Jamestown, ND (KCSi-T.V. News Jun 7, 2013) — The Jamestown City Council has voted to accept the latest draft agreement presented by Stutsman Rural Water District, concerning territorial service, including the Titan Machinery location west of Jamestown.
The vote was 3-1 to accept the language in draft (Council Member Gumke was not present). Voting in favor of accepting the draft were Mayor Andersen, Council Member Kourajian, and Council Member Brubakken. Council Member Buchanan was the dissenting vote.
Buchanan said he does not feel that SRWD’s legal counsel, Steve Harris does not speak for Stutsman Rural Water Distric.
Buchanan also questions Titan Machinery’s going ahead and hooking up to rural water, being in the city limits.
He said the city should have no contract than a bad contract.
He wanted further definement on the language in the draft.
The Mayor disagreed, saying the contract should be signed even though there are items in the draft that do not have to be in it.
She added that she was not comfortable with some areas concerning the scope of service, and specifically with Great River Energy, contract issues.
The agreement with GRE, concerning water service is with the city, and SRWD. Stutsman Rural Water District, wants the new agreement to address what occurs if a “material breech ” of contract occurs, regarding serving GRE with water.
Discussions by the council dealt with what type of breach of contract would void portions of the contract
The Mayor said she was frustrated with the draft not addressing fire fighting issues at the Titan Machinery site.
She said all areas of economic development have been hurt by not having an agreement in place between the city and SRWD.
Council Members did not have total agreement with items in the draft, but most felt it was in the best interest to move forward and have an agreement in place.
Counsel Tami Norgaard, attending the meeting by phone from the Vogel Law Office in Fargo said there are personality issues between the city and SRWD.
Council Member, Brubakken moved to have the agreement in place, with Stutsman Rural Water District and move forward, and to obtain approval of the draft by SRWD.
The agreement includes a territory swap allowing the new Titan Machinery building to be served by Rural Water and an area south of the airport to be served by the city of Jamestown. It also sets the boundary between the two utilities as the city limits as they existed in 2010.
It motion was approved on the 3-1 vote, and the city’s signing off on the draft will be sent to Stutsman Rural Water District, for their signature, if they still agree to the terms.
The Stutsman Rural Water District Board of Directors is scheduled to meet on Tuesday June 11, 2013, at 8 a.m. or its regular meeting.
Any agreement between the City and SRWD would require the agreement of USDA officials and representatives of the North Dakota Financing Authority because both the city and Rural Water are indebted to those organizations.

Jamestown,ND (KCSi-T.V. News Jun 7, 2013) — The U.S. Army Corps of Engineers will make any decision on cutting reservoir releases from Jamestown Dam on Saturday morning (Jun 8, 2013).
Spokesman, Bob Martin in Jamestown said, the Corps is keeping in touch with the National Weather Service regarding forecasted rain amounts for the James River basin, along with monitoring the rainfall amounts that occur.
Martin said this past Wednesday (Jun 5, 2013)the Corp returned the release from Jamestown Dam back up to 1,000 cfs,
from 900 cfs and with the Pipestem Dam release still at 200 cfs, the combined release as of Friday morning remained at 1,200 cfs below the confluence,in Jamestown.

MANVEL, N.D. (AP) – Authorities have identified a Minnesota construction worker who died while working on a northeastern North Dakota highway.
The Highway Patrol says 58-year-old Otis Gohman, of Clear Lake, Minn., died Thursday morning after becoming trapped under a concrete grinder he was operating on Interstate 29 near Manvel.
The Occupational Safety and Health Administration is investigating.
TRENTON, N.D. (AP) – A crash in the western North Dakota oil patch involving a van, a semitrailer and two motorcycles has killed the drivers of the motorcycles.
The Highway Patrol says the van was trying to pass the semi on state Highway 1804 near Trenton about 10 p.m. Thursday and collided head-on with the two oncoming motorcycles.
Authorities say the drivers of both motorcycles were thrown from the bikes. One driver landed in a ditch and the other was struck by the semi.
The victims were not immediately identified. One was a 20-year-old man from Fairview, Mont., and the other an 18-year-old man from Roundup, Mont.
The man from Fort Worth, Texas, who was driving the van was taken to a Williston hospital with unspecified injuries. The driver of the semi, from Alpine, Wyo., was not hurt.
FARGO, N.D. (AP) – The attorney for a Fargo man accused of killing his wife and staging her death as a suicide wants a judge to throw out his client’s alleged confession.
Defense attorney Ross Brandborg maintains that police did not properly inform Ronald Rogers Jr. of his rights while interviewing him at a psychiatric hospital. Police officers say Rogers asked to speak with them.
Judge Lisa Fair McEvers will rule on the defense request later.
Rogers is accused of shooting his 40-year-old wife, Elizabeth, in the head Feb. 19 and placing a pistol in her hand to make it look like she shot herself. He is charged with murder and disturbing a body.
BISMARCK, N.D. (AP) – A Bismarck couple faces felony child abuse charges for allegedly locking three boys in a basement and physically abusing them when they weren’t in school.
32-year-old Trevor Runningbear and 29-year-old Kacie Schaeffer each appeared in court Thursday on Class C felony and Class B felony abuse or neglect of a child charges. The youngsters were ages 3, 6 and 9.
South Central District Judge David Reich set bond for each at $1,500 cash and prohibited them from having contact with the children.
Officials say that the 9-year-old boy reported to his school in May that his mother and her boyfriend were abusing him and his younger brothers, prompting detectives to search the home.
Lawyers for the couple couldn’t be located for comment Friday.
BISMARCK, N.D. (AP) – The U.S. Bureau of Economic Analysis says North Dakota’s economic growth has outpaced all other states for the third straight year.
The report says that North Dakota’s gross domestic product increased by 13.4 percent to $38.7 billion in 2012. GDP measures total economic production.
Texas had the second-largest increase, growing at rate of 4.8 percent. The country’s average growth rate was 2.5 percent in 2012.
Gov. Jack Dalrymple says the state’s strong business climate, skilled and dedicated workforce and small business innovation is powering economic growth.
The governor’s office say North Dakota has created 102,100 new non-farm jobs since 2000.
BISMARCK, N.D. (AP) – A Canadian pipeline company is planting more than 100 trees around a pump station in southeastern North Dakota to help hush noise at the facility and quiet complaints from nearby residents.
Calgary-based TransCanada Corp. says the tree-planting project began this week along the Keystone pipeline near Fort Ransom.
The Keystone has been operating for three years and transports crude from Canada through seven states. The pipeline is separate from the company’s proposed Keystone XL pipeline that still needs the Obama administration’s approval to proceed.
Bruce Pantzke (PANTS’-kee) owns a farm less than a mile from the pump station and says it emits a sound similar to “fingernails on a chalkboard.” Pantzke says the tree buffer might help but he’d rather see the pump station enclosed with sound-deadening insulation.
BISMARCK, N.D. (AP) – The U.S. Navy is naming one of its new ships after North Dakota’s capital.
The military says the USNS Bismarck will be a high-speed transport vessel. Such ships serve a variety of roles, from providing humanitarian assistance and disaster relief to supporting special operations forces.
North Dakota’s congressional delegation issued a statement saying the naming of a ship after Bismarck “pays tribute to all North Dakotans and serves as an especially fitting recognition of all of our state’s veterans.”
BISMARCK, N.D. (AP) – North Dakota officials are going on a trade mission to Norway.
Gov. Jack Dalrymple will lead the delegation of business and government leaders that is departing Saturday and returning next Thursday. Dalrymple says the trip is part of ongoing efforts to create more markets around the world for North Dakota products.
Norwegian heritage is prominent in North Dakota. U.S. Census data shows that more than 30 percent of the state’s population has Norwegian heritage.
GRAND FORKS, N.D. (AP) – Preliminary work is under way for the demolition of the old Ralph Engelstad Arena on the University of North Dakota campus.
The hockey arena site eventually will house an indoor practice and competition facility for the school’s football, baseball, softball and track programs.
Demolition of the old arena is to wrap up by late summer, with construction of the new facility starting in the fall.
The UND hockey team played in the arena from 1972 to 2001, before moving into the new Engelstad Arena.

(AP) – President Barack Obama is assuring Americans, “Nobody is listening to your telephone calls.” Speaking Friday at a health care event in San Jose, Calif., he defended the collection of millions of phone records in the United States, and the monitoring of some Internet activity overseas through U.S. Internet companies, saying the surveillance is a necessary defense against terrorism.
WASHINGTON (AP) – Senator Rand Paul has introduced legislation that would require a warrant before any government agency could search the phone records of Americans. Responding to the uproar over the disclosure of the National Security Agency program, Paul says the bill introduced Friday is intended to stop the NSA from spying on U.S. citizens. The Kentucky Republican and tea party favorite has been highly critical of President Barack Obama over protecting civil liberties.
MEXICO CITY (AP) – Revelations that the U.S. government has been snooping on Internet users worldwide isn’t shocking people in other countries. Many say they’ve already given up on expectations of online privacy in the face of growing surveillance from governments and private companies. From London to Ecuador, Web users say they already carefully limit the information they include in emails or post on social networks such as Facebook. Still, some said they were outraged that their privacy had been violated.
PESHAWAR , Pakistan (AP) – Pakistani intelligence officials say a suspected U.S. drone strike has killed seven militants near the Afghan border. Many Pakistanis oppose U.S. drone strikes because they say they the strikes kill large numbers of innocent civilians – something the U.S. denies. The country’s new Prime Minister, Nawaz Sharif, has lashed out against the U.S. drone program and called for an end to it.
PHILADELPHIA (AP) – At a tourist attraction in Philadelphia, visitors are getting a taste of life behind bars. It’s the Eastern State Penitentiary, which was once the home of Al Capone. It was abandoned in 1971, but still gets a lot of visitors. This weekend, they’re being served sample inmate meals from the 1830s, the 1940s and today. The menu includes broiled salted beef with “Indian mush,” and an unappetizing concoction called Nutraloaf, which is currently served as punishment in prisons across the country.
