Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council met in Regular Session on Monday (Aug 5, 2013) at City Hall. All members were present.

Under bids:

Opening bids for the as-direct sale of 1999 GMC Suburban.

Consent Agenda items considered separately included:

 

Item “B” was asked to be removed by a audience member, Jerry Demore, a Resolution to authorize reinstatement of the original $100,000 of Economic Development Funds for FLEX PACE funding for Buffalo City Rotisserie Grill with the City Share to be 100% and paid from the City Sales Tax Fund.

He asked why the item was to be reinstated, and questioned why the request was made.

Mayor Andersen explained the application was on behalf of the new owner, who decided not to use another type of loan for the previous remodeling. She further explained the process of Flex Pace Funding.

The City Council then voted to approve the reinstatement, on a 3-2 vote, with Council Members Buchanan and Brubakken voting in opposition..

 

Council Member Buchanan asked that item “E” be discussed, a Resolution to approve the request from Dean Hafner and Clyde Schmaltz to use the 25%/75% special assessment provisions provided in Section 8 of Appendix B of the City Code relative to the development of 6-10 additional lots in the Meadow’s Addition on 3rd St NE, and for the City to cover the estimated $30,000 cost of increasing a portion of the water main to be looped and various ditch and storm water improvements.

He asked for reconsideration and denial.

He also questioned the percentage of Special Assessment in Section 8, and the Section of the City Code, itself.

He also questioned the procedure in coming to the City Council, and asked for a written opinion for the City Attorney.

Mayor Andersen said the plan was to provide a tool for developers, and help solve the housing shortage, and help create new housing starts.

Dean Hafner spoke and agreed with statements made by the Mayor.

The City Council voted 4-1 to approve the request with Council Member Buchanan voting in opposition.

 

On the Regular Agenda:

 

A Public Hearing was held, concerning the special assessment list for Seal Coat, Patching, Construction and Reconstruction District #12-41.

Following the Public Hearing the City Council approved the special assessments in the total amount of $2,178,412.10, with the City Share to be $512,185.56, with the balance of $1,666,226.54 to be assessed to benefited properties within the district.

Another Public Hearing was held concerning the request to vacate the unvacated alley portion adjacent to Lots 8, 9, that portion of Lot 10 line perpendicular to the east lot line of Lot 32, and all Lots 32 & 33, Block 9, Kelley & Fuller’s 2nd Addition, all to the City of Jamestown, Stutsman County, North Dakota.

Following the Public Hearing, the City Council approved the request.

Committee Reports:

The City Council awarded the bid for the as-is direct sale of a 1999 GMC Suburban to Budget Auto Sales & Service in the amount of $1,110.00.

 

Under Ordinances:

Discussion was to be held on a Ordinance to create and enact a new Chapter 27 of the City Code pertaining to the regulation of sexually oriented businesses of adult cabarets and escort services.

Mayor Andersen said still at issue was the distance the businesses can be located from residences, churches and schools, along with the right combination of zoning.

Other options under consideration in lieu of a distance limit is fencing, and hours of operation.

At Monday’s meeting, City Attorney Ken Dalsted requested the item be delayed and taken up at this month’s committee meeting, and the item was tabled until then.

A Public Hearing was held, concerning an Ordinance to annex the remaining undeveloped land located with the Marjo First Addition and located within the NE1/4, Section 30, T140N, R63W, into the City of Jamestown, Stutsman County, ND.

Following the Public Hearing the Council approved the Second Reading.

 

A Second Reading of an Ordinance to amend and re-enact Section 5.4, Appendix C of the City Code, pertaining to uses permitted in R-3 Districts, was approved.

The change allows unlimited number of units on a lot.

Appointments: None were made. Mayor Andersen suggested that in the future openings be advertised.

 

Mayor and Council Members Report: Council Member Buchanan said that he and Council Member Kourajian attended a recycling symposium, ane heard specifically about successfully recycling efforts in Grand Forks. He suggested the City of Jamestown again look seriously at recycling. He pointed out that Valley City has a 24/7 recycling program.

Kourajian pointed out that recycling save space in the landfill and agreed that Jamestown needs to address recycling included in the strategic plan.

Mayor Andersen said she attended a workshop in Jamestown attended by 40 individuals. It was hosted by the North Dakota League of Cities outlining open records and meeting laws by the North Dakota Attorney General’s Office, and other items concerning running governmental agencies.

Other business:

The City Council approved the request for a gaming site authorization for the Jamestown Hockey Booster Club, Inc., at the Quality Inn & Suites (Executive Room), for February 12, 2014.

As explained by Darrell Hournbuckle of Interstate Engineering, Council Members approved a Change Order to Sellin Brothers, Inc., for construction on Wastewater Lift Station & Force Main Improvement Project, Phase II, Force Main & Gravity Sewer & District for a net increase in the contract price of $5,671.32.

He pointed out that with the sanitary sewer project, the area of 4th Avenue is moving slower than anticipated, due to soil issues, and accepting pavement.

At the lift station replacement in the Jamestown Business Center, the work was slowed by hitting rocks, which has broken some equipment.

 

The City Council accepted the proposal from Energy Services Group for a Guaranteed Savings Project for the Jamestown Civic Center. A portion of the project costs will go to pay toward lower energy costs.

The City Council approved entering into a Development Agreement between the City of Jamestown and Anne Carlsen Center, providing for completion of engineering documents required for Anne Carlsen Center Addition.

The new addition is east of Jamestown Regional Medical Center.

Council Members approved Resolutions pertaining to Paving, Water & Sewer District, including setting up and establishing the district.

It also included having Interstate Engineering, Inc., prepare a report of the general nature, purpose and feasibility, and an estimate of costs for the district. along with

preparing plans and specifications for the construction of the district, and accepting and approving the plans and specifications, as prepared by Interstate Engineering, Inc., for the construction of the District. (Lots located in The Meadows.)

The City Council declared it necessary to construct the district and to direct the City Administrator to publish notice of a public hearing concerning the district.

and to direct the City Administrator to advertise for bids for the construction of the district.

Council Member Buchanan voted in opposition.

New Business

City Commissioners approved the NDDOT TAP funds for the 9th Street NE Shared Use Path, for FY 2014.

The Commission approved a 5 year Municipal Waste Transfer quote from Ken’s Sanitation beginning September 1, 2013 through August 31, 2018.

Approved a carpet quote from Valley Paint and Glass in the amount of $12,091.00 for Public Works offices.

The carpet received damage in the June 2oth flash flood, and the carpet was in need of replacement due to wear.

 

Approved a new member Ken Reid, to the Zoning Board of Adjustments for a 3 year term.

 

City Administrator Report:

With an AMI automated meter system update…a 10 month plan was outlined to install the load control equipment, with assistance from Cooper Power, with the delivery schedule, and found additional meters without cost to the city. Four gateways will be installed.

Completion is expected in early 2014.

With the buyout program for 2013, the city met with Deb Kantrud of the South Central Regional Council and discussed the previous year’s buyouts for future reference.

 

City Updates & Commission Comments

City Police Chief Fred Thompson said in his first year with the Department he’s seen numerous improvements.

KLJ reported the 9th Avenue Northwest project will be receiving concrete in about two weeks. All projects are expected to wind down in the next few weeks.

Mayor Werkhoven noted debris of clay still in some parts of town from the June 20, 2013 flash flooding.

He noted he attended the Devils Lake Water Commission meeting, where it was noted the Lake levels, may possible be lowering by fall.

Commissioner Nielson reported fire fighters passed tests, with a higher than national average score.

She pointed out the first block party is set for Tuesday at 6-p.m., at 6th Avenue.

Commisioner Luke noted new items at the library.

Jamestown, ND (KCSi-T.V. News Aug 5, 2013) — The new Southwest water storage tank and associated force main project is progressing on time.

On Monday’s (Aug 5, 2013) Wayne Byers Show on CSi Cable 2, Jamestown Mayor Katie Andersen said, the footings for the tower have been placed and a the trench for the force main, to supply water to the elevated tank is in the process of being dug. (a portion of the trench digging can be seen near the Jamestown Wal-Mart.

The tower is expected to be up and supplying water to southwest Jamestown later this year, and the tower will be painted next spring.

She added that the Jamestown sanitary sewer project is progressing as well, and contractors are in touch with the principal and staff of Washington Elementary School on 4th Avenue, Northwest, as the work there is expected to be finished and the street repaved in plenty of time for the first day of school later this month.

 

Jamestown, ND (KCSi-T.V. News) — Some of the dogs rescued recently from an apparent puppy mill in Wheatland, North Dakota, on July 10, 2013 are now available for adoption.

Many of the dogs seized by the Cass County sheriff’s deputies, were neglected and undernourished, and others had fur matted so badly that they couldn’t move.

Their former owner, 51 year old Darcy Smith, of Wheatland, waived his rights to regain custody of the dogs during a court hearing last week, which allowed them to be legally adopted by others interested.

The Wheatland dogs have been distributed to rescue organizations, led by “4 Luv of Dog Rescue,” in Fargo.

Also Prairie Paws Rescue of Jamestown has taken nine of the dogs, and four of them are likely to be ready for adoption as soon as they are spayed or neutered.

It’s expected the remaining five dogs will take longer to put up for adoption, still being scared and shy, based on their previous experience.

Foster families are also wanted for the dogs.

Anyone fostering or adopting them, is required to have a fence, and the dogs need to be leash-trained, or housebroken.

Meanwhile Prairie Paws Rescue has 18 other dogs in need of homes, and seven kittens.

Jamestown, ND (KCSi-T.V. News Aug 6, 2013) — Local North Dakota agencies are once again ramping up efforts as they look to curb the continued problem of individuals driving under the influence of alcohol and other drugs. The Southeast Jamestown Regional DUI Task Force in conjunction with the North Dakota Department of Transportation (NDDOT) is announcing that additional law enforcement officers will be present and monitoring city, rural and state roads throughout North Dakota from August 16, 2013 through September 2, 2013.

This effort coincides with the national Drive Sober or Get Pulled Over campaign.

Highway Patrol Captain, Brian Niewind says “Governor Jack Dalrymple recently signed House Bill 1302 into law giving North Dakota stricter DUI penalties. This bill doubles the fines for drinking and driving offenses and in many cases doubles the jail time as well, but it’s those who have had multiple offenses that are hit the hardest, including additional jail time and/or possible felony charges.”

Authorities say, that statistical data has shown that there is still work to be done when it comes to eliminating the problem of people who choose to drink and drive in North Dakota. However with increased enforcement comes the opportunity at increased safety on roadways. Regional efforts done across the state will help to eliminate drunk driving.

One tool aimed at helping to educate the general public has been the continued presence of the TODD campaign. Short for “To Designate a Driver,” the TODD public service campaign consists of a series of television, radio and print ads distributed through North Dakota. Complementing these materials is an interactive website: www.dontforgettodd.com <http://www.dontforgettodd.com>, where information is provided regarding regional DUI enforcement activity. Other information on the TODD website includes lists of increased enforcement periods, safe ride information, text and email alert options and much more.

Stutsman County Sheriff Chad Kaiser says, “These DUI enforcement periods are designed to enhance North Dakota Law Enforcement officers’ ability to deal with problems commonly associated with motorists who drink and drive. It will also serve to encourage voluntary compliance of existing traffic laws by motorists,”

Jamestown Police officer Justin Blinsky adds, “Until there are zero lives lost to alcohol related crashes on our roads, we’ll continue to have increased DUI Enforcement periods.”

The Southeast Jamestown DUI Task Force includes the following agencies: North Dakota Highway Patrol, Foster, Griggs, Stutsman, Barnes, McIntosh, and LaMoure Forks County Sheriff’s Departments, and Carrington, Jamestown, Valley City, and Oakes Police Departments.

 

Jamestown, ND (KCSi-T. V. News Aug 5, 2013) — Jamestown/Stutsman Development Corporation staff, DeAnn Brunner and Holly Miller, attended the International Economic Development Council’s Workforce Conference July 18th-19th, 2013.

The course focused on the workforce topic and the idea that skilled workers are the backbone of a productive and efficient economy. This course explained the strong relationship between economic and workforce development through case studies, practical examples, and current research. DeAnn and Holly learned what programs currently leverage federal, state, and local financial resources to support workforce development. The conference also covered collaborative programs that will help upgrade the skills of the community’s existing workforce.

Ms. Miller, summed up her experience at the conference, by saying, “The networking opportunities at this conference were invaluable. I was able to take away key points from every speaker and apply them to scenarios in our community, as well as learn more about the key role education plays in strengthening and growing our workforce. This course allows me to further expand my knowledge and earn credits towards becoming a certified economic developer.”

Ms. Brunner agreed that this statement was the perfect explanation of the conference.

 

FARGO, N.D. (AP) – Fargo police are searching for a person who robbed a pizza delivery driver at gunpoint. Authorities say the holdup happened about midnight Monday while the driver was making a delivery. The driver wasn’t hurt.

 

FARGO, N.D. (AP) – A man convicted of murder in Fargo more than two decades ago will not get the new trial he sought.
 
     East Central District Judge Frank Racek has ruled that Reginald Tweed failed to show that his attorney in the case did a poor job. Tweed tells KVLY-TV that he will appeal.
 
     Tweed is serving a life sentence for killing 32-year-old Terry Dorff by hitting him five times in the head with a 17-pound rock, after Dorff allegedly make sexual advances while they were drinking in Dorff’s apartment in 1991.
 
     A second man also was charged with murder in the case. David Sumner was acquitted after Tweed refused to testify against him.

 

 BISMARCK, N.D. (AP) – A Dickinson man has pleaded not guilty to human trafficking.
 
 29-year-old Bobby Abplanalp pleaded not guilty to the Class A felony Monday in Bismarck. His next court hearing is scheduled for Sept. 9.
 
     Abplanalp is accused of making contact on June 7 with a woman believed to be trafficking her underage daughters for money.
 
     He was charged June 13 with human trafficking, which carries a maximum penalty of 20 years in prison.
 
     Abplanalp is being held at the Burleigh County jail in lieu of a $50,000 cash bond.
 

FARGO, N.D. (AP) – A federal judge says the wife of a man convicted of bilking millions of dollars out of people in North Dakota, South Dakota, Minnesota and elsewhere in an investment fraud scheme cannot collect proceeds from his insurance policy
 
     Verlin Swartzendruber, of Laredo, Texas, was sentenced in 2010 to five years in prison, after pleading guilty to one count of wire fraud. He was ordered to pay back more than $3 million.
 
     Swartzendruber’s wife, Lois, filed a motion in federal court asking to keep the insurance proceeds. She says the money should be excluded from restitution because the law considers her an innocent spouse.
 
     U.S. District Judge Ralph Erickson in Fargo denied the claim Monday. Erickson says he’s sympathetic to her financial hardship but she’s not the owner of the policy.

 

FARGO, N.D. (AP) – A former Fargo investment broker who pleaded guilty to bilking 18 investors out more than $900,000 has been sentenced to 10 years in prison.
 
     Judge Frank Racek sentenced 65-year-old Robert Medhus (MAY-hoos) on Monday. Medhus had pleaded guilty in East Central District Court in June to 13 counts of securities fraud, two counts of theft of property and one count of selling unregistered securities.
 
     Prosecutors say Medhus forged client checks, created fake investment account statements and failed to invest client assets as promised. 
 
     The North Dakota Securities Department uncovered the fraudulent scheme after receiving investor complaints, and the Cass County State’s Attorney investigated criminal charges.

 

 BISMARCK, N.D. (AP) – Interior Secretary Sally Jewell is getting a look at North Dakota’s oil and gas development.
 
     Jewell begins a two-day tour of the oil patch Tuesday with stops in Williston and the Theodore Roosevelt National Park South Unit. She will be in Dickinson on Wednesday morning.
 
     North Dakota Sens. John Hoeven and Heidi Heitkamp say the tour and meeting with energy sector leaders is meant to help Jewell understand the state’s “comprehensive approach” to energy development.
 
     The outing will include tours of several rigs.

 

FARGO, N.D. (AP) – Cool average temperatures across North Dakota have been good for small grain development, but warmer weather and additional moisture is needed to help row crops.
 
     The U.S. Agriculture Department says in its weekly crop says that some western and extreme northern and southern areas of the state received significant rainfall, but most central and eastern areas received little to no moisture.
 
     Topsoil moisture supplies are rated 7 percent very short, 32 percent short, 56 percent adequate and 5 percent surplus.
 
     Durum wheat headed is at 99 percent, ahead of the 93 percent average. Soybean blooming is at 86 percent.
 
     Sugar beet conditions are rated 10 percent poor, 27 percent fair, 43 percent good and 20 percent excellent.

 

BISMARCK, N.D. (AP) – The state Capitol in Bismarck is hosting is ninth annual Farmers Market Day on Wednesday.
 
     Agriculture Commissioner Doug Goehring says more than 20 vendors from around North Dakota will take part – the most ever. The event will run from 9 a.m. to 2 p.m. at the top of the Capitol loop on the south lawn.
 
     A lunch also is planned, with members of the Bismarck-Mandan Symphony Orchestra performing. North Dakota Dairy Princess Susan Hintz will serve free ice cream.
 
     Gov. Jack Dalrymple has proclaimed this week as North Dakota Farmers Market and Growers Week. It’s also National Farmers Market Week.
 
     The federal Agriculture Department says there are more than 8,100 farmers markets listed in its directory. Dalrymple says North Dakota has more than 50.

Valley City State University is pleased to welcome two new head coaches in women’s athletics.

Elle Fracker has been promoted to head softball coach, and Cathy Hanek has been hired as the new head women’s basketball coach.

Fracker spent the last two seasons as the assistant softball coach to Chad Slyter, who resigned in July. As an assistant, she worked primarily as the hitting coach while also working with outfield defense and the catchers.

Fracker is a 2008 graduate of Indiana State University, where she lettered four years in softball as a catcher. Prior to joining the VCSU staff in February 2012, she worked assistant coach jobs at Drexel University and Oberlin College.

Hanek comes to VCSU from Miles Community College in Miles City, Mont. She officially takes over the Viking women’s basketball program on Aug. 19. She replaces Jill DeVries, who resigned earlier this summer.

Hanek spent one year as head women’s coach and assistant men’s coach at Miles Community College. Prior to that she worked from 2007 to 2011 as the assistant women’s basketball coach for Lakeland College in Sheboygan, Wis. Hanek is a native of Youngstown, Ohio, and played college basketball for Youngstown State from 2000 to 2005.

 

 VALLEY CITY, N.D. (AP) – The North Dakota High School Activities Association has signed a five-year, $195,000 contract to join the National Federation of State High School Associations Network. The network is a partnership of the federation and the PlayOn! Sports broadcasting company. It’s to begin broadcasting this fall.
 

MINNEAPOLIS (AP) – The Minnesota Timberwolves will play two of their seven preseason games at Target Center.

The Wolves announced their preseason schedule on Monday. It begins with a game against CSKA Moscow at Target Center on Oct. 7. Guard Alexey Shved and former forward Andrei Kirilenko both once played for the Russian team.

The Wolves will host the Toronto Raptors at Target Center on Oct. 12. They will also serve as the designated home team for a game in Sioux Falls, S.D., against the Milwaukee Bucks on Oct. 10 and in Montreal against the Boston Celtics on Oct. 20.

Road games will be played at Toronto on Oct. 9, at Philadelphia on 23 and at Detroit on Oct. 24.

The regular season schedule is set to be announced on Tuesday.

 

MORRISTOWN, N.J. (AP) – The principal owner of the Minnesota Vikings football team and relatives are on the losing end of a New Jersey lawsuit that has spent 21 years in the courts.

A judge on Monday found Zygmunt “Zygi” Wilf, his brother and cousin had committed fraud, breach of contract and fiduciary duty, and had violated New Jersey’s civil racketeering law.

The family was sued by partners in a 764-unit apartment complex in Montville, who claimed they were cheated of their fair share

The judge says Wilf himself had testified that he had reneged on the deal.

The Wilfs’ lead attorney says the family has earned a well-deserved reputation for integrity and honest dealings.

The judge will announce the rest of the ruling and damages in two weeks.

 KANSAS CITY, Mo. (AP) – Eric Hosmer drove in a career-high five runs to help the Kansas City Royals rout the Minnesota Twins 13-0 last night. The Royals have won 12 of their past 13 games. It was Jeremy Guthrie’s second career shutout and he lowered his earned run average to 3.94.

CHICAGO (AP) – Alex Rodriguez made his season debut and went 1-for-4 in the New York Yankees’ 8-1 loss to the Chicago White Sox. Rodriguez was loudly booed before his first at-bat, a bloop single to left field in the second inning. Rodriguez returned just as the Yankees were placing shortstop Derek Jeter back on the disabled list, this time with a strained right calf.

  NEW YORK (AP) – New York Yankees third baseman Alex Rodriguez has received a lengthy suspension for his association into Biogenesis, a closed anti-aging clinic in Florida accused of distributing banned performing-enhancing drugs. Rodriguez received the harshest penalty among the players punished, a suspension that will run through the 2014 season. However, Rodriguez has appealed the suspension and will be allowed to play until an arbitrator makes his decision on the matter.

 NEW YORK (AP) – Rangers outfielder Nelson Cruz, Tigers shortstop Jhonny Peralta (JAH’-nee peh-RAHL’-tah) and Padres shortstop Everth Cabrera are among 13 players to receive 50-game suspensions for their relationship with Biogenesis of America. All three were All-Stars this season, with Cruz leading Texas in homers and RBIs, and Peralta serving as Detroit’s second-best hitter behind Miguel Cabrera. Others agreeing to 50-game bans include Yankees catcher Francisco Cervelli, Philadelphia pitcher Antonio Bastardo, Seattle catcher Jesus Montero and New York Mets infielder Jordany Valdespin.

  MLB also cleared Nationals pitcher Gio Gonzalez and Orioles third baseman Danny Valencia, saying its inquiry found no violations by the players linked to Biogensis in media reports. Gonzalez says he has no lingering sense of animosity toward baseball .

 COLLEGE STATION, Texas (AP) – Texas A&M coach Kevin Sumlin has told reporters that he is taking a wait and see attitude on the allegations that quarterback Johnny Manziel (man-ZEHL’) accepted cash for autographs. Sumlin says the school is investigating the story that ran on ESPN that said the Heisman Trophy winning quarterback signed items in exchange for a five-figure fee.

 GLENDALE, Ariz. (AP) – IceArizona has completed its purchase of the Phoenix Coyotes from the NHL and received approval from the league’s Board of Governors, keeping the Coyotes in the desert for the foreseeable future. Completion of the sale triggers a $225 million lease agreement for Jobing.com Arena reached last month by the city of Glendale and Renaissance Sports and Entertainment, managing partner of IceArizona.

WASHINGTON (AP) – The U.S. and Britain are evacuating embassy personnel in Yemen, and the State Department is warning non-essential personnel to leave the country immediately because of what it describes as the “extremely high” security threat level. Intercepted communications between al-Qaida’s chief and the leader of the terror network’s Yemen branch have led to the temporary closure of 19 American diplomatic posts across the Middle East and Africa. And a drone strike today in Yemen killed four suspected al-Qaida members.
 
     BEIRUT (AP) – Syrian activists say rebels have captured a major air base in the north of the country after months of fighting. But Syrian state TV says government troops are still defending the base and inflicting heavy losses on the rebels. The fall of the air base would deprive President Bashar Assad’s forces of one of their main posts near the border with Turkey. The Syrian Observatory for Human Rights says al-Qaida-linked militants have been leading the rebel assault. 
 
     FORT HOOD, Texas (AP) – The trial of the man who carried out the Fort Hood shooting gets underway today. Maj. Nidal Malik Hasan (nih-DAHL’ mah-LEEK’ hah-SAHN’) will represent himself at the court-martial and is expected to question witnesses, including some of the more than 30 people who were wounded. Thirteen people were killed in the attack, and Hasan is facing a possible death sentence. He has never denied carrying out the attack.
 
     CAMPBELLTON, New Brunswick (AP) – Autopsies will be performed today on two boys believed killed by a snake in an apartment in Canada. The apartment is located above a New Brunswick pet store, and investigators believe a python escaped from its enclosure in the store and slithered upstairs through the ventilation system. Police captured the snake.
 
     LONDON (AP) – If you’ve ever wondered what 15 tons of fat looks like, a London utility company is likening it to an iceberg. Thames (tehmz) Water says it finds massive lumps of congealed fat in the city’s sewers all the time, but this one is the biggest ever. The company says it’s sharing the news in hopes that customers will think twice about what they dump down the drain. It says such “fatbergs” cause flooding and backups.
