 BOWMAN, N.D. (AP) – The National Weather Service says three tornadoes touched down Monday in the southwestern corner of North Dakota.
 
     Weather service meteorologist Nathan Heinert tells KFGO that the twisters were rated as weak, with wind speeds between 65 and 85 mph.
 
     Heinert says funnel clouds reached the ground in open country near Bowman, Rhame and Golden Valley. The only damage reported was at a ranch near Rhame, were several large trees were downed.
 
     Connie Gaebe (GAY’-bee), who lives 3 miles west of Bowman, tells the Dickinson Press she spotted a tornado from town while her husband, Randy, saw it from their farm.
 
     She says the twister was followed by rain and pea-sized hail, “but nothing destructive.”

 

 Jamestown, ND (KCSi-T.V. News Jun 3, 2013) — In anticipation of an inch to and inch and a half of rainfall, Monday night through Tuesday night in the James River basin, the U.S. Army Corp of Engineers has reduced the release from Jamestown Dam.

Spokesman Bob Martin in Jamestown said the flow was reduced from 1,000 cfs, to 900-cfs, on Monday afternoon.

Pipsestem Dam’s release stays at a rate of 200 cfs. for a combined release of 1,100 cfs.

The decrease is expected to lower the James River level below the confluence by about 6 inches.

He says the Corps of Engineers will make a decision later this week pending rainfall amounts as to when the release will be increased again from Jamestown Dam.

On Monday afternoon Jamestown Reservoir’s flood storage capacity was at 24 percent, and Pipestem Reservior’s flood storage capacity was at 38 percent.

 

Jamestown, ND (KCSi-T.V. News Jun 4, 2013) — At Monday’s meeting, the Jamestown Public School Board approved the hiring of Jeff Nold, who was chosen by a selection committee for a position at Jamestown Public Schools.

Nold, the son of Jamestown High School Principal Bill Nold, was previously recommended for a Jamestown High School, Business Department teaching position.

The school board twice previously voted not to hire him due to concerns about nepotism.

On Monday, the School Board voted 8-0 ( Diane Hanson not present) to hire Jeff for a position in the Business Department, at Jamestown Middle School.

 

Jamestown, ND (KCSi-T.V. News) Jun 3, 2013) — Jamestown Mayor Katie Andersen says the City of Jamestown was notified over the weekend, that Stutsman Rural Water District’s attorney, Steven Harris told the city that a number of points made in the city’s draft agreement of water service has been rejected.

On Monday’s Wayne Byers Show on CSi Cable 2, Mayor Andersen said the City Council will meet later this week, to go back and meet with city attorneys to discuss the rejected items and look at what the city may do in terms of offering another proposal to SRWD.

The Mayor indicated that the city does not want to “damage” the existing contracts with Stutsman Rural Water District as it applies to Great River Energy gray water issues.

The agreement with GRE, concerning water service is with the city, and SRWD. Stutsman Rural Water District, wants the new agreement to address what occurs if a “material breech ” of contract occurs, regarding serving GRE with water.

At a joint meeting last week between the city and SRWD, Rural Water District attorney Harris suggested a separate agreement allowing Rural Water to serve Titan while other points of the agreement are finalized.

City officials expressed concern if Rural Water would follow through with the rest of the agreement.

Mayor Andersen said she is leery of the agreement having other issues “unnecessarily lumped into the draft.”

The City Council approved and authorized the issuance of improvement warrants and exchanging them for $2,210,000.00 Refunding Improvement Bonds of 2013, Series V and awarding the sale of $2,210,000.00 Refunding Improvement Bonds to R.W. Baird for the purchase price of $2,320,640 at an average annual net interest rate of 1.86%, for 15 years.

The City of Jamestown has a bond rating of Double A-3.

Approved:

The awarding the bid for New Watermains, Phase II, 2012 Water Tower & Distribution System Improvements, to Nonstad Brothers of Hatton, ND. 8 bids were received.

The awarding the bid for Phase I, for three Lift Station Replacements, in the Sanitary Sewer Improvement Project, to Swanberg Construction , in the amount of $4,836,000 pending approval of the State Health Department, with the dollars coming from the City Sales Tax Fund for infrastructure.

The awarding the bid for Phase II, Force Main & Gravity Sewer, 2012 Sanitary Sewer Improvement Project, to Sellin Brothers in the amount of $4,736,547, subject to approval of the State Health Department. The majority of the cost paid from the City Sales Tax Fund for infrastructure.

An open house for the public on the project will be set within 90-days.

Construction schedules will be announced in the next week.

The City Council authorized the City Attorney to retain Municipal Code Corporation for the revision and recodifying of the City Code of Ordinances.

The City Council approved the request from North Dakota 5, LLC and Marjo Incorporated for the annexation of the remaining undeveloped land located within the Marjo First Addition and located within the NE1/4, Section 30, T140N, R63W, Stutsman County and for the City to contact the current owner of Lot 14, Block 4, to ascertain whether they would support the annexation of that property into the City.

The current owner has been contacted by the City Attorney.

Ordinances:

The City Council denied the request to amend and re-enact Ordinance No. 329 of the City Code by amending the District Map to change the zoning of Lot 2, Block 1, Meadowlark Lane Addition, from R-1 (Single Family Residential District) to R-3 (General Multiple Dwelling District).

FIRST READING: Concerned an ordinance to amend and re-enact Section 5 of the City Code pertaining to alcoholic beverages to provide for the furnishing of complimentary alcoholic beverages in a designated area of hotels.

FIRST READING: Concerning an ordinance to create and enact a new Chapter 27 of the City Code pertaining to the regulation of sexually oriented businesses of adult cabarets and escort services; and to incorporate a 1250’ distance for any such establishment from a church or school and a similar distance restriction from any licensed alcoholic beverage establishment. Mayor Andersen says the likely zoning proposed is M-2, Manufacturing.

The City Council added language to the Ordinance to be brought to the June committee meeting for further discussion.

FIRST READING: Concerning an ordinance to repeal and re-enact Section 26 of the City Code pertaining to regulations and requirements for taxicab licenses and taxicab driver’s licenses in the City of Jamestown.

A Public Hearing was held: Concerning annexation of Auditor’s Lot 30-1 into the City of Jamestown.

Following the Public Hearing the City Council approved the Second Reading of Ordinance No. 1392, to annex Auditor’s Lot 30-1 within the NE1/4 Section 30, T140, R63W, Bloom Township, into the City of Jamestown, Stutsman County, ND.

Following the Public Hearing the City Council approved The Second Reading of Ordinance No. 1393, to amend and re-enact Section 8.8 and Section 9 of Appendix C, pertaining to building requirements within zoning districts.

A Public Hearing was held concerning an ordinance to change the zoning of the S.55’ of the W.130’ of Lot 7, Auditor’s Plat No. 3, from R-2-A to C-2.

Following the Public Hearing the City Council approved the Second Reading of Ordinance No. 1394, to amend and re-enact Ordinance No. 329 of the City Code by amending the District Map to change the zoning of the S.55’ of the W.130’ of Lot 7, Auditor’s Plat No. 3, from R-2-A (One to Twelve Family Residential District) to C-2 (General Commercial District). The lot adjacent to the Wilhelm car dealership.

Mayor Andersen voted in opposition.

Hearing From the Audience …

Ben Gums spoke in favor of bringing back interstate bus service to Jamestown.

Previously Rimrock bus line was servicing Jamestown, at S & J Jamestown Truck stop. Jefferson bus lines also has ceased service to Jamestown.

He said a growing population of senior citizens in Jamestown requires a regular bus stop in Jamestown.

He asked that the City Council look into the challenge of restoring bus service to Jamestown.

Mayor Andersen said she made suggestions to other 24 hour businesses to investigate if they may be interested in becoming a Jamestown bus stop.

Council Member Charlie Kourajian said he is looking into a possible location, in Jamestown.

Appointments:

The City Council voted to approve the appointment of Scott Hare to serve as a member of the Special Assessment Commission for a term to expire April 2018.

In Other Business:

The City Council approved the request from the Wonder Bar Sports Bar for a street dance permit to close the west end of 100 Block/2nd St SW from 8PM to 2AM on the following dates: June 21, July 19, and August 2, 2013.

The request from the Corner Bar for a street dance permit to close the east end of 100 Block/2nd St SW from 6PM to 2AM on August 3, 2013, was approved.

The request from the ND Buffalo Foundation and National Buffalo Museum for a waiver on the rental fee for the Civic Center on June 12, 2013, for the fundraiser banquet was discussed. City Administrator Jeff Fuchs said if a precedent was set in granting the waiver, other non profit groups may seek the same request.

The City Council voted unanimously to deny the request.

The City Council approved a change order to Manitou Construction for construction on a Sewer & Water District for a net increase in the contract price of $27,874.00. The sewer line to Titan Machinery’s new building west of Jamestown.

The City Council considered Letter of Intent—Water Purchase Agreement between City of Jamestown and Great River Energy for Process Water Supply to a Biorefinery owned by Dakota Spirit AgEnergy, LLC. GRE’s Al Christianson said this agreement is separate from the three party agreement between the City of Jamestown, Stutsman Rural Water District, and GRE.

The City Council voted unanimously to approve the letter of intent, contingent on approval of the City Attorney.

Mayor Andersen said the selection committee of a new City Forester, has chosen Douglas Wiles currently living in Farmington, Missouri.

His start date is July 16, 2013.

The City Council approved the selection at the Council meeting.

Valley City, ND (KCSi-T.V. news) — The Valley City Commission met in Regular Session Monday evening (Jun 3, 2013) at City Hall. Commissioner Magnuson joined by conference telephone call.

Public Forum : Richard Betting spoke on Devils Lake water issues, as he said concerns need to be addressed to the State Water Commmission.

The City Commission approved a Resolution to ratify the existing Blanket Bond coverage of $2,000,000.

New Business

City Commissioners approved the Public Works Capital Budget for 2014.

City Administrator Schelkoph explained the utilities projects and budget availabilities, and balances.

He suggested separate City Budget, and Utility Budgets.

The Commissioners Considered the ND National Guard lease for 50 years.

Discussion was then held on the Audi Sale. Commissioner Pedersen said he met with the State Water Commission and FEMA. He said FEMA does not grant variances for buildings in the floodway.

He indicated that city officials are looking for more information. He added it may be too risky for a private developer to purchase the property.

The City Commission approved a Construction Engineering Agreement with KLJ for Paving Improvement District Nos. 102 and 103.

Approved was a Renaissance Zone 5 year income tax exemption and 5 year property tax exemption for:

Leroy and Edith Magnuson, and designate it as VC-72

Charles and Carol Olson, and designate it as VC-73

5 properties for Legacy Developments, LLC, and designate them as VC-74, VC-75, VC-76, VC-77 and VC-78.

The City Commission approved a Special Alcohol Beverage Permit for the VFW at the Winter Show Parking Lot for the Rally in the Valley Mud Run on June 15, 2013.

An update was given on the Devils Lake Advisory group meeting. Commissioner Luke attended the meeting with state and regional officials about the outlet plans. The State now has the option of running 600 cfs. She updated the projected high levels of the lake, adding that storage in the dry fields and wetlands will have a large baring on the lake levels.

Water flows in Valley City will be higher if the outlets are operated more.

Mayor Werkhoven said the flood buyouts and bank stabilization are pluses in flood mitigation, and reducing river bank erosion.

City Administrator Report:

David Schelhoph indicated that the city is willing to supply black dirt and grass seeds, to apply atop of permanent dikes in the city.

He added a representative of Cooper Power will be in Valley City Tuesday to discuss more about setting the approved automated metering reading system.

 

City Updates & Commission Comments included:

City Assessor Sandy Hansen reminded residents of the availability of the Homestead Credit Act, and to contact her office for more information and eligibility.

Commissioner Pedersen said that he and Commissioner Nielson and other Valley City officials attended a recent State Water Commission meeting and talked about with KLJ officials and State Senator Robinson, securing $11.6 million in Valley City project funding.

City Fire Chief Gary Retterath suggested testing the city’s warning sirens, light of the possibility of severe summer weather.

FARGO, N.D. (AP) – A permanent replacement for departing North Dakota University System Chancellor Hamid Shirvani might not take over until 2015, or perhaps not at all if voters opt to dump the state Board of Higher Education.
 
     The board voted unanimously Monday to release Shirvani from his three-year contract, ending a tumultuous year that saw numerous complaints over the chancellor’s leadership style. Shirvani says he was just doing his job.
 
  Board president Duaine Espegard told staff that the search for a replacement will begin immediately. But it will likely be an interim position.
 
     Residents will be asked in November 2014 to vote on a constitutional amendment that would eliminate the board and the chancellor’s office in favor of a three-member commission of higher education appointed by the governor.

 

 FARGO, N.D. (AP) – A 20-year-old North Dakota man facing a mandatory minimum sentence of 20 years in prison for rape has been sentenced to five years.
 
     A Fargo jury in February convicted Jermaine Jones of Class AA felony gross sexual imposition, which carries a sentence between 20 years and life in prison.
 
     But East Central District Court Judge Wickham Corwin said in court Monday that a 20-year sentence for Jones would be the “equivalent of another of this young man’s lifetimes.”
 
In order for the downward departure in sentencing, the judge was required to show that the 20-year term would represent a “manifest injustice.”
 
     Jones and his half-brother were charged with raping two 13-year-old girls at a Fargo party.

 

 BISMARCK, N.D. (AP) – A Bismarck man accused of stabbing two people during a fight in city parking lot has pleaded not guilty. Authorities say 28-year-old Jeramy Bison stabbed two men during a fight in late April. If convicted, Bison faces a two-year mandatory prison sentence on each charge. 
 

MINOT, N.D. (AP) – The number of temporary federal housing units still occupied in the Minot area of northern North Dakota has fallen below 250.
 
     The Federal Emergency Management Agency made more than 2,000 mobile homes available to residents displaced by historic flooding in June 2011.
 
     FEMA officials say residents continue to return to their repaired homes or find new places to live as more rental properties become available in the area.
 
     A total of 242 temporary units were still in use through June 2. FEMA has consolidated 228 of them to Virgil Workman Village in east Minot. The other 14 are on private property.
 
     The Souris River flood swamped 4,100 homes and other structures in Minot and Ward County.

 

 BISMARCK, N.D. (AP) – Wet weather across much of North Dakota has continued to prevent farmers and ranchers from making progress planting crops.
 
     The U.S. Department of Agriculture says in its weekly crop report that there were 2.3 days suitable for fieldwork on average last week.
 
     Spring wheat seeding was rated 64 percent complete. This is well behind last year at 100 percent and the 89 percent average.
 
     Spring wheat was 42 percent emerged, behind last year at 99 percent and the average of 73 percent.
 
     Oats seeding was 72 percent complete, behind 100 percent last year and 90 percent on average.
 
     Pasture and range conditions were rated 1 percent very poor, 4 percent poor, 21 percent fair, 57 percent good and 17 excellent.

 UNDATED (AP) – Mike Malone has been introduced as the new head coach of the Sacramento Kings. Malone comes from the Golden State Warriors, where he served as an assistant coach and helped them make the playoffs this season for only the second time since 1994. And the Bucks have introduced new head coach Larry Drew, less than a week after his tenure in Atlanta came to an awkward end with the hiring of his replacement.

     David “Deacon” Jones, a Hall of Fame defensive end credited with terming the word sack for how he knocked down quarterbacks, has died. He was 74.
 
     The Washington Redskins say that Jones died of natural causes at his home in Southern California. Redskins general manager Bruce Allen, whose father, George, coached Jones with the Los Angeles Rams, calls Jones “one of the greatest players in NFL history. Off the field, he was a true giant.”
 
     Jones was the leader of the Rams’ Fearsome Foursome unit from 1961-71, and then played for San Diego for two seasons before finishing his career with Washington in 1974. He was inducted into the Pro Football Hall of Fame in 1980 and was voted to the league’s 75th anniversary all-time team.

WASHINGTON (AP) – The leaders of six conservative groups targeted by the Internal Revenue Service get to tell their side today at a House Ways and Means Committee hearing. Several of the groups say their applications for tax-exempt status were delayed while agents asked intrusive questions, hindering fund-raising efforts. A new report is scheduled to be released today on IRS spending for employee conferences.
 
     WASHINGTON (AP) – The effort to stop sexual assault in the military takes center stage today at a Senate Armed Services Committee hearing. Top commanders, including Joint Chiefs Chairman Gen. Martin Dempsey, will testify. Senators may signal the extent of their willingness to curb the authority that commanders have to discipline the forces they lead.
 
     CAIRO (AP) – An Egyptian court has convicted 43 nonprofit workers, including at least 16 Americans, of illegally using foreign funds to foment unrest. Most of the Americans have left Egypt. The work and funding of nonprofit groups have consistently been a bone of contention between the U.S. and Egyptian authorities trying to control the organizations.
 
     KABUL, Afghanistan (AP) – Officials say a father and three children were killed when the Afghan family’s car struck a bomb buried in a road in western Afghanistan today. They are the latest deaths in a sharp rise in civilian casualties amid a fierce wave of insurgent attacks. Officials say the mother was critically injured.
 
     MOSCOW (AP) – Russia is looking at action star Steven Seagal to be the face of its weapons industry as it guns for first place on the world arms market. Russian news agencies report that Deputy Prime Minister Dmitry Rogozin says Seagal may head up an international marketing campaign. Rogozin accompanied Seagal on a visit to an arms plant today. Russian officials are big Seagal fans.
