JAMESTOWN, N.D. (AP & KCSi-T.V. News Aug 20, 2012) – A woman who has been convicted of manslaughter says she sold drugs to the victim.
Twenty-two-year-old Janelle Cave testified during the fifth day (Monday Aug 20, 2012) of 34-year-old Leron Howard’s trial that she sold 18-year-old Abdi Ali Ahmed marijuana.
Howard has pleaded not guilty to murder and criminal conspiracy in the April 2011 death of Ahmed, whose body was found in a ditch near Spiritwood.
A jury convicted the 22-year-old Cave on manslaughter and criminal conspiracy charges in February.
She is appealing.
Her sentence required her to testify at Howard’s trial.
Cave denied Ahmed owed her any money.
Cave testified that Howard struck Ahmed outside her trailer and knocked him unconscious.
They transported Ahmed to the home of Delmonte Jones near Spiritwood, where they left Ahmed unconscious in the car.
Cave testified that they went into the Jones’ home where they did marijuana.
The jury heard testimony regarding information recovered from a phone that allegedly belonged to Howard.
Tuesday may be the last day of testimony in the case.
Howard is expected to take the stand during the trial to tell his version of the events surrounding Ahmed’s death.
Judge Thomas Merrick says the case could go to the jury by midweek.
Valley City, ND (KCSi-T.V. News) — The Valley City Commission met in Regular Session on Monday (Aug 20, 2012) at City Hall.
All Commissioners were present.
Consent Agenda items approved includes:
A Game of Chance Raffle Permit for Valley City State University Golf Team.
A Master Heater Installer License for Quality Heating & Air Conditioning.

Resolutions:
City Commissioners approved a Resolution, accepting the low bid and awarding the contract for Pavement Marking Improvements to Northstar Safety Inc. in the amount of $119,406.20.
Funds come from the State Highway Department.
A Resolution was approved consisting of a Street Right of Way issue on 11th Avenue SW between 5th and 6th Street SW.
An easement will be created for city access for infrastructure purposes, while others will be able to sell properties.
Property lines will be indicated by GPS and staked.
The City Commission approved the First Reading of An Ordinance,creating a Perpetual Restrictive Covenant where properties were removed in accordance with the State Water Commission, regarding previously flood areas.
Thirteen properties are involved.
New Business:
A Public hearing was held on the Final Status and Performance Reports from City of Valley City for $310,000 of CDBG Funding for a Valley City Emergency Sewer Project.
The project stems from 2009 flooding.
City Commissioners approved three Renaissance Zone applications for a 5 year income tax exemption and 5 year property tax exemption for Six D Construction, and designate the three projects as VC-68, VC-69 and VC-70.
The applications are for Phase III of the Legacy Place expansion.
An Image Enhancement Retail and Image Grant for Valley Service in the amount of $3,092, was approved. The amount will be used for signage improvements.
Another Image Enhancement Retail and Image Grant for VCSU in the amount of $5,000 was approved.
The dollars to be used to replace the electronic signage, near Osmond Fieldhouse.
The City Commission apporved a Flex PACE loan to Nicki and Josh Nelson (The Tax Team) in the amount of $6,000, to buy down interest.
The loan will be repaid.
Commissioners approved an application to Block Off Street at 3rd Avenue SE from Main Street to Alley on August 25 for Boomer’s Benefit.
The City Commission then approved land conveyance for the property line correction/encroachment by Valley City Development property for Malach USA.
The property owned by the city is not usable.
The Commission approved a Construction Engineering Agreement for Pavement Marking Improvements to Kadrmas Lee & Jackson in the amount of $11,000.
Consideration was given for bids for Five Traffic Signal Controller replacements.
The Commission approved the bid of $41,751.
The City Commission tabled approving $70,000 for pavement reconstruction on 4th Avenue NE between 6th and 9th Street NE, and 8th Street NE between 3rd and 4th Avenue Northeast, near the water treatment plant.
The Commisioners reviewed the plan to sell the auditorium. City Administrator Schelkoph said a plan has been developed to review potential purchasers plans for the building, plus a bidding pool would be established.
City Administrator Report:
David Schelkoph reported progress of street projects, as Chad Peterson from KLJ gave an update on the sanitary sewer, storm sewer and water main projects, along with street reconstruction pours and overlays.
Schelkopf reported on the events surrounding the failure of the Master Sewer Lift Station, last week.
He said the good news of the problem was that no one was injured in the process of containing the sewage when the plug failed during routine maintenance last Thursday.
He said the quick response of city crews in installing pumps, saved the city and it’s citizens dollars and “heartaches,” with what could have happened with damages.
Four pumps are now working and two additional pumps will be going back on line this week.
He pointed out the State Health Department was notified and kept up to date on the pumping of the raw sewage into the Sheyenne River, which was stopped last Friday afternoon.
A final report will be issued to the city and State Health Department.
City Updates & Commission Comments:
Commissioner Magnuson praised the city crews in their quick response to the main sewage lift station emergency last week.
City Attorney Russell Myhre said closing has been completed on 13 flood buyout properties.
City Auditor Richter said copies of the 2013 city budget has been readied to be presented on Monday August 27, 2012, the start of the budgeting process.
Police Chief Thompson told the Commissioners that when dispatch receives 9-1-1 phone calls, each call will be responded to with a police officer sent to the scene.
He said the change in policy is now in effect.
Mayor Werkhoven said it was refreshing to see the flood property buyouts are progressing, along with the plans to sell the auditorium.

Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council will hold a public input meeting today at 4:00 PM, at the Building, Planning and Zoning Committee meeting.
Input will be gathered concerning Section 8 of Appendix B of the Jamestown City Code relative to subdivision development improvements and suggested changes.
The purpose of the meeting is to allow the public an opportunity to comment and provide assistance to the City Council in determining future ordinance changes/policies.

MAPLETON, N.D. (AP) – Authorities have arrested a teenage boy in the armed robbery of a gas station in the southeastern North Dakota town of Mapleton.
The robbery at Gordy’s Travel Plaza was reported about 6 p.m. Monday.
The Cass County Sheriff’s Office says the 17-year-old suspect was stopped a short time later on Interstate 29 in the Fargo area and arrested without incident.
Authorities say items in the boy’s car link him to the holdup.
No one was injured in the incident.
BISMARCK, N.D. (AP) – A North Dakota man has pleaded guilty to
attacking two women.
U.S. Attorney Timothy Purdon announced Monday that 21-year-old
Lionel R. Jewett OF Fort Yates pleaded guilty to counts of assault
with intent to commit murder, two counts of assault with a
dangerous weapon and two counts of burglary.
Prosecutors say Jewett attacked two women in January of this
year. Jewett attacked one woman with a garden hoe and kicked both
women.
He also stole a vehicle, tools and some money from a local
church in March and October of last year.
Sentencing is set for Dec. 10.
BISMARCK, N.D. (AP) – A North Dakota district judge has been
disciplined by the state Supreme Court, but she says she’s pleased
by some parts of the court’s ruling.
The Supreme Court admonished Cynthia Feland for her conduct in
her former job as a Burleigh County prosecutor.
She’s been a judge for almost two years.
The case arose from Feland’s prosecution of former North Dakota
workers’ compensation director Sandy Blunt.
Blunt was convicted of misspending agency funds.
The Supreme Court says Feland failed to turn over some evidence
to Blunt’s defense lawyer.
The court said the mistake didn’t hurt Blunt’s case.
Feland says she’s pleased the Supreme Court concluded she didn’t
withhold evidence on purpose, and that her error didn’t harm
Blunt’s defense.
The admonishment won’t affect Feland’s ability to work as a
judge.
WILLISTON, N.D. (AP) – A state health official says it doesn’t
appear that an oil well blowout south of Williston contaminated
water sources.
Environmental geologist Kris Robertss ays dozens of acres of crops and pasture land have been affected by the 800 gallons of oil and salt water
that sprayed over the area last week.
Roberts says cleanup crews have placed absorbent booms to
prevent contamination from spreading into a creek that empties into
Lake Sakakawea on the Missouri River.
They also are cutting and removing contaminated vegetation. She says there will be little impact to soil.
State officials are investigating the blowout.
The Occupational Safety and Health Administration is investigating the death of a worker who was struck by a pickup truck leaving the site after the
incident.
MINOT, N.D. (AP) – Health officials in the Minot area are looking into how many damaged houses have been abandoned following the historic Souris River flooding last summer.
Those that have been deserted stand to be razed for health and safety reasons.
The city earlier reported about 280 houses throughout the river valley left untouched since the 2011 flood.
The First District Health Unit is investigating how many have truly been abandoned.
Environmental Health Director Jim Heckman says a number of people have notified officials that they are rebuilding or trying to sell their homes.
He says fewer than 50 people have failed to reply to First District’s notice of potential demolition.
City Finance Director Cindy Hemphill says property owners will be billed for the cost of demolition.
BISMARCK, N.D. (AP) – The latest weekly crop report presents a
mixed picture for agriculture in North Dakota.
On one hand, relatively good weather has continued to spur
harvest progress.
But the U.S. Department of Agriculture’s report
out Monday also shows that more precipitation is needed for most
row crops.
According to the report, barley made it to 93 percent harvested,
Durum wheat reached 60 percent harvested, spring wheat rose to 83
percent harvested and the oats crop is 90 percent harvested.
Canola is 90 percent swathed, which is more than two weeks ahead
of the average pace.
Pasture and range conditions are rated 12 percent very poor, 29
percent poor, 37 percent fair, 21 percent good and 1 percent
excellent.
Topsoil moisture supplies are rated 15 percent very short, 46
percent short, 38 percent adequate and 1 percent surplus.

Jamestown College head men’s wrestling coach C.J. Campbell announces that Alex Jackson, Brandon Edwards, Liam Kautz, Antonio Rivera, Joshua Claymore and Dalton Barrie all signed Letters of Intent to enroll at Jamestown College next year and compete in wrestling for the Jimmies.
Jackson will wrestle at 141 pounds. A graduate of Hobbs High School in Hobbs, N.M., he was a two time state finalist at 140 pounds (second place in 2010 and 2011).
Edwards will wrestle at 133 pounds. A graduate of Missoula Sentinel High School in Missoula, Mont., he was a two time state finalist at 130 pounds (fifth in 2011 and third in 2012).
Kautz will wrestle at 133 pounds. A graduate of Southeast High School in Torrington, Wyo., he placed sixth at state at 130 pounds.
Rivera will wrestle at 174 pounds. A graduate of Etiwanda High School in Fontana, Calif., he was a two time state finalist at 170 pounds (second place in 2012 and 2011).
Claymore graduated from Eureka High School in Eureka, S.D. He is the first wrestler in the Jimmie program since 2006.
Barrie graduated from Park High School in Emigrant Mont.
“It has been a great recruiting year for us,” said Campbell. “The battles in our wrestling room alone will be fun to watch, I can’t wait to see how we do against our competitors.”

UNDATED (AP) – The Boston Red Sox lost an outfielder and
dismissed a pitching coach Monday.
The team has announced that Carl Crawford will have Tommy John
surgery on Thursday, ending his season. Crawford has been playing
with elbow pain since coming off the disabled list last month.
Boston also fired pitching coach Bob McClure and replaced him
with Randy Niemann for the rest of the season. The 60-year-old
McClure became the pitching coach in December after six seasons in
the same capacity with Kansas City.
The Red Sox’s 4.30 team ERA was 11th in the American League
heading into Monday’s games.

AUGUSTA, Ga. (AP) – Augusta National’s membership is about to
include females for the first time since the club was founded 80
years ago.
Former Secretary of State Condoleezza Rice and South Carolina
financier Darla Moore will be presented with the club’s iconic
green jackets when the new season opens in October.
Augusta has been under pressure for years to admit a woman as a member.
Club chairman Billy Payne calls the admission of Rice and Moore a
“joyous occasion.”

GREENSBORO, N.C. (AP) – Sergio Garcia completed a round of
4-under-66 to win the PGA’s Wyndham Championship.
The final round was washed out Sunday, forcing the Monday finish.
Garcia’s 18-under-total was two shots better than Tim Clark, who shot a
final round 67. Bud Cauley was third at minus-15.
This is Garcia’s first PGA Tour victory since the 2008 Players
Championship.

HOUSTON (AP) – Former Major League ace Rogers Clemens has signed
with the Sugar Land Skeeters of the independent Atlantic League and
is expected to start for them on Saturday at home against
Bridgeport.
The 50-year-old right-hander was acquitted in June of charges he lied to Congress when he denied using performance-enhancing drugs.
Clemens hasn’t played for a team since pitching for the Yankees
in 2007.
His agent, Randy Hendricks, says the pitcher’s “fastball was clocked at 87 mph.”

KABUL, Afghanistan (AP) – The top U.S. military commander’s
plane was damaged when militants fired rockets into a U.S. base in
Afghanistan while Army Gen. Martin Dempsey was discussing the war
and attacks on U.S. troops by their Afghan counterparts.
The general was not near the aircraft and has since departed, while the
Taliban claim insurgents knew right where the plane was parked.
MANTON, Calif. (AP) – One evacuated resident says all they can
do is pray. Meanwhile, aided by a shift in wind direction,
firefighters made a stand against a huge lightning-sparked wildfire
burning on the edge of three small Northern California towns.
The fire threatens thousands of homes.
PLAINFIELD, N.J. (AP) – Police say a thief got away after two
good Samaritans grabbed the wrong person on a northern New Jersey
street.
The Samaritans were driving down a street in Plainfield
when they saw what appeared to be a man assaulting a woman early
yesterday.
They grabbed the man but it turns out the woman was
trying to rob him.
