Jamestown, ND (KCST.V. News Sept 11, 2013) – The North Dakota Highway Patrol reports a Jamestown Man died and his 24 year old passenger, also from Jamestown was injured, Wednesday evening, (Sept 11, 2013,) in a one vehicle rollover near Spiritwood, about 9:40-p.m.

The report says a 1972 Ford pickup was northbound on Stutsman County Road 62 en route from Spiritwood, to Wimbledon. The vehicle dropped off the east edge of the roadway and the driver over-corrected losing control of the vehicle. The vehicle slid sideways across the roadway and entered the west ditch. The vehicle overturned several times in the west ditch.

Both the driver and passenger were not seat belted and were ejected from the vehicle. The driver was pronounced dead at the scene. The female passenger was injured and taken to Jamestown Medical Center by ambulance for non life threatening injuries.

Their names will be released after family members have been notified.

The Stutsman County Sheriff’s Office assisted at the scene.

The crash is under investigation by the NDHP.

 

Jamestown, ND (KCSi-T.V. News) — The Stutsman County State’s Attorney has filed charges against an inmate accused of attacking a prison guard at the James River Correctional Center on July 28, 2013.

Shawn Ostafin has been charged with the assault on the correctional officer, Jeremiah MacDonald.

MacDonald sustained severe head injuries and was airlifted to a Bismarck hospital.

Ostafin is also charged as a habitual offender.

If found guilty on that charge Ostafin could face an additional ten years in prison.

Ostafin was serving a sentence for terrorizing.

Ostafin was disciplined last year for assaulting two staff members at the state penitentiary in Bismarck.

In 1990 he was convicted in the murders of his father and stepmother in Mandan.

 

JAMESTOWN, N.D. (AP) – An emergency dispatcher in Jamestown has been fired after allegedly leaking confidential information about an investigation.

Stutsman County officials allege that Miranda Meisch provided information to a suspect – including the name of the person who complained about suspicious activity at a residence.

County Emergency Manager Jerry Bergquist says Meisch jeopardized a police investigation and could have put the person who called authorities in danger.

Meisch was put on administrative leave Aug. 12, 2013 and was fired Aug. 28 after violating terms of the leave by going out of town.

Meisch had been a dispatcher for more than two years. A telephone listing for her could not immediately be found.

Jamestown, ND (KCSi-T.V. News Sept 11, 2013) – Interstate Engineering reports that a section of 3rd Avenue NE near Lincoln Elementary School is expected to close today Thursday (Sept 12, 213) as part of the Jamestown sanitary sewer project. Starting Thursday afternoon, 3rd Avenue NE will close from 6th St NE to 7th St NE.

Jamestown, ND (KCSi-T.V. News) — The South Central Human Service Center’s license to provide substance abuse treatment will be suspended for 90 days, starting Monday, September 16, 2013.

The 90-day suspension involves just the substance abuse cases and does not affect treatment for other mental health issues.

Department of Human Services superintendent of institutions, Alex Schweitzer, says, “We need to look at how we review cases and documentation.”

Schweitzer said the substance abuse program currently serves 63 clients, adding that  other regional human service centers and private addiction counselors  will treat everyone that needs treatment.

No layoffs, are planned regarding the the suspension.

Regional human service centers are located in Fargo, Devils Lake, Grand Forks, Minot, Williston and Dickinson.SCHSC serves the counties of Wells, Foster, Griggs, Stutsman, Barnes, Logan, LaMoure, McIntosh and Dickey.

 

Jamestown, ND (KCSi-T.V. News) — Patriot’s Day this year will be commemorated locally today, Thursday, September 12. Charlie Kourajian, Chairman of the Jamestown Patriotic Council, says the change of date was due to scheduling conflicts at the All Vets Club.

Kourajian says, “This (is) the 12th Anniversary of the terrorist attacks on our country. The tragic events of September 11, twelve years ago, are constant reminders what can happen in our country if we are not vigilant”

Patriots Day will feature a “Freedom Walk” in downtown Jamestown at 6 p.m. to commemorate the events of that day and to honor our first responders in our community. We encourage people of all ages to walk the short distance with us, or ride if walking is not possible.

The walk will start with the playing of the National Anthem and the pledge to the flag and then proceed around downtown. After the short walk the Vets Club will be serving a free will offering spaghetti supper to all present, followed by a short program.

Jamestown, ND (KCSi-T.V. News Sept 11, 2013) — The JSDC Board granted an option to buy two lots in the I-94 Business Park to Kal Patel.

On Wednesday’s (Sept 11, 2013) Wayne Byers Show, on CSi Cable 2 the Jamestown/Stutsman Developement Corporation, Marketing and Workforce Developer, Holly Miller said, the agreement gives Patel a six-month option to purchase lots located next to the current Stutsman Harley-Davidson building.

She said Patel is looking for possible tenants, and if found Patel would purchase the lots and move ahead with the project.

His $2,000 option cost is non-refundable if he does not purchase the lots.

The JSDC also gave approval to a $10,000 Flex Pace interest buydown for an expansion to Reister Meats.

Reister Meats operates a slaughter plant at the Reister family farm near Streeter and a retail meat market in Medina.

The Flex Pace interest buydown reduces the interest expense on the loan and then is repaid to the JSDC after the term of the original loan.

The JSDC also agreed to contract with KLJ Engineering for an updated strategic plan for the organization,at a cost of $3,000 plus travel costs incurred while meeting with local officials.

The Jamestown/Stutsman Development Corporation Board of Directors has approved a land purchase from the JSDC to Kost Materials, presently operating in Fargo.

The business plans to operate a cement ready mix plant and aggregate gravel operation near Jamestown.

Kost Materials is buying three lots, about 35 acres adjacent to the Cavendish Farms potato processing plant east of Jamestown, at a price of $7,500 per acre.

Ms. Miller also pointed out that Jamestown will host the North Dakota Economic Development Association, Fall Conference October 28-30.

She said about 70-80 individuals will be in Jamestown for the conference.

Grand Forks, ND (KCSi-T.V. News) — “Serve and Protect,” takes on a new meaning, as Law Enforcement Torch Run® volunteers donate their time to serve delicious food at Applebee’s restaurants, all for a great cause.

The Law Enforcement Torch Run (LETR) for Special Olympics will conduct the 8th annual statewide “Tip A Cop” event at all Applebee’s Neighborhood Grill & Bars, September 24 & 25, 2013 from 5-p.m., to 9-p.m. Local law enforcement personnel in Jamestown, Bismarck, Fargo, Dickinson, Grand Forks, Minot and Williston will be working dinner shifts collecting “tips” to help Special Olympics provide programs to children and adults with intellectual disabilities.

The Law Enforcement Torch Run program is the largest grass-roots public awareness and fundraising program for Special Olympics throughout the world.

The torch, which is the Flame of Hope, is part of all Special Olympics ceremonies, symbolizing the unlimited potential of the human spirit.

Special Olympics North Dakota provides year-round programs of sports training, athletic competition, and health athlete initiatives for 1,400 children and adults with intellectural disabilities in North Dakota.

 

BISMARCK, N.D. (AP) – A federal judge has dismissed part of a lawsuit challenging a new North Dakota law that blocks abortions on the grounds of genetic defect or unwanted gender.
 
     The state’s sole abortion clinic in Fargo filed the lawsuit in June challenging the law and another new measure that bans abortion when a fetal heartbeat is detected.
 
     The Red River Women’s Clinic says the ban on abortions based on gender or genetic defects doesn’t affect the clinic because it doesn’t perform abortions for those reasons.
 
     U.S. District Judge Daniel Hovland on Monday granted the clinic’s request to drop that part of the lawsuit.

 

WESTHOPE, N.D. (AP) – A Westhope man accused of killing another resident of the northern North Dakota city says he was carrying out the wishes of a friend who wanted to commit suicide but was unable to pull the trigger himself.
 
     Forty-nine-year-old Timothy Mundt was charged in the February shooting death of 40-year-old Jessie Kirk.  He pleaded guilty Wednesday to a lesser murder charge that carries a maximum sentence of 20 years in prison rather than a life term.
 
     Defense attorney William Hartl said in court that assisted suicide under North Dakota law carries only a maximum sentence of five years in prison but that his client didn’t want to put people through a trial.
 
     Judge Michael Sturdevant sentenced Mundt to serve 12  1/2 years in prison.

 

 BISMARCK, N.D. (AP) – A man accused of violating a protection order by transporting a juvenile from North Dakota to Iowa has been sentenced to federal prison.
 
     David Lilley, of Belcourt, pleaded guilty in May to interstate violation of a protection order and interstate transportation of a stolen vehicle.
 
     Authorities say the 27-year-old Lilley stole a vehicle on Feb. 17 and took the juvenile from the Turtle Mountain Indian Reservation to Iowa.
 
     Lilley was prohibited from having contact with the juvenile because of a tribal court order.
 
     U.S. District Judge Daniel Hovland sentenced Lilley to three years in prison and ordered him to pay back more than $1,400.

 

  RUGBY, N.D. (AP) – Two Rugby jail administrators have been placed on leave and the Heart of America Correctional Center is on probation.
 
     An inmate escaped this summer, and another jumped from a moving transport vehicle several weeks later.
 
 Those incidents prompted a Department of Corrections audit this month.
 
     Besides putting the jail on probation, the DOC placed jail administrator Mary Richard and security director Joey Cotton on paid leave for 30 days.
 
     Steve Engen with the DOC says the agency often used the jail to house prisoners but pulled out all of its inmates at the end of August.
 
     He says final findings of the security audit will be made official within 45 days and the facility will have to correct problems that were found in order to be re-certified.

 

 GRAND FORKS, N.D. (AP) – Explicit rules against explicit dance moves sent students at a Grand Forks high school waltzing out of the gym Friday night.
 
     Red River Principal Kris Arason says students are told at the beginning of every school year what kind of behavior is expected in class and at school activities. He says the dancing Friday night was inappropriate.
Students were warned during the dance about moves mimicking one made infamous by singer Miley Cyrus during the recent televised MTV Video Music Awards.
 
     About three-fourths of the students left, despite paying $5 a ticket. They reassembled on the far side of town to dance as they pleased. Police say nothing illegal happened.
 

GRAND FORKS, N.D. (AP) – Nearly a year after beginning service to Grand Forks, United Airlines is leaving the market. 
 
The  last of the twice-daily flights to Denver will end after Dec. 3.
 
     United says the financial performance of the leg did not meet expectations.
 
     The airline says it will contact customers with reservations and offer a refund or try to work them onto other flights.
 
     The loss happens as the Grand Forks airport is seeing record boarding numbers. The state aeronautics commission says that overall, boardings are up 9 percent so far this year

 

FARGO, N.D. (AP) – A North Dakota State University airplane that drew the ire of lawmakers might have a buyer. The university’s foundation says Scheels All Sports has signed a letter of intent to buy the Beechcraft King Air B200. NDSU has been leasing the plane for roughly $320,000 a year from the privately run foundation since July 2007.

 

MEDORA, N.D. (AP) – Two of the oldest buildings in Medora will stay standing.
 
     A proposal to remove them failed to draw a motion to proceed at a special Planning and Zoning Board meeting.
 
     The  plan was to tear down the Badlands Pizza Parlor and Dakota Cyclery buildings and replace them with a more modern-looking structure.
 
     One of the main issues is the fate of the bike shop, which specializes in setting up cyclists for trips along the popular Maah Daah Hey Trail.
 
     Other people raised concerns about preserving the town’s historic structures.

 BISMARCK, N.D. (AP) – A summer survey indicates that North Dakota’s pheasant population is down about 30 percent from last year.
 
     Stan Kohn with the state Game and Fish Department says the number of broods and the average brood size both were down statewide because of poor reproduction last spring. He says factors include habitat loss and continuous wet weather.
 
     Kohn says that even though pheasant numbers are down overall, there will be still be local areas with good populations.
 
     The regulator pheasant hunting season opens Oct. 12 and continues through next Jan. 5. The two-day youth season is Oct. 5-6.
 
     Pheasants are big business in North Dakota – tens of thousands of hunters kill at least half a million birds in a typical season.

 

FARGO, N.D. (AP) – Fargo’s in-town turkey hunt has been delayed about a month to conform to state hunting rules.
 
     The  season was slated to open at sunrise on Saturday for bow hunters. But due to state regulations, the start of the season has been delayed to Oct. 12.
 
     The state has issued 36 of the 45 turkey hunt permits available in Fargo.
 
     Fargo police Lt. Gene Anderson says the city will send out notices to hunters telling them they’ll have to wait another month for the hunt.
 
     Officials hope the new hunting season will help control turkey populations in town.

 

 FARGO, N.D. (AP) – The North Dakota State University men’s basketball team this season will play games against Ohio State, Notre Dame, Saint Mary’s and Southern Mississippi. NDSU coach Saul Phillips says his team’s upcoming schedule is one of the more challenging ones the program has faced. The Bison open the season with an exhibition game against Concordia Moorhead on October 30th. Viterbo comes to Fargo on November 8th for NDSU’s regular season opener.

     MINNEAPOLIS (AP) – Minnesota manager Ron Gardenhire was ejected in the fourth inning of the Twins’ game against Oakland Athletics. Gardenhire was thrown out after umpires huddled and awarded Jed Lowrie a two-run double after originally calling his line drive down the first-base line foul.  Gardenhire argued for close to five minutes with the umpires.

BALTIMORE (AP) – New York Yankees shortstop Derek Jeter will miss the rest of the season after being placed on the disabled list yesterday with an ankle injury. The 39-year-old Jeter last played Saturday against Boston and started the year on the disabled list after breaking his left ankle in the 2012 playoffs. He returned to the DL twice more and played in only 17 games, batting .190 with one homer and seven RBIs.

UNDATED (AP) – Yahoo Sports is reporting that five SEC players received improper benefits during their college careers, including former Alabama offensive tackle D.J. Fluker, casting yet another dark cloud over college sports. The other players were Tennessee quarterback Tyler Bray and defensive lineman Maurice Couch, Mississippi State defensive tackle Fletcher Cox and wide receiver Chad Bumphis. The report cited text messages and financial records of former Alabama defensive end Luther Davis and an unnamed NFL source who said Davis was a go-between for the players with NFL agents and financial advisers.

UNDATED (AP) – An Associated Press review of radio communications from last Saturday’s Sprint Cup race at Richmond reveals Front Row Motorsports asked for a deal from Penske Racing in the closing laps and then helped make sure Penske’s Joey Logano made the Chase for the championship by having one of its drivers back off. David Gilliland’s spotter tells his crew that Logano’s team wanted Gilliland’s spot on the track “and they said they’d probably be able to help us in the future.” A short time later, Logano passed Gilliland on a restart and finished 22nd, one spot ahead of Gilliland and good enough for a berth in the Chase field.

 Two of Michael Waltrip Racing’s sponsors are reviewing their relationships with the race team following the organization’s attempt to manipulate the finish at the Sprint Cup race in Richmond Saturday.
 NAPA Auto Parts posted on its Facebook page Wednesday it is disappointed a partner would make “such a significant error in judgment.” NAPA is the sponsor for Martin Truex Jr., who was kicked out of the Chase for the championship when NASCAR sanctioned MWR for its actions in Saturday night’s race.
 Also, Clint Bowyer sponsor 5-Hour Energy tweeted it is reviewing its sponsorship relations internally.

NFL…

 Commissioner Roger Goodell (guh-DEHL’) said that the NFL should pay attention to those offended by the Washington Redskins nickname. In an interview with Washington radio station 106.7 The Fan, Goodell said, “If we are offending one person, we need to be listening, and making sure that we’re doing the right things to try to address that.” It was a subtle change in position for Goodell, who had more strongly supported the nickname in his previous statements this year.

 WASHINGTON (AP) – Russian President Vladimir Putin says a potential U.S. strike on Syria would create more victims and could spread the country’s civil war beyond its borders, unleashing a new wave of terrorism. In an opinion piece for The New York Times, Putin urges the U.S. to exercise caution in dealing with Syria. He also takes a shot at President Barack Obama’s Tuesday night remarks on the situation, calling the notion of American exceptionalism “extremely dangerous.”
 
     GENEVA (AP) – Secretary of State John Kerry is testing the seriousness of Russia’s proposal to secure Syria’s chemical weapons. Kerry and a team of U.S. experts plan at least two days of meetings with their Russian counterparts starting today in Geneva. They hope to develop an outline of how some 1,000 tons of chemical weapons stocks and precursor materials can be safely inventoried and isolated under international control in an active war zone and then destroyed.
 
     MOGADISHU, Somalia (AP) – A member of an al-Qaida-linked terror group in Somalia says an American jihadist has been killed in an ambush in southern Somalia. The al-Shabab member identifies the American as Omar Hammami. The U.S. government announced a $5 million reward for Hammami’s capture earlier this year. There also have been reports that Hammami had a falling out with al-Shabab’s top leader, who allegedly ordered the American killed.
 
     BOULDER, Colo. (AP) – Colorado is dealing with more flash flooding today. Days of heavy rains have flooded streets, triggered mudslides, prompted evacuations, and left one person dead in Boulder County. The National Weather Service issued a flash flood emergency for the county and northwest Jefferson County.
 
     WASHINGTON (AP) – Michelle Obama is encouraging Americans to drink more water. She’s getting behind a campaign being announced today by the Partnership for a Healthier America. Organizers say too many people don’t drink enough water daily and about one-fourth of children below age 19 don’t drink any water at all on any given day.
