LINCOLN, N.D. (AP) – The City Council in Lincoln has fired the police chief on a 3-2 vote in which the mayor had to break the tie.

Chief Marcel Sim has been on administrative leave since late September because of a restraining order filed against him after domestic violence complaints made by his wife. He resigned earlier this month but then withdrew the resignation.

The council voted to fire Sim on Monday night during a special meeting attended by more than 50 people. Mayor Robert Johnston says the matter has been painful for everyone involved, but the council has to do what is in the best interest of the city just southeast of Bismarck.

A telephone listing for Sim could not immediately be found. Police Officer Jacob Crook defended Sim during the meeting.

FARGO, N.D. (AP) – The lawyer for a man convicted of killing two children on the Spirit Lake Indian Reservation in North Dakota says his client should either be acquitted or granted a new trial.

Defense attorney Christopher Lancaster on Monday filed separate motions for Valentino “Tino” Bagola, who is awaiting sentencing on two counts of felony murder.

A federal jury in September found Bagola guilty for the May 2011 slayings of 9-year-old Destiny Jane Shaw-Dubois and her 6-year-old brother, Travis Lee DuBois Jr.

Lancaster says the government did not prove its case and presented as evidence a confession that was coerced by an interrogation with several “gotcha” moments.

Bagola earlier this month filed court documents on his own asking to be released from prison because Lancaster did a poor job of defending him.

WILLISTON, N.D. (AP) – Searchers using night-vision gear helped find a deer hunter who spent a night along the Missouri River.

A game warden says 26-year-old Kaleb Trowbridge, of Williston, was hunting with a friend late Monday at the Lewis and Clark Wildlife Management Area south of Williston.

The  men separated to bow hunt from different tree stands. His partner reported Trowbridge missing when he didn’t meet up after dark.

Authorities and friends searched the woods and determined Trowbridge got turned around and walked away from his vehicle after seeing an arrow on the ground pointing in the direction he walked.

He was found along the river’s shoreline before dawn on Tuesday morning when he heard a search boat, turned on his headlamp and was spotted.

BISMARCK, N.D. (AP) – Gov. Jack Dalrymple and Alliance Pipeline have announced the completion of an 80-mile pipeline to carry natural gas from Tioga to Sherwood, where it meets with the company’s existing natural gas line that moves the gas to Chicago.

The Calgary-based company says construction on the $170 million project began a year ago and was completed last month. The company says the 12-inch pipeline is capable of transporting more than 126 million cubic feet of natural gas daily.

Alliance says it has signed an agreement with New York-based Hess Corp. for half of the pipeline’s capacity.

About one-third of natural gas production in North Dakota is being burned off as byproduct of oil production. Dalrymple says the pipeline project will help reduce flaring in the state.

Washington D.C.  (KCSi-T.V. News Oct 29, 2013) – Tuesday, President Obama declined Congressman Kevin Cramer’s offer for the President to visit North Dakota, only four days after his office received the invitation.  An explanation was not provided other than expressing his appreciation, and a promise to keep Cramer’s request on file.

Cramer stated,   “Although I understand the pressures upon the President’s schedule, I am perplexed with the hurried nature of his response.  I continue to believe the President would stand to gain a number of insights on what’s happening in North Dakota, which he can take back to the White House and help our nation. I hope the President’s implied proposal for further consideration is genuine and North Dakotans don’t feel offended, ” stated Cramer.

FARGO, N.D. (AP) – Dry weather over the past week has helped many North Dakota farmers make progress on the harvest of late-season crops.

The Agriculture Department says in its latest crop and weather report that the sugar beet, potato, flaxseed, dry bean and canola harvests all are nearing completion. The corn, soybean and sunflower harvests still lag behind the average pace, however.

Pasture and range conditions in the state are rated 70 percent good to excellent, and calf and cattle conditions are 85 percent good to excellent.

Topsoil moisture is 97 percent adequate to surplus, and subsoil moisture 95 percent adequate to surplus.

BISMARCK, N.D. (AP) – A Houston-based energy company is cleaning up a saltwater spill on U.S. Forest Service land in the western North Dakota oil patch.

The spill from a disposal line was discovered a week ago. It leaked an estimated 150 barrels of saltwater, a byproduct of oil production. That’s about 6,300 gallons. State health officials say some of the saltwater reached Blacktail Creek north of Belfield but that no harm to fish, wildlife or livestock has been observed.

Encore Energy environmental coordinator Bart Brinkerhoff tells The  company is pumping water from a beaver dam on the creek where the saltwater might have collected and also will be washing salt off the hard-packed soil in the area.

The company and Health Department are awaiting results from water tests.

SIOUX FALLS, S.D. (AP) – The man charged with killing the 2-year-old son of Minnesota Vikings running back Adrian Peterson has bonded out of a South Dakota jail.

The Minnehaha County Jail in Sioux Falls says 27-year-old Joseph Robert Patterson is no longer housed there.

His attorney, Tim Rensch, confirmed Patterson’s release and says there are no conditions on it, but Patterson plans to stay in the area and defend himself.

Patterson’s bond was reduced to $750,000 on Monday, so he had to post $75,000.

He’s charged with second-degree murder, manslaughter, aggravated assault and aggravated battery in the death of Tyrese Robert Ruffin.

Patterson is the boyfriend of Tyrese’s mother.

Peterson had just recently found out that Tyrese was his son.

In world and national news…

WASHINGTON (AP) – She had told Congress in the past that everything was on track for a reasonably smooth launch of the online health insurance exchanges that are a key part of the new health care law. But Tuesday, Marilyn Tavenner told a House panel that the website “has not worked as well as it should.” The Medicare chief wouldn’t provide any figures on how many people have been able to enroll — but said, “We expect the initial numbers to be small.”

WASHINGTON (AP) – The chairman of the House intelligence committee is warning that a congressional plan to bar the U.S. government from collecting the phone records of millions of Americans would scrap an important tool for tracking terrorists. Republican Mike Rogers says the U.S. cannot return to the pre-9/11 intelligence-gathering mindset he said limited investigators from piecing together clues and preventing an attack. He spoke at the start of a hearing where top intelligence officials were testifying, including National Security Agency Director Keith Alexander.

NEW YORK (AP) – Investors have been sending stocks higher Tuesday on expectations that the Federal Reserve will keep its economic stimulus program in place. Fed policymakers began a two-day meeting Tuesday. After the 16-day partial government shutdown, economists are doubtful that the Fed will start winding down its bond-buying program until at least next year.

CHICAGO (AP) – Jesse Jackson Junior has started serving a two and a-half year prison term for misusing campaign funds. A prison official says the former congressman is now an inmate at a North Carolina federal prison. He reported at least a couple of days earlier than required.

TOMS RIVER, N.J. (AP) – A New Jersey mother has been sentenced to two years of probation for slapping two boys who she says were bullying her daughter. Rebecca Sardoni pleaded guilty in September to assault and other counts. Prosecutors say she got on a school bus in October 2012 screaming profanities and then assaulted two students. She says they were bullying her 9-year-old daughter. Officials say the boys were not seriously injured.
