelly & Fuller 2nd Addition,) by the granting of a five (5) year 100% property tax exemption and a request to the State for a five (5) year 100% state income tax exemption. The property is the former Job Service building in Southwest Jamestown.
Schmeichel Brothers Property, LLP requested the annexation of (Auditor’s Lot 30-2 within the NE1/4 Section 30, T140, R63W, Bloom Township,) into the City of Jamestown. Mayor Andersen said the area would be served by Stutsman Rural Water District, if the proposed territory swamp between the city and SRWD takes place.
The committee recommends approving the request.
The committee recommends approving the request from James & Debra Schumacher for the annexation of (Auditor’s Lot 30-1 within the NE1/4 Section 30, T140, R63W, Bloom Township,) into the City of Jamestown.
The request from BL2 Management, LLC, was recommended for approval for an On-Sale Beer & Wine license for The Depot Cafe. (new owner request).
The committee recommends approving providing credit card payments for utilities, licenses, permit fees, etc. The credit card fee will likely be $3 for the minimum amount charged to the card. The committee recommends using the “Municipay,” credit card company.
The committee recommends entering into a Public Site Lease for a 3 year period, instead of the current 4 year period with the Buffalo City Tourism Foundation to provide an area to house the tourism offices. The period is retroactive to January 1, 2013.
The committee recommends entering into an agreement for engineering services with Prairie Engineering, P.C., for the Jamestown City Hall Cooling Tower Replacement, not to exceed $10,500.
The committee reviewed the application of Ben Maulding for an animal permit to pasture and keep horses at 605 10th Avenue NW in the City. The item was forwarded to the May committee meeting until the new city Ordinance is in effect.
Discussion then centered on filling the City Forester position within the City. Mayor Andersen moved and was seconded for the committee to recommend approving advertising for a City Forester/Equipment Operator position, with the same pay range as a full time City Forester. The City Forestry Department will remain. Deputy City Auditor Jay Sveum said the primary job will be City Forester, and assisting in the Street Department in the winter months, as qualified. Sveum does not feel the added title of Equipment Operator will limit the number of applicants for City Forester.
Former Shade Tree Committee member Roy Sheppard said he was a 30 year member of the committee and worked with four full time and one part time City Forester, and outlined reasons for a individual holding a City Forester position only.
Others advocating a full time City Forester were Chamber President, Tim Burchill, and City Beautification Committee member, Joan Morris. City Council Member Buchanan noted the previous full time City Forester, Vern Quam worked on landscape planning on Mill Hill, and was able to save the city money, with in-kind services.
Mayor Andersen rescinded her motion based on the 2002 job description, of a City Forester only, position.
The committee voted unanimously to recommend.
The committee recommends, recognizing the Ave Maria Village Fundraising Committee as an other public spirited organization and to authorize the issuance of a raffle permit with the drawing to be held June 17, 2013.
The committee then considered the request from Otter Tail Power Company on whether the City would consider acquiring Lot 14, Block 3, Replat of Block 3 Hi-Acres 3rd Addition, from Stutsman County in order to provide an easement to Otter Tail Power Company for the placement of a power line. The utility will be upgrading its local system.Without the easement Otter Tail Power would need to purchase the property on its own.The committee recommends the city acquire the property and grant the easement.

Monthly departmental reports were presented.
It was noted that the Second Reading of Ordinance to amend and re-enact Section 6-7 of the City Code pertaining to animals and fowl is scheduled for the May 6, 2013, City Council meeting.
Also a Public Hearing relative to the special assessments for the 2012 Sidewalk, Curb & Gutter District # 12-11 is scheduled for the May 6, 2013, City Council meeting.
With Building, Planning & Zoning Committee business:
Draft Minutes of the April 8, 2013, Planning Commission meeting , and draft minutes of the April 18, 2013 Planning Commission meeting were presented.
The committee discussed introducing the First Reading of an Ordinance to amend and re-enact Ordinance to change the zoning of the S55’ of the W130’ of Lot 7, Auditor’s Plat No. 3 from R-2-A (One to Twelve Family Residential District) to C-2 (General Commercial District). The land south of the Don Wilhelm car dealership.
Currently a single family home is located there and would be removed under Wilhelm’s plan to use the property for the dealership, parking. Mayor Andersen pointed out that C-2 Zoning will allow for other types of businesses locating there, such as a “quick lube,” business.She feels that a “buffer zone,” be in place between residential and commercial property.The City Planning Commission recommends approval, but not unanimously.It was noted that issuing a condition use permit would not require a zone change.The committee recommends moving the Ordinance to the City Council meeting without recommendation.
The committee recommends introducing the First reading of an Ordinance to amend and re-enact Section 8.8(F), Paragraphs 1 & 2 and Section 9(B), Appendix C, pertaining to building requirements within zoning districts, concerning the height of walls of accessory buildings, (such as garages or storage buildings) in residential areas.
Civic Center and Promotion Committee, had no official business.
Council Member Charlie Kouarjian pointed out that White Cloud the Albino buffalo gave birth this week to her 10th calf, a brown heifer.

Valley City, ND (KCSi-T.V. News Apr 23, 2013) – The planned District 24 Legislative Forum scheduled for Saturday April 27, 2013 in Valley City has been postponed, until after the 2013 legislature.
The date to be announced.
At that time area legislators will review selected bills passed in this session.
Jamestown, ND (KCSi-T.V. News Apr 22, 2013) — The Jamestown Education Association and the Jamestown Public School Board are meeting in teacher negotiations.
Ground rules were set at the first meeting on Monday.
With the next meeting set for Tuesday April 30, 2013 at 7-p.m., at the Jamestown Middle School, Thompson Community Room, the organizations will present their initial proposals for a contract.
The next meeting is scheduled to have both presenting final proposals.
Jamestown Public School Board negotiators are Terry Anderson, Tanya Ostlie and Roger Haut.
Negotiators for the Jamestown Education Association are Cody Mickelson, Todd Roth, and Bill Nelson.
The goal is to complete negotiations by July 1, 2013,or stayed if progress is being made.
BISMARCK, N.D. (AP) – The North Dakota Emergency Commission has approved additional funding to fight expected spring flooding.
The commission on Tuesday agreed to accept loan proceeds from the Bank of North Dakota that would provide a total of $775,000 to the National Guard, Civil Air Patrol and Department of Emergency Services. The funding approved Tuesday is in addition to $60,000 the commission accepted earlier this month.
The most serious flooding is expected along the Red River and its tributaries in eastern North Dakota. The National Weather Service says the river has a 40 percent chance of topping the record 2009 flood of nearly 41 feet.
The emergency commission includes the governor, secretary of state, Senate and House majority leaders, and chairmen of the Senate and House appropriations committees.
DICKINSON, N.D. (AP) – A man accused in a hit-and-run death in Dickinson late last year has pleaded not guilty.
Forty-eight-year-old Timothy Menges is accused of hitting 47-year-old Tracy Freer with his pickup truck in a motel parking lot last Nov. 21, killing him. He could face up to five years in prison if convicted of felony negligent homicide.
Investigators say Menges was driving under the influence of alcohol, and struck Freer after Freer accosted him for almost running over his dog.
Defense attorney Ryan Heintz says Freer’s death is unfortunate but it does not rise to the level of negligence on the part of Menges.
WILLISTON, N.D. (AP) – An inmate is back in custody after escaping from a courthouse where he was scheduled to have a bond hearing.
19-year-old Calum Kinstler was facing a several felonies and misdemeanors stemming from an alleged theft and armed robbery when he escaped from the Williams County Courthouse on Monday.
Officers were able to apprehend him a few minutes later at a nearby garage.
This was the second inmate to escape from the courthouse in a week.
BISMARCK, N.D. (AP) – A Bismarck woman accused of leaving two toddlers home alone has pleaded guilty to felony child abuse or neglect.
Twenty-six-year-old Bonnie Packineau was accused of leaving a 2-year-old boy and a 3-year-old girl home alone on March 12. Authorities say a neighbor found the boy outside in 15-degree weather, screaming.
Packineau told officers she went to Mandan to pick up a friend and could not handle all of her children in the car. She said during an earlier court appearance that she has a 7-month-old and a 5-year-old.
Packineau could face up to 10 years in prison. A sentencing date was not immediately set.
BISMARCK, N.D. (AP) – A North Dakota man has pleaded not guilty to starving about 100 cattle to death.
Forty-four-year-old James Schnabel is charged in McIntosh County with four misdemeanor counts of mistreating animals. He could face up to four years in jail if convicted.
Court documents indicate Schnabel told authorities stray dogs chased some cattle into a shed in January, leading to trampling and suffocation deaths.
A veterinarian concluded almost all of the dead cattle died of starvation.
BISMARCK, N.D. (AP) – North Dakota Attorney General Wayne Stenehjem is investigating whether the State Board of Higher Education violated open meeting laws.
Stenehjem was asked to look into whether the board broke the state’s open meeting laws at two dinner events earlier this year.
Stenehjem ruled that the board violated the laws during a Jan. 16 dinner at Chanellor Hamid Shirvani’s home but did not violate the rules at a March 6 dinner because no public business was discussed.
But in a letter sent to board members and Shirvani on Tuesday, Stenehjem says several people at the March 6 dinner said public business was discussed. Stenehjem is instructing each person at the dinner to give their own account by April 29.

BOSTON (AP) – Federal officials say the Boston Marathon bombing suspect’s medical condition has improved. Dzhokhar Tsarnaev (joh-KHAHR’ tsahr-NEYE’-ehv) had been listed in serious condition at a Boston hospital since he was captured Friday. Tuesday, the U.S. attorney’s office said his condition had been upgraded to fair. The 19-year-old was wounded in a shootout with police and suffered gunshot wounds in the head, neck, legs and hand. Tsarnaev was charged Monday in the twin bombings that killed three people and wounded more than 260. His older brother, Tamerlan Tsarnaev, died after the shootout.
MOSCOW (AP) – U.S. investigators have traveled to southern Russia to talk to the parents of the two Boston bombing suspects. According to a U.S. Embassy official, the trip by the U.S. team was made possible because of Russian government cooperation with the FBI investigation into the bombing. There’s no word on whether investigators have talked to the parents — but a lawyer for the family said Tuesday that they had just seen pictures of the body of their elder son, and were not up to speaking with anyone at the moment.
WASHINGTON (AP) – Boeing didn’t just make the 787 “Dreamliner” — it also was allowed to write the safety conditions for the plane’s battery system, and also to spell out how to test it. And then it was allowed to carry out those tests itself. The amount of leeway given to Boeing by federal regulators was spelled out Tueday at a hearing by the National Transportation Safety Board. As airlines prepare to resume flying the 787 after a three-month grounding, the NTSB is looking at how the battery system was approved, and whether regulators should be exerting more control over safety standards.
TRIPOLI, Libya (AP) – It’s the latest indication that Libya’s central government is unable to stop the country’s slide toward lawlessness. A car bomb today targeted the French Embassy in Libya’s capital, wounding two French guards and a Libyan teenager. There have been several attacks on diplomatic missions in the city of Benghazi, but this was the first in Tripoli since the country’s civil war ended with the death of Moammar Gadhafi.
UPPER MARLBORO, Md. (AP) – Authorities are searching for the stepson of a Washington, D.C. police detective who was shot and killed at his home Monday night. They say they stepson killed the off-duty officer following a dispute over yard work at the home, where the 27-year-old stepson also lived. The incident was captured by surveillance cameras at the home.
