Jamestown (CSi) — A man who assaulted a corrections officer at the James River Correctional Center in July will serve an additional eight years in prison.
On Monday, in Southeast District Court in Jamestown 41 year old Shawn Ostafin, pleaded guilty to aggravated assault, a Class C felony,
On July 28, Ostafin was an inmate at the JRCC serving time for the terrorizing conviction. Ostafin hit guard Jeremiah MacDonald, losing consciousness as a result of Ostafin’s assault.
In court Monday, Ostafin testified he thought as he went up to hit MacDonald that MacDonald would defend himself.
Ostafin said he was sorry for his actions and didn’t realize the damage he had done to MacDonald until after the fact.
Ostafin is currently an inmate at the North Dakota State Penitentiary in Bismarck.
Judge Thomas Merrick sentenced Ostafin to serve eight years consecutively at the end of his current sentence for terrorizing.
Ostafin was scheduled to be released on April 22, 2020. With the new sentence, Ostafin will be eligible for release in 2028.
With a Habitual offender status Merrick was able to double Ostafin’s sentence to 10 years in prison.
Merrick said given Ostafin’s criminal history, including convictions in 1990 for murdering his father and stepfather, that he had no problem granting the habitual offender motion.
Valley City (CSi) — The Valley City Commission met in Regular Session Monday evening (Nov 18, 2013) at 5-p.m., at City Hall. All members were present.

Ordinances

Resolutions
A Public Hearing was held for the replat of Greenline Deere Addition.
Following the Public Hearing the City Commission approved a Resolution of Necessity for the replat of the east end.
The City Commission approved a Resolution to refer to Professional Land Surveyor.
City Attorney Russell Myhre said the next step before the replat, and then back to the City Commission for further review and action.
New Business
The City Commission considered purchasing new radio base stations for Public Works. City Administrator Schelkoph said a base station would replace the phone lines, for radio communications with City Hall, the fire department and other that use base stations.
He said the quote from Jamestown Communications was approved.
He added the payback over using the phone line, which costs about $400 per month is 18 months.
The City Commission went on record to approve the Heritage Fund grant.
City Commissioners approved a Special Alcohol Beverage Permit for Dakota Silver at The Vault for the First Friday Meeting on December 5, 2014.
The City Commission reviewed Water Service Cooperative Agreement with Barnes Rural Water. City Attorney Myhre said the agreement requirement by the state, is mandated between the city and Rural Water, and addresses the needs of the city as it grows. He says federal and state law is also taken under consideration in the agreement.
Mayor Werkhoven said the city and Rural Water have been meeting to discuss issues in the agreement.
The City Commission took no action on Monday evening.
City Administrator Schelhoph ‘s Report:
He said the automated meters have been installed to 5% of the city users, adding that November 22 is the shipping date for the load control relays.
He said the water tower standpipe has had problems.
He suggested putting a pump at the base to shoot to the top of the unit, to circulate water, and avoid icing problems.
With garbage collection a mistake was noted in the commercial rate structure, which is being looked into.
He noted that city employees should be standardized in the wearing of vests by city employees on the streets.
City Updates & Commission Comments:
City Attorney Myhre said planning and zoning items are being worked on with proceedures and protocol. With buyouts, some closings are being set. Recodification meetings are continuing. He added that the Myhre Law Offices will be expanding, and should help serve the city.
Mayor Werkhoven noted the need to address issues with street flooding concerning waves created by vehicles and entering houses window wells and into basements.
City Auditor Avis Richter said an independent audit report has been submitted to the city, with a “clean opinion,” using generally accepted accounting procedures, presented fairly.
She said the report will be placed on the city’s web site.
Commissioner Luke noted changes coming with the city’s electric service in the future coming from WAPA.

Jamestown (CSi) — Jamestown Police has issued an arrest warrant for a Jamestown man, 22 year-old James Wallace Abell, Jr.
Police say he is wanted for Abuse and Neglect of a Child, a Class B felony stemming from the fact that the victim is under the age of 6.
Abell Jr’s last known address was 607 2nd ST Southwest.
He has ties to Carrington and Valley City.
Anyone with informationleading to his arrest, is asked to contact Jamestown Police at 252-2414.
Jamestown (CSi) — The Jamestown/Stutsman Development Corporation,took no action on a proposal, but placed it on the agenda for its executive board meeting next Monday.
The proposal to purchase a portion of the development associated with a possible big box home improvement retail store was opposed at a Special JSDC Board meeting, Monday.
Prairie Haven is located west of R.M. Stoudt, northwest of the Buffalo Mall.
Mayor Katie Andersen proposed that JSDC purchase about 43 acres of the 73-acre development for $5.6 million.
Andersen said she brought the proposal to the board as a member of the JSDC Board and not as a representative of the City Council.
JSDC attorney Joe Larson disagreed with Andersen on whether the JSDC could purchase the land, saying “Changes to the bylaws have to be approved by the city and county. If the JSDC doesn’t change its policy it does not go to the city and county.”
Larson said he was also concerned about competition issues.
The developer’s agreement between the city of Jamestown and the R.H. Johnson Co. requires the city to purchase the land.
The Prairie Haven development is a project of R.H. Johnson Co., to bring a big box home improvement store such as a Menard’s, Home Depot or Lowes to Jamestown. The development includes a number of lots around the main property for smaller businesses.
Members of the public attending the meeting questioned whether the city should take steps to lure a big box home improvement store to Jamestown.
Jamestown (CSi) — Kevin J. Dvorak, President and CEO of the North Dakota Community Foundation delivered a grant from the North Dakota Community Foundation’s State-wide Greatest Needs (Unrestricted) Fund to the Jamestown Regional Medical Center (JRMC) Foundation. NDCF Area Board Members are Steve Ottmar – Jamestown, Becky Thatcher-Keller – Jamestown, Diane Peyerl – Fural Penn, David “White Thunder” Trottier – Rugby. NDCF Development Director, Kara Geiger also participated in the presentation.
The JRMC Foundation and Family BirthPlace accepted the grant for the Hugs® Infant Protection System in the amount of $1,500.
Dvorak says, “The North Dakota Community Foundation is pleased to partner with JRMC. It’s great to see that JRMC is completed and has continued to enhance their equipment and technology, and we are glad to be a part of it.”
The area grants were made from the North Dakota Community Foundation’s State-Wide Great Needs Fund. Grants were awarded on a competitive basis. This year the Foundation received 149 grant requests of which the Board of Directors approved 49. The NDCF and its component funds will make over $3 million in grants all across North Dakota in 2013.

Bismarck (CSi) – Gayle Nelson and Tena Lawrence of the Jamestown Dollars for Scholars attended the sixth annual North Dakota Dollars for Scholars Conference held in Bismarck on Saturday, November 2, 2013.
Chapter representatives learned about volunteer recruitment and fund raising. For attending the conference, the Chapter will receive a $1,000 scholarship donation from Bank of North Dakota (BND).
North Dakota Dollars for Scholars has 80 community chapters in the state. Bank of North Dakota provides a State Director and operational support for local chapters. Since the first chapter was established in Grand Forks in 1962, Dollars for Scholars chapters in North Dakota have raised over $27 million and helped over 22,500 students.
This year, the Jamestown chapter plans to distribute $17,500 to local high school students and recent graduates attending college. Events such as Blue Jay football “Touchdown Sponsors” in addition to chapter memberships increase the funds available for the students.

FARGO, N.D. (AP) – Fargo police are investigating the death of a man whose body was found along railroad tracks in an industrial area but say no foul play is suspected.
The body was spotted by a passing train crew late Monday afternoon. Sgt. Mike Erbes says the man had been struck by a train.
Authorities identified the man as 43-year-old Chad Lewis Johnson, of Fargo.
Johnson is a former Fargo Force hockey team assistant coach who resigned in September as coach of the Lincoln Stars of the United States Hockey League.
FARGO, N.D. (AP) – A Fargo man convicted of attempted murder for locking two men in his apartment and beating them with a sword and a table leg will serve 10 years in prison.
The Forum newspaper reports 23-year-old Damon White Bird was sentenced Monday after representing himself in a trial earlier this year.
Jurors also found him guilty of several other charges, including felonious restraint and tampering with evidence.
The prosecutor says one of the men spent 27 days in the hospital and had part of his skull replaced with titanium mesh.
LEITH, N.D. (AP) – A white supremacist seeking to take over a small North Dakota town is representing himself against terrorizing charges, while a man who joined Craig Cobb in Leith (leeth) has asked for a public defender.
Both the 62-year-old Cobb and the 29-year-old Kynan Dutton have been ordered held without bond on seven felony terrorizing counts. They each could face a minimum of 10 years in prison and a maximum of 35 years if convicted.
The two are accused of terrorizing people in Leith with guns over the weekend. They said they were patrolling the town because of violence and harassment directed at them.
Cobb and Dutton are being held in the Mercer County Jail in Stanton because Grant County doesn’t have a jail. Their next court appearances haven’t been scheduled.
BISMARCK, N.D. (AP) – Gov. Jack Dalrymple has appointed East Central District Court Judge Lisa Fair McEvers, of Fargo, to the North Dakota Supreme Court.
Dalrymple announced the appointment Monday. McEvers will replace Justice Mary Muehlen Maring, who announced in September that she’ll retire at the end of the year with four years remaining on her 10-year term.
McEvers was one of a dozen judges and lawyers who applied for the position. The Judicial Nominating Committee pared the list of 12 people to the four finalists.
McEvers has been a district court judge since September 2010 and presides over civil and criminal cases.
GRAND FORKS, N.D. (AP) – University of North Dakota President Robert Kelley is giving his State of the University address today.
The speech is set for 3:30 p.m., during a meeting of the University Council in the Memorial Union Lecture Bowl.
University Senate Chairman Ryan Zerr also is scheduled to give a status report.
BISMARCK, N.D. (AP) – Gov. Jack Dalrymple says he is forming a panel to increase pipeline safety in the state.
Dalrymple says the group will include independent engineers, members of the pipeline industry and state officials.
Dalrymple says he met with officials from the federal Pipeline and Hazardous Materials Safety Administration on Monday. The governor says the federal agency has agreed to put a member of its staff on the panel.
Dalrymple says the group is “tasked with researching the use of the latest available technologies to enhance pipeline safety in the state.”
The move comes after a Tesoro Corp. pipeline rupture that was discovered in September and sent more than 20,000 barrels of crude oozing across a wheat field near Tioga.
FARGO, N.D. (AP) – Dry weather helped North Dakota farmers over the past week, but a shortage of propane and storage space has slowed the corn harvest.
The National Agricultural Statistics Service says farmers are waiting for high-moisture corn to dry in the field because of propane shortages and the lack of available storage.
And it says some grain elevators have been limiting the bushels of corn that can be delivered based on the amount that could be dried every day.
The soybean harvest is close to wrapping up because combines can now get in wet areas that were hardened by freezing temperatures.
The U.S. Department of Agriculture agency says the corn harvest is about 78 percent complete. That’s well behind last year’s 100 percent but ahead of the 69 percent average.
BISMARCK, N.D. (AP) – Lena the turkey will live out her life on a rural Milnor farm, thanks to North Dakota Gov. Jack Dalrymple.
Dalrymple on Monday pardoned the 26-pound, 20-week-old turkey owned by North Dakota Turkey Federation President Harvey Hofer in an annual pre-Thanksgiving holiday ceremony held at the Capitol.
Lena stood stoically in the middle of a conference table during the lighthearted ceremony, prompting Dalrymple to speculate that she had been tranquilized. Hofer said later that wasn’t the case.
Before the pardon, Dalrymple and state Agriculture Commissioner Doug Goehring presented frozen turkeys to representatives of the Abused Adult Resource Center and the Ruth Meiers Hospitality House.

GRAND FORKS, N.D. (AP) – The University of North Dakota has fired head football coach Chris Mussman after a 3-8 season, including a 2-6 mark in the Big Sky Conference.
UND athletic director Brian Faison says the two met Monday and Mussman was relieved of his duties immediately.
Mussman coached six seasons with UND and had an overall 31-34 record.
He joined the coaching staff as the offensive line coach in 1999, became offensive coordinator in 2001 and took over as the head coach prior to the 2008 season.
Before arriving in Grand Forks, Mussman spent eight seasons at Minnesota State University, Mankato. He was a four-year letter winner and starting offensive lineman at Iowa State, where he was team captain in 1990.
Faison says a national search for a new coach will start immediately.

SAN FRANCISCO (AP) – The San Francisco Giants have worked out a two-year, $23 million contract with pitcher Tim Hudson, who was 8-7 with a 3.97 ERA in 21 starts for Atlanta this year. He needed season-ending surgery after breaking his right ankle in a first-base collision with Mets outfielder Eric Young on July 24. Hudson made his major league debut with the Athletics in 1999 and went 92-39 in six seasons with Oakland.
PHILADELPHIA (AP) – Two people familiar with the negotiations tell the Associated Press that Philadelphia Phillies All-Star catcher Carlos Ruiz has agreed to a $26 million, three-year with the team. The 34-year-old hit .268 in 92 games last year after serving a 25-game suspension for using a banned amphetamine.

ROME (AP) – At least 17 people have died in torrential rains that turned the picturesque Italian island of Sardinia into a flood-ravaged mud bath. The freak storm smashed bridges and swept away cars. Italian Premier Enrico Letta says the priority is reaching remote areas, saving the lives of those still unaccounted-for and providing for those left homeless.
MIAMI (AP) – There’s a storm brewing in the Atlantic. The National Hurricane Center says Subtropical Storm Melissa has gained some strength and could transition to a tropical storm later in the day or overnight. Forecasters say large swells from the storm will continue affecting parts of the northern Leeward Islands, Puerto Rico, Hispaniola and the southeastern Bahamas. The swells can bring life-threatening surf and rip currents.
NEWTOWN, Conn. (AP) – General Electric Co. which has its headquarters in nearby Fairfield, Conn., is donating $15 million to Newtown, Conn., to build and operate a community center. It’ll serve as the central meeting space the town didn’t have following the shooting deaths last December of 20 children and six educators at Sandy Hook Elementary School. A number of GE employees live in Newtown.
BEIRUT (AP) – It’s one of the worst bombings to target the predominantly Shiite area in southern Beirut. Officials say twin suicide bombings struck outside the Iranian Embassy in the Lebanese capital, killing 23 people, including the Iranian cultural attaché, and wounding dozens more. The bombings appeared to be related to the conflict next door in Syria. Iran supports Syria, as do Lebanon’s Hezbollah militants.
SANFORD, Fla. (AP) – George Zimmerman has a bail hearing today in his latest brush with the law. Zimmerman is charged with aggravated assault, battery and criminal mischief after his 27-year-old girlfriend called 911. He’s had several issues since his acquittal in the Trayvon Martin murder case that sparked nationwide debates about race and self-defense laws.
