Jamestown, ND (KCSi-T.V. News May 28, 2013) — The Jamestown City Council met in Special Session Tuesday afternoon in the lower level meeting room, at City Hall, with the representatives of Stutsman Rural Water District and legal counsel, along with Titan Machinery representatives, and at the conclusion of the meeting parties indicated an agreement was near.
At issue is which entity will serve Titan Machinery’s location under construction west of Jamestown, and other parcels in that area, within the one mile extra-territory of Jamestown.
At Tuesday’s meeting, Rob Thompson, President of C.I. Construction and project manager for the Titan Machinery building project, said the new facility west of Jamestown has had the sprinkler system approved, to meet fire fighting needs, and will connect with Stutsman Rural Water District within the next week, whether the city and SRWD reach a formal agreement, or not.
Titan Machinery had hoped to open its farm equipment dealership in March this year, however delays caused by the water territory dispute have now caused the opening to move the end of June this year.
The city and Stutsman Rural Water District have agreed to allow Titan Machinery to connect to Rural Water at its earliest convenience.
At the meeting, Mayor Andersen said the City of Jamestown is ready to go forward with an agreement, as is Stutsman Rural Water District, and both parties indicating a formal agreement may be forthcoming within the next two weeks.
The agreement purportedly will modify the proposed contract between the two parties. If the next draft with the modifications is approved an agreement could be finalized in the next two weeks.
The tentative agreement will be brought to the Jamestown City Council and Stutsman Rural Water Board of Directors for approval.
It would also require the agreement of USDA and representatives of the North Dakota Financing Authority as both the city and Rural Water District are indebted to those organizations.

Valley City, ND (KCSi-T.V. News) — The Valley City Commission met in Special Session Tuesday evening (May 28, 2013) at City Hall. All Commissioners were present.
On the agenda, City Commissioners unanimously voted to approve a Resolution approving the Issuance of $2,900,000 Sales Tax Revenue Bonds. Mike Manstrom, of Onstad Twitchel, explained the City of Valley City has an A-1 Special Assessment rating, and an A-2 Bond Rating.
He said the bond sale will take place on Wednesday.
City Commissioners approved the Resolution on the basis that the interest rate does not exceed three percent.
The City Commission awarded a Tree Planting bid for 13th Avenue SE to Pine Country Nursery in the amount of $13,179.50. 33 trees and or bushes will be planted.

Valley City, ND (KCSi-T.V. News) — Valley City Police are looking for information concerning vandalism of the water fountain at City Park.
The renovated fountain was dedicated a year ago, with funds supplied and renovation helped by members of the community, over a two year period.
A number of dedicated people in the community worked hard and donated their money to get the city park water fountain renovated over a two year period and it was destroyed in a matter of minutes.

Jamestown, ND (KCSi-T.V. News May 28, 2013) – The North Dakota Highway Patrol has announced the results of the Southeast Region alcohol saturation in Barnes County over Memorial Day weekend.
The detail resulted in the Highway Patrol issuing 30 citations that included 1 Driving Under the Influence arrest, 1 Minor in Consumption arrest and 2 Open Container citations
As of May 24, 2013, there have been 43 traffic fatalities in the State of North Dakota. 14 of the fatalities have been alcohol related. Impaired driving continues to be a contributing factor in many traffic fatalities.
FARGO, N.D. (AP) – A 59-year-old man is dead after being struck by a train in downtown Fargo.
Fargo police say John Dean Westra, of Fargo, was approaching the train tracks from the south when he was hit by the eastbound train about 4 a.m. Tuesday.
The case remains under investigation. The stopped train also blocked other crossings.
BOWBELLS, N.D. (AP) – Authorities are investigating a death at an oil rig in northwestern North Dakota.
The Burke County Sheriff’s Office says the fatality happened shortly after noon Saturday. The victim was not immediately identified and details of what was described as an accident were not immediately released Tuesday.
The sheriff’s office, North Dakota Highway Patrol and state medical examiner’s office are investigating.
FARGO, N.D. (AP) – A North Dakota man is set to be sentenced for driving drunk and causing a crash that killed his brother.
Jamie Belgarde, of St. Michael, pleaded guilty in federal court with involuntary manslaughter. He faces a maximum penalty of eight years in prison.
Authorities say Belgarde was under the influence of alcohol and speeding last summer when he failed to negotiate a curve in the road and the vehicle crashed. Donald Belgarde Jr., a passenger in the vehicle, was pronounced dead at the scene.
Defense attorneys say Jamie Belgarde made a “terrible, tragic decision,” but does not have a significant criminal history and has excelled at school and work. They’re asking for a sentence of not more than 18 months.
Sentencing is scheduled Friday morning in Fargo.
FARGO, N.D. (AP) – More than 400 American Crystal Sugar Co. workers who have been locked out of their jobs for nearly two years are back to work.
A little more than a month after the union ratified a new contract, some 400 workers returned to their jobs Tuesday. About 1,300 sugar workers had been locked out of their jobs in North Dakota, Minnesota and Iowa since August 2011 after the union rejected a company contract offer.
Vice President Brian Ingulsrud says the company is glad to have its employees back. He says the union workers are evenly spread throughout the company’s factories.
The company has said about 650 union employees had resigned or retired.
A message left with the union was not immediately returned.
BISMARCK, N.D. (AP) – Williston State College and the University of Mary in Bismarck are building more housing.
A 74-unit apartment complex for Williston State faculty and staff is to open on campus Aug. 1. The building will include 7,500 square feet of retail space on the first floor.
The $8.5 million project got help from the North Dakota Housing Incentive Fund, which aids developers of affordable housing. Housing is in short supply in western North Dakota because of the oil boom.
The University of Mary is building two apartment buildings north of campus for upper-class and graduate students. The two buildings – one for men and one for women – are to be ready by August.
GRAND FORKS, N.D. (AP) – University of North Dakota graduate Karen Nyberg has returned to space.
The 43-year-old 1994 UND graduate traveled to the International Space Station aboard a space shuttle in 2008. On Tuesday, she completed her second journey to the space station aboard a Russian Soyuz capsule that blasted off from Kazakhstan, carrying her and astronauts from Russia and Italy.
They will conduct a variety of experiments over the next six months. Nyberg also will deliver the keynote address at UND’s summer commencement ceremony on Aug. 2 from space.
BISMARCK, N.D. (AP) – A former North Dakota Air National Guard commander has been named director of an unmanned aircraft systems test site that would be located in the northeastern part of the state.
Gov. Jack Dalrymple on Tuesday appointed Col. Robert Becklund to lead the project. Becklund recently returned from a stint with an unmanned systems task force at the Pentagon.
The state recently committed $1 million in promotional costs and $4 million in operational costs in an effort to become one of six Federal Aviation Administration sites in the U.S. to test civilian drones.
The winners are expected to be announced in December.
Dalrymple also established a Northern Plains Unmanned Systems Authority that will be chaired by Lt. Gov. Drew Wrigley and include representatives from several agencies.
BISMARCK, N.D. (AP) – Wet weather across much of North Dakota prevented farmers and ranchers from planting last week.
The U.S. Department of Agriculture says in its weekly crop report that there were 2.8 days suitable for fieldwork on average.
Spring wheat seeding was rated 62 percent complete. This is well behind last year at 100 percent and the average and the 81 percent average.
Spring wheat was 27 percent emerged, behind last year at 95 percent and the average of 59 percent.
Cattle and calf conditions were rated 0 percent very poor, 4 percent poor, 17 percent fair, 68 percent good and 11 percent excellent.
Sheep and lamb conditions rated 1 percent very poor, 5 percent poor, 21 percent fair, 62 percent good and 11 percent excellent.
JEFFERSON CITY, Mo. (AP) – A Missouri Supreme Court ruling has essentially scuttled plans to ship crude oil from North Dakota through a Mississippi River port in southeast Missouri.
The state’s highest court ruled Tuesday that the Southeast Missouri Regional Port Authority cannot use eminent domain to take 30 acres of land in Scott County. The port authority had hoped to lease the land to a company that would build large storage tanks there.
The court said the condemnation violated a 2006 state law prohibiting eminent domain from being used solely for economic development purposes.
Dan Overbey is executive director of the port authority. He says the court ruling essentially puts an end to a project that could have resulted in a $20 million investment and 30 to 40 jobs.

MADISON, Wis. (AP) – Two programs that help restore wetlands in North Dakota and two other states have received federal grants worth a combined $3.4 million. The groups are Ducks Unlimited Inc. and Pheasants Forever. Their projects aim to protect wetland and grassland habitat for migratory birds, and restore more than 3,000 acres of wetland in the Lake Michigan watershed.

Lance Stephenson added 20 points for the Pacers, who closed out the game on a 16-6 run. LeBron James led the Heat with 24 points before fouling out in the final minute.

LOS ANGELES (AP) – Justin Williams scored twice and Jonathan Quick stopped 25 shots as the Kings downed the San Jose Sharks 2-1 to advance to the NHL’s Western Conference finals. Williams opened the scoring with a power-play goal in the second period before making it 2-0 just 2:57 later. Quick closed out the victory while the Sharks outshot the Kings 14-4 in the final period.
The Kings now await the winner of today’s game between the Chicago Blackhawks and visiting Detroit Red Wings. Los Angeles will host the first two games of the Western Conference finals if the Wings top the Hawks.

UNDATED (AP) – The NBA Board of Governors has unanimously approved the sale of the Sacramento Kings to a group led by TIBCO Software chairman Vivek Ranadive (VIHV’-ehk rah-nah-DEE’-vay).
The NBA said in a statement Tuesday that the “transaction is expected to close shortly.”
After league owners blocked the sale and relocation of the franchise to Seattle earlier this month, the Maloof family reached an agreement to sell a 65 percent controlling interest in the Kings to Ranadive’s group at a total franchise valuation of $535 million.

Filling a mostly empty stadium court with her familiar shrieks on Wednesday, the former world No. 1 beat Elena Vesnina of Russia 6-1, 6-4 in a match postponed one day because of rain. That meant Azarenka reached the second round 72 hours after some players.

The Minnesota lawmaker, who ran for the Republican presidential nomination last year, says recent inquiries into her campaign have nothing to do with the decision. She says if ran again, she would win.
ROSEDALE, Md. (AP) – Officials say fire department operations have been reduced to a watch in the Baltimore suburb where a train hit a trash truck and derailed at a private crossing. Officials say the fire that began yesterday is under control. CSX has moved unaffected cars away from the derailed cars of the chemical-carrying train. Federal investigators are at the scene.
SANTA BARBARA, Calif. (AP) – Firefighters are in the driver’s seat in the battle against a big wildfire in mountains northwest of Santa Barbara, Calif. They’ve also managed to defeat several smaller fires that popped up around dry Southern California. The big fire is now 65 percent contained after improving weather gave firefighters the chance to gain the upper hand.
BEIJING (AP) – Graduates in China have something in common with their U.S. counterparts this year — a tough job market. It could be China’s tightest market ever for grads. A record number of young grads, about 7 million, are leaving universities and graduate schools to seek their first employment at a time when companies are hiring fewer people due to a slow-down in China’s rapid growth.
LOS ANGELES (AP) – Justin Bieber’s driving didn’t sit well recently with other residents of his gated community. Los Angeles County Sheriff’s detectives are investigating Bieber for reckless driving after witnesses – including former NFL star Keyshawn Johnson – complained about the pop-star’s alleged freeway speeds in their 25-mile-per-hour community.
