BISMARCK (CSi) – Gov. Jack Dalrymple will honor North Dakota’s veterans and service members by attending a Veterans Day ceremony on Monday, November 11, beginning at 10 a.m. in the Missouri River Events Center at the North Dakota Heritage Center in Bismarck. Lt. Gov. Drew Wrigley will attend a flag raising ceremony for the North Dakota Medal of Honor Memorial at 4 p.m. at Roosevelt Park in Minot. The former memorial was damaged as a result of the 2011 flood and has since been restored. November 11 marks the official re-opening of the memorial.
Gov. Dalrymple is encouraging North Dakotans to observe Veterans Day, Monday, November 11, by honoring the service and sacrifice of veterans and those currently serving at home and abroad through ceremonies and patriotic activities, and by displaying the American and North Dakota flags.
“Throughout our history, generations of patriots have answered this nation’s call to duty and have courageously defended our homeland and protected our way of life,” said Dalrymple. “Our veterans and servicemen and women represent the very best of our state and nation, serving with honor and distinction and selflessly making sacrifices in the name of freedom and democracy. Jamestown (CSi) — An indoor Radio Controlled Fun Fly comes to the Jamestown Civic Center November 16, 201, 10-a.m. to 5-p.m.
The event is sponsored by the Buffalo City Radio Control Squadron.
The Fun Fly features electric airplanes, helicopters and multi-engine aircraft.

Jamestown (CSi) — The Jamestown Salvation Army as set
this year’s Kettle Campaign goal is $147,000, $1,000 more than last year.
Money raised in the Kettle Campaign goes to the Salvation Army’s many programs, including rental and utility assistance, food pantry, prescription assistance, bus vouchers, clothing vouchers, gas assistance, emergency lodging, youth programs, disaster services and more.
The Salvation Army partners with businesses or individual donors who agree to match kettle donations.
Starting November 13, 2013 red kettles will be open for donations at Park Plaza Mall by Coborn’s Grocery and at the Buffalo Mall by Home of Economy.
Kettles will be added at Walmart and the Buffalo Mall Sears entrance, starting November 29.
The last day for all kettles is December 24. Donations can also be made by mail or directly to the Salvation Army office, on First Avenue North in Jamestown.

DEVILS LAKE, N.D. (CSi) – A veteran of Desert Storm and Operation Iraqi Freedom recently assumed command of the North Dakota National Guard’s Headquarters of the 164th Regional Training Institute. Lt. Col. Leo Ryan, of Jamestown, took the leadership role during a Nov. 2 ceremony at Camp Grafton Training Center, Devils Lake, N.D., where the unit is based.
Ryan enlisted in the Guard in 1985 as a bridge crewmember with the Bismarck-based 957th Engineer Company (Multi-Role Bridge). He deployed to Southwest Asia in 1990 as a squad leader with the Grand Forks-based 132nd Quartermaster Company in support of Operations Desert Shield/Storm. Two years later, he was commissioned as a second lieutenant after completing Officer Candidate School. In 2007, he deployed to Iraq with the Minot-based 164th Engineer Battalion, serving as the executive officer.
He earned a bachelor’s degree in 1994 from the University of North Dakota and a juris doctor degree in 1997. He’s an owner and practicing attorney for Dalstad and Ryan, P.C., in Jamestown and Carrington, N.D.
Col. Lee Nordin, of Grand Forks, N.D., previously commanded the unit since October 2011. He recently deployed to Kuwait, where he’s serving as the assistant chief of staff for 3rd Army National Guard affairs.
The 164th Regional Training Institute provides U.S. Army Training and Doctrine Command courses for Soldiers around the nation in engineer-focused military occupational specialties, as well as training in food service and water treatment military occupational specialties. The schoolhouse also hosts Officer Candidate School for North Dakota Guardsmen.
Jamestown (CSi, Jamestown Sun) – In an opinion issued Friday by the North Dakota Attorney General’s office, a January 30,2013 meeting of the Jamestown/Stutsman Development Corp. Executive Board violated the open records and meetings law.
The Jamestown Sun had requested the opinion on February 28, 2013 on four issues: whether the JSDC is a public entity subject to open records and meeting laws, whether the JSDC Executive Board made decisions during an executive session meeting on January 30th, whether a personnel evaluation for Connie Ova, CEO of the JSDC, conducted in executive session violated open meeting laws and whether the JSDC violated open records laws by not furnishing the salary information for Ova to The Jamestown Sun.
The January. 30th executive board meeting was conducted in an executive session that excluded the public and press. Executive session meetings can be used to discuss proprietary information but the board can only vote in sessions open to the public and press.
The opinion, issued by Attorney General, Wayne Stenehjem, ruled that the JSDC is a public entity because it receives public tax funds.
The opinion said the “JSDC admits, and a review of the tape of the executive session confirms, final action was taken by the Executive Committee during executive session.” This is in violation of North Dakota open meeting laws.
The attorney general’s opinion also ruled that performing an employee evaluation during an executive session and withholding salary information violated open meeting and record laws.
The Attorney General’s Office ordered the JSDC to amend its minutes of the January 30 meeting to reflect all actions taken during the executive session and to furnish The Jamestown Sun a copy of Ova’s employee evaluation along with a salary figure at no cost.
JSDC President, Gary Rife says, “We have already changed our procedures. The last meeting and the employee evaluations conducted in an open meeting are an example of that.”
Riffe said the JSDC would comply with the attorney general’s requests by Monday.
The topic of the complaint was discussed during the JSDC Board of Directors November meeting as part of an amendment to the 2013 JSDC budget. The board noted the organization’s legal expenses were over budget in part because of $4,000 spent in researching and presenting the JSDC response to The Jamestown Sun complaint.
Carrington (CSi) — Two Foster County, officials have been arrested and face multiple felony charges.
Foster County Auditor, Roger Schlotman, and Foster County Commission, Chairman James Carr, both face multiple felony charges for crimes related to the county’s property, records and finances, according to court documents.
Schlotman’s alleged crimes occurred between June 2011 and September 2013, and Carr’s were between September 2011 and September 2013.
Both were released on a personal recognizance bond. An initial appearance is scheduled for December 4th, 2013 at 9:30a.m. in the Foster County Courthouse in Carrington.
Foster County Assistant State’s Attorney, Kathleen Murray says, a number of people had questioned actions in Foster County Commission meetings, which prompted the Foster County state’s attorney to contact the North Dakota Bureau of Criminal Investigation.
She says, “The initial investigation BCI did on these specific allegations were at least a year ago, as early back as at least July or August 2012.”
On Nov. 6, BCI executed search warrants at the Foster County Auditor’s Office and conducted interviews at the Foster County Courthouse in Carrington.
Also on Nov. 6, Schlotman gave a handwritten resignation to Murray.
She did not know if the County Commission had made a decision on whether to approve the resignation. The commission’s last meeting was Nov. 5.
Murray says, “As far as what his letter said, his resignation was effective immediately.”
Murray, who works full time as the Wells County state’s attorney usually only assists Foster County with conflicting cases.
Similarly, the state’s attorney contacted BCI first, instead of Foster County sheriff, because the investigation involved county employees.
The case is still an open investigation.
Murray says she did not know if there would be further charges.
Carrington (CSi) – A waterfowl hunter was injured Saturday morning in an accidental shooting in southeast Foster County
Sheriff Michael Tufte says the waterfowl hunter was accidentally struck in the lower abdomen after a deer hunter shot at a buck that was running toward the area where the waterfowl hunters were concealed.
The waterfowl hunters heard the shooting and were putting on blaze orange clothing to become more visible when one of them was hit. The hunter was taken to the hospital in Carrington and then transferred to Fargo.
The accident remains under investigation. Tufte says, it did not appear the injury was life-threatening.
VERONA (CSi) – The North Dakota Highway Patrol reports, a 55 year old California man was injured after he was struck by a pickup in a construction zone on Hwy 13 MP305 3 miles west of Verona). The accident occurred about 7-p.m. on Friday evening during rain.
Sgt Luke Henrickson reports, a pickup driven by 59 year old Connie Braun of Leonard, struck 55-year old Robert Alan Noel of Ventura, California after he suddenly turned around into driving lane of the Braun vehicle.
Noel was transported to the Oakes Hospital and treated for non-life threatening injuries to his right leg and right hand .
LaMoure and Oakes Ambulance responded to the scene.
LEITH, N.D. (AP) – Authorities say they are investigating a vandalism complaint reported by a white separatist who is trying to turn the small North Dakota town of Leith into an Aryan enclave.
Craig Cobb, who has bought property in the town with the hope of developing an all-white enclave, says some people slashed tires, spray painted two vehicles and put paint on a religious building. He calls the vandalism a hate crime because people in the area know he’s a member of the Creativity religion.
Grant County Deputy Sheriff John Foss says Cobb called in a complaint, and the matter is being investigated.
WILLISTON, N.D. (AP) – A Texas man accused in a fatal shooting at a worker camp in the western North Dakota oil patch has pleaded guilty to reduced charges. Victor Lamont was charged with murder, attempted murder and terrorizing for the slaying of Gerald Schild and shooting and wounding Travis Lomax. Lamont pleaded guilty to felony charges of manslaughter and reckless endangerment.
BISMARCK, N.D. (AP) – Six North Dakota National Guard soldiers who spent nearly a year in Afghanistan are back home for Veterans Day.
The members of Detachment 42 Operational Support Airlift flew into Bismarck, Fargo and Grand Forks on Sunday.
The soldiers left last January to provide aerial surveillance and support for ground troops in Afghanistan.
GRAND FORKS, N.D. (AP) – University of North Dakota graduate Karen Nyberg has returned from her most recent trip to space.
A Russian space capsule carrying Nyberg and two other astronauts returned to Earth on Monday from the International Space Station in a flawless landing in Kazakhstan. They brought the Sochi Olympic torch with them.
All three were to be taken for tests at a medical tent at the landing site, then flown to the city of Karaganda for a welcome ceremony.
Nyberg is from Vining, Minn. She graduated from UND in 1994, and went on to join NASA and take part in a 2008 mission on the space shuttle Discovery. She blasted off into space again last May.
BISMARCK, N.D. (AP) – North Dakota Democratic lawmakers have slated a hearing this month to seek some answers on pipeline safety.
House Minority Leader Kenton Onstad of Parshall says the hearing was spurred by a Tesoro Corp. pipeline rupture discovered in September that sent more than 20,000 barrels of crude spewing across a North Dakota wheat field.
Onstad says the recent Tesoro pipeline spill near Tioga has raised “questions about the integrity and security of oil pipelines in western North Dakota.”
Onstad’s district is in one of the state’s top oil-producing areas.
The hearing is slated for Nov. 20 in Stanley.
FARGO, N.D. (AP) – A divided North Dakota Industrial Commission will soon decide whether to designate special places subject to development restrictions that would protect them from oil drilling or other development.
The commission has discussed the possibility of a list of special sites for half a year.
Gov. Jack Dalyrmple has proposed more than 40 sites as candidates for protection.
Candidates include Little Missouri State Park, Killdeer Mountain, roadless areas in the Little Missouri National Grasslands and the units of Theodore Roosevelt National Park.
Attorney General Wayne Stenehjem also is compiling a list and formulating a policy.
But the commission’s third member, state Agriculture Commissioner Doug Goehring, says he is not in favor of such lists. He says drilling permits should be reviewed on a case-by-case basis.
BOTTINEAU, N.D. (AP) – The superintendent of Bottineau (BOT’-tin-oh) schools says the school board may try again to push a bond issue for a new elementary school. The Minot Daily News reports that Bottineau voters defeated an $18.9 million school bond issue last week. School superintendent Jason Kersten says the unofficial vote count showed the bond issue was defeated 566 to 483.
FARGO, N.D. (AP) – North Dakota dairy farmers produced 84 million pounds of milk during July, August and September, down 2 percent from the third quarter of 2012.
The Agriculture Department says the number of milk cows in the state during the three months averaged 17,500 head, down 500 over the year.
Milk production nationally during the quarter totaled 49.4 billion pounds, up 1.5 percent from last year.

VALLEY CITY (VCSU) – The Valley City State football won a share of its third straight conference championship Saturday, defeating Mayville State 37-12 at Shelly Ellig Field.
The Vikings finish with a 3-1 conference record, sharing the title with University of Jamestown. It is the third straight conference title for VCSU, which won the DAC in 2011 and the A.I.I. in 2012.
Saturday was the final home game for nine Viking seniors who led an impressive performance and avenged a loss against Mayville earlier this season. VCSU led 17-0 at halftime and 30-6 early in the fourth quarter.
Viking senior running back Derek Elliott had a career and record-setting day, finishing with 286 rushing yards and two touchdowns on 44 carries. His 286 yards rushing tied the single-game record at VCSU, also held by John Overbey. Elliott also broke three single-season records Saturday, setting new marks for single-season rushing yards and touchdowns, and single-season total touchdowns.

MIAMI (AP) – Embattled Miami Dolphins guard Richie Incognito has told Fox Sports that teammate Jonathan Martin sent him a threatening text message only a week before their relationship mushroomed into a harassment case that has prompted an NFL investigation. Incognito said he didn’t take the threat seriously, which he says included a threat against his family. Incognito said he regrets racist and profane language he used with Martin, but said it stemmed from a culture of “brotherhood” in the locker room, not from bullying.

AVONDALE, Ariz. (AP Csi) — Jimmie Johnson has taken control of the championship battle following a disastrous performance by Matt Kenseth at Phoenix International Raceway.
Johnson widened his lead in the Sprint Cup standings to 28 points over Kenseth heading into next Sunday’s season finale at Homestead by finishing third in a workmanlike performance for the five-time champion.
Kenseth had a horrific race Sunday as his title hopes were derailed by an ill-handing Toyota. He was struggling early, complained to crew chief Jason Ratcliff he didn’t even know what to tell him to fix, and wound up 23rd.
Kevin Harvick won the race for the second year in a row after Carl Edwards ran out of gas headed to the white flag. Harvick sailed by on the last lap for his fourth win of the year.

COLLEGE FOOTBALL-BCS STANDINGS
‘Bama, FSU are 1-2
UNDATED (AP) – Florida State took firm hold of second place in the BCS standings behind top-ranked Alabama and grabbed the inside track to the national championship game.
The Seminoles were second last week and solidified that position after Oregon was knocked off by Stanford Thursday night. Florida State then went out and crushed Wake Forest Saturday.
Ohio State is third, followed by Stanford and Baylor.
The top two teams in the final BCS poll will meet for the national championship.

A new No. 2
UNDATED (AP) – Florida State moves up to No. 2 in this week’s The Associated Press college football poll, the Seminoles’ best ranking since 2000.
Alabama remains No. 1 and received 56 first-place votes from the media panel. Florida State got the other three first-place votes. Ohio State is No. 3, followed closely by Baylor. Stanford is fifth.
PGA TOUR-MCGLADREY CLASSIC
Kirk wins a ticket to Augusta
ST. SIMONS ISLAND, Ga. (AP) – Chris Kirk was the winner of the PGA’s McGladrey Classic. He closed with a 4-under 66 and received plenty of help from Briny Baird. They were tied for the lead playing the 18th hole when Baird topped a 4-iron out of a fairway bunker into the water hazard. Kirk had only to make par for a one-shot win over Baird and Tim Clark. The win sends Kirk to the Masters for the first time.

LONDON (AP) – Rafael Nadal (rah-fay-ehl nah-DAHL’) has advanced to the final of the ATP World Tour Finals. He defeated Roger Federer in the semifinals 7-5, 6-3 and will face Novak Djokovic (NOH’-vak JOH’-kuh-vich), a 6-3, 6-3 winner over Stanislas Wawrinka (vah-VINK’-ah).
The world’s two highest-ranked players are unbeaten in London this week and have faced each other five times this season, with Nadal winning three times.

ISLAMABAD (AP) – One of the most feared militant groups fighting U.S. troops in Afghanistan has lost an important figure. Nasiruddin Haqqani (hah-KAH’-nee) was shot dead near the Pakistani capital. He’s the son of the Haqqani network’s founder. The death could bolster suspicions in Washington that the network has support from Pakistan’s intelligence agency, something Islamabad denies. The dead man is considered an emissary and financier, while his brother runs the network.
TEHRAN, Iran (AP) – Another sign of optimism in Iran, which agreed today to allow expanded U.N. monitoring at the country’s nuclear sites. The deal was struck during talks in Tehran with the U.N. nuclear chief. It could bode well for broader talks with world powers which are scheduled to resume November 20.
TACLOBAN, Philippines (AP) – The confirmed death toll in the Philippines typhoon is nearly 950 according to the country’s military, but the government still says thousands may be dead. Disrupted transportation and communications links have made it difficult to count the dead and distribute relief goods. The U.S. military has begun to fly in supplies.
STOCKHOLM (AP) – The world’s population of smartphones is expected to explode over the next few years. Sweden’s Ericsson AB, the world’s largest maker of telecommunications networks, predicts that by 2019, the number of smartphones will triple to 5.6 billion. And that’ll be just 60 percent of all cellphones on the planet. Total mobile subscriptions are predicted to reach 9.3 billion.
MOSCOW (AP) – The Sochi Olympic torch is safely back on Earth after a trip to and outside of the International Space Station. A Russian space capsule carrying the torch and three astronauts made a flawless landing on the steppes of Kazakhstan today.
