Jamestown, ND (KCSi-T.V. News Jul 30, 2013) — The North Dakota Highway Patrol is investigating an attack by an inmate on a guard at the James River Correctional Center that occurred on Sunday, about 1:10 p.m.

Corrections officer, Jeremiah McDonald was airlifted to a Bismarck hospital for treatment of severe head injuries.

There were no weapons involved.

McDonald’s condition was not immediately released.

No one else was involved in the incident, and the inmate, Shawn Ostafin was not injured.

The Highway Patrol Captain Bryan Niewind says charges will be filed against Ostafin, who is serving time for the 1990 murders of his father and stepmother in Mandan, and is serving a sentence for terrorizing.

Niewind says the exact charges have not yet been determined, partly because authorities are still waiting to see the extent of McDonald’s injuries.

Ostafin, formerly of Mandan, has a violent criminal history.

He served a lengthy sentence for the 1990 murders of his father and stepfather and is now serving time for terrorizing.

Last year Ostafin, was disciplined for assaulting two staff members at the State Penitentiary in Bismarck.

 

Valley City, ND (KCSi-T.V. News Jul 30, 2013) Valley City Police say s 24-year-old man  reported to police that two pit bulls approached him and a woman at a campfire.

Fearing the dogs were going to attack, he grabbed a handgun from the woman and fired several rounds at the dogs.

Officers quickly arrived and saw two pit bulls leaving the scene, but could not catch them.

Police Chief Fred Thompson says 24-year-old Nathan Preston called police to say he fired a number of rounds at the approaching dogs.

Thompson says no humans, houses or other property were struck by the discharged rounds.

No report of any dogs being struck by bullets in this incident.

Thompson says the investigation of this shooting continues and once completed the facts will be submitted to the State’s Attorney’s Office to determine if any charges will be filed.

Anyone with information is asked to call Valley City Police.

 

Jamestown, ND (KCSi-T.V. News Jul 30, 2013)—With the Jamestown sewer project, Interstate Engineering reports, construction is underway on the 600 to 900 blocks of 4th Ave NW. Work includes completion of underground work on Thursday, August 1. Pavement replacement will follow on Friday and Saturday, August 2-3.

4th Ave NW is expected to re-open to traffic on the evening of Saturday, August 3.

3rd Ave NW Construction:

Starting Thursday, August 1, 3rd Ave NW will be closed from 6th St NW to 7th St NW. This closure is expected to last for about two weeks. A detour on 2nd Ave NW will be in place.

5th St NW Partial Lane Closure:

Starting on Wednesday, July 31, there will be a partial lane closure on 5th St NW at 3rd Ave NW. The closure is expected to be in place for three days.

Partial closure of 3rd Ave NW in the area of 5th St NW will occur at the same time. This section of 3rd Ave NW will be open to local traffic only.

At Historic Franklin School, home for CSi, the project will border the entire south side and east side. Interstate Engineering wants citizens along the proposed route to sign-up at the project website for email alerts.

Also the west parking lot of the Jamestown Business Center is closed so crews can begin setting up equipment and preparing for excavation of the lift station.

The parking lot is closed for the next several months. People are asked to use the south or east doors of the Jamestown Business Center.

Jamestown, ND (KCSi-T.V. News Jul 30, 2013) – Titan Machinery officially opened at its new location on the western edge of Jamestown, south of I-94.

Titan officals say the new 78,000-square-foot complex has much better access for hauling large equipment than its previous building and has more room for parts and service centers.

Operations began Tuesday as the last details of the certificate of occupancy were being finalized by city officials.

At issue were concerns that the water flow supplied by Stutsman Rural Water District were not sufficient for the fire sprinkler system.

Attorneys for the city of Jamestown and Titan worked reached agreement on the wording of the indemnification agreement Tuesday, which holds the city harmless in the event a fire caused damage to the Titan building while fire suppression systems are not fully in place.

 

Jamestown, ND (KCSi-T.V. News) — The renamed “Community Music Fest,” is set for Sunday August 25, 2013, from 3-7-p.m., at Atonement Lutheran Church in Jamestown.

On Tuesday’s (Jul 30, 2013) Wayne Byers Show on CSi Cable 2, Buffalo Valley Red Cross Chapter, Manager, Beth Dewald said, a free will offering will be collected with half the proceeds benefiting the Buffalo Valley Red Cross Chapter in Jamestown, and half going to the Community Action Region Six Backpack Program for children in need. Supplemental funds provided by Stutsman County Thrivent Financial for Lutherans.

The Backpack program offers weekend meals to bring home, for needy children.

Ms. Dewald pointed out that this is 9th year of the music fest, and last year about 500 attended.

She said the event previously featured bluegrass music, however, the music will now span bluegrass, Southern Gospel and Christian Rock. Barbershop harmony will be provided by Cheaper Than Therapy of Jamestown.

At the event, in addition to the music there will be BBQ pulled pork sandwiches, salads, desserts, fresh popcorn and a soda sale, plus, children’s activities.

Bring along a blanket or chair to spread out under the big top.

 WILLISTON, N.D. (AP) – A collision involving an Amtrak train and a bulldozer in northwestern North Dakota killed the driver of the bulldozer. The Highway Patrol identified the driver as Dennis McQueen. More than 300 passengers and crew were on the train when it collided with the bulldozer yesterday. No train passengers were hurt.

 

 FARGO, N.D. (AP) – A change of plea hearing for a man accused of threatening to kill a federal judge in North Dakota was postponed when the defendant did not answer questions. Carlos Kidd is charged with two counts of mailing threatening communications. Authorities say he mailed letters from Texas to U.S. District Judge Daniel Hovland in Bismarck.
 
     BILLINGS, Mont. (AP) – A Montana prosecutor is asking a judge to accept a confession from an illiterate man charged in the killing of a high school teacher. Defense attorneys have sought to suppress Michael Keith Spell’s alleged confession to the 2012 murder of 43-year-old Sherry Arnold of Sidney.

 

 FARGO, N.D. (AP) – A rural North Dakota man says he will no longer challenge the attempt by Cass County authorities to take his dogs.
 
     Authorities earlier this month took about 170 dogs and puppies from breeder Darcy Smith, of Wheatland, after reports they were being kept in poor condition.
 
     Prosecutors say the dogs had no access to food or water, and had no air conditioning or ventilation in hot conditions.
 
     KFGO radio reports that a hearing on whether Smith could keep the dogs was held Tuesday morning in Fargo, but Smith decided not to contest a district judge’s order giving the sheriff’s office control of the animals.
 
     Most of the dogs are in foster care and soon will be available for adoption.

 

 MINOT, N.D. (AP) – A sentencing hearing is scheduled for Oct. 21 for a North Dakota man accused of threatening to blow up a Social Security office in Minot.
 
     Kevin Skiles pleaded guilty in federal court Monday to threatening to damage or destroy property by means of explosive.
 
     Authorities say the 54-year-old Skiles left a voicemail message on the phone of a Social Security representative after identifying himself, giving his Social Security number, and leaving his phone number.
 
     Skiles allegedly threatened to blow up the building and told the employee, “I’m coming in tomorrow and you guys aren’t going to like it.”
 
     The charge carries a maximum sentence of 10 years in prison.

 

 GRAND FORKS, N.D. (AP) – Two vulnerable adults who were judged to be in need of a public administrator to oversee their financial affairs are suing Grand Forks County, claiming they were fleeced by two county officials.
 
     The attorney representing Faith Krueger and Paul Veum says they are missing hundreds of thousands of dollars in cash and assets and that the county is liable.
 
     County attorney Howard Swanson says it isn’t clear that any assets are missing and that if they are, the county isn’t responsible.

 

 BISMARCK, N.D. (AP) – Crime is on the rise in North Dakota, and Attorney General Wayne Stenehjem is calling the report “not a rosy one.”
 
     Stenehjem says the per capita crime rate increased 7.9 percent in 2012. The number of offenses reported by local law enforcement agencies jumped from 13,778 in 2011 to 14,866 last year.
 
     Stenehjem issued a new report Tuesday that provides statistics for crimes ranging from murder to car thefts. Data show that crime was up in nearly every category.
 
     The number of violent crimes rose 7.2 percent and these offenses comprise nearly 10 percent of reported crimes. Statewide, the number of murders increased from 15 to 20.
 
     Stenehjem says crime has increased in the oil patch but so has the population. He says illegal drugs and organized crime are a big concern in oil-producing counties.

 

 BISMARCK, N.D. (AP) – North Dakota customers of Otter Tail Power will continue to foot the bill for a power plant that was never built.
 
     The Big Stone II electric power plant in northeastern South Dakota was abandoned in 2009 before construction began.
 
     The Public Service Commission in June 2010 approved a plan to have and Montana-Dakota Utilities and Otter Tail customers in North Dakota pay a share of Big Stone’s $13.7 million development costs over three years. The PSC on Tuesday extended the payments eight months for Otter Tail customers.
 
     Commissioner Brian Kalk says the extended payments will go toward a transmission line that was separate from development costs.
 
     An average Otter Tail residential electric customer has been paying 62 cents more per month. MDU customers have paid about $1.50 extra each month.

 

HETTINGER, N.D. (AP) – Residents in North Dakota’s Adams County are debating a proposed wind farm.
 
     The  project would place up to 75 wind turbines in the county, which borders South Dakota in the far southwestern corner of the state.
 
     Developers say the farm would provide $800,000 to be split among landowners and would pump about $650,000 in tax revenue into the county’s coffers each year.

 

BISMARCK, N.D. (AP) – North Dakota’s state Mill and Elevator is reporting its third most profitable year on record.
 
     The mill Tuesday reported making $11.9 million during its last budget year, which ended in June. That’s up 48 percent from fiscal year 2012, when the mill made $8 million.
 
     State officials say the mill has transferred about 52 percent of profits, or more than $5.6 million, to the state’s general fund. Nearly $600,000 goes to an agriculture fuel tax fund and the rest of the money is used for mill operations.
 
     Agriculture Commissioner Doug Goehring says farmers sold a record 25.5 million bushels of grain to the mill last year and millers produced record shipments of 1.1 billion pounds of flour.
 
     The mill, established in 1922, is overseen by the state Industrial Commission.

 

 BISMARCK, N.D. (AP) – North Dakota’s Industrial Commission has fined an oil and gas company $1.5 million for violations that regulators say put a county’s drinking water at risk.
 
     The fine against Halek Operating ND LLC is the largest civil penalty the commission has issued. The commission first announced its intentions last year.
 
     Halek Operating was accused of injecting saltwater into a disposal well in Stark County that was not up to state standards. Saltwater is a byproduct of oil production. Administrative Law Judge Allen Hoberg says no water sources have been contaminated but there is still a risk.
 
     The Forum newspaper reports that Halek admitted the allegations in court records but said the company had transferred ownership and was not in control of the well at the time of the most egregious allegations.

 

 FARGO, N.D. (AP) – The state Board of Higher Education is holding its first meeting since Bismarck State College president Larry Skogen was named interim chancellor of the university system and asked to review some evaluations of fellow presidents.
 
     Skogen took over for Hamid Shirvani, whose three-year contract was bought out by the board after just one year on the job. Shirvani had planned on staying until July 15, but was placed on administrative leave after controversy over his assessments of college presidents.
 
     Skogen, who reworked four reviews by presidents who were unhappy with Shirvani’s performance reviews, says he would like to change the way evaluations are done in the future.
 
     The board at its  meeting in Bismarck today  is scheduled to assess the evaluations and decide on salaries for the state’s 10 presidents.

  BISMARCK, N.D. (AP) – A record 11 million walleye fingerlings have been stocked in North Dakota waters this year.
 
     The state Game and Fish Department credits excellent production at national fish hatcheries at Riverdale and Valley City.
 
     Jerry Weigel with Game and Fish says spring rains raised water levels at many fisheries across the state, resulting in conditions that should be good for the survival of the 30-day-old fish that averaged about 1  1/4 inches when stocked.
 
     A total of 110 lakes and rivers in North Dakota were stocked. The most fingerlings went into Lake Sakakawea – 4.3 million.
 
     Weigel says there’s never been a better time to fish for walleye in North Dakota.

 

FARGO, N.D. (AP) – Prosecutor Cherie Clark says she’ll seek jail time for three former North Dakota State football players accused of skipping out on court-ordered community service.
 
     One of the three, Don Carter, appeared in court on a bench warrant Monday. Arrest warrants have been issued for Aireal Boyd and D.J. McNorton.
 
     They’re among 15 people accused of faking signatures on petition forms for two ballot initiatives last summer. They all pleaded guilty last fall to an election offense and were sentenced to probation, community service and fines.
 
  Carter told Judge Frank Racek that he hasn’t been in Fargo often enough to complete his sentence by the court’s deadline because he was traveling between Fargo and Baltimore for his mother’s medical issues.

 MEMPHIS, Tenn. (AP) – Former Timberwolf, Mike Miller’s amnesty release by the Miami Heat has opened the way for his return to the Grizzlies. The 3-point specialist has signed with Memphis where he holds eight franchise records from when he spent parts of six seasons with the team.

 DETROIT (AP) – The Detroit Pistons acquired Brandon Jennings as they desperately try to end their four-year postseason drought.
 
     Detroit landed the point guard from Milwaukee for point guard Brandon Knight and two prospects, according to a person familiar with the deal.

 UNDATED (AP) – The man who scored the first basket in NBA history has died.  Former New York Knicks guard Oscar “Ossie” Schectman succumbed after developing complications related to respiratory failure according to his son.  He was 94.
 
     Schectman scored the opening basket of a game in what was then known as the BAA on Nov. 1, 1946 for the Knicks against the Toronto Huskies, a layup after cutting down the center of the lane.

 NEW YORK (AP) – Major League Baseball has told the union which players it intends to suspend in its drug investigation and which ones will receive lengthier penalties for their roles in the Biogenesis case, two people familiar with the talks tell The Associated Press.
 
     The sides are trying to reach as many agreements as possible that would avoid grievance hearings, and talks could push back an announcement until Friday.
 
     Three-time MVP Alex Rodriguez of the New York Yankees stands to receive the longest suspension. The stiffer penalties for some players are tied to other alleged violations, including not being truthful to MLB investigators.
 
     Three 2013 All-Stars could face bans: Texas outfielder Nelson Cruz, San Diego shortstop Everth Cabrera and Detroit shortstop Jhonny Peralta.
 
 
     UNDATED  (AP) – Boston has acquired pitcher Jake Peavy (PEE’-vee) from the White Sox as part of a three-team, seven-player deal.
 
     The 32-year old Peavy was 8-4 with a 4.28 ERA for Chicago this season.  The right-hander is a former Cy Young Award winner and three-time All-Star.
 
     Boston sent a trio of minor leaguers to the White Sox in the deal.
 
     The Red Sox acquired reliever Brayan Villarreal from Detroit and sent shortstop Jose Inglesias to the Tigers. Boston also got outfielder Avisail Garcia from Detroit and sent him to the White Sox.
 
 
     – The Oakland Athletics have acquired third baseman Alberto Callaspo (ky-AS’-poh) from the Angels for infielder Grant Green.  Callaspo is hitting .253 with five home runs and 36 RBIs entering Tuesday. Green is hitless in 15 at-bats during his first stint in the major leagues this season.
 
     – The Cleveland Indians have acquired left-handed reliever Marc Rzepczynski (ZEHP’-chihn-skee) from the St. Louis Cardinals.   The Indians sent minor league infielder Juan Herrera to St. Louis.

 

In world and national news…

 UNDATED (AP) – As the sentencing hearing looms today for Army Pfc. Bradley Manning, the reaction to his conviction for leaking sensitive information depends on one’s point of view. WikiLeaks founder Julian Assange says it’s “national security extremism” while other supporters are relieved Manning was acquitted of the most serious charge. Manning’s critics say justice was served.
 
     LONDON (AP) – A British appeals court decision continues a ban on euthanasia. The ban had been challenged by two severely disabled men who argued that they should be allowed to choose the way they die. One of the men has since died of pneumonia. The court says the ban on euthanasia is justified.
 
     WEST NEW YORK, N.J. (AP) – Authorities say the death of an 8-month-old girl in a chain reaction collision started by a bus crash happened because the bus driver in northern New Jersey was talking on his cellphone. Authorities have issued summonses for reckless driving and using a cellphone while driving for the bus driver. The sheriff in Hudson County tells The Jersey Journal the bus driver will be charged with death by auto.
 
     WASHINGTON (AP) – The Federal Reserve is not expected to take any significant actions as a result of its two-day meeting which wraps up today. Chairman Ben Bernanke rattled markets last month when he said the Federal Reserve might slow its bond purchases later this year if the economy strengthens. A more low key approach is expected this time around.
 
     WASHINGTON (AP) – The latest economic snapshot is expected to show very low growth — a result of automatic budget cuts and higher taxes, but economists are hopeful that a weak second quarter is a temporary lull. A survey by FactSet finds economists predicting 1 percent growth in the April-June quarter.
