JAMESTOWN, N.D. (AP & KCSi-T.V. News Aug 21, 2012) — A Jamestown man on trial for murder in the death of a Somali immigrant says he hit the victim and knocked him to the ground, but denied stabbing him.

35-year-old Leron Howard testified Tuesday that he struck 18-year-old Abdi Ali Ahmed twice during an argument between Ahmed and Janelle Cave on April 30, 2011.

Howard said an altercation between Cave and Ahmed started in a trailer home Cave shared with Howard and Alexa Stoller, over money owed by Ahmed for drugs.

Howard stepped between Cave and Ahmed and struck Ahmed when Howard thought Ahmed was going to strike Cave.

Cave earlier testified that she never witnessed Howard hit Ahmed, and that it was Howard who stabbed Ahmed along a rural roadside.

Howard said Cave stabbed Ahmed.

A medical examiner earlier testified that Ahmed likely died because of blunt force trauma to the head, and that the stab wounds to the abdomen accelerated the death.

Ahmed’s body was found around noon on April 30, 2011, in a road ditch near Spiritwood.

Howard testified Tuesday that he did not know Ahmed was dead until Howard was booked into the Stutsman County Jail, that evening.

Howard is charged with murder and criminal conspiracy in the death of Ahmed, whose body was found in a ditch near Spiritwood.

Cave was earlier convicted of manslaughter and criminal conspiracy and is serving an 11-year prison sentence.

Tuesday  afternoon the prosecution and defense rested, and presented closing arguments.

Defense attorney Steve Mottinger asked the jury to find Howard guilty on a lesser charge of manslaughter, saying Howard did not intentionally kill Ahmed, and that  Howard admitted to hitting Ahmed in the head twice, and kicking him.

 In his closing arguments, prosecutor, Stutsman County State’s Attorney, Fritz Fremgen said,  Leron Howard and Janelle Cave  want to distance themselves from the stabbing as it shows intent to harm Ahmed.

The jury  begins deliberation  Wednesday morning

Valley City, ND (KCSi-T.V News Aug 21, 2012)   –   Valley City police is seeking information on park vandalisms, and is increasing patrols.

Reports of vandalism, fires, and other incidnt reports have recently increased at Chautauqua and City Parks.

Incidents include graffiti on park equipment, and  a city-owned dumpster and garbage can at Chautauqua Park were set on fire, along with  reports of drinking and possible drug activity, which have likely occurred at night, when the parks are off limits.

 Police are increasing park patrols.

Anyone seeing suspecious activity should call Valley City Police at 845-3110. 

 

Jamestown, ND (KCSi-T.V. News) — The Jamestown City Council’s Finance & Legal Committee, Building, planning & Zoning Committee, and Civic Center & Promotion Committee met Tuesday Evening (Aug 21, 2012) at City Hall.

Council Member Gumke was not present.

With Finance & Legal Committee Business:

A motion was made and seconded to table the offer from Tim Dabill to purchase Lots 1 & 2, Block 2, Beverly Hills 6th Addition, and Lots 18 & 19, Beverly Hills 3rd Addition, in the amount of $6,000, subject to the buyer paying for all costs of surveying and approval of a re-plat prior to deed transfer.  Dabill was not present at the meeting.

Approved was the request from the Corner Bar for a permit to close the east end of 2nd St West and to dispense alcoholic beverages on September 15, 2012, from 10:00AM to 2:00AM, September 16, 2012.

Informational: Monthly departmental and financial reports, were presented.

 

At the Building, Planning & Zoning Committee meeting:

Planning Commission minutes of August 13, 2012, were presented.

 

A Public Input Meeting was held to receive public comments regarding Section 8, of Appendix B of the City Code relative to subdivision development improvements and suggested changes.

Committee Chairman, Dan Buchanan outlined guidelines for speaking at the meeting, including a three minute oral presentation, followed by two minutes for the committee response.

Comments would only be taken on the subject at hand.

He added that written comments to supplement oral comments may be submitted to City Administrator Jeff Fuchs by 5-p.m., on August 31, 2012.

 

Mark Goehner, representing Eddy Funeral Home and Marjo, Inc., spoke of changes needed, concerning costs to developers, and installation of infrastructure issues.

He said he has worked with Jordahl developers from Fargo.

 

Clarice Liechty asked what the City Council has been doing to address reviewing and any changes to the city Ordinance, and to look at what other cities are doing.

 

Corey Bayer said he has not developed new properties.

He said Jamestown could look at ways to stretch developers dollars over a period of time, to make projects more cost effective.

The committee asked for general comments from those in attendance.

 

Candice Dempsey, of Reuben Liechty Realty, said the climate for housing in Jamestown is stagnant.

She added a need for condominiums in Jamestown.

Families new to Jamestown in some cases are struggling to find a home to buy in Jamestown.

 

Dave Hillerud, of Hillerud Construction also suggested seeing what other cities are doing with their Ordinances, concerning development.

He asked what kind of timeline the city has to make changes.

City Attorney Ken Dalsted it takes couple of months to affect an Ordinance change based on a consensus by the City Council, in addition to any recommendations by the City Planning Commission.

 

Mayor Andersen said the city has copies of Ordinances from North Dakota cities of similar size to Jamestown, that will be reviewed.

 

City Administrator Jeff Fuchs added, currently the developer is responsible for the costs of installing water and sewer lines, road grading and graveling, curb and gutter, and paving.

Paying Special Assessments is the responsibility of the developer until the property is sold.

Valley City, ND (KCSi-T.V. News) — The Barnes County Municipal Airport in Valley City is hosting the “Wings & Wheels Airshow,” Saturday September 8, 2012.

On The Wayne Byers Show, on CSi Cable 2, Airshow Co-Director, Lori Jury said in addition to aerobatic entertainment, the event will feature the Bridge City Cruisers Classic Car Show & Shine.

There will also be military and static aircraft displays, plus, and evening outdoor bbq dinner served.

Plans include a fireworks display, and entertainment by the band “Past Due.”

On site concessions will also be available.

There will also be a “Night Air Show,” beginning that evening at 9:30.

The airshow is being dedicated to the memory of local aviators Larry Lindemann and Bob Beyer.

Lindemann served as the manager of the Barnes County Municipal Airport for 27 years from 1985-2012. He passed away March 17, 2012.

Beyer was appointed to the Barnes County Municipal Airport Authority in 1976, serving as chairman for eight years.

He retired in 2009, and passed away in 2011. Beyer was instrumental in securing funding for and implemented many ideas for development of the local airport.

Aircraft performers include…award winning Pilots Matt Younkin, and Warren Pietsch, along with Jim “Fang” Maroney, Toby McPherson, Rex Hammarback, and Jarrod and Paul Lindemann.

Barnes County Airport Authority Chairman, Denny Helland said there will be an after dark performance.

McPherson, from Page, North Dakota, flies the P-51 Mustang, which he says won World War II for the allies.

He will fly the winner of a drawing in his aircraft the day of the show.

Ms. Jury added that advance ticket holders have the chance to win the ride with McPherson.

The drawing will be held on Monday August 27, 2012.

Jamestown, ND (KCSi-T.V. News) — The Jamestown Public School Board Monday (Aug 20, 2012) considered how to keep students in the school district.

It was noted that seven students or their parents have decided to leave the school district, on kindergarten student, one in sixth grade, two freshman, two sophmores and one junior.

Requested to be allowed to move to the Pingree-Buchanan school district.

Considering each request separately, the board voted 6-1, for approving the no cost tuition for the seven students.

Roger Haut, Greg Allen, Shelly Jystad, Heidi Larson, Terry Anderson and Roy Musland were in favor with Gail Martin opposed. Board members Tanya Ostlie and Diane Hanson were absent.

About $4,000 in foundation aid payments go from the state to the other school district.

Jamestown School Superintendent, Robert Toso said the school district has sent out a letter to everyone who has left Jamestown Public Schools requesting reasons for leaving. He said there has only been one or two responses.

Board member Greg Allen said if students leave the school district that it does not indicate that there necessarily is anything wrong with the school district.

  BISMARCK, N.D. (AP) – Workers are adding 280 parking spaces on
the west side of the state Capitol building in Bismarck.
     Facilities Manager John Boyle says the $1.2 million project is
the first part of a three-phase process to increase parking and do
landscaping work on the Capitol grounds.
     During the legislative session every two years, lawmakers take
up 175 parking spots, leaving about 100 for visitors and lobbyists.

That means many people have to park on the road that loops in front
of the Capitol or on city streets. Boyle says the new parking
spaces should create a safer environment.
     The new lot is to be done by November, in plenty of time for the
start of the 2013 Legislature in January.

 

 FARGO, N.D. (AP) – The North Dakota Army National Guard plans to
beef up its aviation presence in the eastern part of the state.
     The Guard says it will base a Black Hawk helicopter in Fargo,
and rotate Lakota and Kiowa helicopters between Fargo and Bismarck.
     Army National Guard aircraft have flown solely out of Bismarck
since 1958. The Guard says also flying out of Fargo will help it
better respond to natural disasters and search-and-rescue missions
in eastern North Dakota.

 

BISMARCK, N.D. (AP) – A North Dakota woman who tried to flee
police while driving drunk with two teenage passengers in her
vehicle says she will plead guilty in federal court.
     Kristal Good Bird is charged with child abuse in Indian country.
Authorities say she was speeding on Main Street of New Town on May
21 and crashed her vehicle into a gas pump while trying to elude
authorities.
     Police say a 14-year-old passenger was injured in the crash and
hospitalized overnight for observation.
     Good Bird faces a maximum penalty of five years in prison.

 

  MAPLETON, N.D. (AP) – Authorities have arrested a 17-year-old
boy in the armed robbery of a Mapleton gas station.

The holdup took place Monday evening at Gordy’s Travel Plaza.

The Cass County Sheriff’s Office says the teenage suspect was arrested without incident about a half hour after the robbery.

 

 GRAND FORKS, N.D. (AP) – Investigators say a house fire in which a retired Grand Forks attorney died started on the kitchen stove and spread to nearby combustibles and the kitchen cabinets.
 
     Eighty-six-year-old Fred Arnason died Aug. 14. He was a former assistant Grand Forks County prosecutor who later started a private law practice.
 
     Grand Forks fire officials have ruled the fire accidental.

 

 FARGO, N.D. (AP) – Flood insurance might be needed for thousands more properties in Fargo.

About 500 structures are affected by the current flood plain but thousands more could fall under the federal requirement based on a preliminary new flood plain map.

 

 BISMARCK, N.D. (AP) – North Dakota Sen. Kent Conrad says his official papers will be digitized and available to the public after he leaves the Senate this year.
 
     Conrad on Tuesday donated his papers to George Washington University in Washington, D.C.
 
     The university is setting up a partnership with the State Historical Society of North Dakota to make them available to the public.
 
     Conrad says the papers will be digitized and searchable on the Internet.
 
     He calls them a “treasure trove” of history on everything from budget negotiations to the impeachment of former President Bill Clinton.
 
     Conrad says nothing is being left out. He says papers detailing allegations that he got favorable loans from the Countrywide mortgage company will be included.
 
     The Senate Ethics Committee concluded Conrad didn’t get favorable treatment.

 EDEN PRAIRIE, Minn. (AP) – Minnesota Vikings running back Adrian Peterson is fine with the team’s plan to hold him out of the preseason.

Coach Leslie Frazier confirmed yesterday his change of mind about Peterson’s preseason action. Peterson is coming back from offseason knee surgery.

 

UNDATED (AP) – Nearly two years after playing in his last NFL
game, running back Clinton Portis is announcing his retirement.

The Washington Redskins say that Portis and owner Dan Snyder will hold
a retirement news conference Thursday.
     Portis played two seasons with the Denver Broncos and then seven
with the Redskins. He set a Washington franchise record in 2005
with 1,516 yards rushing.

 

NHL-TALKS…
     TORONTO (AP) – NHL labor talks are set to resume with a wide gap
remaining and time running out to avoid a potential lockout.
     NHL Players’ Association executive director Don Fehr and NHL
commissioner Gary Bettman are scheduled to be back at the
negotiating table at the union’s headquarters in Toronto today.
     It’s the first time in a week the two leaders have met face to
face.

 INDYCAR…
     FORT WORTH, Texas (AP) – Texas Motor Speedway will host an
IndyCar race for the 17th straight year next June.

The announcement ends speculation about the future of the open-wheel series at the Fort Worth track. The speedway’s 2013 schedule includes the usual IndyCar race plus two NASCAR Sprint Cup weekends for the ninth
consecutive season.

JEFFERSON CITY, Mo. (AP) – Embattled Rep. Todd Akin says his
decision to stay in the Missouri Senate race is “not about my
ego” but about the voters of Missouri who chose him as their
nominee.

Akin appeared on NBC’s “Today” show and ABC’s “Good
Morning America.”

Akin confirms that Republican vice presidential
candidate Paul Ryan personally asked that he step aside in the wake
of his comments about women and rape.
     
     SAN JOSE, Calif. (AP) – Nine citizens are now responsible for
deciding a legal battle between two technology titans, Apple and
Samsung.

The jury in Apple’s suit begins deliberations today after
last minute talks failed to reach a deal.

 Apple claims Samsung ripped off iPhone and iPad technology. Samsung says the technology at issue was developed before Apple made its top-selling products.
    
     MIAMI (AP) – Tropical Storm Isaac is winding up as it heads for
the Caribbean where tropical storm warnings have been issued for a
swath of islands in its path.

The National Hurricane Center says Isaac is expected to strengthen even more and could become a hurricane by tomorrow.
     
     FEDERAL WAY, Wash. (AP) – A Washington state man is due in
federal court today after his arrest in connection with an email
threat against the president.

Authorities say Anton Caluori is also accused of brandishing a shotgun at officers who came to his door.
     
     CAMDEN, N.J. (AP) – Police in New Jersey say they believe a
woman with a history of mental problems decapitated her 2-year-old
child and killed herself.

Police tell WPVI-TV in Philadelphia that officers responded to a report of a domestic dispute at the home early Wednesday.

They say they think the incident occurred after the woman argued with her boyfriend.
